3 VILLAS DE LAS FLORES HOMEOWNERS ASSOCIATION RULES AND REGULATIONS PREAMBLE TO RULES AND REGULATIONS Villas de Las Flores is a private condominium community, so that all the exterior surfaces of the condominiums, including Roofs, Load Bearing Walls, Front Doors, Downspouts, Rear Patio Walls, Gates and Front Patios are the Sole Responsibility of the Association. Any changes or alterations can only be made with the approval of the Association. These Rules and Regulations are presented so we will enjoy living in a pleasant environment with friendly neighbors and be able to maintain our property values. These Rules and Regulations compliment and are in accordance with the Covenants, Conditions, and Restrictions (CC&Rs) and supersede all previous Rules and Regulations established by the Association s Board of Directors. All previously approved deviations from the new Rules and Regulations are grandfathered in. Your cooperation and understanding is respectfully solicited. Please place this booklet in a conspicuous place so that it may also be used as a handy reference for guests and renters. Be a good neighbor! Let s all enjoy the beauty and tranquility of Villas de las Flores. GOVERNING DOCUMENTS Each homeowner has received a copy of the CC&Rs and the Bylaws. These are the governing documents along with the Rules and Regulations periodically reviewed, updated, approved and distributed to you by your Board of Directors. Please become completely familiar with these publications. In order to maintain a responsible and successful community, these governing documents must be followed. They insure the enjoyment of our community and the continuing appreciation of our individual investment. It is encumbent upon each and every one of us upon seeing an infraction of our rules to call it to the attention of the person violating the rule. Serious and/or repeated violations should be brought to the attention of the Board through the property management company. RENTERS are subject to all of the same rules and regulations as are homeowners. RESIDENTS are defined as either owners or tenants residing within the property. R&R 1
4 COMMON AREAS 1. The common areas, as defined in the CC&Rs, are the areas outside of your unit, which include the clubhouse, parking lots, lawns, landscaping, tennis courts, pools, spas and streets. In addition, these rules also apply to the front patio of each unit which is not enclosed by walls or fences. 2. Common areas are for the exclusive use of the residents and their guests. Discretion and consideration must be used with respect to the number of guests, to avoid monopolizing the facilities. 3. Residents and guests must abide by all the Rules and Regulations. Infractions may lead to fines and/or denial of the use of the common areas as stated in the CC&Rs. 4. Excessive noise is discouraged in the common areas or in homes where it could disturb your neighbors (i.e., loud parties, loud television and/or stereo, barking dogs, etc.). Offensive conduct is giving painful or unpleasant sensations or causing displeasure or resentment. Offensive conduct need not imply an intentional hurting but it may indicate merely a violation of a victim s sense of what is proper and fitting. 5. Any person who cannot demonstrate that he or she has rightful access to the common areas and facilities will be asked to leave the area. If such party fails to leave the area, the local authorities will be summoned to remove individual(s) from the property. 6. The Board of Directors has the right to hold a homeowner liable for damage to the common areas including buildings, equipment and furnishings as a result of negligence, carelessness, misuse or violation of the rules by family members, guests, tenants or themselves. ANIMAL CONTROL 1. Dogs within the boundaries of Villas de las Flores must be on a leash (This is a City of Palm Springs Ordinance). No more than two (2) dogs or cats are permitted and exotic pets are not allowed. 2. Owners are responsible for picking up dog excretion or a fine may result. 3. Pets other than guide dogs are prohibited in pool areas, spas, clubhouse and tennis courts. 4. Dogs are not to be tied / tethered to trees or other objects in the common areas. 5. Pet houses or fences are not allowed on patios or balconies. 6. Dog owners are responsible for controlling excessive barking that disturbs neighbors. R&R 2
5 REFUSE CONTROL 1. Trash must be placed inside portable dumpsters and not placed on the ground within the trash enclosure area. Trash disposal contractor will not pick up any trash left outside dumpsters. 2. Please observe signs posted on enclosure doors regarding prohibited materials. Homeowners must privately arrange for large items or construction material to be taken off the property and shall be billed for the disposal of any prohibited materials 3. The tops of the dumpsters must be closed. 4. All recyclables must be placed in the Blue Recycle Containers per City of Palm Springs ordinance. 5. Use the garbage disposal for disposing of food stuffs. Placing food in the dumpsters causes odors and attracts insects and rats. MISCELLANEOUS 1. Bicycles, segways, skates and skateboards are not allowed on the lawns, walkways, pool areas or planted areas. Please observe signs posted throughout the property. 2. Throwing balls and other objects against buildings is prohibited. 3. Football, soccer, baseball, golf, etc. are not permitted in the common area grounds. 4. Firepots on enclosed patios are allowed as long as they do not offend their neighbors or emit excessive smoke. 5. Yard / garage sales are not allowed. 6. Personal security cameras are allowed with approval by the Architectural Committee, following legal requirements. STREETS AND PARKING The following shall be adhered to in order to meet fire department regulations and to insure available spaces for residents and guest parking. 1. All streets within the complex are private. The speed limit is 10 MPH. 2. Parking is prohibited on any Villas de las Flores streets. Exceptions include attended vehicles, service vehicles, vehicles used for loading and unloading or delivery (maximum of 15 minutes). All vehicles should be parked in carport stalls assigned to unit or in guest parking areas. No back-in parking allowed; this prevents damage to walls and bushes. Anyone parking illegally may be towed at their expense. R&R 3
6 3. A vehicle of a size, such as a motor home, camper, trailer and boat, which precludes it from fitting in a designated assigned carport is also prohibited from parking in any of the Villas de las Flores private or guest parking areas, except for loading and unloading. Absolutely no living in the vehicles is allowed. 4. Residents are responsible for their guest s parking and should inform such guest that they must use the designated off street guest parking areas. Guests should not park in assigned carports. 5. Vehicles with a registration that is expired for more than one (1) month shall not be parked anywhere on the property. Excusable delays in registering a parked vehicle are permitted as long as the VDLF property manager is notified by the vehicle s owner, i.e. seasonal property owners. Once a seasonal owner returns, a vehicle must be registered within 30 days. 6. Vehicles must be properly maintained. Vehicles with flat tire(s), fluid leaks, missing/broken major parts such as tail pipes, tires, windows or any other equipment necessary to operate safely on the highways constitute an unreasonable nuisance and unsightly intrusion on the common areas, and negatively impact VDLF property values. Excessive engine noise is not permitted. A car cover in a neutral shade is permitted. 7. Assigned parking spaces are to be kept free of oil or other fluid leaks, catch trays, carpets or other similar items placed on the asphalt floor. Vehicles may not be placed on blocks or subject to overhaul/restoration while parked at VDLF. 8. Any vehicle in violation of the R&R may be towed at the owner s expense. POOL RULES The purpose of these rules is to establish order, ensure safety and preserve the enjoyment of the pool area for all residents and their guests. Definition of Pool Area: The pool area encompasses the pool and pool decking area within fencing. 1. Proper swimwear must be worn by all pool participants. Cutoffs, thong bathing suits and street clothes are not allowed. In accordance with county health regulations, incontinent persons of any age are not permitted in the pools. 2. Observe all posted rules. There is NO LIFEGUARD on duty. Swim at your own risk. Pool hours are from 8:00 am to 10:00 pm.. 3. Children under the age of 14 are not permitted in pool area unless a guardian is present within the pool enclosure. 4. Owners shall not allow their family members and / or guests to monopolize the pool area for long periods at a time. The pools are for everyone s enjoyment. R&R 4
7 5. Glass items are not permitted within pool areas. Plastic or other non-breakable containers must be used. 6. Loud noises, running, rough housing and boisterous play within the pool area are prohibited. 7. Long hair must be secured before swimming in the pool. 8. Pool furniture may not be RESERVED (i.e., putting towels on lounges early in the morning or when leaving pool area to eat). 9. Homeowners and tenants may use another pool as an invited guest of another homeowner or tenant in a different pool area. Otherwise, please stay at your own pool. 10. Tampering with pool equipment and controls is not allowed. Report any equipment malfunction to a Board representative or to the property management company. 11. Styrofoam floats are not allowed. 12. All pool toys and floats must be removed from the pool area by the end of each day. 13. Those people using floats should be considerate of others and move to the side allowing swimmers to use the length of the pool. 14. Food and drink are not permitted in the water. Clean up areas used, wipe off tables and place trash in containers provided. 15. Pool furniture must remain in the pool area. Return to original location after use. 16. Towels and floats are not allowed to be hung on pool fences. 17. Pool gates are not allowed to be propped open. 18. No smoking is allowed. 19. In accordance with country health regulations, incontinent persons are not permitted in the pool. SPAS 1. Children under 14 years of age must be accompanied by an adult when using the spa. 2. Observe all posted rules. Spa hours are from 8:00 am to 10:00 pm. 3. No food or glassware allowed in the spas. 4. In accordance with country health regulations, incontinent persons are not permitted in the spas. 5. No smoking is allowed. R&R 5
8 TENNIS COURTS 1. Courts are for the use of homeowners, tenants and their guests. Tennis keys are assigned to each unit and are not to be loaned out. There is a $25.00 charge for a new key through the property management company. 2. Only tennis or pickle ball are permitted within the tennis court enclosures. 3. Proper tennis attire is required at all times, including tennis shoes. No jogging shoes allowed. 4. Gates are to be kept locked at all times. 5. Observe all posted rules. a. There will be no advance reservations for tennis courts. b. Permission to play will be valid only for owners or renters who have an authorized court key. c. When other players are waiting, play will be limited to one hour. No one who has already played is permitted to return until anyone who is waiting has played. 6. Lights for night tennis are operated by the tennis key and will operate when the key is inserted in the time box on the courts. The lights will turn off when the key is removed. The lights are also controlled by a master control, which automatically turns off the lights at 10:00 pm. No playing or use of the courts is permitted after 10:00 pm. EXERCISE ROOM 1. Observe all posted rules. 2. All users of the Exercise Room are required to bring at towel to wipe down equipment after use. 3. Use all equipment at your own risk. Return all weights to the storage rack. CLUBHOUSE 1. The Clubhouse is for the non-commercial use of residents, their invited guests and authorized Association activities. Reservations shall not be made on behalf of non-members or non-residents. There is no charge for use of the Clubhouse. 2. No alterations or modifications to the clubhouse or property contained therein will be made. Temporary decorations, signs, etc., may be erected if they will not leave permanent marks. No furniture or equipment may be removed from the clubhouse. 3. Owners must obtain a rider on their homeowners insurance policy if alcohol will be consumed at the clubhouse. A copy of the policy must be provided to the property management company prior to use. R&R 6
9 4. The property management company is responsible for accepting reservations. Should the clubhouse be damaged during an event, the property management company will present a statement of damages to the applicant and the Board of Directors. The Board may take action at that time. The applicant is responsible for any cleaning and damages which may occur. Reservations will be accepted by the property management company subject to the following priorities: 1. Board of Directors meetings 2. Association special meetings 3. All other events on a first-come, first-serve basis. GENERAL APPEARANCE Homeowners are solely responsible for keeping balconies, patios and any areas that can be seen from the streets or common areas free from debris, litter or any unsightly collection of personal property. Specifically, the following applies: 1. Laundry, clothing, rags, towels, bedding, fencing and/or similar material shall not be hung or displayed upon the patio walls, balconies or any portion of any building. 2. Aluminum foil, paper or bed sheets are not permitted on windows or sliding glass doors. 3. Bicycles, toys and pool floats must be kept on enclosed patios only. 4. Flower pots or other items are not allowed on the top of patio walls. 5. All exposed electrical wiring and satellite dish cables must be painted the same color as the exterior walls. ARCHITECTURAL 1. Any change, addition or alteration to the exterior of any building or any other structure cannot be performed until approved by the Architectural Committee. The Association will ensure a continuity of design which will help to maintain the general appearance of Villas de las Flores and continue to enhance property values. 2. Any change and/or additions must also conform to applicable Palm Springs building codes, ordinances and regulations. The homeowner is responsible for obtaining all necessary approvals and building permits once approval from the Association has been received. Requests for approval may be delivered to any board member or the property management company and will include the following: 1. Scale drawing of proposed change. 2. Brief written description of proposed change(s) along with a list of materials to be used. 3. Proper building permits, if required by the City of Palm Springs. R&R 7
10 3. An Architectural Variance Request must be submitted to the Architectural Committee for approval before any change or addition is made. The Committee will act as expeditiously as possible on all requests. Residents making unauthorized changes could be liable for the costs of restoring said changes to the original condition. 4. Any approved change is to be maintained by the homeowner. If not maintained, the Board will have it maintained or removed at the homeowner s expense. SIGNS No commercial sign or billboard of any kind shall be displayed to the public view on any portion of the properties or any condominium EXCEPT ONE SIGN for each building site in the size and style conforming to the below stated specifications. Such signs shall be used for the purpose of advertising the condominium For Sale or For Rent. Any other sign is prohibited. 1. Maximum size shall be no more than two (2) square feet (1 ft. by 2ft.). 2. Total height of sign including the stake and sign may be no more than three (3) feet from the ground 3. Information may include: Property for sale or rent, name of the owner or agent, addresses and telephone numbers. 4. Only one (1) For Sale or For Rent sign may be posted on premises of property being sold or rented and the sign must be posted parallel to the street. 5. An Open House sign must be removed no later than sunset. 6. All For Sale signs must be removed within 3 days of close of escrow. RENTALS 1. Rentals are not allowed for less than fourteen (14) days with no more than two (2) persons allowed per bedroom. 2. Homeowners are responsible for the conduct of their renters, liable for payment and damages done by their renters as well as fines for rules violations by their renters. A copy of the Rules and Regulations must be provided to renters by the homeowner or rental agency. 3. The Association is responsible for notifying rental agents or homeowners when a problem occurs with a tenant. First notification of a problem will be a letter from the management company. If the problem is not rectified, the homeowner will be sent a Notice of Hearing to appear before the Board. ENCLOSED PATIOS 1. Trees and other plants must be neatly trimmed and maintained. They shall not grow into neighbors property, block the view or prove a danger to life, limb or property. Shrubs must be maintained at a maximum height of two (2) feet above patio walls. Trees must be maintained at a height not to exceed the roof line. Absentee homeowners shall make arrangements to have their plants maintained. R&R 8
11 2. Trees and shrubs are not permitted to touch property walls. 3. Homeowners are responsible for irrigation within the patio. Bubblers or drip irrigation are required to prevent damage to patio gates. 4. Plants located within the enclosed patio area are the responsibility of the homeowners, including removal and protection when repainting of the walls is necessary. 5. No new trees may be planted without approval from the landscape committee. 6.. Retractable awnings are allowed subject to Architectural Committee approval. Torn awnings are not allowed. 7. A maximum of two (2) patio umbrellas are allowed. They are to be maintained in excellent condition. Tents or canopies are not allowed. 8. Appliances (refrigerators, freezers, stoves) are not allowed. Architectural approval is required before a grill is hooked up to the gas line. 9. All items on patios (with the exception of a maximum of 2 small items hung on walls) must be below the height of the wall. 10. Interior walls shall remain the same color as previously determined by the Association. 11. Patios may not be used for storage of trash, boxes or household items. Any added storage enclosures require architectural approval. ADDITIONAL RULES FOR OPEN REAR PATIOS FACING THE GOLF COURSE 1. Permanent black iron fencing is allowed with architectural approval. No other fencing is allowed. 2. Golf ball protection netting is allowed with architectural approval. Netting and frames must be maintained in excellent condition. 3. A maximum of 2 small items may be hung on walls. FRONT PATIOS FACING THE GOLF COURSE 1. Retractable awnings are not allowed. 2. One patio umbrella is allowed. 3. No hanging items (i.e., planters, bird feeders or wind chimes) are allowed. 4. No wall ornaments allowed on front walls. 5. Two (2) planters / urns are allowed on the patio and are the responsibility of the homeowner. R&R 9
12 6. A table and four (4) chairs are allowed. Alternatively, two chaise lounges and a table are allowed. Furniture is the homeowner s responsibility and must be maintained in excellent condition. ALL OTHER FRONT PATIOS 1. Retractable awnings are not allowed. 2. One patio umbrella is allowed. 3. No hanging items (i.e., planters, bird feeders or wind chimes) are allowed. 4. No wall ornaments allowed on front walls. 5. Two (2) planters / urns are allowed on the patio and are the responsibility of the homeowner. 6. A table and four (4) chairs are allowed. Alternatively, two chaise lounges and a table are allowed. Furniture is the homeowner s responsibility and must be maintained in excellent condition. EXTERIORS 1. Roll up shades are allowed. Style and color choice must be submitted to the Architectural Committee for approval. 2. Homeowners may tile their exterior patios. No new carpeting or artificial turf is allowed. Tile choices must be submitted to the Architectural Committee for approval. The homeowner is responsible for the maintenance of the tile. 3. No knobs are to be placed on patio gates. 4. Front doors or patio gates cannot be altered by homeowners in any way. Violators will be billed the cost of a new door or new gate, plus hardware and labor. 5. No name identification of any kind shall be placed on the walls, doors or gates. 6. No resident shall post any advertisements or posters of any kind within the development. 7. Alteration of exteriors, whether for structural change, aesthetic change or utility (electrical), etc., must be submitted to the Architectural Committee for approval. Homeowners are responsible for any maintenance. Specifications for replacement sliders/windows and covering an air conditioning condenser line on the exterior wall and on the roof are available from the property management company. SECURITY DOORS 1. Only black security doors are allowed. To install a new security door, a request must be submitted to the Architectural Committee for approval. If an existing beige door needs to be repainted, it can be painted either beige or black. R&R 10
13 SCREEN DOORS 1.Only Invisible/ Retractable screen doors are allowed. To install a new screen door, a request must be submitted to the Architectural Committee for approval. SATELLITE DISHES 1.Satellite dishes are allowed. An architectural application is required. If a new dish is installed, any old dish(es) must be removed. EXTERIOR FRONT LIGHTING 1.Motion detector or dusk to dawn lights are allowed. All exterior lighting must be the same style and color as the original fixture R&R 11
