2 Background and Summary of Proposal The existing three-unit building is designated on the Indian Lakes Land Use Plan as Day Care. A church wishes to operate on the property; therefore, a modification to the land use plan is required, along with a Conditional Use Permit for a Religious Use. The church proposes to eventually occupy the entire building with a 100-seat sanctuary, with rooms for a children s ministry and a daycare operation. The church plans on providing extensive community outreach programs, such as a food pantry and mental health services. Typically, church services will be held on Wednesday evenings, 6:00 p.m. to 9:00 p.m., and on Sundays, between 10:30 a.m. and noon. The general planning principles for Suburban Area focus on preserving and protecting the overall character, economic value, and aesthetic quality of stable neighborhoods. Three key planning principles have been established in the Comprehensive Plan to promote this stability: preserve neighborhood quality, create and protect open spaces, and connect suburban mobility. To preserve neighborhood quality, the Plan promotes compatible land use, safe streets, careful mix of land uses, neighborhood commercial use, compatible infill development and conditions on places of special care and home occupations. Achieving these goals requires that all land activities either maintain or enhance the existing neighborhood through compatibility with surroundings, quality and attractiveness of site and buildings, improved mobility, environmental responsibility, livability, and effective buffering with respect to type, size, intensity and relationship to the surrounding uses. 3 Natural and Cultural Resources Impacts The property is located within the Southern Rivers Watershed. There is a canal adjacent to the property to the north known as the Chesapeake Canal, which ultimately drains to Stumpy Lake. As the site is almost entirely impervious, there do not appear to be any significant natural or cultural features on the property. The MTP proposes a divided facility within a 110-foot right-of-way. No CIP projects are slated for this area. Public Utility Impacts Water & Sewer This site is currently connected to both City water and sanitary sewer service. Evaluation and Recommendation This request to modify the Indian Lakes Land Use Plan to allow for the use of the property for a church is acceptable and recommended for approval, subject to the proffer agreement and the conditions listed below. This request is consistent with the Comprehensive Plan for the Suburban Area and will be a good reuse of this partially vacant building. Proposed Proffer 1. The Land Use Plan for Indian Lakes Planned Unit Development shall be amended to also allow religious uses on the Property. Such religious uses shall include a church, sanctuary, and classrooms. Accessory uses to the religious use shall include preaching and classroom teaching, a food pantry, counseling, children s ministry and outreach, daycare, and general outreach to the Hispanic community. 4 Recommended Conditions 1. A Certificate of Occupancy shall be obtained by the Building Official s Office prior to occupancy of the building by the church. 2. The number of occupants shall be established by the Building Official s Office. Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site.
