1 Application for a complying development certificate Information for the Applicant This form may be used to apply for a complying development certificate (a CDC ) to carry out development classed as complying development. To complete this form, please place a cross in the relevant boxes, fill out the white sections as appropriate and attach Date received: / / CDC no: copies of all documents indicated in the form as being required to be provided. To minimise delay in receiving a decision about the application, please ensure that all relevant information and documents are provided. Once completed, this application form should be submitted to NCBS Australia for determination 142 Cabarita Road Cabarita Beach NSW 2488, info@ncbsaustralia.com It is recommended that applicants should obtain a planning certificate issued under s.149 Environmental Planning and Assessment Act 1979 from the Local Council and provide it to the certifying authority with this application. This may expedite the determination of the application. A single application for a CDC maybe made for development comprising the concurrent construction of new single storey or two storey dwelling houses if each is to be erected on existing adjoining lots. If the certifying authority issues a CDC, the Applicant (or a subsequent owner of the land on which the development is proposed to be carried out) has permission to carry out the development without the need to obtain further development consent. However, depending upon factors such as the type of development, the location of the development and whether there will be external work or activities involved (eg. road opening, use of footpath areas) there may still be a need to obtain other approvals in order for the work involved to be performed. 2 SECTION C. Describe the development proposed to be carried out Provide a brief description of the development. For example, if a dwelling is proposed, include information such as the type of building (house, townhouse, villa etc), the number of floors, the number of bedrooms, the major building material (brick, brick veneer, timber clad etc). SECTION D. Estimated cost of the development $ The contract price, or if there is no contract a genuine and accurate estimate, for all labour and material costs associated with all demolition and construction required for the development, including the cost of construction of any building and the preparation of a building for the purpose for which it is to be used (such as the costs of installing plant, fittings, fixtures and equipment). GST is also to be included. SECTION E. Authority to enter and inspect land Information for the Applicant: A certifying authority must not issue a complying development certificate for development unless the certifying authority, or an accredited certifier or council on behalf of the certifying authority, has carried out an inspection of the site of the development. By signing this Application, the Applicant, and if the Applicant is not the owner of the property, the owner also, authorise NCBS Australia, or an accredited certifier or council, to enter the subject property at any reasonable time for the purpose of carrying out an inspection in connection with the assessment of this Application. Nomination of Principal Certifying Authority Please tick if you nominate Andrew Sharrock of NCBS Australia to undertake the role of Principal Certifying Authority for the subject site/property, to attend all mandatory inspections and to issue the Occupation Certificate on completion of the project in accordance with the Environmental Planning and Assessment Act *PCA Role will not be accepted without payment of fees in full. A certifier is not authorised to inspect a site (excluding pre-construction site inspections) if they are not the nominated PCA for that particular site. No thank you, I only require the Complying Development Certificate. SECTION I. Payment of Fees I The Applicant, agree to pay the fees (as indicated on the quotation or in accordance with a pre-arranged contract established between the lodging party and NCBS Australia. Signed Failure to pay the quoted fee for services will generally result in a refusal to release the determination. Should a determination be released and payment not honoured the Applicant will be liable in addition to any associated debt recovery costs plus interest incurred from the time of the application. 4 SECTION L. Description of the development 1. 5 SECTION M. Terms and Conditions 1.The PCA refers to the Principal Certifying Authority, this is the individual accredited by the Building Professionals Board to undertake inspections and issue the Occupation Certificate. 2.The Applicant can only be the individual or entity who/which has benefit of a development consent involving building work. Only the applicant can appoint the Principal Certifying Authority, this is usually the land owner. The principal contractor/builder is prohibited from appointing the PCA unless they are also the owner of the land. NCBS Australia can liaise with the principal contractor/builder regarding inspection bookings and general advice, but the applicant is responsible for the fees, and if any unauthorised work occurs on the site. 3.All information provided by the applicant on this form shall be considered as accurate and correct. NCBS Australia will not accept any responsibility for any intentional or unintentional omission made by the applicant on this form. 4. NCBS Australia reserves its right to withdraw acceptance of the PCA role if building works have commenced prior to the acceptance of the PCA role and without the knowledge of the intended PCA. The role of PCA must be nominated and accepted no later than 2 days prior to the commencement of building works or it may jeopardise the legitimacy of the building certification. 5. The role of PCA will not be accepted until all Occupation item components of the invoice are paid in full. 6.It is the applicant s responsibility to notify the PCA of any changes to the details of the builder/principal contractor and any relevant insurances required by the builder. Failure to meet this obligation shall result in the applicant to indemnify the PCA against any losses or suffering as a result of non-compliance with any legislative requirements. 7. It is the applicant s responsibility to notify the PCA when each critical stage of the development is ready for mandatory inspections. The principal contractor/builder can do this on the applicant s behalf. If the applicant fails to notify the PCA at each critical stage, and building works commence, the applicant will be required to cease all work and obtain a 149 Building Certificate from their local council. 8. The Applicant is responsible for ensuring that a copy of Home Warranty Insurance or Owner Builders Permit is submitted to the PCA prior to the commencement of building works, where required by Home Building Act The acceptance will not occur until this requirement has been undertaken. 9. The PCA will not accept responsibility for any damages or costs associated for the inability to issue an Occupation Certificate due to, but not limited to, the following: non-compliance with a development consent condition, approved building plans, or Basix commitments; unsatisfactory final inspection result; missed critical stage inspections; or failure to pay outstanding Occupation Certificate or additional inspection fees. 10. The applicant is responsible for any additional fees that may occur as a result of requiring modified certificates (when plans are altered from their original DA plans) or when unsatisfactory work is inspected and requires a follow up inspection to enable sign off. Additional Fees (occasionally occurring) not covered by standard quotation. As of January 2015, additional fees are as follows: Additional Inspections (per inspection) $140 (inclusive of GST); Modified Complying Development Certificate $750 (inclusive of council lodgement fees $36 and GST); Additional/Interim Occupation Certificate $360 (inclusive of council lodgement fees of $36 and GST). Archive retrieval fee (applies to projects more than 12 months after final inspection $110 (inclusive of GST); Copy costs for plans exceeding A3 in size will be quoted prior to copying (this may slow the process while we wait for quote approval and our staff will be required to take plans to a copying centre and print on your behalf).
