7 Starter Tenancy Information 4 What is a Starter Tenancy? A Starter Tenancy is a type of Assured Shorthold Tenancy Agreement. At the end of the Starter Tenancy, after an initial period of 12 months it can in certain circumstances be converted to a full Assured Tenancy. If it is not converted then the Starter Tenancy will be brought to an end. Why Starter Tenancies? The principal reason behind the use of Starter Tenancies has been as a result of the increase in anti-social behaviour. CALICO HOMES LIMITED believe that by offering Starter Tenancies it is able to deal more promptly with the minority of residents that cause anti-social behaviour or other serious breaches of their Tenancy Agreements. We also believe that it will provide a positive signal to all of our other residents and future customers and the public generally that CALICO HOMES LIMITED takes its responsibilities seriously. What does it mean for me? By taking this Starter Tenancy it means that you are effectively on trial for an initial period of 12 months. It is really a trial period similar to that with a new job. If you meet the required standards by not breaking any of the terms of this Tenancy Agreement we will give you a full Assured Tenancy after a final review has taken place. As a Starter Tenant you will not have the following rights: No right to transfer or mutually exchange your home. No right to take in lodgers or sub-let part of your home. No right to assign the Tenancy unless by Court Order. No right to make improvements. No right to buy or acquire your home. No right to succession. What happens if there are problems with my Tenancy? Calico Homes Limited expects most Starter Tenants to become full Assured Tenants at the end of their trial period. If we receive complaints from other residents about you we will act quickly to investigate and see if the situation can be resolved. Starter Tenancies are not intended to deal with minor neighbour disputes as we expect all our residents to act in a neighbourly way to resolve minor matters themselves. However if the problem is serious we will discuss with you what steps you could take to improve things. We will confirm a warning in writing. If you do not take the action we ask of you in the warning we will take legal action to end your Starter Tenancy. In very serious cases we may not issue any warning and take immediate legal action to end your Tenancy. Please note, that you are responsible for your own behaviour and that of your family and anyone living with you and your visitors to your home. What happens at the end of my Starter Tenancy? Following a final review a decision will be made by us as to whether or not the Starter Tenancy can be converted to an Assured Tenancy. If everything is satisfactory we will write a letter to you confirming in writing that the conversion has taken place. If the conversion is to take place then you will automatically receive additional rights as set out in this Agreement. If there is a problem, it is likely that we have discussed this with you and possibly issued a warning. In that case we would advise you that your Starter Tenancy is to be ended and will provide reasons to you and a formal Notice Requiring Possession within 2 months of the service of the notice. In certain cases we may agree to extend the Starter Tenancy period to give more time for a decision to be made.

8 HN Weekly Rent This section of the Agreement sets out your obligations to CALICO HOMES LIMITED with respect to the weekly rent payments you need to make. It also deals with the increases in your weekly rent. General Provisions 1.1 You must pay your weekly rent as set out on page one every week. 1.2 You must pay your weekly rent on time. 1.3 Your weekly rent is due every week in advance. 1.4 If you want to pay by monthly direct debit please contact us 1.5 If you do not pay the weekly rent CALICO HOMES LIMITED can go to court to get an Order to evict you from your home. If you have any difficulty paying you should contact CALICO HOMES LIMITED immediately. 1.6 If you are joint tenants you are each responsible for all the weekly rent and for any arrears. CALICO HOMES LIMITED can recover all weekly rent arrears owed for your home from any individual joint tenant. 1.7 The amount you pay depends on the amenities in your home and on its size, type and location. Service Charges 1.8 Some tenants pay extra for services as part of their weekly rent. If you are one of these tenants, this will be shown on page one of this Agreement. 1.9 The first part of your payment of Weekly Rent will be allocated towards the payment for any services that you receive You must pay for your services at the same time as you pay your rent If there is to be a change in the amount payable for service charges then Calico Homes Limited will let you know in writing at least one month before any charge takes place. Changes are normally undertaken at the same time as rents are changed but can occur at any time (See 5.14). Changes to the Weekly Rent 1.12 Increases With effect from the first Monday in April in each year we may (in accordance with sections 13 and 14 Housing Act 1988) increase the rent by giving you not less than one calendar month s notice in writing of the increase The notice shall specify the revised weekly rent Subject to Clause 1.13 the weekly rent shall not be increased more than once within 52 weeks of the last increase or of the start of this Tenancy Agreement and no increase shall take effect less than a year after the last increase The revised weekly rent shall be the amount specified in the notice of increase unless EITHER we and you agree to an alternative figure OR you exercise your right to refer the notice to a Rent Assessment Committee to have a market rent determined, in which case the maximum rent payable for one year after the date specified in the notice shall be the rent so determined The Rent Assessment Committee is an independent panel of people who decide on the rent payable Rent Increases for Optional Improvements If we, with your consent, carry out any optional improvement works to the Premises we may increase the rent for the period following completion of such improvements up to the first Monday in the following April. We will agree with you the amount of rent increase (if any) which will be due from you when the improvements are completed before carrying out any such optional improvements. This increase is in addition to the increase due under the Rental Increase Clause

9 6 Arrears and Advance Payments 1.14 If at any time when this tenancy agreement is granted you have made any advance payments or you are in arrears of weekly rent in respect of the Property then CALICO HOMES LIMITED will: a) Credit the amount of any advance payment to your Rent Account, or b) Debit the amount of arrears to your Rent Account. For the avoidance of doubt you agree that any arrears due to CALICO HOMES LIMITED by you in respect of the Property before the date of this tenancy agreement deemed to be arrears under this tenancy agreement may be claimed by CALICO HOMES LIMITED as if this tenancy agreement had not been granted If you vacate the Property to become CALICO HOMES LIMITED S tenant in another property: a) CALICO HOMES LIMITED shall be entitled to use all payments subsequently made by you to settle any outstanding debt due from you to CALICO HOMES LIMITED in respect of the Property or your occupation of it, or b) CALICO HOMES LIMITED shall be entitled to credit your rent account in respect of the new tenancy with any sums due to you from CALICO HOMES LIMITED in respect of this tenancy. Housing Benefit 1.16 We will provide you with advice and assistance in relation to Housing Benefit claims If you are entitled to receive Housing Benefit it is your responsibility to make the appropriate application You consent to the payment direct to us of any Housing Benefit (or equivalent State assistance) which you may claim as part or whole payment of the rent and (if applicable) service charge due to us You may withdraw your consent by sending us written notice and upon receipt we shall advise the Council to pay your Housing Benefit direct to you The amount of such benefit will be credited to your Rent Account when it is received by us. If the Housing Benefit you receive does not cover all the weekly rent then you will have to pay the balance yourself If your circumstances change so that your entitlement to Housing Benefit is affected you must immediately inform the Council and us. Any overpayment which is lawfully recoverable may be reclaimed by us from you.

10 HN Repairs This section of the Agreement deals with the responsibilities of the landlord and the tenant regarding repairs to the Property. It also deals with situations where access is required to the Property by the landlord and also what you need to do if you want to carry out alterations. The Tenant s Rights 2.1 You have the right to get repairs done on time. 2.2 In some cases you have a legal Right to Repair you may be able to get some compensation if certain repairs are not done on time. 2.3 CALICO HOMES LIMITED agree that you have the right to have repairs carried out as soon as if Section 96 of the Housing Act 1985 (as amended) and the Regulations made thereunder applied to this tenancy. Please ask us for more information. Landlord s Duties 2.4 CALICO HOMES LIMITED agrees to repair and maintain: The structure and exterior of the building roof, walls, floors, ceilings, window frames, external doors, drains, gutters and outside pipes. Blocked sinks, basins, toilets, baths, drains and gullys. Kitchen and bathroom fixtures basins, sinks, toilets and baths. The installation for the supply of gas/water/ electricity (but not the meter). Heating equipment and water heating equipment installed by the Landlord. Any communal areas around your home stairs, lifts, landing, lighting, entrance halls, paving and communal areas. Except in the circumstances set out in Clause 2.18 below. The repair undertaken will be in keeping with: The age. The character. The location. The expected life of your home. 2.5 CALICO HOMES LIMITED will keep any common entrances, halls, stairways, lifts, passageways, rubbish chutes, and any other commons parts, including their electric lighting, in repair and fit for use by you and other occupiers and visitors to the Property. 2.6 CALICO HOMES LIMITED will decorate the outside of your home and any communal areas as often as we feel is required. 2.7 CALICO HOMES LIMITED will do repairs in stated target times. When we carry out repairs we will usually tell you when the work will be done by (this depends on how urgent it is). 2.8 CALICO HOMES LIMITED will, where access to your home is required, endeavour to make prior arrangement with you if it is necessary to inspect or repair your home internally. This may not be possible in the case of an emergency. 2.9 CALICO HOMES LIMITED will give you or send you written confirmation of your request for a repair. You should keep this confirmation in case you want to make an enquiry later; it will include a contact name and telephone number There are special circumstances when CALICO HOMES LIMITED has the legal right to take possession of your home because work needs to be done on it. They are: If your Property needs to be empty for major building repair or for complete redevelopment or because it has been demolished. You will be offered a suitable alternative home. You usually get compensation or help with moving costs (or both) depending on your circumstances. Your move could be permanent or temporary. If you agree to a temporary move we have the right to take possession of your temporary home when the work on your original Property is finished. CALICO HOMES LIMITED will always provide alternative accommodation which is appropriate to the Tenant s needs and the needs of those living with the tenant. 7

11 8 The Tenant s Duties 2.11 You must report to us any faults or damage as soon as you become aware of them. You must make sure you receive written confirmation saying that we have got your request for a repair You must allow CALICO HOMES LIMITED workers or people sent by CALICO HOMES LIMITED into your home to inspect and carry out repairs and improvements. Usually you will receive prior notification of this In emergencies we will need access immediately. If you do not let us in you could be putting yourselves and your neighbours at risk. In such circumstances we may enter your home and you may have to pay the costs. Never let anyone in without seeing some official identification. (If you are in doubt contact us on ) 2.14 The most common reason why we may need to enter the Property without permission are: When you have refused to have gas appliances at the Property serviced When we need to carry out urgent works to an adjacent property When we need to make the Property safe because we believe that you have abandoned it and we think you are no longer living there If you, anyone living with you, or any visitors: Damage Destroy Remove Lose Alter Replace Any part of the following (whether on purpose or by neglect): The structure and exterior of the building roofs, walls, floors, ceilings, window frames, external doors, drains, gutters or outside pipes. Sinks, basins, toilets, baths, drains and gullys. Kitchen and bathroom fixtures basins, sinks, toilets, baths. Heating equipment & water heating equipment. Any communal areas around your home stairs, lifts, landings, entrance halls, paving and communal gardens. Then you will be responsible for the repair or replacement. We may do the repairs and charge you for them You are responsible for replacing the following: Damaged locks or lost keys. Broken door handles or hinges. Broken latches to gates, if the gateposts and gate are in good condition. Electricity fuses. Flexible gas tubing which is on your own fittings. Plugs and chains for sinks, baths and wash basins, Minor plaster cracks. Minor repair to kitchen units and other cupboards including hinges and catches You are responsible for decorating inside your home. If you need assistance with decorating, please ask us for more information You are responsible for repairing and maintaining your own equipment such as cookers and washing machines, furniture or belongings, any improvement you have put in yourself (unless you have an agreement for us to repair and maintain it) You must make good any damage you cause by putting in or taking out your own fixtures and fittings You must not remove walls or take out any other part of your home without CALICO HOMES LIMITED s prior written permission, or alter, add or remove any of our fixtures and fittings in your home You must not decorate the inside walls of your home with any artex-type substance or any paint which produces a raised, textured, or rippled finish. If you do, we can charge you for removing this type of covering when you move out You must not decorate the outside walls of your home If you make an improvement or alterations to your home without our written agreement we may tell you to return the Property to how it was before. If you don t, CALICO HOMES LIMITED will do the work and make you pay for it.

12 3. Community Responsibilities This section of the Agreement deals with the tenant s responsibilities to the community and what actions the landlord can take to enforce these obligations. HN Everyone has the right to enjoy life in their own way providing they don t disturb or upset people living around them. A good neighbour will tolerate and understand the different lifestyles of others. However, we all have responsibilities as set out below. CALICO HOMES LIMITED will help people solve their problems peacefully but we may take action when this fails in cases of harassment, nuisance, intimidation or victimisation. CALICO HOMES LIMITED will seek to enforce the tenant s responsibilities by taking all reasonable action, including legal action. The Tenant s Responsibilities Anti-Social Behaviour 3.1 You are responsible for the behaviour of every person (including children and pets) living in or visiting your home. You are responsible for their behaviour in your Property, in communal areas and within the locality in which you live. 3.2 You and your family (including your pets) and your visitors must not: harass, threaten, intimidate or annoy any resident of the neighbourhood, any of the employees, contractors or agents of CALICO HOMES LIMITED or any other person who is authorised to be in the locality at any time or place. (Examples can include loud music, arguing, and door slamming, dog barking and fouling, offensive language, drunkenness, selling drugs or drug abuse, prostitution, rubbish dumping, playing ball games close to someone else s home); abuse, assault, intimidate or threaten any violence against any resident of the neighbourhood, any of the employees, contractors or agents of CALICO HOMES LIMITED or any other person who is authorised to be in the locality at any time or place; damage, or remove without permission any fixture fitting or any other property belonging to any of the employees, contractors or agents of CALICO HOMES LIMITED condone, permit, allow or fail to prevent any member of your household, lodger, sub-tenant and visitor to act in the ways described in paragraphs 3.2.1, and above. 3.3 Where you or any member of your household, lodger, sub-tenant or visitor have broken paragraphs 3.2.1, and above CALICO HOMES LIMITED may require you to pay to us the cost of repairing the damage or making good the loss. 3.4 If you or any member of your household, lodger, sub-tenant or visitor behaves in an anti-social way CALICO HOMES LIMITED will be entitled to take legal action against you; such legal action can include: taking action to take possession of your Property obtaining an Anti-Social Behaviour Order obtaining a Demoted Tenancy Order. 3.5 CALICO HOMES LIMITED have the right to apply for and obtain injunctions against tenant, members of your family and visitors to prevent actual or threatened serious breaches of this tenancy agreement and we may also seek the attachment of a power of arrest to the injunction where we consider this to be appropriate for example where a person uses or threatens to use violence against another person. 3.6 CALICO HOMES LIMITED will work in partnership with the local authority and the Police, in securing Anti-Social Behaviour Orders where necessary. 3.7 Violence and harassment will not be tolerated for any reason which can include harassment on racial or ethnic grounds or due to religious 9

13 10 belief, disability, age, sex, sexual orientation, appearance or mental or physical incapacity. 3.8 Violence and harassment can include: threats of violence abusive or insulting words or behaviour. This may include graffiti, malicious complaints, leaflets, pamphlets and other written material, damage or threats to property including damage to any part of a person s home, any act or omission calculated to interfere with the peace or comfort of any person or to any person or to inconvenience such a person. Domestic Violence 3.9 You must not threaten or commit acts of violence to any other person living in the Property If one partner has left the Property because of violence or threats of violence by their partner towards them or a member of their family who was living at the Property and we are satisfied that the partner who has left is unlikely to return then we may take action to regain possession of the Property. Noise 3.11 You must not play or allow to be played any radio, television, record, tape recording or musical instrument so loudly that it causes a nuisance or annoyance to other persons in the neighbourhood or can be heard outside the Property between the hours of 11 pm and 7.30 am. Immoral Use 3.12 You, and your family and visitors to the Property must not use your home or any communal area for any illegal activity, for example selling drugs, or for prostitution or other criminal activities. Pets 3.13 You can keep up to two dogs and two cats without asking our permission. Please consult us if you have a guide dog or hearing dog for advice and assistance If you live in a flat or maisonette with an enclosed communal entrance, you must not keep any pets other than caged birds without our written permission You must keep your pet(s) and/or any visitors pet(s) under proper control, ensure they do not damage your home and ensure that they are not a nuisance, annoyance, hazard, or danger or frighten your neighbours or the community You must make sure that any fouling by the pet(s) or any of your visitors pet(s) is removed immediately You must not carry out any pet breeding at the Property or keep any form of livestock at the Property. General Responsibilities 3.18 You, your family and visitors to the Property must not damage, deface or put graffiti on the Property or within the neighbourhood or vicinity of your home. You may have to pay for any repair, replacement or cleaning needed as a result You, and visitors to the Property, must not interfere with the security and safety equipment in communal blocks communal doors should not be jammed open and strangers must not be let in without identification You must keep any communal areas clean, tidy and clear of obstruction You must not run a business from your home without CALICO HOMES LIMITED s agreement in writing. We will not normally refuse permission unless the business is likely to cause a nuisance or might damage the Property. You may also need Planning Permission as well as our consent as landlord You must not park a vehicle anywhere on your Property except on a hard standing (a driveway or paved area intended for parking) You must not park a caravan or motor home on the garden, driveway, paved area around your home or on any communal parking areas without CALICO HOMES LIMITED s agreement in writing You and your visitors must not park anywhere that would obstruct emergency services You must not do major vehicle repairs or park an illegal or unroadworthy vehicle on the land around your home or on the road.

14 HN You must not put up structures such as sheds, garages or pigeon lofts anywhere on your Property without CALICO HOMES LIMITED s agreement in writing and where necessary planning permission and/or building regulations approval must be obtained You must keep your garden tidy by cutting the lawn and trimming the hedges. If the garden is overgrown and we do not accept your reasons for being unable to maintain it CALICO HOMES LIMITED can clear it and charge you for the work. Please consult us if you are elderly or disabled for advice and assistance You must not keep or use any dangerous, inflammable or explosive materials in your home or in communal areas, e.g. paraffin, petrol, other than normal household materials, e.g. hairspray, deodorants. CALICO HOMES LIMITED does not advise the use of bottled gas heaters, as in some cases they can be dangerous and can cause excessive condensation You must not cut trees down without our permission You must not take any vehicle or trailer over 1.5 tons in weight onto the estate, except if it is for loading or unloading You must not place any writing, drawing sign, placard, advertisements or notice of any description on or in any window, door or the exterior of the Property which may be visible from outside the Property You must not erect any external satellite dish, antennae, aerial or other device for the reception or transmission of television, radio, telecommunications or similar service on the outside of the Property, without first obtaining CALICO HOMES LIMITED s agreement in writing before doing any work. We will require confirmation from you if planning permission and/or building regulations approval is required for the erections that you propose You must report any vandalism to us and to the Police and obtain a crime file number from them. The Landlord s Responsibilities 3.34 CALICO HOMES LIMITED must give you help and advice if you report nuisance or harassment CALICO HOMES LIMITED will look into your complaints and decide what action to take. 11

15 4. Tenant Involvement The Homes and Communities Agency is the regulator that makes sure social landlords such as Calico Homes Limited act in the best interests of their tenants and keep their promises. This section sets out the Homes and Communities Agency guidelines. 12 Landlord s Responsibilities 4.1 CALICO HOMES LIMITED must ask you views about any of its housing plans if they substantially affect either all tenants or certain groups of tenants- for example, we will consult you about modernisation or improvement work that is planned for your home or your area. 4.2 We will involve you or your tenants group in the local housing issues. 4.3 We agree to give you the right to be consulted as if the provisions of Section 105 of the Housing Act 1985 applied to this tenancy. 4.4 We will get your consent to any changes to the Tenancy Agreement (except for rent and service charges). 4.5 We will send you a special housing report every year that describes our work and performance. It will tell you how the service is paid for and how your money is spent. 4.6 CALICO HOMES LIMITED has a complaints procedure under which we will deal with your complaints quickly, efficiently and effectively. A copy of the complaints procedure is available at our offices. The Tenant s Rights 4.7 CALICO HOMES LIMITED will comply with the provisions of the Data Protection Act We will allow you reasonable access to all other personal information held about you or members of your family (provided that this right does not apply to information provided to us in confidence by third parties) and allow you to correct or record your disagreement with the information held by us. 4.8 You have the right to start or join in local tenants groups in accordance with CALICO HOMES LIMITED s Community Involvement Policy. Ask us for information about groups in your area or about how to start one. 4.9 You have the right to go to meetings of our Board of Management and its sub-committees and to speak with them in accordance with our policy on openness at meetings. You can find out more by contacting CALICO HOMES LIMITED You have the right to information from us about the terms of this Tenancy and about our repairing obligations as well as our policies and procedures on tenant consultation, housing allocation and transfers, equal opportunities and our principles for setting rents. You also have the right to be provided with information about our performance. We agree to give you the right to information as if the provisions of Sections 104 and 106 of the Housing Act 1985 applied to this Tenancy CALICO HOMES LIMITED will provide and update as required a tenants handbook.

16 HN Using The Property This section sets out the rights you have to occupy your home and the circumstances when you can let someone else live in your home. It is in your best interests to read carefully and to understand what exactly this Agreement is expecting of you as a CALICO HOMES LIMITED tenant. The Tenant s Rights Right to Occupy 5.1 You have the right to occupy the Property peacefully except: Where access is required to inspect the condition of the Property or adjoining Property provided that reasonable notice has been given by us that such access is required, save in the case of emergency; or A Court has given us possession by ending the Tenancy; or Where we need to make your home safe because we believe it has been abandoned and we think that you are no longer living there. Assignment 5.2 You cannot assign the Tenancy except in furtherance of a Court Order made under section 24 of the Matrimonial Causes Act 1973 or with CALICO HOMES LIMITED s written consent when exercising the right to exchange set out in Section 7 of this Agreement. Tenant s Responsibilities 5.3 You must move into your home on the signing of your Agreement and receiving your house keys. If there are to be delays on your moving into your new home, you must discuss this matter with our office. 5.4 You must use the Property as your only or main home. 5.5 You must report any faults or damages as soon as you are aware of it to our office. 5.6 You must keep the Property in good condition and use the fixtures responsibly. 5.7 You must pay for repair or replacement if damage is caused deliberately or by your own neglect or by the neglect of anyone living with you or by any visitors (not reporting a leaking pipe for example). 5.8 You must tell us if you will be away from home for more than a month, for example to go on holiday or go into hospital. We will be able to provide you with advice on how to keep the Property safe while you are away. 5.9 You must not have more people living in your home than the maximum number allowed. The number is shown on page one of this Agreement You must not keep mopeds or motorbikes inside your home or in indoor communal areas (entrance halls, stairs, and landings) You are advised to take out tenant s household insurance. 17 14 Landlord s Responsibilities 5.12 We will give you your keys and possession of the Property at the start of the Tenancy We will not interfere with your right to occupy the Property peacefully except where: Access is required subject to reasonable notice (save in the case of emergency), to inspect the condition of the Property or to carry out repairs or other works to the Property or adjoining Property or: We are entitled to possession at the end of the Tenancy; or We have obtained a Court Order to exclude you from the Property: or We request access during the last month of the Tenancy, for example to show the Property to a prospective tenant. We will always ask your permission and give you notice of our proposed visit and make an appointment with you; or To check on your safety or welfare where there may be reasonable cause for concern We will provide the services listed on page one of this Agreement and included in the weekly rent. We may (following consultation with all the tenants affected) increase, add to, remove, reduce or vary the services and the associated costs There are special circumstances when CALICO HOMES LIMITED has a legal right to take possession of your home. We can move you if the Property has special adaptations for a disabled or elderly person who no longer lives there. But we only do this in very exceptional cases if the Property is needed by another elderly or disabled person who has nowhere suitable to live. Even if it does happen you will be offered another suitable home before you have to move out (See ground 9 in Section 9).

18 HN Ending The Tenancy This section sets out what must be done by you to end your tenancy. If you want to give up your home, you must give us four full weeks notice in writing. The Tenant s Responsibilities 6.1 You must notify us in writing at least four weeks before you want to leave your home. This four weeks notice period must end on a Monday and you must return your keys to us by noon on the day you leave or by noon of the Monday your tenancy ends, which ever is the later. 6.2 You must leave the Property, the fixtures and any furnishings that we have provided in good conditions when you go. You must then remove all personal possessions and rubbish. Do not leave any of your belongings behind. If you do then: CALICO HOMES LIMITED will store them for 28 days following which they will be disposed of and you will have to pay for the costs of disposal CALICO HOMES LIMITED may pursue legal remedies for civil trespass as well as breach of this Agreement. 6.3 You must pay for repair or replacement if damage has been caused deliberately or by your own neglect. You will not have to pay for normal wear and tear. 6.4 You must not leave anybody else living in your home when you move out. You cannot pass on your tenancy to anyone else, save as set out in Section 7 of this Agreement. 6.5 If we have reasonable grounds for believing that you have left the Property or that it is insecure we shall write to you at the Property to confirm if you are still living there. If you do not confirm that you are still living at the Property then after a period of 4 weeks we will treat the Property as abandoned and change the locks. 6.6 You may not be given another CALICO HOMES LIMITED home in the future if: You have not complied with your responsibilities under this Agreement. You do not satisfy the criteria listed in CALICO HOMES LIMITED s Rejections Policy. 6.7 If you are joint tenants any one of you can end the tenancy by giving us four weeks notice. We will decide if any of the other joint tenants can stay in the home. All joint tenants are equally responsible for any damage in the Property or any belongings left in the Property. 15

19 7. How Calico Homes Limited Can End Your Tenancy We can end your tenancy by first obtaining a court order. We will only ask the court to consider granting an eviction order for specific reasons. These reasons, called grounds, are set out in this section of the Agreement. We will give you at least four weeks notice in writing before we intend to get a court order, unless we are using grounds 14 and 14A when the notice may be less than four weeks. We can also end your tenancy by first giving you two months notice. 16 Security of Tenure 7.1 You have security of tenure as an assured tenant so long as you occupy the Property as your only or principal home. 7.2 CALICO HOMES LIMITED can end your Tenancy by first giving you two months notice. 7.3 CALICO HOMES LIMITED can end the Tenancy by obtaining a court order for possession of the Property on one of the grounds listed in Schedule 2 of the Housing Act 1988 (as amended by the Housing Act 1996). 7.4 The Court will not make an order unless CALICO HOMES LIMITED shall have served on you a notice in writing complying with the requirements of the Housing Act 1988 (as amended) or the Court considers it just and equitable to dispense with service of such a notice. 7.5 CALICO HOMES LIMITED agree that you will receive not less than four weeks notice in writing of our intention to seek a possession order (except where proceedings involve nuisance (Ground 14) and that we will only serve a Notice and thereafter seek to recover possession of the Property on one or more of the grounds set out in Clause 9.6 below and in the circumstances set out in those clauses. 7.6 Except in relation to the following grounds, and in the circumstances referred to, CALICO HOMES LIMITED agrees that it would not be just and equitable for the Court to dispense with service of the requisite notice. Grounds for Possession 7.7 THE FOLLOWING ARE THE ONLY GROUNDS AND CIRCUMSTANCES IN WHICH WE WILL SERVE NOTICE AND SEEK TO RECOVER POSSESSION Ground 7 Where the tenancy has devolved under your Will or on your intestacy; a) We may bring proceedings for the recovery of possession of the Property under Ground 7 within twelve months after your death or if the court so directs within twelve months after the date on which (in the opinion of the Court) we became aware of your death. b) In accordance with the provision of Ground 7 acceptance by us of rent after your death shall not be regarded as creating a new periodic tenancy unless we agree in writing to a change in the amount of the rent, the period of the tenancy or the Property which is let or any other term of tenancy. Ground 9 Suitable alternative accommodation is available for you or will be available for you when the Order of Possession takes effect. We will only seek to recover possession of the Property on this Ground; if in addition we can show: a) That we intend within a reasonable time of obtaining possession to demolish, reconstruct or refurbish the Property and/or the building of which the Property form part or an adjoining or adjacent building cannot reasonably do so without obtaining possession; or b) That the Property has features which are substantially different from those of ordinary dwellings which are designed to

20 HN make them suitable for occupation by a physically disabled person who requires accommodation of a type provided by the Property and no person residing in the Property longer does so and we require the Property for occupation by a physically disabled person; or c) That you are a successor other than a spouse in whom the tenancy has vested under Section 8 and the accommodation afforded by the house or flat is more extensive than is reasonably required by you and we apply for possession no sooner than 6 months after death of the previous tenant; or d) That the Property is one of a group of dwellings which it is our practice to let for occupation by persons with special needs, and a social service or special facility is provided in close proximity to the group of dwelling houses in order to assist persons with those special needs, and no other person with those special needs continues to reside in the Property. Ground 10 You have not paid the weekly rent which is due; Ground 12 You or anyone living at the Property have broken, or failed to perform, any one or more of the conditions of this Tenancy. Ground 13 You or anyone living in the Property have caused the condition of the Property stairs, lifts, gardens or any other part of the building which you are entitled under this Tenancy to use in common with others to deteriorate; and in the case of an act of waste by or the neglect or default of a person lodging with you or subtenant of yours, you have not taken such steps as you ought reasonably to have taken for the removal of the lodger or sub-tenant. Ground 14 You or anyone living in or visiting the Property have been found guilty of conduct causing or likely to cause a nuisance or annoyance to anyone living, visiting or carrying out a lawful activity in the locality, or you have been convicted of using the Property or allowing it to be used for immoral or illegal purposes of an arrestable offence carried out at or in the locality of the Property. Ground 14A The Property was occupied by you and your partner and your partner has left because of violence or threats of violence made by you to him/her (or a member of their family living in the Property before they left) and the Court is satisfied they are unlikely to return. Ground 15 You or anyone living in the Property have ill treated any furniture provided under this Tenancy causing it to deteriorate; and in the case of ill treatment by a lodger or sub-tenant you have not taken such steps as your ought reasonably to have taken for the removal of the lodger or sub-tenant. Ground 16 The property was let to you by consequence of your employment with us and you have ceased in that employment. Ground 17 The tenancy was granted to you as a result of you (or someone acting on your behalf) knowingly or recklessly making a false statement; FOR THE AVOIDANCE OF DOUBT WE HEREBY RESERVE THE RIGHT TO USE ANY OF THE GROUNDS OF SCHEDULE 2 OF THE HOUSING ACT 1988 TO OBTAIN POSSESSION OF THE PROPERTY OR TO RELY ON SECTION 21 OF THE HOUSING ACT 1988 (AS AMENDED) 7.8 Cessation of Assured Shorthold Tenancy If the Tenancy ceases to be an assured shorthold tenancy (for example, if it ceases to be your only or principle home), we may end the tenancy by giving you four weeks written notice. 7.9 Costs We may in requesting an order for possession from the court request that you pay the costs incurred by us in obtaining the order Abandonment If we have reasonable grounds for believing that you have left the Property or that it is insecure we shall write to you at the Property to confirm if you are still living there. If you do not confirm that you are still living at the Property then after a period of four weeks we will treat the Property as abandoned and change the locks. 17

21 8. General Provisions This section sets out the rights you might have to buy or acquire your home 18 The Tenant s Rights 8.1 Insurance We will insure the Property for such sum and against such risks as we (acting reasonably) believe appropriate. You are responsible for insuring your furniture and personal possessions. 8.2 Giving our consent Where this tenancy agreement states that our consent is required, we will not unreasonably refuse to give it. In some circumstances our consent may be given subject to reasonable conditions. 8.3 Remedies and Costs CALICO HOMES LIMITED reserves the right to use all remedies that are available to us either to require you to comply with or to stop you breaching your obligations under this Agreement. The use of all remedies available to us may be in addition or as an alternative to: a) any possession proceedings under the grounds set in Clause 7.7 of Section 7 of the Agreement (or Clause 14.6 of Section 14 of this Agreement if this Starter Tenancy is converted). b) the use of injunctions. c) the use of other forms of court proceedings for breach of the obligations under this Agreement. In addition we shall seek to recover any legal and administrative costs incurred by us in the use of the remedies available to us from you. 8.4 Data Protection Act The Data Protection Act 1998 and our own policies mean that any personal information you give us is effectively protected and treated with respect On signing the tenancy agreement you agree that we are able to release personal information where there is a legal obligation to do so, including the disclosure of any relevant personal information to third parties. This will include but is not limited to: Utility companies, as there is a legitimate interest to make sure that service charges are passed on to those responsible for their collection, and to enable a utility provider to contact a former tenant regarding continuing social support Rental payments, where you leave without paying rent, and no arrangements are in place to do so, we may pass on details to a tracing agency or debt collection company to seek recovery, Repairs and maintenance, at our discretion, we may provide tenant s contact details to the agents, contractors or repairers, Right to Buy enquiries when we have to provide tenant contact details to the valuers A copy of our Data Protection Policy is available on request.

22 HN Support Services This section of the Agreement only applies if CALICO HOMES LIMITED has agreed to give you support and assistance ( the Support Services ) by providing the Tenant with an allocated support worker. If you are to receive the Support Services the box on the first page of this Agreement will be completed. Support Services 9.1 If CALICO HOMES LIMITED provides you with Support Services then those services may include the provision of general counselling and support in relation to all or any of the following: maintain the condition of the home maintaining the safety of the home basic welfare and benefits advice signposting to other organisations 9.2 The cost of the provision of the Support Services will be charged on to you as support services fees. 9.3 We may vary the services fees by giving you one calendar month s written notice of any charge. 9.4 We will usually increase these fees in April each year, although we reserve the right to vary the charges at different times and more than once a year. 9.5 In varying the Support Services Fees, we will limit any increase by reference to the level of charges approved by the Supporting People Administering Authority. 9.6 You agree to accept the level of Support Services made available to you as a condition of your occupancy. 9.7 You agree to pay the Support Services Fees direct to CALICO HOMES LIMITED, should the Supporting People Administering Authority cease to make payment because of your ineligibility or otherwise. 9.8 If, instead of providing you with Support Services direct a support provider provides such Support Services as are listed, then you shall be responsible for observing the terms of any separate agreement in addition to the weekly support service fees which is payable in accordance with the Tenancy Agreement Notices 10.1 You may send us any notice about your Tenancy by addressing it to: Calico Homes Limited Centenary Court Croft Street Burnley BB11 2ED 10.2 This address is provided in accordance with Section 48 of the Landlord and Tenant Act You agree that notices (including notices of legal proceedings) may be served on you by us either personally or by posting them (by registered post) to or leaving them at the Property or if different (your last known address).
