2 RULES AND REGULATIONS JANUARY 2016 GENERAL POLICY: These rules and regulations are established to the Declaration and Bylaws to promote the highest quality of life for all residents of the Condominium and to protect the value of our homes and property. Because quality of the Condominium lifestyle depends primarily upon the mutual respect and cooperation of all, homeowners and residents are expected to exercise restraint, tolerance, and consideration in matters of personal conduct and lifestyle that may affect their neighbors. Residents should expect similar courtesies from their neighbors. The Declaration of Condominium for Commonwealth at Calumet Condominium Association (the Declarations) contains specific restrictions relating to ownership and occupancy of all Condominium Residences. These rules and regulations are not intended to modify or limit them. Rather, these rules prescribe the general parameters of occupancy, safety, hygiene and upkeep for the Condominium. DEFINITIONS: For definitions of Common Elements; Limited Common Elements and Unit Description, see Commonwealth at Calumet, A Condominium. (filed January 28, 2004 and Amendment to the Declaration, filed January 2016 respectively) Resident (for Rules & Regulations purposes): A resident is defined as an individual(s) who has established a permanent legal address in The Commonwealth. 1

3 I. SAFETY AND SANITATION A. Outside Areas 1. Residents shall not obstruct the sidewalks, porches, or lawn areas with inappropriate patio furniture, bicycles, boxes, or any other equipment or objects. 2. Storage is not allowed on patios, driveways, or decks. This includes, but is not limited to: tools, toys, and recreation equipment. B. Patios, Decks, Porches, Garage Door Openings 1. Residents shall maintain patios, decks, and porches in a safe, clean, and orderly condition and appearance. 2. No laundry, rugs, linens, towels (specifically beach towels) or other such items are to be hung from decks or railings. (Exceptions are hanging plants under section D below.) No clothes lines or poles shall be permitted. 3. No screens or sliding glass doors shall be installed in overhead garage openings. 4. Deck furniture of an appropriate outdoor nature is allowed on front porches and patios. C. Use of Grills 1. The State of Georgia Safety Fire Commissioner has adopted fire safety rules regarding using open flame cooking devices or grills (including charcoal or LP-gas) located in multi-family dwellings: "No charcoal or LP burners shall be kindled on balconies or within ten (10) feet of combustible buildings, patios, or overhangs on ground floors" as per NPFA (National Fire Protection Agency). 2. The State of Georgia office of Insurance and Safety does not permit using open flame cooking devices or grills (including charcoal or LP-has) on decks or screened porches. 3. Open flame device grills may be used in your driveway 10 feet away from the garage and building. 4. Electric grills may be used on decks and screened porches. 5. Storing the grill: 1. Cool the grill before moving to storage. 2. Turn off the tank when storing. 3. Disconnect the hose from the grill tank. 4. Store in a well-ventilated area. 6. Recommendations: 1. When in use, immediate access to a fire extinguisher is recommended (minimum size 5lbs) 2. Do not leave the grill unattended during operation. 2

4 D. Plant Containers 1. Plant containers must be placed where they present no danger or obstruction. Residents must obtain written approval of the Board of Directors for hanging plants on limited common areas. 2. Permanent plant materials may not be added or removed without prior approval of the Board of Directors. 3. Empty plant containers or containers with dead plants are not permitted. E. Garbage and Recyclables F. Insurance 1. Owners and residents must abide by all ordinances and policies as set forth by local, state and federal laws which are subject to change. 2. Garbage and recyclable containers must be stored from view and inside garage of owner s unit at all times other than the collection day assigned by refuse removal vendor. The container shall be placed outside garages no earlier than the evening before collection day and returned to garages by the end of collection day. 3. Garbage containers must be sealable containers provided by the vendor performing removal contract services. 4. Recyclable containers must be provided by the vendor performing removal contract services. 5. No loose or bagged trash, garbage, or other materials (such as but not limited to boxes) may be placed outside the unit at any time except collection day. 6. Outside storage is prohibited (e.g., paint cans, oil, gas, lumber, cement blocks, empty flower pots, scooters, bicycles, motorcycles, etc.). 7. Owners and residents shall be responsible for maintaining their containers in a clean and undamaged condition. 8. City of Newnan requires all residents to contract with vendor services. 1. The Association is required by law to obtain 100% replacement cost insurance coverage as per the Georgia Condo Act. 2. It is the unit owner s responsibility to carry Condominium insurance (HO6) coverage for personal property damage or loss, and for all personal injury and property damage not covered by the Association s policies. Homeowners must request their insurance provider to send the Certificate of Insurance to Commonwealth's Property Management Company and request them to update as changes occur. 3

5 G. Dangerous Items 1. No fireworks are allowed anywhere on the property. 2. The use of firearms on the property is prohibited. The term firearms includes, without limitation, B-B guns, pellet guns, archery equipment and firearms of all types. II. GROUNDS CARE AND AESTHETICS A. Alteration of Grounds, Structures, or Landscaping B. Signs 1. No alteration or modification to the exterior of units, common areas, or limited common areas (i.e. Buildings, landscaping, patios, etc.) is permitted without written prior approval of the Board of Directors. Modifications include glass/storm doors, enclosure of patio/deck areas, fences, outside lighting, installation of satellite dishes, TV cable systems, and any other external apparatus. Approval will be granted or denied within 45 days of receipt of the written request. In addition, a waiver must be signed that the homeowner is responsible for any damages caused to the structure while making approved modifications. 2. Owners wishing to make any type of alteration or addition to the unit exteriors, common areas, or limited common areas must submit a Request for Property Modification (RPM) Form (See Attachment "A") to the Property Manager who will process, forward and track. Such request must contain specifications, drawings, plans, and permits as issued by the City of Newnan. No changes may be made until approval is received. Any changes made without approval may be removed at owner's expense by the Board of Directors. 3. American flags, not to exceed 3 ft by 5 ft, may be displayed on a Commonwealth at Calumet Board approved pole. All other flags are prohibited. A Request for Property Modification must be approved before affixing a flag pole. 4. All outdoor storage (including animal shelters, runs, kennels, cages, etc.) is prohibited. 1. Signs advertising a unit for sale, lease, or rent shall be permitted only in the window of a unit on the inside or on the outside of the garage door of the unit UNLESS there agent is an on duty. Such signs shall not be greater than 18" x 18" and must comply with Coweta County and Newnan City laws and 4

6 may be removed at the discretion of the Board. See Declaration of Condominium, Article Signs. 2. No garage sales, yard sales, flea market, political or similar activity shall be conducted in any portion of The Commonwealth at Calumet property without the prior written consent of the Board of Directors. C. Door and Window Treatment 1. All curtains, drapery materials, window shades, or other window treatments visible from the exterior of a Unit (including screened in decks or porches) shall be white or off-white in color and shall not be of reflective material. All windows of a Unit shall have interior window coverings or treatments which meet this requirement. 2. Door, deck, patio, and window ornamentation (such as wreaths) should be chosen with regard to the appearance of the property as a whole. III. LEASING AND USAGE OF UNITS A. For purpose of these rules and regulations, under the Declaration and Bylaws, Leasing is defined to mean the regular occupancy of a unit by any person other than the owner. All leasing must be approved by the Board of Directors to ensure compliance with the Declarations concerning maximum number (20%) of units leasable Access at or by contacting the property manager. B. Units may be leased only in their entirety and no fraction or portion of a unit may be leased. A unit owner may share the occupancy of his unit (i.e. roommate) but there shall be no subleasing of units. C. No unit owner shall be permitted to lease his/her unit if the unit owner is past due on the payment of assessments (association dues) at the commencement of the proposed lease. D. Homeowners pre-approved for leasing their units must provide a signed copy of the lease agreement to the Property Management Company. The lease must state the names(s) of all individuals who will occupy the unit. E. All roommates or house guests are subject to the provisions of the Declarations, Bylaws, and Rules and Regulations of the Association. Should The Commonwealth at Calumet become the guest's permanent, legal address, the homeowner must notify the Property Management Company of their name and phone number (for safety or emergency purposes). IV. PETS A. Restrictions 5

7 1. Only animals commonly accepted as household pets (i.e. dogs, cats) and those pets that pose no danger to other residents are permitted to dwell in the community. 2. No unit may house more than a total of two pets. 3. No animal shall be maintained, housed, or bred for commercial purposes. 4. No animal may be outside of an owner s unit at any time unaccompanied. 5. Pets and animals are not permitted in the fenced area of the pool. B. Owner s Responsibilities 1. All pets shall be cared for and controlled by the owner (City of Newnan Leash Law), so as not to create a danger or a nuisance to the community. [i.e. barking] 2. A pet s owner shall be held liable for any damage caused within the community by the pet, including damage to grounds, structures, common property, or individual property, and for any personal injury caused by the pet. 3. Pet owners must remove any droppings left by their pets in any common area. Failure to do so could result in fines assessed to the owner. 4. No structure or pen shall be built or kept on a deck/patio or any part of the common area, nor shall a pet be housed on any part of the common areas or limited common areas including decks and patios. 5. No pet shall at any time be left unattended or chained on the common or limited common areas, including decks, screened porches, and patios. 6. No pets (except service animals) are permitted within the fence of the pool area or inside the Clubhouse at any time. 7. If required, the pet owner shall remove or exercise control over any pet judged a danger or a nuisance by the Board of Directors. V. SWIMMING POOL A. Pool Use 1. Swimming pool hours are from 6 a.m. to 10 p.m. 2. Absolutely no glass/breakable containers within the fenced-in pool area 3. No diving, running, boisterous or rough play is allowed. 4. Abusive or foul language is not permitted. 5. Music must be played at a moderate level that does not interfere with others. 6. No food or drinks are to be taken into the pool or within five (5) feet of the pool. 7. No grilling in the pool or patio area (grassed area outside the fence may be used). B. Homeowner Responsibility 1. There is an inherent risk of serious injury in swimming alone and/or unsupervised. 6

8 2. There is no lifeguard provided at the pool. Swim at your own risk. As a precautionary safety measure, persons under the age of 14 are not permitted without adult supervision. 3. Maximum capacity of the pool is 43 people. 4. Persons with open cuts, wounds, sores, or blisters may not use the pool. 5. Any person who is incontinent or not fully potty trained must wear appropriate waterproof clothing when entering or being carried into the pool. IF an accident happens in the pool due to incontinence, the Health Department requires the pool to be drained and closed for a minimum of 24 hours. 6. There is no trash pickup nor ashtrays at the pool. Do not leave trash or cigarette butts in the pool deck area. Take all trash (including cigarette butts) with you when you leave the pool area. 7. Owners/residents are permitted four (4) guests maximum at the pool and MUST be present with their guests at all times. 8. Owners/residents are liable and responsible for any damage caused by the homeowner or their guests. 9. Pets and animals are not permitted in the fenced area of the pool. 10. Only customary and appropriate swimsuits are permitted for use in the pool. 11. Rafts and large inflatables (greater than 30 inches) are not permitted. 12. Make sure gates and Clubhouse doors are closed at all times and locked securely upon exiting the pool area. (Violation of these Rules and Regulations may result suspension of pool privileges, and/or other legal sanctions.) VI. FACILITIES USE A. ANNUAL FACILITIES USE AGREEMENT An Annual Facilities Use Agreement must be signed and on file with the Management Company prior to use of the clubhouse, fitness center and, or pool (See Attachment "B"). B. CLUBHOUSE 1. Owner dues must be current to reserve clubhouse. 2. Owner/residents must accompany their guests at all times. 3. Using the clubhouse without prior authorization will result in a $50.00 fine. 4. The Clubhouse may be reserved for parties or meetings by owners/residents with prior authorization by the Board of Directors. (See Attachment "C") The fee structure is as follows: 7

9 $25 fee for owner/resident functions $50 fee for professional/business functions per each four (4) hours of use. (This includes Home Party Businesses (like makeup or cooking wares) 5. The Clubhouse must be left clean (See Attachment "D"), orderly and undamaged upon departure. If you move any furniture, it must be returned to its original location. Make sure all windows and doors are locked when you leave and the thermostat is returned to posted temperatures. 6. All trash must be bagged and removed from the Clubhouse. (There is no trash pickup at clubhouse). (See Checklist - Attachment "D") 7. Loud or objectionable noise is not permitted. 8. Do not put anything on the walls, ceilings or windows that would damage them. 9. Reserving the clubhouse DOES NOT include exclusive use of the pool or fitness center. Normal pool/fitness center rules will be followed and all homeowners may use the pool/fitness center. 10. Parking a. Parking for the clubhouse should be in the dedicated, painted spaces. b. If you need additional parking, park on Commonwealth Circle on the outside curb only. c. No parking is allowed on the mail center circle. d. Do not park on sidewalks or grass. e. Guests may not use parking spaces assigned to owners/residents. f. Failure to follow these guidelines may result in being towed at owner's expense. 11. Children must be supervised by an adult at all times. VIII. VEHICLES A. Restricted Vehicles Owners of motorcycles shall use vehicle strictly for transportation in and out of the property. No racing or joy riding of any vehicle is allowed on the property. B. Parking Control The streets inside The Commonwealth at Calumet are privately owned and narrower than a standard city street. Be considerate of others when parking your vehicle in 8

10 the Commonwealth. Do not block others from reaching their property or the amenities. 1. Parking for the clubhouse should be restricted to the dedicated, painted spaces. 2. No parking is allowed on the mail circle This area is for drop off/pick-up of mail only. 3. If you need to park on Commonwealth Circle, park on the outside curb only. 4. No vehicle may park on the street overnight. 5. If you need to park on Paddock Lane, park on the West curb only. 6. Do not park in front of anyone s driveway. Do not double-park in front of the clubhouse. 7. No parking on sidewalks or grass. 8. Overnight guests parking in "Visitor Parking" spaces must display a Parking Pass on dash of vehicle. (Contact Property Manager for parking pass) 9. No vehicle will be parked in a manner that would impede fire, emergency, or safety response. No vehicle will impede the ingress or egress of other residents vehicles. 10. The term "parking areas" shall refer to the number of parking spaces in the garages and driveways serving the Unit. Vehicles shall be parked only in parking areas serving Units. The term "vehicles," as used herein, shall include, without limitation, motor homes, boats, trailers, motorcycles, minibikes, scooters, go-carts, golf carts, trucks, campers, buses, vans and automobiles. No vehicle may be left upon any portion of the Condominium for a period longer than five days if it is not licensed or if it is in a condition such that it is incapable of being operated upon the public highways. After such five-day period, such vehicle may be removed from the Condominium by the Board of Directors. Any towed vehicle, boat, personal watercraft, recreational vehicle, motor home, trailer, motorcycle, minibike, scooter, go-cart, golf cart, commercial truck, camper, bus or mobile home regularly stored in the Condominium or temporarily kept in the Condominium for periods longer than 24 hours may be removed from the Condominium by the Board of Directors. Trucks with mounted campers which are used as a primary means of transportation shall not be considered recreational vehicles provided they are used on a regular basis for transportation. The Board of Directors may exercise any and all remedies available for a violation of this provision in addition to or in lieu of its authority to remove the violating vehicle. 11. Owners/residents/guests who violate these rules may be towed at their own expense. C. Commonwealth at Calumet Vehicle Restrictions 9

11 1. The Commonwealth at Calumet Condominium property speed is 15 mph. 2. No type of motorized vehicle shall be operated on the property if not licensed or its condition or mode of operation presents a health or injury risk to residents. 3. No person shall operate a motorized vehicle on the property if that vehicle could not legally be operated on the city/county roads. 4. A vehicle owner shall be liable for damage to pavement, grounds, or other community property caused by reckless or improper use of their vehicle. 5. All vehicles shall be quiet in operation. 6. Vehicle maintenance/repairs (changing oil, tune-up, etc.) should not be performed on the property. D. Towing 1. The Commonwealth at Calumet Condominium Association reserves the right to tow, at the owner s expense, any vehicle on the property that violates the Association s Rules and Regulations. 2. The storage of vehicles is prohibited on the Commonwealth at Calumet Condominium property. IX. NOISE 1. Outside speakers, horns, or other outside sound-devices are prohibited. 2. Residents are requested to be sensitive to their neighbors need for peace and quiet when playing radios, stereos, televisions, and other sound-making and noise-producing devices both inside and outside the unit. X. ENFORCEMENT OF RULES AND REGULATIONS A. Compliance It is the responsibility of the unit owner to inform family members, roommates, guests, lessees, and renters of the Rules and Regulations of the Commonwealth at Calumet Condominium Association and to comply with same. B. Reporting of Violations 1.Owner/residents are encouraged to report violations of these Rules and Regulations to the Property Management Company, or authorities as warranted. The statement should contain a. the unit number and/or name of the person in violation. 10

12 b. a description of the violation as observed, including the date and approximate time of the violation. Include photo if possible. 2.If the violation is considered dangerous to others or to the property, it must be reported to appropriate authorities as soon as possible and verbally reported to the Management Company. 3.Upon notification, The Property Management will bring the violation to the resident's attention. If corrective action cannot be accomplished within ten (10) days, please contact the Property Management Office so they can notify the association s Board of Directors. 4.If the violation is not remedied with a 10-day period, fines, restrictions, or other legal sanctions may be imposed. XI. MAINTENANCE (HOMEOWNER S) FEES A. Monthly maintenance (homeowner s) fees are due on the 1st of the month. B. A 10% late fee will be charged if payment is not received by the 10th of the month. C. A fee of $25 will be charged for returned checks. D.
