Unless there is testimony to the contrary, the Council should now adopt the resolution confirming the assessments. Fiscal Impact Resolution must be passed to collect the $12,449 in assessments, which fund District activities for the coming fiscal year. 2 BEFORE THE CITY COUNCIL OF THE CITY OF LAFAYETTE IN THE MATTER OF: Confirming tlie Engineer's Report and the Diagram and Assessments Therein for Fiscal Year for the Landscape and Lighting District No Residential Lighting, Pursuant to the Landscaping and Lighting Act of 1972 RESOLUTION WHEREAS, the City Council of the City of Lafayette, California has by previous Resolutions, initiated proceedings and declared its intention to levy assessments, and order the preparation of an Engineer's Report (hereafter referred to as the "Engineer's Report" or "Report") that describes the assessments against parcels of land within the district designated "Landscape and Lighting District No (Residential Lighting)" (hereafter referred to as the "District") for the Fiscal Year commencing July 1, 2016, and ending June 30, 2017, pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section (hereafter referred to as the "1972 Act"); and. WHEREAS, the City Council desires to levy and collect assessments against parcels of land within the District for the Fiscal Year commencing July 1, 2016, and ending June 30, 2017, to pay the maintenance, operation and services required for local street lighting improvements of the District and all appurtenant facilities, operations and expenses related thereto; and, WHEREAS, an Engineer's Report for fiscal year 2016/2017 has been prepared and filed with the City Clerk, and the City Cleric has presented to the City Council said Report in connection with the proposed levy and collection of assessments upon eligible parcels of land within the District as outlined by the District Diagram contained therein; and. WHEREAS, on April 11, 2016 the City Council adopted a resolution accepting the Engineer's Report, declaring the intention to levy and collect assessments for fiscal year 2016/2017, and directed the City Clerk to provide notice and setting May 23, 2016 for a public hearing; and. WHEREAS, the City Clerk has published in a newspaper of general circulation notice of a public hearing, as required by law. Page 1 Resolution
3 NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL OF THE CITY OF LAFAYETTE FOR THE LANDSCAPE AND LIGHTING DISTRICT NO (RESIDENTIAL LIGHTING), AS FOLLOWS: Section 1 Following notice duly given, the City Council has held a full and fair public hearing at the appointed time on May 23, 2016 regarding the District, the levy and collection of assessments, the Report and Diagram prepared in cormection therewith, and considered all oral and written statements, protests and communications made or filed by interested persons regarding these matters. Section 2 Based upon the oral and written evidence presented, including the Engineer's Report, the City Council finds that there is substantial evidence in the record demonstrating that the properties within the District receive a special benefit over and above the benefit conferred on the public at large and that the amount of the assessment is proportional to the special benefit conferred on the property. Section 3 The Engineer's Report accepted by the City Council on May 23, 2016, is hereby approved and adopted as the fiscal year 2016/2017 final Engineer's Report for the District and the diagram showing assessment district boundary thereof and the proposed assessments contained in the Engineer's Report are hereby confirmed. Section 4 Based upon its review (and amendments, as applicable) of the Engineer's Report accepted by the City Council on May 23, 2016, the City Council hereby approves and adopts said Report as the fiscal year 2016/2017 final Engineer's Report for the District, and finds and determines that: a) The land within the District as defined by the Assessment Diagram contained in the Engineer's Report, will be benefited by the operation, maintenance and servicing of improvements to be provided by the District; and, b) The District includes all of the lands so benefited; and c) The net amount to be assessed upon the lands within the District is apportioned by a formula and method that distributes the net amount among all eligible parcels in proportion to the benefits to be received by each parcel from the improvements and services. Section 5 The Report and assessments as presented to the City Coimcil and on file in the Office of the City Clerk comply with the applicable provisions of the 1972 Act and the California State Constitution Article XIIID, and are hereby confirmed as filed. 4 Section 6 The City Council hereby orders the District improvements to be made pursuant to the 1972 Act, which improvements are briefly described as the maintenance and servicing of local street lighting improvements of the District and all appurtenant facilities, operations and expenses related thereto. The improvements may consist of all or a portion of the public street lighting and appurtenant facilities within and adjacent to the District and its Zones. These improvements generally include, but are not limited to the materials, equipment, utilities, labor, appurtenant facilities and expenses necessary for the ongoing maintenance and operation of public street lighting constructed and installed within each Zone of the District, and are more fully described in the Engineer's Report. Section 7 Upon receipt of the required documentation and assessments, the County Auditor of the County of Contra Costa shall enter on the County Assessment Roll opposite each eligible parcel of land, the amount of levy so submitted and apportioned by the formula and method outlined in the Engineer Report, and such levies shall be collected at the same time and in the same manner as the County taxes are collected, pursuant to Chapter 4, Article 2, Section of the 1972 Act. After collection by the County, the net amount of the levy, after deduction of any compensation due the County for collection, shall be paid to the City Treasurer. Section 8 The City Treasurer shall deposit all money representing assessments collected by the County for the District to the credit of a fund for the Landscape and Lighting District No (Residential Lighting) and such money shall be expended only for the maintenance, operation and servicing of the improvements as described in Section 6. Section 9 The adoption of this Resolution constitutes the District levy for the Fiscal Year commencing July 1, 2016, and ending June 30, Section 10 The City Clerk is herby directed to file the assessments and a certified copy of this resolution with the Auditor of Contra Costa County immediately after adoption of this resolution, but no later than the third Monday, in August. Section 11 The City Clerk, or their designate, is hereby authorized and directed to file the levy with the County Auditor upon adoption of this Resolution, but no later than the third Monday, in August pursuant to Chapter 4, Article 1, Section of the 1972 Act. 9 #fwilldan miffl Financial Services INTRODUCTION OVERVIEW Pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section (hereafter referred to as the "1972 Act"), this Engineer's Report (hereafter referred to as "Report") has been prepared as required pursuant to Chapter 3, Section of the 1972 Act, in connection with the proceedings required for the annual levy of assessments for the assessment district designated as: Landscape and Lighting District No (Residential Lighting) (hereafter referred to as "District"), which includes ali iots and parcels of land within various residential subdivisions of the City limits of Lafayette (hereafter referred to as the "City"). The District was formed in 1979 and since the formation of the District the City Council has levied annual assessments pursuant to the provisions of the Landscape and Lighting Act of 1972 to provide funding for the maintenance and servicing of public street lighting improvements that provide a direct and special benefit to those properties within the District. For Fiscal Year 2016/2017, the City Council once again proposes to levy and collect annual assessments on the County tax rolls to partially fund the costs and expenses required to service and maintain the street lighting improvements within the District. The improvements to be provided by the District and the assessments described herein are consistent with the improvements and assessments historically associated with the District and do not represent new or increased assessments pursuant to the provisions of the California Constitution Article XIIID. Each Fiscal Year, an Engineer's Report is prepared and presented to the City Council describing the District, any changes to the District or improvements, and the proposed budget and assessments for that Fiscal Year. The City Council shall annually conduct a noticed public hearing regarding these matters prior to approving and ordering the improvements and proposed levy of assessments each Fiscal Year. As part of that proceeding, this Report describes the District, the improvements, and the proposed budget and assessments for Fiscal Year 2016/2017 to be levied against properties in connection with the benefits the properties will receive from the maintenance and servicing of the District improvements. Tlie improvements and assessments described in this Report are based on the existing approved improvements and assessments for the properties within the District. The word "parcel," for the purposes of this Report, refers to an individual property assigned its own Assessor's Parcel Number (APN) by the Contra Costa County 2016/2017 Landscape and Ligliting District No (Residentiai Ltgliting) Page 1

Tiie Contra Costa County Auditor/Controller uses Assessor's Parcei Numbers and specific Fund Numbers to identify properties to be assessed on tlie tax roll for the special benefit assessments. COMPLIANCE WITH CURRENT LEGISLATION On November 5, 1996, California voters approved Proposition 218. The provisions of this proposition are now contained in the California Constitutional ArticlesXlilC and XliiD. Pursuant to Articie XIIID, Section 5, certain existing assessments (those that existed on or before November 6, 1996) were exempt from the procedural requirements of Articie XliiD, Section 4 and property owner balloting for the previously approved and authorized assessments was not required unless such assessments are increased. Specifically, beginning July 1, 1997, all existing, new, or increased assessments shall comply with the substantive and procedural provisions of Article XIIID, Section 4 that outlined the imposition of assessments and property owner approval process (balloting). Notwithstanding the foregoing, pursuant to Article XIIID Section 5(a) any assessment imposed exclusively to finance the capital costs or maintenance and operation expenses for sidewalks, streets, sewers, water, flood control, drainage systems or vector control are exempt from the procedural balloting requirements set forth in Article XIIID, Section 4. Because the improvements provided by this District are considered part of the street right-of-way and fund the maintenance and operation expenses associated with streets, the existing assessments established for the District prior to the passage of Proposition 218 qualify as existing assessments that are exempt from the substantive and procedural requirements of Article XIIID, Section 4. The proposed assessments described in this Report for Fiscal Year 2016/2017 do not exceed, and are consistent with the assessments that were approved and imposed for the District prior to the passage of Proposition 218 and are therefore compliant with the provisions of Article XIIID. However, any subsequent new or increased assessment shall be subject to the substantive and procedural requirements of Article XIIID, Section /2017 Landscape and Lighting District No {Residential Lighting) Page 2

The District was formed with multiple benefit zones and additional territories and zones have been annexed and added to it since its formation. The District is currently composed of twelve (12) non-contiguous Zones. Part II The Method of Apportionment: A discussion of benefits the improvements and services provide to properties within the District and the method of calculating each property's proportional special benefit and annual assessment. Part III The District Budget: An estimate of the annual costs to operate, maintain and service the lighting improvements and facilities within the District. Part IV District Diagram: A Diagram showing the exterior boundaries of each of the Zones within the District is provided in this Report and includes all parcels that will receive benefits from the improvements. Parcel identification, the lines and dimensions of each lot, parcel and subdivision of land within the District, are inclusive of all parcels as shown on the Contra Costa County Assessor's Parcel Maps as they existed at the time of the passage of the Resolution of Intention, and shall include all subsequent subdivisions, lot line adjustments or parcel changes therein. Reference is hereby made to the Contra Costa County Assessor's maps for a detailed description of the lines and dimensions of each lot and parcel of land within the District. 13 -HfwILLDAN WMi Financial Services Improvements Authorized by the 1972 Act As generally defined by the Landscaping and Lighting Act of 1972 and appiicabie to this District, the improvements include one or more of the foiiowing: The instaliation or construction of pubiic lighting facilities including, but not limited to street lights and traffic signals; The installation or construction of any facilities which are appurtenant to any of the foregoing or which are necessary or convenient for the maintenance or servicing thereof; The maintenance or servicing, of any of the foregoing including the furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of any improvement including but not limited to: > Repair, removal, or replacement of all or any part of any improvements; > Grading, clearing, removal of debris, the installation or construction of curbs, gutters, walls, sidewalks, or paving, or water, irrigation, drainage, or electrical facilities; > The cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti; > Electric current or energy, gas, or other illuminating agent for any public lighting facilities or for the lighting or operation of any other improvements; Incidental expenses associated with the improvements including, but not limited to: > The cost of preparation of the report, including plans, specifications, estimates, diagram, and assessment; > The costs of printing, advertising, and the publishing, posting and mailing of notices; > Compensation payable to the County for collection of assessments; > Compensation of any engineer or attorney employed to render services; > Any other expenses incidental to the construction, installation, or maintenance and servicing of the improvements; > Costs associated with any elections held for the approval of a new or increased assessment. 2016/2017 Landscape and Lighting District No (Residential Lighting) Page 5
14 IK^WILLDAN WMi Financial Services Public Lighting Improvements The lighting improvements for the District and its Zones may include but are not limited to the cost of providing eiectrical energy and servicing of lighting fixtures, poles, meters, conduits, electrical cable and associated appurtenant facilities associated with: Zone 1 - IVlaintenance and operation of five (5) residential street lights located on or near Via Media. Zone 2 - Maintenance and operation of fourteen (14) residentiai street lights located on or near Woodview Drive and Walnut Lane. Zone 3 - Maintenance and operation of eight (8) residential street lights located on or near Castle Court, Morecroft Road, and Bradbury Drive. Zone 4 - Maintenance and operation of four (4) residential street lights located on or near Marlene Drive. Zone 5 - Maintenance and operation of one (1) residential street lights located on or near Silverado Drive. Zone 6 - Maintenance and operation of three (3) residential street lights located on or near Bavarian Court. Zone 7 - Maintenance and operation of one (1) residential street lights located on or near West Creek Court. Zone 8 - Maintenance and operation of thirteen (13) residential street lights located on or near Candy Court, Quandt Court, Campo Calle, Del An'oyo Court, and Laurel Lane. Zone 9 - Maintenance and operation of twenty (20) residential street lights located on or near Peaceful Lane, Happy Hollow Court, Bacon Court, and Secluded Place. Zone 10 - Maintenance and operation of one (1) residential street lights located on or near Meadowlark Court. Zone 11 - Maintenance and operation of eleven (11) residential street lights located on or near Vista Bella and Martino Road. Zone 12 - Maintenance and operation of one (1) residential street lights located on or near Beaumont Court. Lighting facilities may also include but are not limited to all safety lights, security lights or ornamental lights located within the various landscape improvement areas installed as part of the District's landscape improvements. GENERAL BENEFIT The 1972 Act permits the establishment of assessment districts by agencies for the purpose of providing certain public improvements, whicli include the construction, maintenance, and servicing of public lights, landscaping and appurtenant facilities. The 1972 Act further requires that the cost of these improvements be levied according to benefit rather than assessed value; "The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements." In reviewing the District improvements, it is evident that the ongoing maintenance and operation of those improvements directly affect the properties within the District. Although the improvements include public facilities (public streetlights) available or visible to the public at large, the construction and Installation of these improvements were not necessarily desired by properties or developments outside the District and any public access or use of the improvements by others is incidental. B. SPECIAL BENEFIT The special benefits of street lighting and other public lighting facilities are the convenience, safety, and security of property, improvements, and goods. Specifically: Enhanced deterrence of crime and the aid to police protection. Increased nighttime safety on roads, streets and public areas. Improved ability of pedestrians and motorists to see. Improved ingress and egress to property. Reduced vandalism and other criminal act and damage to improvements or property. Improved traffic circulation and reduced nighttime accidents and personal property loss. All of the preceding special benefits contribute to the esthetic value and desirability of each of the assessed parcels within the District and thereby provide a special enhancement of the properties. Furthermore, it has been determined that the lack of funding to properiy service and maintain the District improvements would have a negative impact on the properties within the District. 2016/2017 Landscape and Lighiting District No (Residential Ligliting) Pages

ASSESSMENT METHODOLOGY The approved assessment methodology for the District and its twelve (12) Zones of benefit for Fiscal Year 2016/2017 is described as follows: Zone Assessment The total costs of providing the improvements within each Zone of the District is based on each Zones proportional number of streetlights within the District and establishes a Balance to Levy for that Zone. The sum of each Zone's Balance to Levy amount (Total of all twelve Zones) represent the consolidated budget for the District. 32 -ii^willdan fifawi Rnancial Services PART V ASSESSIVIENT ROLL Parcel identification for eacli lot or parcel witliin the District is based on the Assessment Diagram presented herein and is based on available parcel maps and property data from the Contra Costa County Assessor's Office at the time the Engineer's Report was prepared. A listing of the proposed lots and parcels to be assessed within this District along with the assessment amounts is provided herein. Non-assessable lots or parcels may include, but are not limited to public streets and other roadways (typically not assigned an APN by the County); dedicated public easements, open space areas, right-of-ways, common areas; landlocked parcels, small parcels vacated by the County, bifurcated lots, and any other property that cannot be developed or has little or no value. These types of parcels are considered to receive little or no benefit from the improvements and are therefore exempted from assessment. If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the Fiscal Year, a corrected parcel number and/or new parcel numbers will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel or parcels shall be based on the method of apportionment and assessment rate described in this Report as approved by the City Council. Therefore, if a single parcel is subdivided to multiple parcels, the assessment amount applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.
