2 The Ugliest Word in Housing is Not Eviction it is Most landlords go running and screaming when they hear the word eviction. As soon as they hear the word they immediately begin thinking of attorneys, angry tenants, court rooms, and their bank account being drained of all of their money. Eviction is a taboo word among many landlords. They image of putting someone on the street is too harsh to deal with. Many landlords would rather have someone pay their rent late, make a partial payment, or not pay at all then even think of the word eviction. Eviction isn t the scariest word that a landlord can face. A scarier word is foreclosure. A landlord can lose their asset when they fail to pay their mortgage. Many well meaning landlords fail to think that this could happen. When you don t pay a mortgage the bank will not hesitate to take your property. When you are a good landlord, as I know you are or you wouldn t be reading this, you have a right to be paid for providing quality housing. I used the word quality intentionally. Landlords who allow roofs to leak on their tenants, fail to respond to request for repairs in a reasonable time, or are disrespectful to their tenants deserve the full force of the legal system against them. You deserve to be treated with the same respect that you show your tenants and property. This guide will help you avoid the problems that arise from being a nice guy. You can still be nice just nice within the law to protect yourself. Lie #1 Being Patient with Their Tenants is a The Right Thing to Do Most landlords aren t heartless souls who are looking to take advantage of the less fortunate. We are often told by our friends who don t own property to cut them a break or give them time. I am not 2 P a g e

3 suggesting you start evicting a tenant for being 3 minutes late on rent however waiting or being too patient can work against you down the road. Avoiding eviction because you have been told that it takes 6 months is completely untrue. When the correct process is followed an eviction can take under 6 weeks. This will allow you to provide your quality housing to a tenant who treats you with the same respect that you treat them. I would encourage you to think of eviction as protecting your interests in the property. It has more to do about protecting you, your family, and your property than being unfair to a tenant. Lie #2 Once You Start an Eviction It Can t Be Stopped and I am Going to Lose My Tenant Recently in a conversation with a landlord who was having issues with a tenant they told me that they hadn t started the eviction process because they believed that the tenant would eventually come through with the back rent that was owed. Many good hearted and well meaning landlords fall into this category. The truth is that an eviction can be stopped. The first place to stop is filing the demand for compliance. This officially starts the eviction process. It by no means is the point of no return. By filing the Demand for compliance a landlord is protecting their interest in the process. Completing this step provides the tenant with time to become current on the rent. While it may not seem like it this process provides a win-win situation. Lie #3 An Eviction Is Far Too Expensive to Carry Out So You Are Better Off Losing the Rent for a Month or Two & Hope the Tenant Gets Back on Track The legal system can be extremely intimidating. The thought of lawyers getting involved and billing hundreds of dollars an hour is enough to keep landlords from filing eviction notices. 3 P a g e

4 A few steps in the process that many landlords are familiar with are the process of getting the Sheriff to serve the notice, filing of court documents, and one of the greatest fears is the tenant damaging your property because of the eviction. Many landlords avoid filing because they believe that the math works in their favor to lose rent. Costs to carry out an eviction are far less than many landlords believe. On average the cost of eviction is less than the cost of the one month s rent. Lie #4 Confrontations With Tenants Could Turn Violent So Don t Evict Them The fear of confrontation keeps many from filing eviction. Avoiding violence is in everyone s best interest, yours and the tenant. Following a methodical and logical process is in everyone s best interest. Eviction isn t a legal process that only provides protection for the landlord there are protections built in for the tenant. The truth is that evictions only take place when someone hasn t lived up to their end of the transaction. You provide quality housing and the tenant agrees to pay rent in exchange for that service. Following a legal process where the tenant is allowed to make the owner of the property whole is the right thing to do. During an eviction if it comes to the point where the tenant has to move out you can let the Sheriff be in charge of the process. This prevents you from having to fear violence. Lie #5 The Best Way to Handle an Eviction is To Contact an Attorney 4 P a g e

5 The legal system contains procedures, systems, and specialized vocabulary. Attorneys attend law school for 3 years or more in some cases so they can operate this system effectively. Many believe that the best way to handle an eviction, because of the legal process, is to contact an attorney. Attorney s have their place in the legal system. While they can handle an eviction they are rarely the most affordable solution. Attorney s can charge $1,500 or more to handle an eviction where they are doing nothing more than delegating the work to others. Delegation costs time and your hard earned money. There are ways to get an eviction completed that will save you time, money, and be just as effective as if an attorney handled the transaction. WARNING: When you bring this lie up to attorneys they will disagree. Attorneys have a business to run as well. An honest attorney will inform you of your options. Lie #6 A Tenant Will Protest & Cause More Problems than Just Waiting for Them to Pay Can tenants protest an eviction? Tenants who don t want to live up to their end of the lease agreement that they signed will absolutely protest. These dead beat tenants will use any tactic possible to delay the eviction. Many will spend more time and effort fighting the process than it takes to pay what they owe. A common counter claim is that repairs were not made in a timely manner. Quality landlords have nothing to fear. Landlords that treat their clients with respect, care for their properties, and keep records have little to fear. Tenants who fight often know they are in the wrong. These types of tenants need to be removed from your property so a quality tenant can enjoy your property for years to come. 5 P a g e

6 Lie #7 An Eviction Takes Months. It is Better to Lose a Month s Rent We have all heard the horror story of an eviction that took 6 months, 7, or even an entire year. Many believe that the only difference between a short eviction and a long one is the tenant. It is easy to blame the tenant for the problems isn t it? The truth is the difference between an eviction that takes 6 months and one that takes 6 weeks is the person in charge of the eviction. When you follow the rules of the court system with the proper filing methods the eviction process can take place in as little as 6 weeks. 6 weeks from now a new tenant who wants to pay you, will love your property, and wants to avoid court could be in your property.
