The resolution permits the establishment of a 260-square foot outdoor seating area with 18 seats, located in an existing patio area in front of Chipotle entirely on private property within the Claremont Promenade shopping center. The Conditional Use Permit approval is based on the findings set forth in Section of the CMC, and subject to the conditions listed in the draft resolution; seconded by Commissioner Curtis, and carried on the following vote: AYES: NOES: ABSENT: Commissioners Curtis, Emerson, Jackson, Lyon, and Rosenbluth None Commissioners Jones and Reed This item can be appealed within ten calendar days. APPLICANT - TERRI DICKERHOFF FOR ORANGETHEORY FITNESS SUMMARY Orangetheory Fitness has submitted an application for approval of a Conditional Use Permit (CUP) for an indoor fitness studio at 2213 East Base Line Road, in the Sycamore Hills Specific Plan Area 14 and Commercial Use area. Orangetheory Fitness offers high energy small group fitness classes, located in the recently constructed retail center located along Base Line Road at Monte Vista Avenue. The tenant space is a newly-constructed space within the center. Staff finds that the proposed indoor fitness studio is consistent with the Claremont Municipal Code (CMC), the General Plan, and the Sycamore Hills Specific Plan designation. RECOMMENDATION Staff recommends that the Planning Commission adopt the resolution (Attachment A) approving CUP #17-C07 for an indoor fitness studio located at 2213 East Base Line Road, subject to the findings set forth in Section of the CMC, and conditions listed in the draft resolution. ALTERNATIVES TO RECOMMENDATION In addition to the recommendation, there are the following alternatives: 1. Continue the item for additional information. 2. Express an intent to deny CUP #17-C07 in its entirety, specifically identifying the findings of Section that cannot be met, and continue the item to February 20, 2018, for adoption of a denial resolution. 10 FINANCIAL REVIEW Costs associated with the review of this project have been borne by the applicant. ANALYSIS The project site is located within the Sycamore Hills Specific Plan Area 14 and Commercial Use area according to the General Plan land use map. Section of the CMC states, Indoor fitness studios require the approval of a CUP for commercial zones. The approximately 2.4-acre parcel of land on which the project site is located is situated in Development Area B within the new planned community development, Sycamore Hills Plaza. The project site is located along the eastern boundaries of the City of Claremont and Los Angeles County, just north of Base Line Road. Adjacent land uses to the subject site include, the I-210 freeway to the northwest, San Bernardino County and the City of Upland along with Development Area A of the Specific Plan to the east, and the continuing mining operations and water basin facilities to the south, across Base Line Road. The subject site was previously undeveloped land zoned commercial until the property and adjacent properties within the City of Upland were rezoned under the Sycamore Hills Specific Plan, previously name Park View Specific Plan, to stimulate new development in the surrounding area. Sycamore Hills Specific Plan encourages a mix of residential uses which are within walking distance (one quarter mile) to open spaces and a commercial plaza connected by roads, trails, walkways, and parkways. The close proximity of residential and commercial uses is intentional, offering a California outdoor lifestyle centered on parks and trails. The tenant space currently occupies approximately 3,000 square feet of gross floor area in Pad two, located at the southeast corner of the subject site. Parking for this use is provided on-site, as 158 of the available parking spaces in the commercial development are allocated to the City of Claremont. Orangetheory Fitness is an established chain of circuit training studios located throughout the Los Angeles area. Patrons of Orangetheory Fitness engage in high intensity training broken into intervals of cardiovascular and strength training, using a variety of equipment including treadmills, rowing machines, light weights, medicine balls, and suspension cables. Project Description The proposed project consists of a 3,000 square foot tenant space located in the newly- developed Sycamore Hills Plaza on Pad area number two. The tenant space includes an approximately 1,820 square foot fitness studio furnished with twelve sets of treadmills, row machines, and weight lifting stations, along with an office, reception desk, two unisex bathrooms, one single-occupancy shower room, and a storage room, separated by a hall way. The main entrance is located on the north end of the tenant space with a secondary exit located on the south side. Business Operations Orangetheory Fitness offers one-hour high intensity training classes, separated by 15- minute intervals. Each class will serve a maximum of 24 students with an expected class size from students. Classes will be offered throughout the day between the hours of 5 am to 9:30 pm, seven CLAREMONT Page 2 of 3 Printed on 2/1/2018 powered by Legistar

11 days a week. Equipment for the classes includes the following: Rows of exercise machines and lightweight lifting stations are located in a single fitness studio which serves one class at a time. Exercise equipment utilized as part of the routine includes treadmills, row machines, bosu ball, medicine balls, and workout mats. Rooms including the reception area, an office, storage room, bathrooms, and shower are all located on the west side of the tenant space, serving as a buffer between the studio speakers and the adjacent tenant space. The parking demand for Orangetheory Fitness is not expected to adversely impact parking located on-site. The proposed use is considered general commercial, thus parking is calculated at one parking space per 250 square feet of tenant space. Orangetheory Fitness requires twelve of the 158 available parking spaces allocated to the City of Claremont within the shopping center. BASIS FOR RECOMMENDATION The approval of a CUP, for use as an indoor fitness studio, requires that the Planning Commission make findings provided in Section , and identified in the draft resolution (Attachment A). CEQA REVIEW The proposed use (indoor fitness studio) within the existing commercial building footprint, is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301(a) Class 1 for existing facilities, in that it involves the leasing of a tenant space within an existing private structure involving negligible or no expansion of use beyond that which currently exists. Therefore, no further environmental review is necessary. PUBLIC NOTICE PROCESS This item has been noticed through the regular agenda notification process. On Thursday, January 25, 2018, the property was posted and written notices were mailed to property owners within 300 feet of the boundaries of the site. 12 RESOLUTION NO A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CLAREMONT APPROVING CONDITIONAL USE PERMIT #17-C07, TO ALLOW FOR AN INDOOR FITNESS STUDIO LOCATED AT 2213 EAST BASE LINE ROAD. APPLICANT TERRI DICKERHOFF WHEREAS, on November 30, 2017, the applicant submitted an application for a Conditional Use Permit (CUP) (File #17-C07), for the establishment of an indoor fitness and personal training studio located at 2213 East Base Line Road; and WHEREAS, the property is located within the Sycamore Hills Specific Plan 14 Area, where indoor fitness studios are allowed only with the approval of a CUP, and such zoning is consistent with the General Plan designation of Commercial Use; and WHEREAS, notice of a public hearing was duly given and the above-mentioned site was posted on January 5, 2018; and WHEREAS, the Planning Commission held a public hearing on February 6, 2018, at which time all persons wishing to testify in connection with said proposal were heard and said proposal was fully studied. NOW, THEREFORE, THE PLANNING COMMISSION DOES HEREBY RESOLVE: Section A. The Planning Commission has determined the indoor fitness studio use is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(a) Class 1 for existing facilities, in that it involves the leasing of a tenant space within an existing private structure involving negligible or no expansion of use beyond that which currently exists. Therefore, no further environmental review is necessary. Section B. The Planning Commission makes the following findings in regards to the CUP for the above-described project: 1. The approximately 3,000 square-foot tenant space is adequate in size and shape to accommodate the use of an indoor fitness studio. Operations at Orangetheory Fitness will not have an adverse impact on the overall development of Sycamore Hills Plaza. The use will be located in a newly developed retail commercial center with no additional square footage added to the building footprint. Parking for the commercial center in which the business is located is provided on-site and in accordance with the parking requirements of the CMC. Of the 158 available parking spaces found on-site, twelve will be allocated to this new use. 2. The site for which the indoor fitness studio use has been proposed relates to streets and highways properly in that the access is provided through the main entrance located on the City of Upland s side of the development. Orangetheory Fitness is not anticipated to generate additional traffic that will not relate properly to the streets serving the site, as the project site is located adjacent to the I-210 freeway and on

13 Resolution No Page 2 the north side of Base Line Road, which is designated as an Arterial Street in the Mobility Element of the General Plan. 3. The addition of Orangetheory Fitness will not impair the integrity and character of the Sycamore Hills Specific Plan 14 Area in which it is located or otherwise adversely affect adjacent properties or the permitted use thereof. The indoor fitness studio will serve as a complementary use within the planned community development, which is intended for a mixture of residential and commercial uses within walking distance, to promote healthy living. Sycamore Hills Plaza is in the midst of establishing a variety of retail shopping, services, and dining options, of which Orangetheory Fitness is one. 4. The proposed indoor fitness studio use is not contrary to the General Plan, as the policies of the General Plan encourage economic and social activity in commercial areas along the City s prominent commercial corridors. 5. The use will not endanger or otherwise constitute a menace to the public health, safety, or general welfare as it is intended to increase the health and wellbeing of Claremont residents as well as nearby Upland residents. Orangetheory Fitness will provide an outlet for surrounding residents to engage in physical fitness in a controlled setting with personal trainers. The addition of Orangetheory Fitness will assist in establishing business active within a new shopping center. Section C. The Planning Commission hereby approves CUP #17-C07, based on the findings of Section of the CMC outlined in Section B above, and subject to the following conditions: 1. This approval permits an indoor fitness and personal training studio at 2213 East Base Line Road, which offers high intensity circuit training classes. The location, size, orientation, and internal circulation of the area to be used for indoor fitness shall generally comply with the approved floor plan on file with the Planning Division and as further described in the staff report. 2. This approval shall be valid for two years from the date of the Planning Commission action. If a business permit is not secured or renewed within that time frame, or an extension is not granted, then this approval shall automatically expire without further action by the City. 3. If the use for which this CUP was granted (indoor fitness studio) is discontinued for a period of 12 months or more, such use shall not be re-established, and the matter shall be referred to the Planning Commission to initiate the proceedings for the revocation of this CUP. 4. The approved hours of operation for Orangetheory Fitness are between 5 am 9:30 pm, seven days a week. Business operations are restricted to inside the tenant space with any proposed outdoor activities requiring approval from the Planning Division.

14 Resolution No Page 3 5. Noise sources associated with music and indoor speakers shall not exceed the noise levels as set forth in Section of the CMC. 6. All activities associated with the indoor fitness studio shall be confined to the interior space. No activities shall be conducted outdoors on the property. 7. Any signage proposed for Orangetheory Fitness shall fully comply with the City standards regarding signs further identified in Title 18 of the CMC. 8. Noncompliance with any Condition of Approval shall constitute a violation of the CMC. Violations may be enforced in accordance with the provisions of Title 16 and/or the administrative fines program of Title 1 of the CMC. 9. The applicant/owner, by utilizing the benefits of this approval, shall thereby agree to defend, at its sole expense, any action against the City, its agents, officers, and employees because of the issues of such approval. In addition, the applicant/owner shall reimburse the City et al for any court costs and attorney fees which the City et al may be required to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action, but such participation shall not relieve the applicant/owner of its obligation hereunder. 10. Failure to comply with any of the conditions set forth above, or as subsequently amended in writing by the City, may result in failure to obtain a building final and/or a Certificate of Occupancy until full compliance is reached. The City s requirement for full compliance may require minor corrections and/or complete demolition of a non-compliant improvement regardless of costs incurred where the project does not comply with design requirements and approvals that the applicant agreed to when permits were pulled to construct the project. Section D. The Planning Commission Chair shall sign this Resolution and the Commission s Administrative Secretary shall attest to the adoption thereof. APPLICANTS - PATRICK AND COREY ENMAN FOR FIT BODY BOOT CAMP SUMMARY Fit Body Boot Camp submitted an application for approval of a Conditional Use Permit (CUP) for an indoor fitness studio at 855 West Foothill Boulevard, in the Mixed-Use 3 (MU3) zoning district. Fit Body Boot Camp offers high energy small group fitness classes, located in the existing Sprouts shopping center. The tenant space was previously occupied by Bags and Bobbins, a small retail store. Staff finds that the proposed indoor fitness studio is consistent with the Claremont Municipal Code (CMC), the General Plan, and the MU3 zoning designation. RECOMMENDATION Staff recommends that the Planning Commission adopt the resolution (Attachment A) approving CUP #18-C01 for an indoor fitness studio located at 855 West Foothill Boulevard, subject to the findings set forth in Section of the CMC, and conditions listed in the draft resolution. ALTERNATIVES TO RECOMMENDATION In addition to the recommendation, there are the following alternatives: 1. Continue the item for additional information. 2. Express an intent to deny CUP #18-C01 in its entirety, specifically identifying the findings of Section that cannot be met, and continue the item to February 20, 2018, for adoption of a denial resolution. 24 FINANCIAL REVIEW Costs associated with the review of this project have been borne by the applicant. ANALYSIS The project site is located within the MU3 zoning district, and the Mixed-Use area, according to the General Plan land use map. Section of the CMC states, indoor fitness studios require the approval of a CUP for MU3 zones. The project site, one of several properties located in the Sprouts shopping center, is in an area with a mix of uses including the Sprouts grocery store, Chase Bank, several personal wellness and health services, and small retail stores. Adjacent land uses to the subject site include single-family residences to the north, Sprouts shopping center to the east, several retail stores and personal services to the west, and Mountain View Elementary School to the south, across Foothill Boulevard. The tenant space currently occupies approximately 3,000 square feet of gross floor area, and is centrally located on the north side of the row of shops. The existing tenant space will remain relatively unchanged with minor interior improvements such as new flooring for the entry area, and two-inch thick gymnastic mat flooring in the workout area. Parking for this business is categorized as general use, otherwise, calculated at one space per 250 square feet of gross floor area. The business will require 13 of the 229 parking spaces provided through a shared parking agreement between 805, 821, 835 West Foothill Boulevard, approved in November of Project Description Section of the CMC requires CUPs for new indoor fitness studios located in the MU3 zoning district. As Fit Body Boot Camp is considered a new indoor fitness studio with exercise equipment and class training sessions, it must be reviewed and approved by the Planning Commission. Fit Body Boot Camp is located in an existing tenant space where no additional square footage is proposed, while minor alterations to the interior include new two-inch thick gymnastics flooring in the workout area, wood flooring near the front and rear entry, new tile in the single unisex bathroom, sound proof walls, and a drinking fountain in the changing room. Business Operations Fit Body Boot Camp provides small group personal training, serving anywhere from two to fifteen people at a time, throughout the week. The target market is year old adult men and women who have moderate to little fitness experience and work mid-day during the week. To accommodate clients busy schedules, 30 minute sessions operate Monday through Friday mornings, from 5:30 am to 7:30 am, and evenings from 5:30 pm to 7:30 pm, Saturdays from 7:30 am to 8:45 am. Fit Body Boot Camp will serve patrons primarily in the mornings and evenings when other business are closed, further reducing its impact on required parking while generating business activity at a wider range of hours during the week. Group training sessions are led by an experienced and nationally certified personal trainer. Instructors demonstrate the exercise prior to leading them through the workout, while guiding clients and modifying exercises to match the clients ability to complete it. Workouts generally utilize a person s body weight and small equipment exercises. Once the workout is complete, instructors lead clients through a cool down period with stretch exercises until the next training session begins. 25 The tenant space includes an open concept workout space which utilizes a variety of weights and exercise equipment for high intensity workouts. Several pull up bar stations are to be attached to the western wall near the front; with exercise rope positioned further back in the rear. Dumb bells, kettle bells, and medicine balls are stationed along the eastern wall. The entire workout space is covered with a two-inch thick sound deafening Dollamur Gymnastics flooring to reduce potential noise created from using the exercise equipment. To accommodate clients need to change outfits, a changing room located near the rear provides privacy with a curtain, along with fresh water from a new filtered water dispenser. The parking demand for Fit Body Boot Camp is not expected to adversely impact parking located on and off site. Fit Body Boot Camp requires 13 of the 229 parking spaces provided through a shared parking agreement, which has a surplus of eight spaces based on a previous shared parking agreement approval (Attachment D). Staff conducted parking counts on several days to justify the addition of a use which will generate a higher demand at regular intervals during the day. Staff concluded that parking can be sufficiently met as an average of 48 percent of the available parking spaces were occupied, while the highest number of occupied parking spaces observed was 58 percent of the total parking available. BASIS FOR RECOMMENDATION The approval of a CUP, for use as an indoor fitness studio, requires that the Planning Commission make findings provided in Section , and identified in the draft resolution (Attachment A). CEQA REVIEW The proposed use (indoor fitness and personal training studio) within the existing commercial building footprint, is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301(a) Class 1 for existing facilities, in that the project involves the leasing of a tenant space within an existing private structure that involves negligible or no expansion of use beyond that which currently exists. Therefore, no further environmental review is necessary. PUBLIC NOTICE PROCESS This item has been noticed through the regular agenda notification process. Copies are available at the City Hall public counter, the Claremont Public Library, Alexander Hughes Community Center, the Youth Activity Center, and the City s website. On Thursday, January 25, 2018, the property was posted and written notices were mailed to property owners within 300 feet of the boundaries of the site. 27 RESOLUTION NO A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CLAREMONT APPROVING CONDITIONAL USE PERMIT #18-C01, TO ALLOW FOR AN INDOOR FITNESS STUDIO LOCATED AT 855 WEST FOOTHILL BOULEVARD BY APPLICANTS PATRICK AND COREY ENMAN WHEREAS, on January 8, 2018, the applicant submitted an application for a Conditional Use Permit (CUP) (File #18-C01), for the establishment of an indoor fitness studio located at 855 West Foothill Boulevard; and WHEREAS, the property is located within the Mixed-Use 3 zone district, where indoor fitness studios are allowed only with the approval of a CUP, and such zoning is consistent with the General Plan designation of Commercial Use; and WHEREAS, notice of a public hearing was duly given and the above-mentioned site was posted on January 25, 2018; and WHEREAS, the Planning Commission held a public hearing on February 6, 2018, at which time all persons wishing to testify in connection with said proposal were heard and said proposal was fully studied. NOW, THEREFORE, THE PLANNING COMMISSION DOES HEREBY RESOLVE: Section A. The Planning Commission has determined the indoor fitness studio use is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(a) Class 1 for existing facilities, in that it involves the leasing of approximately 3,100 square foot of tenant space within an existing private structure involving negligible or no expansion of use beyond that which currently exists. Therefore, no further environmental review is necessary. Section B. The Planning Commission makes the following findings in regards to the CUP for the above-described project: 1. The approximately 3,100 square-foot tenant space is adequate in size and shape to accommodate the use of an indoor fitness studio business. Fit Body Boot Camp serves anywhere from six to fifteen people at a time, reducing the demand for parking. The use will be located in an existing retail commercial center with no additional square footage added to the existing building footprint. Parking for the commercial center in which the business is located is provided on and off-site through a previously approved shared parking agreement (File # 07-A31). Of the 229 available parking spaces, thirteen will be allocated to Fit Body Boot Camp. Staff justified these approved parking by conducting parking counts. Staff concluded an average of 48 percent of parking space in the shopping center were occupied during the week, thus the demand for parking is lower than what is requires. 2. The site for which the indoor fitness studio use has been proposed relates to streets and highways properly in that the adjacent streets, namely Foothill Boulevard, will continue to be able to accommodate the amount of traffic generated by the

Because the project site has access to both Mountain and Regis Avenue, Fit Body Boot Camp s impact on traffic along Foothill Boulevard is expected to be negligible. 3. The addition of Fit Body Boot Camp will not impair the integrity and character of the MU3 zoning district in which it is located or otherwise adversely affect adjacent properties or the permitted use thereof. The indoor fitness and personal training business will serve as an appropriate use within the MU3 zoning district, a zoning district that is intended for a mixture of uses which includes retail and personal services businesses. The Sprouts shopping center contains a variety of retail sales and personal services including the Sprouts grocery store, Chase bank, a hair salon, nail salon, homeopathic wellness, and retail food establishments. The addition of a fitness studio is appropriate for this site as several health and wellness services are adjacent to the tenant space. 4. The proposed indoor fitness studio is not contrary to the General Plan, as the policies of the General Plan encourage economic and social activity in commercial areas along the City s prominent commercial corridors. The use is consistent with the Mixed-Use designation by the General Plan as it increases the diversity of uses along the West Foothill Boulevard corridor. The use is also consistent with Goal 2-3 of the General Plan Land Use Element, which encourages the accommodation of a range of land uses that meets the economic needs of the City. The addition of this use enhances the variety of fitness studios located in the City, providing a wider range of services. Furthermore, it is consistent with Goal 2-6 of the Land Use Element by strengthening West Foothill Boulevard as an activity node with a mixture of complementary commercial uses located together. The use will complement adjacent businesses, promoting customers to stop at multiple locations within the same shopping center. 5. The use will not endanger or otherwise constitute a menace to the public health, safety, or general welfare as it is intended to increase the health and wellbeing of Claremont residents. Fit Body Boot Camp will provide an outlet for residents to engage in physical fitness in a controlled environment with a certified fitness instructor. The addition of Fit Body Boot Camp will provide greater activity during the morning and evening in the Sprouts shopping center as it will be open when other businesses are generally closed. Section C. The Planning Commission hereby approves CUP #18-C01, based on the findings of Section of the CMC outlined in Section B above, and subject to the following conditions: 1. This approval permits an indoor fitness studio at 855 West Foothill Boulevard, which offers small group instructional training. The location, size, orientation, and internal circulation of the tenant space to be used for indoor fitness shall generally comply with the approved floor plan on file with the Planning Division and as further described in the staff report.

29 Resolution No Page 3 2. This approval shall be valid for two years from the date of the Planning Commission action. If a business permit is not secured or renewed within that time frame, or an extension is not granted, then this approval shall automatically expire without further action by the City. 3. If the use for which this CUP was granted (indoor fitness studio) is discontinued for a period of 12 months or more, such use shall not be re-established, and the matter shall be referred to the Planning Commission to initiate the proceedings for the revocation of this CUP. 4. The approved hours of operation for Fit Body Boot Camp are between 5:30 a.m. 7:30 p.m., seven days a week. Business operations are restricted to inside the tenant space with any proposed outdoor activities requiring approval from the Planning Division. 5. Noise sources associated with music and indoor speakers shall not exceed the noise levels as set forth in Section of the CMC. 6. Any signage proposed for Fit Body Boot Camp shall fully comply with the City standards regarding signs further identified in Title 18 of the CMC. 7. Noncompliance with any Condition of Approval shall constitute a violation of the CMC. Violations may be enforced in accordance with the provisions of Title 16 and/or the administrative fines program of Title 1 of the CMC. 8. The applicant/owner, by utilizing the benefits of this approval, shall thereby agree to defend, at its sole expense, any action against the City, its agents, officers, and employees because of the issues of such approval. In addition, the applicant/owner shall reimburse the City et al for any court costs and attorney fees which the City et al may be required to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action, but such participation shall not relieve the applicant/owner of its obligation hereunder. 9. Failure to comply with any of the conditions set forth above, or as subsequently amended in writing by the City, may result in failure to obtain a building final and/or a Certificate of Occupancy until full compliance is reached. The City s requirement for full compliance may require minor corrections and/or complete demolition of a non-compliant improvement regardless of costs incurred where the project does not comply with design requirements and approvals that the applicant agreed to when permits were pulled to construct the project. Section D. The Planning Commission Chair shall sign this Resolution and the Commission s Administrative Secretary shall attest to the adoption thereof.
