1 Overview of Placer Permitting Process How to acquire and maintain Mineral Tenure on Commissioner's Land for placer mining How to operate as a Class 2 How to obtain a Land Use Permit How to obtain a Class 3 Approval How to obtain a Class 4 Approval and Water Licence
2 How to acquire and maintain Mineral Tenure on Commissioner's Land for placer mining Prospecting Anyone age 18 or older may enter available land and locate the claim for mining purposes. Mineral Claim(s) Parcel of land granted for placer mining. Claim size varies. Prospecting Lease Measured between one and five miles. Can be renewed for a maximum of three years. Determine available land. Review claim maps. Identify withdrawn areas. Review Staking Guidelines. Contact the district Mining Recorder Office (MRO) if any questions. Consult the placer staking guide and the placer maps. Stake the Claim(s) or Prospecting Lease. Record the Claim(s) or Prospecting Lease. Submit application form, fees and sketch to MRO within travel time. Mining Recorder assesses claim or lease application(s). Approve Claim(s) or lease granted and claim tags issued. Reject claim(s) or lease denied. Claim holder must affix tags on claim posts. Apply for a Grouping Certificate, if applicable. Claims can be grouped to allow work performed to be distributed to any or all claims in the group. Please note: you must apply for and get a grouping certificate approved before work can begin on a claim. Assessment work on claim(s) or lease. (within one year) Any land-based access to claim or lease may require a Land Use Permit. Refer to the How to obtain a Land Use Permit chart. Determine what permits may be required. Refer to Placer Mining Land Use Regulations. Renew claim(s) or lease? Complete the Application for Renewal form. Check Schedule of Representation work. Lapsing Mineral Claim(s) or Prospecting Lease. Work not performed. Claim(s) or lease automatically lapses when not renewed. All worksites to be reclaimed (claim or lease holder retains liability). AB Actions
3 How to operate as a Class 2 Contact Mining Lands Officer (MLO) to: Ensure program is within threshold limits. Ensure information provided is complete. Complete Notification Form. Describe the proposed work and outline reclamation and proposed mitigation work. Submit Notification Form to MLO with fees. Chief determines if program needs to be bumped up to a different class. Contact AB Designated Office (DO). Complete and submit AA Form 1. Program deemed Class 1 Program proceeds subject to operating conditions. AB DO determines if AB DO begins environmental and may be requested by the AB DO. AB DO completes an Yukon Decision Body and other Decision Bodies. accept, vary or reject the Any additional mitigation identified in the Decision Document must be included and agreed to by the applicant in their Class 2 notification. 4 How to obtain a Class 3 Approval Contact Mining Lands Officer (MLO) to: Ensure program is within threshold limits. Ensure information provided is complete. Complete Application Form. Describe the proposed work and outline reclamation and proposed mitigation work. Submit Application Form to MLO with fees. Determine if Water Licence is required. If yes, Chief will bump operation to Class 4. See How to Obtain a Class 4 Approval chart. It is highly recommended that the proponent contact affected First Nations in area to discuss program. MLO determines if application is subject to AA thresholds. Contact AB Designated Office (DO). Complete and submit AA Form 1. Program deemed Class 1 If Class 1, program proceeds subject to operating conditions. Any land-based access to claim may require a Land Use Permit. Refer to the How to obtain a Land Use Permit chart. AB DO determines if AB DO begins environmental and may be requested by the AB DO. AB DO completes an Yukon Decision Body and other Decision Bodies. accept, vary or reject the Chief, Placer Land Use decision to approve or reject exploration program application (within 25 days). Submit application to Yukon Water Board Water Board begins review of the application and may request clarification and additional information. Contact Yukon Environmental and Socio-economic Assessment Board Designated Office (AB DO). It is highly recommended that the proponent contact affected First Nations in area to discuss program. Complete and submit AA Form 1. AB DO determines if AB DO begins environmental and may be requested by the AB DO. AB DO completes an Yukon Decision Body and other Decision Bodies. accept, vary or reject the Proponent receives and reviews Decision Document. Proponent completes Yukon Water Board s Project Confirmation Form and submits it to Yukon Water Board. Proponent must submit decision document to Yukon Water Board. Approve Water Board issues Mining Land Use Approval and Water Licence. Proponent proceeds with mining program. Yukon Water Board determines if application is adequate. Once application is deemed adequate, application undergoes a period of public comment (minimum 25 days). Yukon Water Board conducts a regulatory review of the Mining Land Use application and the Water Licence application. AB Actions
6 How to obtain a Land Use Permit AB Designated Office Evaluation Process A Land Use Permit may be necessary to access claims Submit Land Use Permit Application Form to Land Management Branch. Land Management Branch reviews Application. Application subject to AA thresholds? Applicant directed to AB Designated Office (DO). Complete and submit AA Form 1 and copy of Land Use Application form to AB DO. No permit required, proposal under thresholds. AB DO determines if AB DO begins environmental and may be requested by AB DO. AB DO completes an Yukon Decision Body. either accept or reject the Government of Yukon approves or rejects the application. Approved Land Use Permit issued.
