FOR SEALED/REGISTERED TENDER: 1) Tenderer must file his tender quotation in a sealed envelope super scribing Tenderer s name, the code no. & name of the property. Envelope without proper seal will not be accepted. 2) All the tenderers/bidders should, prior to filing the tender/quotation and participating in the auctions, satisfy themselves about the correctness of the descriptions, measurements, boundaries, etc., of the properties. No enquiries or objections in this regard will be entertained at the time of auction or anytime thereafter. Once a property is declared successful to the highest bidder through any of the auction process i.e. Sealed Tender, Public Auction and E-Auction, it shall be deemed that he has waived all objections to the title, description, etc. of the property. 3) Submission of public tender will be in two bid system: All bidders are required to submit their offers through registered post in two covers, as technical and commercial bids, in the Office of the Competent Authority & Administrator, SAFEM(FOP) Act, 1976 & NDPS Act, 1985, 20 B, ABDUL HAMID ST. 4 GENERAL TERMS & CONDITIONS 1) The lease hold immovable properties are being sold on AS IS WHERE IS and AS IS WHAT IS BASIS simultaneously through the Sealed Tender, Public Auction & E-Auction. 2) The properties can be physically inspected by the intending buyers as per the schedule - 3 above. 3) The documents relating to the properties can be inspected during office hours from and between 11:00 AM to 03:00 PM in the Office of the COMPETENT AUTHORITY AND ADMINISTRATOR, SAFEM(FOP) ACT, 1976 & NDPS ACT, 1985, 20 B, ABDUL HAMID ST. EAST INDIA HOUSE, 4 TH FLOOR, KOLKATA (Contact person Shri Kalyan Mukhopadhyay, Inspecting Officer, Phone: / ). 4) Earnest Money Deposit 25% of the Reserve Price of each property is to be paid by Demand Draft/Pay Order, payable at Kolkata and drawn in favour of ZAO, CBDT Kolkata, which shall be attached with the quotations/tender form/participation form and submitted in the office of COMPETENT AUTHORITY AND ADMINISTRATOR, SAFEM(FOP) ACT, 1976 & NDPS ACT, 1985, 20 B, ABDUL HAMID St. EAST INDIA HOUSE, 4 th FLOOR, KOLKATA on or before up to 04:00 PM. It is further clarified that any bidder who has submitted Earnest Money Deposit (EMD) at the rate of 25% of the reserve price for any property shall be eligible to participate in all the three processes of auction for that particular property. 5) During inter se Bidding of public auction and e-auction, the Bidders can improve their Bid Amount as per the Bid Incremental value (mentioned in Schedule 1 above) or its multiple and in case bid is placed during the last 5 minutes of the closing time, the closing time will automatically get extended for 5 minutes (each time till the closure of auction process). Otherwise, it will automatically get closed. The bidder who submits the highest bid amount (not below the Reserve Price) on the closure of the auction process shall be declared as a Successful Bidder for respective auction process by the Authorised Officer, after required verification. 6) The highest successful bidder for the respective property will be decided from the simultaneous result of all the three auction processes. 7) The Earnest Money Deposit (EMD) of the successful bidder shall be retained towards part sale consideration and the EMD of unsuccessful bidders shall be refunded. The Earnest Money Deposit shall not bear any interest. 8) The successful bidder shall have to deposit 25% of the sale price, adjusting the EMD already paid, within 7 days of the acceptance of bid price by the Authorised Officer and the balance 75% of the sale price on or before 30 th day of sale or within such extended period as agreed upon in writing by and solely at the discretion of the Authorised Officer. In case of default in payment by the successful bidder, the amount already deposited by the offer shall be forfeited and property shall be put for reauction and the defaulting borrower shall have no claim/ right in respect of property/amount. 9) The purchaser shall bear the applicable stamp duties/ additional stamp duty/ transfer charges, fee etc. and also all the statutory/non-statutory dues, taxes, rates, assessment charges, fees etc. owing to anybody. 10) Bidding in the last moment should be avoided in the bidders own interest as neither this office nor the auctioneer will be responsible for any lapse/failure (Internet failure/power failure etc.). In order to ward-off such contingent situations, bidders are requested to make all necessary arrangements / alternatives such as power supply back-up etc, so that they are able to circumvent such situation and are able to participate in the auction successfully.

5 11) Scanned copy of ANNEXURE-II & III (which can be downloaded from the Web Portal: are required to be uploaded on the website after being duly filled in and signed. 12) It shall be the responsibility of each prospective Tenderer/Bidder to ascertain any dues viz. Municipal taxes, Government dues, Society charges, Transfer Fees to Landlord, etc., on the properties and it will be the responsibility of the successful Tenderer / Bidder to pay the pending dues, which may come to light or knowledge at any time. VAT and Stamp Duty, wherever applicable, are required to be paid by the purchaser. 13) Any person who is competent to contract, except a minor or lunatic person, may participate in tender and/or bid in the auction. 14) All Tenderers/Bidders are required to declare beforehand whether they are participating on their own or on behalf of their principals. When a Tenderer / Bidder acting as an agent has to submit an authority from his principal for participating in the Sealed Tender, Public Auction and E-Auction, which is subject to verification. 15) No one can participate in any of the auction process without payment of proper deposits. 16) Caution Money Deposit (CMD): A sum of Rs. 2 lakhs on account of Caution Money Deposit (refundable) is required to be deposited by the bidders at the venue for participating in the public auction (apart from the EMD) with the auctioneers by way of Demand Draft/Pay Order payable at Kolkata and drawn in favour of ZAO, CBDT, Kolkata. The CMD is liable to be forfeited if the participant causes or attempts to cause disturbances or hurdles or disruptions in the conduct of the public auction. a. The intending participant will be allowed to take one extra person to the auction hall, with the condition that the intending bidder will be responsible for his/her proper conduct, decorum and observance of rules of auction sale. b. The CMD will be refunded to unsuccessful bidders on conclusion of Public Auction or adjusted with the net sale value in case of successful bidder. 17) The Sealed Tenders of respective properties will be opened in the office of COMPETENT AUTHORITY & ADMINISTRATOR, SAFEM(FOP) ACT, 1976 & NDPS ACT, 1985, 20 B, ABDUL HAMID St. EAST INDIA HOUSE, 4 th FLOOR, KOLKATA on at 01:30 P.M. The bidders who want to witness the opening of sealed tenders may attend the proceedings accordingly. If bidders are not able to present themselves for the same, they can send their authorized person along with authorized letter of participation. 18) In the rare event, if the bids from all the three methods of disposal, namely; Sealed Tender, Public Auction and E-Auction, being identical and by different bidders, the successful bidder will be decided by drawing of lot in presence of competing bidders, if available, on the date of opening of sealed tender or at any date and time thereafter, which will be communicated to the concerned bidders. 19) Failure on the part of the successful Tenderer/Bidder to pay the balance bid amount within 30 days from the date of auction shall result in forfeiture of the amounts (including EMD) already paid. No request for extension of time shall be entertained on any ground and this office will be at liberty to re-auction the said property. 20) The COMPETENT AUTHORITY & ADMINISTRATOR, NDPSA & SAFEMA, KOLKATA reserves the right to award, cancel or postpone the Tender/Public Auction/e-Auction or to withdraw any property from the Tender/Public Auction/e-Auction at any time without assigning any reason. He also reserves the right to reject any bid, including the highest bid, without assigning any reason. In such an event, the

6 money already paid will be refunded to the intending purchaser without any interest, unless the same is forfeited as above. 21) The Hon ble High Court of Kolkata and respective High Courts of states where public auction is taking place shall only have exclusive jurisdiction to adjudicate upon any matter arising under or relating to the Tender-cum-Auction Sale. 22) The properties shall be deemed to have been sold in the same state of conditions as they stood at the time of Tender/Auction Sale. From the date of his taking possession or signing the lease/transfer deed, whichever is earlier, the properties so sold will be at the risk of purchaser. Therefore, they should take proper precaution to receive the property. 23) The intending purchaser shall abide by the order/rules of the Central Government/State Government/Local Authorities as may be applicable to the property. 24) The successful bidder should mention in the bid sheet, the correct name(s) of purchaser/purchasers in whose name/names, the property is intended to be transferred. No subsequent change or alteration of the name(s) will be allowed. 25) The purchaser shall also abide by any other conditions, which may be announced by authorized Officer on behalf of the Competent Authority & Administrator, SAFEMA/NDPSA, K o l k a t a, at the time of auction process. 26) All Tenderers / Bidders shall be deemed to have acquainted themselves with the conditions of the auction process and given their Tender / Bids subject to these conditions.
