3 Need & Benefit The Federal Energy Regulatory Commission has ordered the City of Garland/ under section 210 of the Federal Power Act to interconnect with Southern Cross Transmission LLC s proposed transmission line. The City of Garland /, is one of only a few utilities in Texas that meets the requirements of the FERC s FPA interconnection order and that has the capability of owning and operating transmission and interconnecction facilities. The Rusk-Panola Transmission Project is being built as part of a plan to interconnect the Electric Reliability Council of Texas (ERCOT) and the southeastern United States via the Southern Cross Transmission Project. The City of Garland / sees this project as an opportunity to generate additional revenue for its rate payers and has partnered with Rusk Interconnection LLC. The Rusk-Panola Transmission Project will create an additional interconnection allowing electric power flow between ERCOT and facilities located outside of Texas. 6 Additional Permit Requirements The Rusk to Panola Transmission Project Team may need additional permits or approvals from various federal, state, and local agencies. These include, but are not limited to: U.S. Corps of Engineers Wetland Assessment (Section 404) U.S. Fish and Wildlife Service Threatened and Endangered Species Concurrence, Bald and Golden Eagle Protection Act, and Migratory Bird Treaty Act Federal Aviation Administration Structure Height Notification Texas Department of Transportation State Highway Utility Permit, State Highway Access Permit, Oversize/Overweight Permit Texas Parks & Wildlife Threatened & Endangered Species Concurrence Additional State & Local Permits Certificate of Convenience and Necessity - Public Utility Commission of Texas (PUCT) Stormwater Construction Permit NOI & SWPP for Construction Activities, Wetland Assessment - Texas Commission on Environmental Quality Cultural Resource Assessment - Texas Historical Commission (THC) State Land Use - Texas General Land Office (GLO) Utility Construction Notification - Panola County Floodplain Development Permit - Rusk County Railroad Crossing Permit - Specific Railroad Companies
7 Easement Process The RPTP Project Team notifies all landowners impacted by potential route options After the Public Utility Commission of Texas selects a final route, the RPTP Project Team notifies all impacted landowners to begin the easement acquisition process The RPTP Project Team meets with landowners to discuss: Project Overview Type of Structure Construction Process Land Restoration Proposed Easement Compensation Construction Access Damage Settlement What is an easement? 10 An easement is an interest or right to use the land of another for a specific purpose. 18 For this project, landowners will be asked to grant an easement for the right to use a defined strip of land for the electric transmission line s: 115 Construction Operation Maintenance Total
