2 Building Amenities: Parking Parking operation hours for 8383 Wilshire Parking Structure are as follows: Monday through Friday: 8:00 a.m. 8:00 p.m. Saturday: 10:00 a.m. to 6:30 p.m. Please note that in order to exit the parking structure after Parking Operation closes, all visitors must have enough validations or pay by credit card at the exit gate. There will be no parking operations on Sunday. Entrance can be gained into the parking structure only through cardkey access or pulling ticket and paying by credit card when exiting. There are three (3) types of parking available: Monthly Parking, Daily Parking and Validated Parking. Explanations of each as well as current rates, which are subject to change, are as follows: Monthly Parking: All monthly parkers will be issued a cardkey which is used to activate the security entrance and exit equipment to the garage. The Parking Manager will issue Cardkeys upon receipt of the Cardkey Information Form. Types of Monthly Parking and Current Rates Unreserved: $ Tandem Reserved $ (not available) Reserved: $ VIP P1: $ Daily Parking Parking is available on a daily cash basis based upon prevailing market rates. Each 12 minutes $2.20 Maximum Daily Charge $22.00 The amount charged for daily parking will be computed according to length of time parked in the structure. A lost ticket will pay the maximum rate. Validated Parking: Validating parking tickets is normally done as a courtesy by tenants for their visitors. Validation stickers may be purchased from the Parking Office on a monthly billing or cash basis, based upon prevailing market rates. Visitors without a validated parking ticket must pay the rate of time on parking ticket. 9 Building Security: After Hour Access Tenants: After-hour access for tenants is allowed by using the cardkey with the cardreaders. You will only be granted access if you have those privileges on your card key or if you have made prior arrangements with the Office of the Building. Visitors: Any Tenant expecting an after-hour visitor should provide the Office of the Building with a memo authorizing access. Please note that tenants will need to make specific arrangements with Building Management to allow visitor access to their individual suites. Security staff does not have access to tenant suites. 10 Building Security: Building Access The building is open for business without restricted access during the following hours: Monday through Friday: 7:00 a.m. to 7:00 p.m. (Except Holidays) Saturday: 8am-1pm Card Access Systems 8383 Wilshire has installed a Card Access System, which provides automated parking garage access, building access and elevator access. This system enables the Building to provide the utmost in convenience and security to our tenants. The Access Card (Cardkey) itself looks somewhat like a credit card. Although this card is very durable, please handle it with care. Do not punch holes in the cardkey as it weakens its integrity. All new tenants will be provided with Cardkey Application Forms for their employees. It is necessary that all employees fill out all the information required (employee name, car information, access levels and time zones). Please make sure that Cardkey Application Form is signed by an authorized tenant liaison noted on the Tenant Authorization Form on hand in the Property Management Office. Cardkeys will be issued by ABM Parking AFTER ALL INFORMATION HAS BEEN PROVIDED on the Cardkey Application Form. All Cardkey Application Forms can be turned in at the parking office and/or the Building Management Office. Upon completion the Parking Manager will contact/deliver the cardkey to the tenant after 3:00 p.m. Please have all requests for Cardkey changes to the Parking Manager by 12:00 p.m. for same day service. All requests received after noon will be delivered the next business day. Card Access Systems (Continued) Each card is individually numbered and assigned to ONLY ONE PERSON. Cardkeys are not transferable and should only be used by the person to whom it was assigned. The tenant is responsible for the use of its employees Cardkeys including lost, stolen or damaged Cardkeys. If a Cardkey is lost, stolen or damaged, please report it to the Property Management Office immediately so that a new card can be issued and lost card voided. There is a charge of $30.00 for each cardkey that must be replaced. Do not punch holes in the cardkey as it weakens its integrity. Location of Cardkey Readers: Front & Rear lobby doors Elevator cab #3, #4, #7 & #8 Tenant/Vendors Access Please note that it is Building Policy for Tenants to schedule with Building Management, at least 48 hours in advance, all outside vendors who will be accessing the Building and/or Tenant Suites. In addition, a vendor insurance certificate will be required if the vendor will be performing any activity that involves Building Systems (i.e. electrical, HVAC, telephone, cabling, etc.) and/or any activity that could possibly harm building fixtures or the persons moving them (i.e. moving furniture, heavy boxes, etc.). Please obtain an insurance certificate from your vendor in compliance with the building requirements, in the forms section, and submit to the Management Office with your written request for vendor access. 11 Building Security: General Office Security Reporting Thefts Any property, which is determined to have been stolen, should be reported to the Beverly Hills Police Department and the Office of the Building immediately. The security of your office is your responsibility. In your office, valuables, purses, etc. should not be left in plain view. We recommend that purses be locked in desks and that valuables be put away and locked up at night. Our security staff is available to assist you. Should an incident or loss occur, contact the Office of the Building and a security officer will be dispatched to take a report. It is advisable to record all serial and identification numbers in a secure place. It is the Tenant s responsibility to ensure that corridor doors are closed and locked at the close of business. Suspicious Persons If you see suspicious or offensive persons in the building, please call the Office of the Building immediately. If possible, make note of appearance, clothing, etc., to assist building security in locating them. Please be aware of strangers in your Tenant areas and halls. Quite often a question such as May I help you locate someone? is enough to deter a potential thief. Suspicious encounters of this type should be reported to the Office of the Building immediately. Security Checklist For your own internal security and also for the security of the building, it is in your best interest to control the number of keys issued. Only people needing after hour access should be issued a key. The following is a list of general office security suggestions, which are offered to you as an aid in establishing your internal security procedures: Restrict office keys to those who actually need them. Keep complete, up-to-date records of the distribution of all office keys. Have adequate procedures for collecting keys prior to termination of employees. Secure all typewriters, adding machines, calculators, photocopiers, etc. with maximum-security locks. Establish a rule that keys must not be left unguarded on desks or cabinets. Require that filing cabinet keys be removed from locks and placed in a secure location after opening cabinets. Prevent unauthorized personnel from reporting a lost key and receiving a replacement. Designate a responsible person to be in charge of issuing all keys. Store keys systematically in a secured wall cabinet of either your own design or from a commercial key control system. Keep a record showing issuance and return of every key, including name of person, date, and time. Security Checklist (Continued) Use telephone locks to prevent unauthorized calls when the office is unattended. Provide at least one lockable drawer in every secretary s desk to protect purses and other personal effects. Establish a rule that purses and personal property such as cameras should be kept inside employee s desk. Instruct employees to remove wallets from jackets hung in closets or hung on coat racks and place them in a secure location. Insist on identification from repairmen who come to work in your office. Deposit incoming checks and cash each day so that you do not keep large sums in the office overnight. Clear all desks of important papers. When working alone in the office at night, set the front door lock to prevent anyone else from entering. Keep the police, fire department, and building security telephone numbers posted. Double check to see that all doors are securely locked before you leave. Have an inventory listing all office equipment in your space including serial number and identification. Require written authorization by a responsible person before any office equipment is released for repair or maintenance.

13 Building Security: Key and Lock Policy Control over issued building keys is an integral part of the overall Security System. All locks and/or latch sets and other hardware must be up to building standard. Therefore, should you require any changes or additions, they must be done through Property Management. In the event that you are locked out of your suite during normal business hours, you may obtain access by the Property Management Office if authorization is provided by an individual noted on the Tenant Authorization Form. Should you be locked out of your suite after normal business hours, Property Management will not be able to assist you. You must contact your office manager or an authorized representative of your company to gain access. Please note Security Officers do not have keys to Tenant Suites. 14 Building Security: Lost and Found Items that have been lost or found in the building can be claimed or turned into the Security Console or Management Office #340 during regular working hours.

15 Building Security: Solicitation We attempt to keep all solicitors out of the building. If a solicitor visits your office, please contact the Office of the Building or Security at once. The solicitor will be escorted out of the building and off the premises.

16 Building Services: Cleaning 8383 Wilshire currently provides janitorial services Monday through Friday, except holidays. The cleaning staff begins cleaning at approximately 6:00 p.m. If you should have any over standard cleaning requirements, which are not covered under the Lease, please contact the Property Management Office. The Property Management Office will notify the janitorial contractor and arrange for special cleaning services with them directly. Please note there may be an additional charge to tenant for over standard services.

17 Building Services: Elevators The elevators in the Building are operable during the following hours: Monday through Friday: 7am-7pm Saturday: 8am-1pm Please note: For after-hours entry into the Building and for use of the elevators, please see the Security Section of this handbook.

18 Building Services: Fee Schedule We have engineers who are qualified to ensure the efficient operation of our air-conditioning, plumbing and electrical systems. Should you require assistance in these areas, please contact the Property Management Office. Engineering and maintenance labor requests, in excess of standard services (i.e. repairing non-standard equipment, hanging pictures, re-keying, etc.), will be billed to your tenant account.

20 Building Services: HVAC Heating and air-conditioning hours of operations are: Monday through Friday: 8:00 a.m. to 6:00 p.m. (Except Holidays) Saturday: 9:00 a.m. to 1:00 p.m. (Except Holidays) If additional heating or air-conditioning is needed other than the hours noted above, please fill out the After-Hour Air-Conditioning Form. Please note: All after-hour heating and air-conditioning services are currently $70.00 per hour with a four (4) hour minimum. All after-hour and requests must be received no later than 12:00 p.m., Monday through Friday, and for weekend use, no later than 12:00 p.m. on the previous business day. 21 Building Services: Mail Service There is a building mailroom with individual postal boxes, which are assigned to each tenant. Each tenant will be given an assigned postal box and keys when receiving their suite keys. It is the tenant s responsibility to keep the Property Management Office informed as to the name(s) (companies and individuals) under which mail will be received. All mail must have the number of the suite included in the address. This will ensure proper delivery. There is a collection box in front on Wilshire Boulevard which is picked up at 2:45 p.m. daily.

22 Building Services: Maintenance Requests Tenant must use the Net Facilities Work Order System to submit track and manage all service requests. To access the system: 1. Go to 2. Enter your username and password provided by the Office of the Building. 3. Once logged into the Net Facilities system users are taken to the "Dashboard". The Dashboard is the home page or administrative hub where users can: View and track the status existing work orders Create a new work order View invoices for completed work orders View a complete history of work orders Use the blue navigation bar on the top of the page to choose the area of the system you would like to enter. To submit a work order: 1. Click on the "Work Order" link in the blue navigation bar on the top of the Dashboard page. 2. Which: Choose the type of service required 3. When: Select a date and time for the service. 4. Where: Choose a Building Area ( optional) 5. What : Describe the work to be done in as much detail as possible. 6. Click Submit and your work order request will be routed to the appropriate personnel. 24 Emergency Procedures: Bomb Threat Telephone Threat When a bomb threat is made over the telephone, obtain the following information from the caller: Exact location of the device. Time set for explosion; Description of the device; Reason the caller has placed the bomb; Exact words used by the caller. Keep this information as confidential as possible. Notify the Police Department. Call 911. Notify the Management Office at (323) Once the Management Office has been notified of a bomb threat, it is our policy to advise your firm s manager or officer. It is up to the manager or officer to decide whether it is appropriate to evacuate the office. In the event that you are asked to evacuate the Building, move away from the Building to allow for the clear passage of emergency personnel. Do not re-enter the Building until the Management Office or the Police or Fire Department has given clearance. Suspicious Packages or Mail Bombs Letter bombs are usually sent through the mail addressed to a specific individual in the company, usually disguised to look like some sort of gift or a small package. Letter bombs have the power to kill or maim anyone close to them if they go off. Letter bombs are usually a large size manila envelope ¼ to ½ thick and are fairly rigid. They have been mailed from cities or small towns in the United States, as well as from foreign countries. They are usually mailed to a person by title, such as Chairman, President, Manager, Security Officer, etc. If a letter is suspected to be a letter bomb: Clear everyone out of the area for at least 25 feet around it. Notify the police at 911 and Building Management at 1(323) DO NOT HANDLE IT UNDER ANY CIRCUMSTANCES. DO NOT ATTEMPT TO DEACTIVATE IT YOURSELF Click here to download a Bomb Threat Report Form

25 Emergency Procedures: Civil Disturbance Should a riot or civil disturbance start outside the Building, the security guards will immediately lock all entrances to the building. The police will be notified. We will keep you informed. If a disturbance should occur in the main lobby, all elevators will be turned off at the first floor and the police will be summoned.

26 Emergency Procedures: Earthquake Before an Earthquake Plan your course of action before an earthquake occurs. Employees should establish an out of state telephone contact and make sure family members can act independently for at least 72 hours. Store essential emergency supplies such as food, water, first-aid kit, radio, and batteries. Enough supplies should be stored to support every employee for a minimum of 72 hours. Secure objects such as files, office equipment, bookshelves and other potentially dangerous objects. Be familiar with your immediate work area and floor plan. This will help you react effectively when it is necessary to find the closest and safest shelter point. During an Earthquake Get under a sturdy table or desk and hold on or move towards the center of the building. The building core is the strongest part of the structure. Keep your back to all glass objects if you cannot avoid them completely. Be aware of falling debris. Cover your head as much as possible. Do not panic. A clear mind will help you through the dilemma. After the Earthquake Remain calm and stay in your area (unless any emergency dictates otherwise). Look for injured people and administer first aid where needed. Barricade hazardous areas to prevent other persons from accessing a dangerous area. Use telephones for emergencies only. Be alert for after shocks. Their intensity can produce further damage. Respond to the after shock as though it is the original earthquake. Check your food and water supplies. Building Security will attempt to contact tenants via the public address system to advise on building and local conditions. Evacuation Normally, it is not recommended to evacuate a building after an earthquake. Outside one may experience falling glass from the buildings. However, if an evacuation is required, use the stairs. Do not use the elevators. Walk down at a steady pace. Do not run. If you are outside when an earthquake occurs Immediately find the safest cover, perhaps an alcove, a doorway, a parking garage or a building. Stay away from storefront windows. The primary danger is from falling debris, particularly glass. Stay under cover as after shocks may cause further damage.

27 Emergency Procedures: Elevator Malfunction In the event that an elevator stops with passengers in it, remember to remain calm. Lifting the telephone receiver within the cab will alert Security that the cab is malfunctioning, what cab number it is, and what floor it is stuck on. The Guard will continue two-way communication with passengers until help arrives. In the event of a power outage, elevators will continue to operate using our emergency power generator. Should an outage occur, elevator lights will remain on, but the car will temporarily stop. Each elevator will automatically return to the lobby where the doors will open and they will then be out of service. All elevators function on a Fireman s Return Systems, which automatically returns the elevators to the main floor without stopping when smoke is detected on any floor. IN THE EVENT OF A FIRE, ELEVATORS MUST NOT BE USED FOR EVACUATION. USE THE STAIRWELLS.

29 Emergency Procedures: Evacuation In the event it is necessary to evacuate the building, the Fire Safety Director or Building Security will utilize the buildings public emergency voice / alarm system to immediately begin the evacuation of occupants and to direct the floor warden teams. It will be of paramount importance that all building occupants follow the directions of the proper authorities when evacuating. It is critical for the safety of all building occupants that everyone follows directions that are issued. We must not assume that all disasters require evacuation. In some instances such as earthquakes, spontaneous evacuation could cause injuries or death due to conditions that are unforeseen which could or may occur into the areas to which you flee. Communication while evacuated Occupants in this building will follow the directions of the building Fire Safety Director or the Security Officer who will be announcing the evacuation procedures over the P.A (Public Address System). The Floor Wardens and Suite Monitors will be the critical information link back to the occupants at the assembly area(s). He/she will provide the information as to when occupants can return to their work area(s) or re-enter the building and to provide occupants current information regarding the status of the emergency. If runners are to be used for these purposes, then written messages should be used to assure accurate information is relayed. When Evacuation is required: Move quickly but DO NOT RUN. Go to the safest designated stairwell or exit. DO NOT USE ELEVATORS. Remove high heels to prevent injuries (carry them with you). Use handrail, which is most continuous (usually center). Each floor will relocate down and out of the building (unless otherwise directed). Allow room for others to enter into an orderly flow of traffic without holding up others. Gain assistance for those who are slower moving or require assistance. Dispel any false information or rumors (to prevent panic refrain from using the word fire ). Treat any injuries incurred in the stairwell at the nearest floor landing when required and if practical. Complete relocation. DO NOT CONGREGATE IN STAIRWELL.

30 Emergency Procedures: Fire and Life Safety If you discover a fire, evacuate the premises, notify security, and call the Office of the Building. While evacuating, activate one of the manual pull stations located at the entry to each stairwell and the elevator lobby. This immediately notifies both security and the Fire Department. If the building s fire safety system detects a fire on your floor, the fire department will be notified immediately. Floor Wardens will be responsible for directing occupants to safe refuge areas. You are required to assign a Floor Response Team. These are people who, in case of emergency (fire, bomb threat, natural disaster, etc.), would be Floor Wardens, Assistant Floor Wardens, Searchers, and Stairwell Monitors. These Tenant representatives should be individuals who are on the Premises during regular working hours. Single Tenant floors will require a Warden to be appointed by the firm occupying that floor. On a multi-tenant floor, each Tenant is responsible for having a Suite Warden and designating a Response Team including a Floor Warden from the various Suites on that floor. Each warden will be fully briefed on all emergency procedures, and will assist both Management personnel and City authorities in directing fellow Tenants in emergency situations. The basic duties for each of these personnel are as follows: Floor Warden The Floor Warden shall direct, enforce and have full charge of the evacuation for all personnel on his/her assigned floor during an emergency. Designated Assistant Floor Wardens, a Searcher and Stairwell Monitor or others that may be required will assist them in their duties. An orange vest will be provided and should be worn by all Floor Wardens in the event of an Emergency. Assistant Floor Warden In cases where the Floor Warden is not present the Assistant Floor Warden will assume their duties and assist the Floor Warden in an emergency. Searcher The Searcher will thoroughly search restrooms, lunchrooms, conference rooms, etc. for occupants unaware of the emergency and direct them to the nearest safe exit, closing all doors behind them. Assistants for Disabled Assistants must be assigned for those in need of extra assistance in time of emergency. In an emergency, the disabled individual and assistant will enter the stairwell and remain inside the stairwell door until help arrives. A list of these individuals must be submitted to the Office of the Building. This list must include those individuals with any condition which would require assistance such as broken limbs, pregnancies, asthma, wheelchair, crutches, etc. and must be updated as needed. Stairwell Monitor Stairwell Monitors are to verify the safety conditions of exit stairways and to help maintain such safe conditions at all times. Place your hand on the exit door. IF THE EXIT DOOR IS HOT, DO NOT OPEN IT; seek an alternate route. If it is NOT HOT, open door and allow evacuees to enter, closing the door behind them. Once all occupants have evacuated the floor, close the door and proceed down five floors.

31 Emergency Procedures: Flooding If possible, remove all desktop items and close file drawers to limit damage. Building management will turn off the water source and shut down electrical power as required.

33 Emergency Procedures: Medical Emergency In the event that an accident or illness of an employee or visitor takes place in your office area: Call Emergency at 911. Give Emergency Dispatcher the following information: Your name: Building name and address: 8383 Wilshire Floor number and location of emergency on floor: Any details of accident or illness: Do not move injured/ill person. Try to make them as comfortable as possible. Whenever possible, have someone meet the emergency unit in the lobby. Call the Building Management Office at 1(323) Inform them you have called 911 and briefly describe the nature of the emergency. The emergency unit will be with you shortly and will administer necessary medical assistance. Determine, if possible: Name, address and age of injured/ill person Nature of problem Allergies and if currently on any medication Local doctor The Management, Engineering and Security staff will do all we can to make the person comfortable while awaiting the arrival of the medical rescue team. Although we assume no liability for our assistance, we strongly encourage Tenants and employees to become familiar with First Aid and how and when to contact emergency services.

34 Emergency Procedures: Power Failure The building has an emergency generator, which will provide emergency power for certain basic building function in the event of power failure. The functions include: Activating emergency lights on each floor throughout the building including all Exit signs. Activating all stairwell lighting. Activating the building s emergency Fire, Life and Safety Systems as well as the building s communication systems. Bringing all elevators down to the ground floor lobby. (One elevator will remain operative for use by security to assist handicapped persons or to take service crews and equipment into the building, as needed.) It is seldom necessary to evacuate the building during a power failure. Unless you are directed to do so through the emergency communication system (or by your floor warden), please remain in your offices. Please DO NOT CALL the Office of the Building unless you need to notify us of the location of a disabled employee.

35 Emergency Procedures: Severe Weather When severe weather conditions become apparent, the U.S. Weather Bureau describes conditions by two (2) classifications, a Watch or a Warning. This applies to the reporting of severe thunderstorms, the approach of weather conditions favoring the formation of tornadoes, a hurricane condition, a winter storm condition, etc. A Watch becomes effective when atmospheric conditions are right to produce the particular weather phenomenon. A Warning means that the weather condition has been spotted and prompt action must be taken for safety. Except in very rare circumstances, the decision to evacuate the building based on the above weather reports will not be made by Building Management, but rather by each Tenant Company. However, in the event these conditions do exist, the following guidelines should be kept in mind: Move away from outside windows. If the windows in your offices are supplied with blinds, close the blinds (this will provide protection from broken glass). Do not panic. If evacuated, lock all desk drawers and take all items of value with you. If evacuated, use a route that is in the building interior and stay away from large expanses of glass and windows. Use the stairwells rather than the elevators. If evacuated, do not return to your office until advised to do so.

36 Emergency Procedures: State Fire Marshal's Law TITLE 19 FIRE/LIFE/SAFETY TRAINING MUST BE COMPLETED WITHIN FOURTEEN (14) DAYS OF OCCUPANCY. Please be advised that under the provisions of section 3.09 and 3.10 of Title 19 of the California Administrative Code, the Beverly Hills City Fire Department requires that managers and Tenants of each high rise building in the city, in cooperation with the Fire Department, establish, implement and maintain an Emergency Pre-Fire Plan that will aid in the prevention of fire, explosion and panic in the building. All Tenants MUST be trained within the first 14 days of occupancy. Within 14 days of your tenancy, Tenant must contact RJ Westmore to set up and complete the online training for all employees. Participation is mandated by law, and tenants who refuse to comply are subject to prosecution and penalties as set forth in the local codes and Title 19. Also, under the Fire Department s Plan regulations, each Tenant (as an employer) along with Building Management share the responsibility for implementing this Pre-Fire Plan, instructing all occupants on the procedures to be taken in the event of an emergency, including evacuation procedures. Documentation of Occupant Instruction shall be maintained by the Office of the Building and available for Fire Department Inspection. It is each Tenant s responsibility to notify the RJ Westmore of new employees in your offices, and immediately schedule Fire Life Safety Training. Please fill out the List of Fire Wardens, Deputy Wardens, Persons trained in CPR and First Aid provided at the end of this manual, indicating the names of those people in your office who are trained in CPR and First Aid, and who will be appointed as your Suite Warden and Alternate Suite Warden. Fire Wardens and Alternate Suite Wardens need to be full time employees who will be responsible to work with the Office of the Building, to maintain proper records and assist in evacuation procedures of the building. Tenants who refuse to comply, may be cited for violation of the State Fire Marshall s Law. Such a citation, if issued, could constitute a fine of $1, and/or six- (6) months imprisonment.

37 Emergency Procedures: Toxic Hazard If there is a toxic spill or exposure, immediately get to an area where you are not exposed and call 911. Give building address, floor and phone number, and also what type of spill. Take action to contain the hazard; close doors behind you, and always follow all safety procedures when working with toxic materials.

42 Policies and Procedures: Contractors The Property Manager must approve all contractors before scheduling any work.

43 Policies and Procedures: General Rules and Regulations 1. Access. Tenant and/or Tenant's agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders shall only use the sidewalks, entrances, lobby(ies), garage(s), elevators, stairways, and public corridors as a means of ingress and egress, and shall take such actions as may reasonably be necessary to ensure that the same remain unobstructed at all times. The entrance and exit doors to the Premises are to be kept closed at all times except as required for orderly passage to and from the Premises. Except on balconies available for the joint or exclusive use of Tenant as otherwise specified hereinabove, Tenant shall not permit its agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders to loiter in any part of the Building or obstruct any means of ingress or egress. Tenant shall not cover any doors, and shall not cover any window, other than with vertical or mini-blinds pre-approved in writing by Landlord. Landlord specifically disapproves the installation of any film or foil covering whatsoever on the windows of the Premises. Neither Tenant, nor its agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders shall go up on the roof or onto any balcony serving the Building, except upon such roof, portion thereof, or balcony as may be contiguous to the Premises and is designated in writing by Landlord as a roof-deck, roof-garden area, or exclusive use balcony area. 2. Restroom Facilities. The toilet rooms, toilets, urinals, wash bowls and other apparatus (the "Restroom Facilities"), whether contained in the Common Areas of the Building and/or the interior of the Premises, shall not be used for any purpose other than that for which they were designed. Tenant shall not permit its agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders to throw foreign substances of any kind whatsoever or papers not specifically designated for use in the Restroom facilities down any toilet, or to dispose of the same in any way not in keeping with the instructions provided to Tenant by the management of the Building regarding same, and Tenant hereby specifically agrees to reimburse Landlord directly for the expense of any breakage, stoppage or damage resulting from Tenant's violation of this rule. 3. Heavy Equipment. Landlord reserves the right, in Landlord's sole discretion, to decline, limit or designate the location for installation of any safes, other unusually heavy, or unusually large objects to be used or brought into the Premises or the Building. In each case where Tenant requests installation of one or more such unusually heavy item(s), which request shall be conclusively evidenced by Tenant's effort to bring such item(s) into the Building or Premises, Tenant shall reimburse Landlord for the costs of any engineering or structural analysis required by Landlord in connection therewith. In all cases, each such heavy object shall be placed on a metal stand or metal plates, or such other mounting detail of such size, as shall be prescribed by Landlord. Tenant hereby indemnifies Landlord against any damage or injury done to persons, places, things or the Building or its Common Areas when such damage or injury primarily arises out of Tenant's installation or use of one or more unusually heavy objects. Tenant further agrees to reimburse Landlord for the costs of repair of any damage done to the Building or property therein by putting in, taking out, or maintaining such safes or other unusually heavy objects. 4. Transportation of Freight. Except as otherwise agreed to by Landlord in writing, Tenant or Tenant's agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders shall only carry freight, furniture or bulky materials in or out of the Building before or after Normal Business Hours, (as that term is defined in Section 8.1 of the Lease). Tenant may only install and/or move such freight, furniture or bulky material after previous written notice of its intention to complete such a move, given to the Office of the Building. The persons and/or company employed by Tenant for such work must be professional movers, reasonably acceptable to Landlord, and said movers must provide Landlord with a certificate of insurance evidencing the existence of worker's compensation and all risk liability coverage in a minimum amount of$2,000,000. Tenant may, subject to the provisions of the immediately preceding paragraph, move freight, furniture, bulky matter and other material in or out of the Premises on Saturdays between the hours of 8:00 A.M. and 6:00P.M., provided that Tenant pays in advance for Landlord's reasonably anticipated additional costs, if any, for elevator operators, security guards and other expenses arising by reason of such move by Tenant. 5. Flammable Materials. Except for such limited quantities of office materials and supplies as are customarily utilized in Tenant's

44 normal business operations, Tenant shall not use or keep in the Premises or the Building any kerosene, gasoline, flammable or combustible fluid or material, other than those limited quantities of normal business operating materials as may reasonably be necessary for the operation or maintenance of office equipment. Nor shall Tenant keep or bring into the Premises or the Building any other toxic or hazardous material specifically disallowed pursuant to California state law. 6. Cooking/Odors/Nuisances. Tenant shall not permit its agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders to engage in the preparation and/or serving of foods unless the Premises includes a self-contained kitchen area. Nor shall Tenant permit the odors arising from such cooking, or any other improper noises, vibrations, or odors to be emanate from the Premises. Tenant shall not obtain for use in the Premises, ice, drinking water, food, beverage, towel or other similar services except at such reasonable hours and under such reasonable regulations as may be specified by Landlord. Tenant hereby agrees to instruct all persons entering the Premises to comply with the requirements of the Building, by advising all persons entering the Premises that smoking of any tobacco or other substance is prohibited at all times, except in such Common Areas located outside the Building as may be designated by the Building management. Tenant shall not permit Tenant's agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders to interfere in any way with other tenants of the Building or with those having business with them. Tenant shall not permit its agents, clients, contractors, directors, employees, invitees, licensees, officers, partners or shareholders to bring or keep within the Building any animal, bird or bicycle, except such seeing-eye dog or other disability assistance type animal as may comply with the requirements of any handicapped ordinances having jurisdiction therefor. Tenant shall store its trash and garbage within the Premises. No material shall be placed in the trash boxes or receptacles if such material is a hazardous waste or toxic substance or is of such a nature that its disposal in Landlord's ordinary and customary manner of removing and disposing of trash and garbage would be a violation of any law, ordinance or company regulation governing such disposal. All garbage and refuse disposal shall be made only through entryways and elevators provided for such purposes and at such times as Landlord shall designate. As and when directed by Landlord and/or if required by any governmental agency having jurisdiction therefor, Tenant shall comply with all directives for recycling and separation of trash. Tenant shall not employ any person to do janitorial work in any part of the Premises without the prior written consent of Landlord, which consent may be withheld in Landlord's sole discretion. Landlord reserves the right to exclude or expel from the Building any person who in Landlord's sole discretion is intoxicated or under the influence of liquor or drugs or who, in any manner, engages in any act in violation of the Rules and Regulations of the Building. Tenant shall not conduct any public or private auction, fire sale or other sale of Tenant's personal property, furniture, fixtures or equipment or any other property located in or upon the Premises, without Landlord's prior written consent, which consent shall be in Landlord's sole discretion. 7. Storage. Tenant may only store goods, wares, or merchandise on or in the Premises in areas specifically designated by Landlord for such storage. 8. Directives to Management. Tenant's requirements, other than those the Landlord specifically agrees to perform elsewhere in this Lease, shall only be attended to upon the Building management's receipt of Tenant's written request therefor. Landlord's employees shall not perform any work or do anything outside of their regular duties unless under special instruction from the Building management. No security guard, janitor or engineer or other employee of the Building management shall admit any person (Tenant or otherwise) to the Premises without specific instructions from the Office of the Building and written authorization for such admittance from Tenant. 9. Keys and Locks. Landlord shall furnish Tenant with two keys to each door lock existing in the Premises. Tenant shall reimburse Landlord a reasonable charge for these and any additional keys.
