Due to slope of the site, the applicant is unable to provide parking access to the rear of the structure required within the Neighborhood Overlay District. Other properties in the vicinity of the subject property have front parking access. The lot slopes upward from Fillmore A venue to rear of property and varies from elevation 291. at front oflot on Fillmore up to elevation 31. at rear. Lot is also a comer lot in the "Old Oxford Overlav District" and measures approximately feet wide and feet deep, This lot was created around 196 and predates Oxford Zoning Regulations and is therefore a "nonconforming lot of record". Describe how a strict application of the provisions of the Zoning Ordinance result in practical difficulties or unnecessary hardship? Section 148.7(1) requires that"... such parking area shall only be accessible from the rear of the structure". Compliance with this provision would require extensive excavation in the rear of the dwelling to accommodate a turning radius to enter the basement from the rear and such excavation would also require a retaining wall approx:imatelv 1-12' high (the retaining wall would then require a retaining wall height variance): such excavation would also require removal of additional trees and Llie side yard on the east side of the dwelling would have to be paved for a driveway to the rear of the structure resulting in additional impervious area; Describe how the granting of the variance will not be materially detrimental to the public welfare or injurious to adjoining properties or to the neighborhood in which the property is located.
