To vacate approximately lineal feet of improved public alley. Toy Partners of Skokie, LLC, and 5328 Partners, LLC, on behalf of Grandbrier Senior Living, LLC The alley totals feet in length on the east side, feet on the south side, and is feet on the west side. The total area of the alley is 400 square feet (0.009 acres). 2 PETITIONER S SUBMITTAL The petitioners are requesting the vacation of a triangular portion of the east side of the south end of the western north-south alley in an area bounded by Lee Street on the north, Lockwood Avenue on the east, Lincoln Avenue on the south, and Gross Point Road on the west. At the present time, the alley is unimproved and contains trees, weeds, and debris. No public utilities are located within the subject site. The petitioners intend to vacate the alley and redevelop it along with the existing vacant commercial properties to the east and south at and 5328 Lincoln Avenue in order to redevelop the property and construct a 1-lot planned development that includes a skilled nursing facility, an assisted-living facility, open and covered surface parking, and storm water detention (case P). The remainder of the north-south and east-west alleys to the west of the subject site will remain public rights-of-way since portions of them are improved and needed for access to off-street parking for the adjacent residences. STAFF ANALYSIS All pertinent departments and divisions were offered an opportunity to comment on this case. Other than the Planning Division comments below, all others did not respond or approved the request without comment. Planning Division The Planning Division staff supports the proposed alley vacation. The vacation of the alley will create a larger, more suitable site for the proposed development to be constructed within. Were the east-west and north-south alleys to be improved and connected to each other at some point in the future, this portion of the alley would not be needed as part of that network because this section is excessively wide. The petitioners will not be required to pay the Village for the land being vacated because the alley vacation is being made in exchange for the widening of 2 alleys as part of a 1 lot resubdivision of the and 5328 Lincoln Avenue properties (case P). The alley vacation meets all State and Village requirements. STAFF RECOMMENDATIONS Staff recommends that the petitioners request to vacate a triangular portion of the east side of the south end of the western north-south alley in an area bounded by Lee Street on the north, Lockwood Avenue on the east, Lincoln Avenue on the south, and Gross Point Road on the west be GRANTED subject to the Recommended Conditions listed below. 3 RECOMMENDED VACATION CONDITIONS 1. The property shall be vacated pursuant to the Plat of Vacation dated <to be determined>, and as may be further revised with the approval of the Village Manager, or designee, and Corporation Counsel. 2. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the Plat of Vacation shall be submitted to the Village with all signatures other than Village staff or elected officials. 3. The vacation shall be effective upon the recording of a Plat of Vacation by the Village in the Office of the Recorder of Deeds of Cook County, Illinois. ATTACHMENTS 1. Site Photos 2.
