DATE: TO: November 27, 2018 Honorable Chairman and Members of the Planning Commission FROM: SUBJECT: Charles Rangel, Development Services Director Zone Code Amendment No. ZCA amending the City of Adelanto Municipal Code ( AMC ) Section (administrative Development Plan Approval), Section (Development Standards), Section (Minimum Design Standards), Section (Accessory Uses and Structures), (Outdoor Storage), (Parking Standards), (Federal Aviation Administration Review), and (Additional Review and Requirements), in the Airport Park Zone (AP); The properties are located in the City of Adelanto, County of San Bernardino. STAFF RECOMMENDATION: Adopt Resolution No. P adopt findings and approve Zone Code Amendment thereby amending various sections of the Airport Park Zone relating to Development Standards, Design Standards, Accessory Uses and Structures, including Outdoor Storage, Parking Standards and Federal Aviation Administration Review BACKGROUND: The Airport Park Property Owners Association (AAPOA) is requesting a comprehensive modification to the Airport Park Zone primarily to enable the airport to be compliant with Federal Aviation Administration regulations so that in the future the airport can be able to allow night time take off and landings operations but additionally, the proposed modifications will also create more flexible development standards relating to permitted uses, Federal Aviation Administration Review are proposed to further restrict objects and improvements in the FAR Part 77 Objects in order to assure the continued safe and adequate operation and maintenance of airport facilities, provide relief on parking standards and modify requirements associated with temporary private airport hangers to encourage investors to develop existing lots in the zone.. DISCUSSION The following is a summary of the proposed amendments submitted by the applicant: Administrative Development Plan Approval The maximum hangar size changed from 10,000 to 12,000 square-feet Parking requirements are not called out in this section but are still required in section The code previously read that a Location Development was required for a hangar over 10,000 square-feet, however a Location Development Plan should be required for development of any size, and Conditional Use Permit is now required for a hangar of over 12,000 feet Development Standards Maximum lot coverage by building went from 60% to 80% to allow more space for hangars and residential uses, the maximum hangar size still applies The phrase when applicable was deleted, as requirements for Federal Aviation Regulations (FAR) Part 77 are always applicable FAR standards for the Runway Object Free Area of 250 feet and Runway Safety Area of 120 feet are written out. This is not a change in regulation, rather a direct reference to specific Federal Aviation Regulations. Multiple storage containers are allowed once a building permit has been issued, rather than the owner being limited to only one container. The containers are subject to the same design and location requirements. Private Hangars are exempt from Chapter of the Municipal Code, referencing fees for hangars, residential uses would not be exempt from DIF. 2

8 Zone Code Amendment No November 27, 2018 Development Impact Fees (DIF). The applicant is proposing to eliminate Development Impact Fees for hangars. It is important to note that City staff neither opposes nor supports the proposed waiver of DIF fees, rather, staff acknowledges this to be a policy issue which the Planning Commission may consider to advise City Council and Council is the final authority Minimum Design Standards Galvanized metal is an additionally approved material for building siding Trash enclosures are no longer required because they present yet another structure which pilots which need to avoid during taxi, take-off and landing operations Accessory Uses and Structures All temporary hangars have been changed to portable hangars to better reflect the intent of these structures A portable hangar can be considered an accessory use to a residential structure for up to five years without a house being built. The original text stated that after five years all Development Impact Fees would be applicable and all requirements for permanent hangars met. The proposed change would allow the builder to apply for two one-year extensions, allowing a maximum of seven years before requirements for permanent hangars must be met. Portable hangars were previously allowed at one per parcel, this change would allow one per acre. Previously the code referenced that Animals are allowed pursuant to Title 7 of the Adelanto Municipal Code, this update will elaborate to include that title 7 is to be applied as it is to Desert Living Zones, where animal uses are allowed subject to lot size Outdoor Storage Clarification that any aircraft in front yard setback must be operable and be in a designated parking area or driveway Eliminates repetition requiring carports to be removed when no longer serviceable, and eliminates the requirement that they are only allowed at a rate of one per acre Parking Standards Parking standards no longer require that parking is provided as per section 17.65, as would be required for other residential uses, unless there is no hangar on the property, in which case a minimum two car garage must be provided per residential unit. Standalone hangars would be exempt from parking as the owner would have space within the hangar for parking Federal Aviation Administration Review Expands the definition of those affected by Federal Aviation Regulations to include properties adjacent to the Airport Park District Additional Review and Requirements The code states that the City is required to consult with the AAPOA regarding any proposed development that has not already been approved by the AAPOA. This change allows the City to contact the AAPOA by in addition to mail, as long as it is from an authorized AAPOA member. AAPOA is responsible for keeping the City informed of its authorized board members. Expands the requirement for noise and Avigation easements to be granted and conveyed to the Adelanto Airpark in addition to the Southern California Logistics Airport. Lists 60 feet as the minimum required width for new roadways, and adds required compliance with SP 114A. Specifies the Runway Object Free Area of 125 feet, previously written as Runway Safety Area, and a distance was not previously specified. 3

9 Zone Code Amendment No November 27, 2018 Adds a requirement that all existing conflicts with FAR Part 77 shall be required to remove the existing conflict prior to the issuance of any further permits. However, permittees having known conflicts may enter into a Part 77 ROFA Obstruction Agreement at AAPOA discretion. Change of ownership through Will or Gift/Sale occurring prior to these requirements are also subject to meeting FAR requirements. The idea behind this is that there exist some properties in and around the runway that the HOA is aware of having objects, structures and improvements which appear to potentially interfere with the runway and this amendment induces those parties to resolve these issues Taxiways, now also encompassing taxi-roads, shall provide a taxiway easement of 60 feet, previously 50 feet. A requirement has been added to require a 20 feet triangular corner when intersecting other taxi roads or airport perimeter public roads All new roads shall have aviation themed names as approved by AAOPA All internal AAOPA taxi roads closures where intersecting public roads shall be in accordance with City and emergency service agency requirements. ENVIRONMENTAL CONSIDERATIONS: The current Zone Code Amendment application is exempt from further environmental review pursuant to Section 15061(b)(3) of the State Guidelines to implement the California Environmental Quality Act (CEQA), which states that the activity is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question, the proposed Code Amendment, may have a significant effect on the environment, the activity is not subject to CEQA. P A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ADELANTO, COUNTY OF SAN BERNARDINO, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL ADOPT ORDINANCE NO. 597 APPROVING ZONE CODE AMENDMENT NO. ZCA AMENDING THE CITY OF ADELANTO MUNICIPAL CODE ( AMC ) SECTION (ADMINISTRATIVE DEVELOPMENT PLAN APPROVAL), SECTION (DEVELOPMENT STANDARDS), SECTION (MINIMUM DESIGN STANDARDS), SECTION (ACCESSORY USES AND STRUCTURES), (OUTDOOR STORAGE), (PARKING STANDARDS), (FEDERAL AVIATION ADMINISTRATION REVIEW), AND (ADDITIONAL REVIEW AND REQUIREMENTS), IN THE AIRPORT PARK ZONE (AP); WHEREAS, the applicant, Charles Laird, representing the Airport Property Owners Association has initiated the filing, ZCA to amend various Tables, permitted uses and related development standards and regulations associated with Federal Aviation Review of the Airport Park Zone generally located generally in the region of Cactus Road to the South, Beaver Road to the East, Pansy Avenue to the North, and Middleton Road to the West in the City of Adelanto, County of San Bernardino within the City of Adelanto, County of San Bernardino; and WHEREAS, the City of Adelanto adopted Title 17 as part of the Adelanto Municipal Code ( AMC ) establishing, among other things, the regulation of Land Uses; and WHEREAS, due to the uniqueness of the Airport Park Zone which allows an innovative mix of residential, commercial and aviation uses, the City desires to adopt Ordinance 597 amending various Sections, Tables and graphs of the Adelanto Zoning Ordinance relating to the Airport Park Zone to create more flexibility, thereby encouraging property owners to develop and build improvements on their properties; and WHEREAS, the proposed amendments also further restricts encroachments in the (Federal Aviation Regulations) FAR Part 77 Objects in order to foster safer airport conditions and proposes amendments to address Federal Aviation Administration Review in order to assure the continued safe and adequate operation and maintenance of airport facilities; and WHEREAS, the proposed zone code amendments are exempt pursuant to Section (New Construction or conversion of Small Structures) of the California Environmental Quality Act (CEQA); and WHEREAS, a duly noticed public hearing was held on the 27 th day of November, 2018 to hear and consider public testimony and consider Ordinance No. 597; and NOW, THEREFORE, BE IT RESOLVED by the Adelanto Planning Commission as follows: SECTION 1. The above recitals are all true and correct. SECTION 2. The Adelanto Planning Commission has reviewed and considered the information included in the staff reports prior to taking action on the proposed Zone Code Amendment. The Adelanto Planning Commission further finds and determines that the City has complied with the California Environmental Quality Act and the Adelanto Planning Commission determinations reflect the independent judgment of the Planning Commission.

13 Adelanto, CA Code of Ordinances CHAPTER AIRPORT PARK (AP) Intent Permitted Uses, Accessory Uses, Conditional Uses, and Temporary Uses Administrative Development Plan Approval Development Standards Minimum Design Standards Accessory Uses and Structures Outdoor Storage Parking Standards Federal Aviation Administration Review Additional Review and Requirements Intent. The Airport Park designated herein by the symbol "AP", is intended to protect the established, private Adelanto Airport and property in the immediate vicinity and to provide for appropriate development of aviation uses and such related uses. Uses in this zoning district are intended primarily for low density single-family residential dwellings and accessory uses, personal aircraft storage areas, mixed-use (residential and airport related commercial), some limited aviation and aircraft related light industry/manufacturing development, and limited commercial uses related to the airport. All uses are intended to create minimal impacts on the surrounding development. The Adelanto Airport is licensed by the State of California as a private Special-Use Airport and is classified as a Utility Airport. A Utility Airport is designed, constructed and maintained to serve airplanes with an aircraft approach category of (A) speed less than ninety-one (91) knots Permitted Uses, Accessory Uses, Conditional Uses, and Temporary Uses. (a) Appendix A: Regulation of Uses by Zone District of this Zoning Code primarily permits Low Density residential uses and the hangars associated with the Airport Park including but not limited to the following: General Manufacturing of aircraft and aircraft parts Aircraft painting Parts Assembly Aircraft restoration Aviation-related hardware stores Other accessory, conditionally permitted, and temporary uses as indicated in Appendix A (b) Uses listed as conditionally permitted uses are subject to the review requirements and conditions contained in Chapter of this Zoning Code. Temporary uses are subject to the review requirements and conditions contained in Chapter Also, certain other uses such as antennas may be subject to Special Use Standards outlined in Chapter 17.80, subject to the special height limitations contained in Table 22-1, Section (a) Administrative Development Plan Approval. The following development of properties within the Adelanto Airport District may be administratively approved, subject to Section and Chapter , and staff review and approval as specified below: (a) A single-family residential structure, with or without a second unit as addressed in Section Second Units, on a lot that complies with all the requirements of this Zoning Code, including but not limited to the Minimum Design Standards contained in Section (b) A hangar limited to personal (non-commercial) use as an accessory to a primary residential use, that is up to 10,00012,000 square feet, and that complies with all requirements of this Zoning Code, including but

14 not limited to the Minimum Design Standards contained in Section (c) A single-family residence within an aircraft hangar for the storage of personal (non-commercial) aircraft, which is limited to personal (noncommercial) use and that complies with all the requirements of this Zoning Code, including but not limited to the Minimum Design Standards contained in Section The floor area of the aircraft hangar shall be less than 10,00012,001 square feet, not including the residential dwelling unit area. (d) An aircraft hangar up to 10,00012,000 square feet for the storage of personal (noncommercial) aircraft, that complies with all the requirements of this Zoning Code, including but not limited to the Minimum Design Standards contained in Section and the Parking Standards contained in Section Hangars without permanent residences shall include a permanent restroom. (e) An accessory structure up to 2,500 square feet, or a combination of accessory structures with a combined total floor area not to exceed 2,500 square feet, that is/are accessory to a primary single-family residential use, not including an attached or detached aircraft hangar limited to personal (non-commercial) use as described in part (b) above. All other new structures shall be subject to review and approval of a Location and Development PlanConditional Use Permit, as described in Chapter Development Standards. 16 (b) Airport Park Special Standards 1. All development within the Airport Park District, unless otherwise specified in this section, shall be in accordance with Chapter Development Impact Fees, or its successor, of the Municipal Code. Private Hangars are exempt from Chapter of the Municipal Code. 2. Once a building permit is issued, one any 8' x 8' x 40' storage containers is permitted per parcel, but must be painted to match the primary structure once completed, placed in the rear of the property, and also screened by drought tolerant vegetation. 3. In order to limit glare and light pollution, all lights except lights related to airport operations, shall be full cut-off fixtures, such that light is directed downward and no light is emitted above the horizontal plane of the bottom of the fixture, and light shall also be directed so as to not cause glare on adjacent properties Minimum Design Standards. The following minimum design standards shall apply to all construction projects, including manufactured housing, within the Airport Park District. (a) All primary single family residences shall have a minimum gross floor area of one thousand (1,000) square feet. The minimum dwelling unit width and depth shall be twenty (20) feet, measured from the exterior of the structure and excluding garages, porches, patios, eaves, cabanas, and bay windows. (b) Utility hookups shall be provided along with a designated laundry space, for residential structures, to accommodate installation of a clothes washer and dryer. This laundry space and utility hookups shall be provided within the primary residential structure or within an enclosed accessory structure. (c) Siding material shall consist of stucco, wood, brick, stone, decorative concrete block, galvanized metal, or powder coated (colored) architectural metal. Synthetic materials of a similar appearance and equivalent durability shall be permitted, subject to the approval of the Community Development Director. Exterior siding shall extend to a point at or near grade. However, if an approved solid wood, metal, concrete, or masonry perimeter foundation is used, the siding need not extend below the top of the foundation. (d) Roofing materials shall be a minimum Class "A" as defined by the Uniform Building Code and shall be architectural metal, such as standing seam metal, or concrete tile, or equivalent. (e) Areas for trash receptacles and recycling containers shall be provided as required by the City of Adelanto. (ef) Manufactured homes placed on a residential lot shall be designed and constructed so as to have an appearance similar to, or consistent with, the predominate architectural style of homes on the street. This shall include, but is not be limited to: Massing Building Materials Replaceable Roofing materials Window and architectural treatments Compliance with Fire Overlay standards Minimum twelve (12)-inch eaves (fg) Architectural Design Any new building or structure, any addition to an existing building or structure, and installation or construction of any site improvements shall be designed to create a unified functional and comprehensive site plan. The improvements shall have an integrated architectural theme that is compatible with and will complement and enhance the subject and surrounding properties. 1. Residential Structures Residential structures shall include architectural features, such as those listed below. Furthermore, hangars shall be architecturally compatible with the residential structure. 17 Awnings or shade elements Exposed beams and wood fascia 2. Commercial-Related Developments Commercial structures shall include architectural features, such as those listed below: Integrated roof elements with parapets Covered outdoor pedestrian areas Landscaped parking island Uniform signs Covered recessed entrances Architectural elements to screen all mechanical equipment 3. Manufacturing/Industrial-Related Developments Industrial structures shall include architectural features, such as those listed below: Integrated roof elements Covered entryways Shaded windows (gh) Walls and Fences 1. The maximum height at all locations, except the required front yard, is eight (8) feet as measured from the top of the wall to finished grade. 2. Retaining and Crib walls shall comply with the requirements contained in Section (b) of this Municipal Code. 3. The height of fences within the required front yard shall be as described in Section (c). 4. All walls must be constructed of masonry, glass block, or a combination thereof. All fences must be built with wood (weatherproofed), decorative/wrought iron, chain link, or other similar materials. The use of unsightly salvage materials is not permitted for fencing purposes Accessory Uses and Structure. Accessory structures are subject to the same height and setback requirements described for primary buildings and structures in Table 30-1 ADD, LM and MI Zone Districts - Development Standards, except as modified by Section Maximum Projections into Yard, and Section (b). Temporary Portable Hangars Portable hangars shall be considered as accessory uses for a period of five (5) years, even when such carports and portable hangars are the only structures on an empty lot. At the end of five (5) years, a permanent residential structure shall be built. If after five (5) years, no permanent residential structure has been built, two one (1) year extensions may be granted. All applicable development impact fees shall be assessed and paid and all requirements for permanent hangars are shall be met at the end of seven (7) years. Temporary hangars shall be considered as accessory uses for a period of five (5) years, even when such carports and temporary hangars are the only structures on an empty lot. At the end of five (5) years, a permanent residential structure shall be built. If after five (5) years, no permanent residential structure is built, all applicable Development Impact Fees shall be assessed and paid and all requirements for permanent hangars met. Such temporary portable hangars shall be exempt from applicable Development Impact Fees at the time building permits are issued, for a non-commercial hangar and be limited to one (1) per parcelacre. If no primary residence is in place, then each temporary hangar shall be required to have a portable toilet in place at the site and maintained in good service. Once a primary structure is added to the property, said temporary portable hangar shall be color matched with the primary structure, and the requirement for a portable toilet will no longer exist. Animals Allowed The regulations pertaining to what type of animals are allowed and the standards for keeping them on a property are addressed in Title 7 of the Adelanto Municipal Code. The Airport Development District has one acre lot minimum and shall comply with DL 2.5 as the minimum, and DL-5, DL-9 as applicable. 18 (a) Storage is not allowed within the required front yard setback, except for operable aircraft and operable vehicles on a designated parking area or driveway. (b) All storage, except for operable vehicles and aircraft, shall be screened from all public right-of-ways and adjacent residential properties. Screening shall be the use of a decorative masonry block wall, solid fencing, or other drought tolerant landscaping barrier. (c) Recreational Vehicle Storage The storage of boats, travel trailers, and other recreational vehicles, including personal aircraft for personal (non-commercial) use, on residential lots within the Airport Park District shall be permitted subject to the following: 1. The open storage of boats, travel trailers, and other recreational vehicles, including personal aircraft for personal (non-commercial) use, is permitted on residential lots subject to the requirements contained in Section Storage of Recreation Vehicles of this Zoning Code. 2. Portable, semi-permanent, or permanent covers and temporary hangars, used to protect boats, travel trailers, or recreational vehicles including personal aircraft for personal (non-commercial) use, from the sun and weather may be used, provided that: A. Such structures are located entirely behind the front setback line of the lot. B. Sufficient distance, as required by the Uniform Building Code, is provided between the structure and any habitable building. C. The cover is maintained in good repair. D. All structures shall be subject to Building Department review and approval. E. Portable or semi-portable carports shall be allowed one per acre, and shall be removed when fabric cover becomes unserviceable. (d) Fuel Storage All fuel storage tanks shall be subject to the review and approval of the San Bernardino County Fire Department, prior to Planning Department approval. (e) Water Storage All water storage reservoirs shall be designed and installed per the San Bernardino County Fire Department standards and regulations, and require a building permit per the Public Works Department Parking Standards. (a) Parking standards for non-residential uses within the Airport Park District shall comply with Chapter of this Zoning Code. (ab) For residential units within the Airport Park District, with or without an attached or detached hanger for the storage of personal (non-commercial) aircraft as described in Section (b), a minimum two (2) car garage or carport shall be provided per residential unit. (bc) For aircraft hangars for non-commercial aircraft, a minimum of one parking space shall be provided per 2,500 square feet of floor space. Location of parking and loading facilities within the Airport Park District shall comply with Chapter of this Zoning Code.Private hangars are exempt from Chapter of the Municipal Code Federal Aviation Administration Review. All properties identified on the City of Adelanto General Plan Land Use/Zoning Map to be within or adjacent to the Airport Park District shall be subject to applicable portions of Federal Aviation Regulation Part 77 prior to development and placement of any structures on such property. Any properties subject to Federal Aviation Regulation Part 77 shall submit to the State of California, Department of Transportation, Aeronautics Division, an agent of the Federal Aviation Administration any and all development applications to the City of Adelanto Additional Review and Requirements. The properties in the Airport Park contain a number of public and private facilities, which are integral to the airport and the uses in this district. These facilities are operated, managed and maintained by the Adelanto Airport Property Owner's Association. In order to assure the continued safe and adequate operation and maintenance of the airport and these facilities, the following additional special provisions and requirements

19 shall apply in the Airport Park District. (a) Adelanto Airport Property Owner's Association Review. In addition to all City application review processes, all new construction and development, including any new subdivisions within the Airport Park and the Airport Park Safety Overlay District shall be subject to the review of the Adelanto Airport Property Owner's Association. Standards for Adelanto Airport Property Owner's Association Review are as follows: 1. Each calendar year, it shall be the responsibility of the Adelanto Airport Property Owner's Association to submit to the City a letter on official letterhead listing all members of the association and those authorized to provide comments for the group. Should this letter not be submitted on an annual basis, the City shall correspond with the Adelanto Airport Property Owner's Association with the most recent contact information provided. 2. It shall be the responsibility of the applicant to submit any proposed project to the Adelanto Airport Property Owner's Association (or its successor). P.O. Box 1102, Adelanto, CA The Adelanto Airport Property Owner's Association shall review, respond, and submit their written recommendations to the City of Adelanto, Planning Division regarding any submittals within thirty (30) calendar days. 3. Should an application for development be submitted without consultation of the Adelanto Airport Property Owner's Association, the City shall provide notification to the Adelanto Airport Property Owner's Association for comments. The requirement for consultation with the Adelanto Airport Property Owner's Association shall be defined as follows: a) Comments on official letterhead or from an authorized AAPOA Board Member of the Adelanto Airport Property Owner's Association with authorized signature(s); or b) A document responding to the City's request for comments with "No Comments"; or c) Verification that project information was sent to the Adelanto Airport Property Owner's Association via certified mail. Should this method be used, the City may not act on a project until 30 days after verified receipt of the project materials. The City shall consider the recommendations of the Adelanto Airport Property Owner's Association prior to granting any approvals for new construction, subdivision, development, or permits. Any appeals shall be directed to Planning Commission and subsequently to the City Council and decided by majority. (b) Avigation and Overflight Easements. A noise and avigation easement on all subdivision parcels and roadways shall be granted and conveyed to the Southern California Logistics Airport and Adelanto Airpark as required in the City adopted Land Use Plan. (c) Access, Utility, Runway, and Taxiway Easements/Agreements. In order to ensure adequate vehicular access, as well as use and access of the airport, prior to any development, subdivision, or issuance of building permits for any new construction the following shall be addressed: 1. Vehicular Access and Utilities. Provide minimum roadways sixty feet (60 ) consistent with the street classification system as described in the General Plan for vehicular access and for proposed and future utilities and per SP 114A.. 2. Runway Object Free Area/Runway Safety Area. The Adelanto Airport Owner's Association (AAPOA) shall provide for a Runway Object Free Area (ROFA) as defined in the State FAA permits. The Far Part 77 Runway Object Free Area (ROFA) easement of 125 and the Runway Safety Area (RSA) are required to enhance the safety of also incorporates the Runway Safety Area (RSA) required to enhance the safety of airplanes that overshoot, overrun, or veer off the runway. The Runway Safety Area (RSA) is centered on the runway centerline and is within the Runway Object Free Area (ROFA), see Figure 1 Runway Object Free Area/Runway Safety. All distances will be measured from the centerline of each runway as defined by the State FAA permits. 3. All land divisions and individual building permits issued on Adelanto Airport shall be considered to provide current FAR 77 (ROFA) easement. Any building permit or land division of property having existing and/or known FAR Part 77 airspace conflicts shall br required to remove all impediments prior to a permit being issued. 4. All building permits issued to those properties along and adjacent to the runways having existing and known conflicts with FAR Part 77 (ROFA) and/or 7:1 transition site slopes may enter into a Part 77 ROFA Obstruction Agreement with AAPOA requirements consistent of City if Adelanto Municipal Code Chapter at AAPOA discretion. This agreement shall also require that upon change of ownership of the property(ies), either through Will/Gift or Sale and prior to the time of the requirements of chapter , all

20 existing conflicts shall be removed/relocated in a way to meet all FAR Part 77 requirements. 5. Taxiways and Taxi-roads.. Taxiway/Taxi-road access shall be provided for all properties to the runways. Taxiway easements shall have a minimum width of fifty sixty (60 50) feet, and have twenty (20) feet triangular corners when intersecting other taxi-roads or airport perimeter public roads/ ThsesTheses AAOPA taxi-road easements shall be a condition of all land divisions and issued building permits. All new taxi-roads shall have aviation theme names as developed and listed by AAOPA.
