3 Welcome to the Shamrock Village Home Owner s Association! Whether you are a new owner or tenant Allred & Co., REALTORS want to warmly welcome you to one of Archdale s most prized communities, Shamrock Village. This handbook of Rules is to be used as a condensed, easy to read guide to the Bylaws & Declarations. The primary role of the Association and its governing Board of Directors is to maintain aesthetic control, enforce the governing documents and care for the Association owned common areas. The Board of Directors consists of a minimum of three elected owners who serve as a President, Vice-President and Treasurer. Allred & Co., REALTORS partners with the Board for all collections, maintenance and day to day business transactions of the community. MANAGEMENT The HOA has retained Allred & Co., REALTORS to be the managing agent for the property. DUES & ASSESSMENTS All homeowners are obligated to pay the monthly common charges/dues. Allred & Co offers an auto draft option free of charge to owners. 1. All payments are to be made payable to SHAMROCK VILLAGE HOA 2. Dues are collected from the 1 st -15 th. 3. On the 16 th a $10 late fee is charged Assessments can be levied by the Board for special projects, capital improvements or to build Reserves for long-term maintenance and repairs. Dues are allocated by the Board with a preapproved annual budget voted on by the community. Dues generally are used for the following monthly and annual expenses: general maintenance, repair or replacement of common elements, Hazard and other Insurance, Lawn maintenance, PAGE 2

4 landscaping upkeep and improvements, all utilities, expenses of administration and the Termite Bond/treatment of the structures. REPORTING PROBLEMS Complaints, questions and maintenance requests should be reported to Allred & Co., REALTORS. It is advisable to submit complaints in writing or by to the managing agent; however emergency situations should be relayed by telephone. The Board nor the managing company are responsible for addressing civil matters between owners, residents or their guests. Allred & Co., REALTORS will always direct residents with civil issues to call the Archdale Police Department. INSURANCE COVERAGE The Association covers a General Liability insurance policy. The Association does not carry any type of insurance on the homes or personal contents of the homes themselves. Each homeowner is responsible for insuring their home with a H03 policy. Homeowners are asked to provide a copy of their insurance renewal annually to the management company. Copies of Shamrock s Master Policy can be requested from the management office. ALL CLAIMS REGARDING THE ASSOCIATION SHOULD BE MADE THROUGH THE MANAGING AGENT: ALLRED & CO REALTORS. RULES AND REGULATIONS The Rules and Regulations of Shamrock Village have been duly approved and adopted by the Board of Directors for Shamrock Village Homeowners Association, Inc. All members, tenants of members, invitees and guests of members or tenants, and any other persons who might lawfully be entitled to use of the common or other facilities of Shamrock Village Condominiums are subject to the terms and conditions of these RULES & REGULATIONS. The term member herein shall mean and refer to any owner of a condominium unit in Shamrock Village. The term premises herein shall mean and refer to common areas and individual condominium units unless otherwise stated herein. This handbook is meant to be a condensed and easy access guide to your original Bylaws, Declaration and Covenant, Conditions and Restrictions. In the case of any conflict between the Declaration and the Rules and Regulations, the Declaration shall control; in the case of any conflict between the By-laws and the Rules and Regulations, the By-laws shall control. The Rules and Regulations may be subsequently added to, modified or replaced at the discretion of the Board of Directors. PAGE 3

5 PETS Designated Pet areas are as at the front of the complex in the large yard behind the mailboxes and next to the 100 building and in the grassy area next to the 400 building. Pets are not allowed between buildings. There is a large, fenced ballpark within walking distance on Goodman Street next to Trindale Pool. 1. Only companion pets such as birds, cats, fish and dogs are permitted. Absolutely no undomesticated animals are permitted. 2. Maximum of two (2) pets per condo. All pets shall be under twenty-five (25) pounds with the exception of service animals. Residents, who are members, whose animal is over the weight limit will be allowed to keep said pet for its lifetime. 3. Pets shall be kept on a leash or carried while outside, including common areas, at all times. 4. Pets shall never at any time be kept on the balconies, porches or decks. Pets are not to be chained or tied outside any unit or on the premises. 5. Pets must relieve themselves only in the designated areas. Pet owners are responsible for picking up pet excrement immediately. Even in the designated areas. 6. The Association reserves the right to ask members/tenants to remove pets that become a habitual disturbance or nuisance to neighbors due to barking, running at large, owner not picking up after the pet, etc. 7. Owners are responsible for providing documentation (tag issued by DHHS) or written documentation from doctor and state proving that an animal is being trained as a service animal as defined by Federal law (42 U.S.C. 3604(f)(3)(B); 24 C.F.R and N.C.G.S NOISE AND ODORS All residents need to be aware of the designated quiet hours between 11PM and 8AM. All residents shall refrain from operating dishwashers or doing laundry during these hours. 1. Owners and residents need to exercise reasonable care to avoid making or permitting to be made inside or outside their homes loud, disturbing or objectionable noises. 2. Music, radio or voices should not be heard outside of your vehicle when pulling onto Shamrock Village property. 3. Honking of horns is not permitted PAGE 4

6 4. Gatherings, cell phone use and music is prohibited on the stairwells and front porches 5. Children should not be permitted to play in the front of the units 6. Singing or playing any musical instruments, radios, television, Ipods, car stereos etc., which is objectionable to other residents is prohibited 7. Loud or incessant barking is not permitted VEHICLES Each unit is designated/reserved one (1) permanent parking space which is marked with the unit number. Spaces marked RESIDENT are for residents who live at Shamrock Village only. Resident spots are first come, first serve. The maximum number of vehicles allotted per unit is two. Guests are to park in the median/unmarked spaces. Please advise your guests accordingly. 1. Vehicles must not be backed into parking spaces, except during periods of snow or ice. An exception for Police vehicles will be made by the Association. 2. Vehicles which are inoperable, in a noticeable state of disrepair and/or are junk vehicles may not be stored on the premises, and if on the premises for more than two (2) days, will be towed at the owner s expense. 3. Any maintenance or repair work which may deposit oil or other fluids on the parking lot surface is prohibited. 4. Vehicles may not be washed in the parking lot 5. Unlicensed or uninsured vehicles must be removed from the premises within five (5) days, otherwise, they will be towed at the owner s expense. 6. Parking is for passenger vehicles only- boats, campers, trailers, utility vehicles, motorhomes, jet skis, etc. Vehicles which are not used for day to day resident transportation will not be permitted to be parked on the property. 7. Owners who damage the parking lot surface will be responsible for repairs 8. DO NOT park your vehicle crooked, such that it is over the line of your marked space. 9. Parking in front of the dumpsters, mailboxes (for extended periods), along the curb, on the grass or anywhere other than a marked parking space is strictly prohibited. MAILBOXES Any problems regarding the mailboxes or keys should be reported to the Archdale Post Office. The HOA nor the Management Company are responsible for mailbox keys. The Association is responsible for the upkeep and maintenance of the mailbox housing and shelter. PAGE 5

7 SOLICITATION No solicitation is permitted on the property without prior consent from the Board of Directors via the managing agent. TRASH- DUMPSTERS & RECYCLING Owners/residents will be fined $50.00 minimum for leaving large items at the dumpster or at the street. Christmas Trees are to be disposed on Frazier Streetoutside of the community entrance. Trees disposed after January 5 th will not be picked up by the city unless otherwise notified. 1. All garbage is to be placed in tied/secured plastic trash bags 2. Residents shall not allow garbage or refuse to remain in condominium unit for an unreasonable length of time. Garbage may not be stored for any period of time on the porches, balconies or patios of any unit. 3. Keep the dumpster bins closed 4. Littering anywhere on the grounds is not permitted. Littering includes discarding of cigarette butts. FINES WILL BE ENFORCED. 5. Trash must be put into the dumpsters 6. Owners will be fined for littering of sodas, Capri suns, candy wrappers, etc., which are left by guests or children in the common areas. 7. Large boxes must be broken down before placing in the dumpster 8. ABSOLUTELY NO DUMPSTER DIVING, scavenging, salvaging or digging for recyclable materials is permitted. If residents see this occurring, please notify the City Police and management. 9. NON RESIDENT dumping is illegal and should be reported immediately to the Archdale Police Department. If possible, take a picture of the license plate number. 10. Owners/Residents are responsible for discarding and disposing of large household items, including appliances, mattresses and furniture. BBQ GRILLS & GAS TANKS According to Randolph County fire codes residents may not store more than 1.5 liters of any flammable propane/gas on their porches, balconies, patios or in storage units in connected housing complexes. 1. Use of a grill/bbq is not permitted within 10 feet of any structure (includes porches/balconies). 2. Storage nor use of grill/bbq is not permitted on the front porches/balconies/sidewalks. PAGE 6

8 3. Grills may not be left in common areas, or any grassy area off your patio- but may be stored on the back patios. CHILDREN Children must be supervised at all times. Parents are responsible for damage to grounds and landscaping caused by children. Children are not allowed to play in between vehicles, on the staircases nor the sidewalks. Skateboarding, inline skating, bikes and scooters are not allowed on the sidewalks or between vehicles. Sidewalk Chalk is not permitted. LANDSCAPING, FLOWER BEDS & VEGETATION 1. Residents may not plant flowers, trees, shrubs or other vegetation on the grounds. 2. Residents may not place statuary, flags, outdoor ornaments, or outdoor ornamental pieces (including benches) in the flower beds or common areas. 3. Vegetable gardens are not allowed. 4. Animals are not to use the flowerbeds, pine needled areas or any common area for defecating. 5. Flower pots with dead greenery/flowers are not permitted FOR SALE/ RENT SIGNS & THE HOA 1. No signs or advertisements may be posted on the grounds. Owners who wish to sell or rent their units must place any signs inside their unit windows. 2. Open House signs may be placed in front of the unit during the hours of the open house only. 3. Vehicle for Sale signs may be posted inside the vehicle only. 4. Owners are responsible for informing property managers and realtors of these rules. PERSONAL PROPERTY & YOUR UNIT 1. Front porches shall not be used as storage area. Personal property shall be properly stored so as not to create an eyesore as outlined in the declaration. 2. Floor coverings and rugs are not allowed on balconies, porches, patios and decks with the exception of a door mat in front of exterior door only. 3. Outdoor furniture and other outdoor items on balconies, patios, porches and decks must be in good repair. No interior furniture, appliances or electronics are permitted to be used, stored or displayed on the exterior of any unit. 4. Bird feeders, clotheslines, hanging clothing or other items (hung to dry) are not allowed anywhere on the exterior of any condominium or in the common areas. PAGE 7

9 5. Personal property in no way shall create a nuisance to the other homeowners. 6. Residents shall not allow any substance to be dropped or thrown from decks, balconies front or rear. This includes but is not limited to grease, garbage, cigarettes, food or food scraps and cleaning solutions/mop water. 7. Satellite dishes, radio antennae or television antennae are NOT to be mounted to any permanent structure including the roofing, siding or decking. Wiring of any nature may not be run along or on the exterior of any building or in the common areas without prior approval by the Board of Directors or Managing Agent. 8. All storm doors must be full glass view only. All replacement doors must be approved by management or Board. TENANTS & RENTALS Homeowners are permitted to rent their homes on long-term leases provided they give the tenant a copy of the Associations policies before the lease is signed. 1. Owners are responsible for the actions of their tenants and guests of the tenants. Owners bear the sole responsibility to apprise and inform all tenants of the Rules and Regulations. It is not the duty of the HOA or the Managing Agent to inform the tenant 2. Tenants are not responsible for-nor permitted to- pay the HOA dues 3. Owners are responsible to send the managing agent a copy of their lease with the name and contact information of the tenant. 4. Tenant violations/infractions will be charged to the owner of the unit 5. Month to month (transient or vacation leases) are not permitted at Shamrock Village. ANNUAL MEETING An annual meeting is held at the beginning of each Fiscal year. The meeting is for the purpose of electing a new Board of Directors, voting on an annual budget and tending to business as necessary with members. The Fiscal year runs April 1 st - March 31 st. VIOLATIONS According to Shamrock Village Bylaws there are two types of violations- MAJOR and MINOR. The Board and/or Management reserve the right to fine owners for violations and infractions which are outlined within this handbook and the Bylaws. The fine for a MINOR violation $10 fine per violation; if the violation continues and is not corrected within three (3) days, then each day thereafter will be a separate violation of $10 fine per day. 10 Example of Minor violations: trash on porch, guests parking in other owner s spots, not picking up after your pet, statuary or personal items in the common areas, toys/bikes left out, littering, etc. (Any minor violation that has been charged to you more than three times will by default become a MAJOR violation and the fees will be charged accordingly.) The fine for a MAJOR violation is $25 first violation, $50 for the second and if the infraction is not corrected after three (3) days- the Board/Management will charge $10 per day. Examples of MAJOR VIOLATIONS: Dogs off leash, habitually violating the noise ordinances, Personal property being an eyesore to the community, Illegal vehicle (also subject to being towed), Police involvement at your home more than three (3) times in a consecutive time span of 30 days, etc. Fines will be assessed against members and units only, and if not paid a lien will be filed against the subject condominium unit in the same manner as regular monthly dues for common expenses. Fines are to be paid to the managing agent. WHAT THE HOA MAINTAINS A complete guide outlining what the Association maintains can be found in the Bylaws. The Association is responsible for: roof repair and replacement, gutter and downspout repair, exterior siding repair, common area lighting, lawn care, trees and shrubs, water and sewer lines from the street, sidewalks, parking lots, parking numbers, mailbox housing, exterior dryer vents. The staircases. Pickets, decking on the front of the units. If you have any situation that you feel may be the responsibility of the homeowner s association to address (plumbing, etc.) you must first contact the managing agent to gain clarification on the situation. IF YOU ADDRESS THE SITUATION YOURSELF WITHOUT FIRST NOTIFYING THE MANAGING AGENT THE ASSOCAITION WILL NOT BE RESPONSIBLE FOR ANY COSTS INCURRED BY THE HOMEOWNER. THE OWNERS RESPONSIBILITY Owners are responsible for any exterior fixture that is solely meant for their unit. Examples are storm doors, porch lights, doorbells, front door paint, back porch/balcony pickets. Owners are responsible for allowing the managing agent s vendors in to their units to do repairs that affect the wellbeing, upkeep or safety of the community as a whole i.e.: replace vinyl on back deck, dryer vent cleaning, etc. PAGE 9
