No details of the said covenants were supplied on first registration. 2 A Deed dated 31 May 1910 made between (1) Fanny Dudney and (2) Emma Rebecca Berry is expressed to release to the extent set out therein the covenants contained in the Conveyance dated 14 July 1908 referred to above (the Principal Indenture) particulars of the material part of the said Deed dated 31 May 1910 are set out below:- The said Fanny Dudney thereby released subject and except as thereinafter provided the said land and hereditaments comprised in the Principal Indenture and also the said Emma Rebecca Berry her heirs and assigns and other the owner or owners for the time being of the said land and hereditaments comprised in the Principal Indenture from the obligations of the thereinbefore mentioned covenants on the part of the said Emma Rebecca Berry her heirs and assigns in the First Schedule of the Principal Indenture contained PROVISO that abstracting release should not extend to the covenants by the said Emma Rebecca Berry not to use or permit to be used any part of the said piece of land comprised in the Principal Indenture or any messuage or building to be erected thereon for any dangerous offensive noisy or noxious trade business or occupation nor permit to remain thereon any caravan house on wheels or roundabout nor should abstracting release extend to the covenant by the said Emma Rebecca Berry her heirs and assigns not to use or permit to be used any part of the said land or any buildings to be erected thereon for the trade or business of a licensed victualler ale house keeper beer house keeper beer shop keeper or wine or spirit merchant nor for the sale or supply of any beer porter stout wines spirits or other intoxicating liquors whatsoever. 3 A Conveyance of the land tinted blue on the title plan and other land dated 27 February 1925 made between (1) Arthur Hudson Dudney (Vendor) and (2) Alfred Charles Waugh (Purchaser) contains the following covenants:- COVENANT by the Purchaser (to the intent to bind the land etc) Not to use or permit to be used the said pieces of land or any part thereof or any buildings to be erected thereon for any dangerous offensive noisy or noxious trade business or occupation or for any purpose which should or might be or grow to be in any way a nuisance damage annoyance or injury to the Vendor his heirs or assigns or other his successors in Title or other the owners or occupiers for the time being of the Red House Farm Estate or the neighbouring land then or lately belonging to the Trustees of the Will of William Dudney AND ALSO not without the written consent of the Vendor his heirs or assigns or other his successors in title to carry on or suffer to be carried on on any part of the said premises or upon any building to be erected thereon the trade or business of a Licensed Victualler Beerhouse Keeper or Wine or 2 of 4

3 C: Charges Register continued Spirit Merchant or sell or suffer to be sold thereon any Ale Beer Porter Wines Spirits or other intoxicating liquors whatever. 4 The land tinted pink, tinted blue and hatched blue on the title plan is subject to the following rights granted by a Conveyance of No. 69 Norway Street dated 22 December 1902 made between (1) Ebenezer Gladman and (2) William John Houghton:- "TOGETHER in addition to the benefit of all general words implied by Statute) with the full and free right and liberty for the Purchaser his heirs and assigns and the owners and occupiers for the time being of the premises hereby conveyed (in common with others entitled thereto) at all times hereafter and for all purposes with or without houses carts carriages and waggons to go pass and repass along over and upon Norway Street aforesaid and Franklin Road leading into Station Road and a proposed new Road shewn on the said plan leading into Norway Street aforesaid the Purchaser his heirs and paying a fair proportionate part of the expense of keeping and maintaining the said roads in good and proper repair and condition and also the free right of passage of water and soil along or through all sewers drains and pipes which are now or may hereafter be laid down or constructed in Norway Street aforesaid and the said proposed new Road when and so soon as such sewers drains and pipes respectively shall have been laid down or constructed and also the right to repair the said sewers drains and pipes in common with others who may now or may hereafter become entitled to the use thereof." 5 The parts of the land affected thereby are subject to the leases set out in the schedule of leases hereto.
