1 Woodway, TX ARCHITECTURAL CONTROL COMMITTEE APPLICATION TO BEGIN CONSTRUCTION Before submitting plans, please consult your copy of the Lake Forest Residential Builder Guidelines, Declaration Of Protective Covenants For Lake Forest, By-Laws Of The Woodway Lake Forest Homeowners Association, and recorded plats/replats. Architectural Control The Woodway Lake Forest Architectural Construction Committee (ACC) and the Woodway Lake Forest Modification Committee (AMC) are committees of the Woodway Lake Forest Homeowners Association, and they are composed of selected representatives. All building plans, specifications or other required items must be submitted with applications to the ACC or AMC for approval before any construction begins. Applications must be signed and initialed (each page) by the Builder and. The items which are required to be submitted with applications are listed within the Lake Forest Residential Builder Guidelines. Unless otherwise approved by the ACC or AMC, no construction of any kind shall be commenced, nor shall any sign, other structure or other apparatus, either permanent or temporary, be erected, placed or maintained on any Lot, nor shall any remodeling or reconstruction thereof, exterior addition thereto, change therein, or alteration, excavation, subdivision or re-subdivision thereof, including without limitation, changes in or alterations of grade, roadways and walkways be made until all applicable specifications and/or guidelines contained within the Lake Forest Residential Builder Guidelines have been satisfied and written approval from the ACC or AMC has been received by the Builder and/or Property Owner. If the ACC or AMC fails to approve or disapprove such submitted plans, specifications or other required items within thirty (30) days after such plans, specifications or required items have been Initialed By, Builder Page 1 of 10

2 submitted to the ACC or AMC, approval of the ACC or AMC will be deemed to have been given, and all approval conditions will be deemed to have been satisfied. The ACC or AMC shall have the right, in its sole discretion, to disapprove any plans and specifications submitted to it. 5 The Lake Forest Architectural Control Committee members and/or the Lake Forest Architectural Modification Committee members hereby expressly disclaim any representation, liability, obligation, or duty in connection with the proposed construction described herein, including without limitation any warranty, either express or implies, of habitability, suitability, fitness for purpose, safety, compliance with applicable laws or restrictive covenants, or the effect of the proposed construction upon any surrounding property. By the execution and delivery of this application, the, Builder and/or Applicant expressly covenants and agrees to indemnify and hold all members of the Lake Forest Architectural Control Committee and/or the Lake Forest Architectural Modification Committee, including all officers, directors, committee members, employees, agents, successors and/or assigns, harmless from any cost, loss, claim liability, damage, expense, or other obligation arising out of, related to, or in any way connected with the construction proposed herein or the effects thereof, including without limitation any claim by any person or entity that such construction (1) fails to meet the requirements of any applicable law or restrictive covenants, (2) is unsafe or unsound, or creates a nuisance or other dangerous condition, or (3) adversely or improperly affects the drainage of water on, across, or under the property in question or any surrounding property. I understand the construction applied for within this application must be completed within a period of twelve (12) months from the date of approval of this application. I understand certification of square footage may be required. I certify that I have personally read the Lake Forest Residential Builder Guidelines, Declaration Of Protective Covenants For Lake Forest, By-Laws Of The Woodway Lake Forest Homeowners Association, reviewed all applicable recorded plat(s)/replat(s), and have reviewed any other pertinent documents regarding the property that this application applies to. To the best of my knowledge, the submitted plans, specifications or other required items conform to all required conditions. In the event I failed to comply with any required condition(s), I will take necessary measures to correct any nonconforming issues within thirty (30) days. 6 I UNDERSTAND THAT: The Architectural Control Committee (ACC) or the Architectural Modification Committee (AMC) will approve or disapprove the application within thirty (30) days of receipt of a complete application and all documentation. If the application is disapproved, the reasons for disapproval shall be given to the Applicant so corrective measures can be taken and new application submitted. The ACC or AMC can only approve improvements that are in compliance with the applicable codes and the existing builder guidelines, covenants and restrictions. An approval granted on improvements not meeting the requirements of the applicable codes and the existing builder guidelines, covenants and restrictions will not act as a general waiver of the codes or the builder guidelines, covenants and restrictions.
