EXECUTIVE SUMMARY Steil Surveying Services, on behalf of Marianne Christensen Living Trust and Lee C. Stevens Et Ux, has submitted a Subdivision Permit/Plat application for Marianne Estates, a replat of Tract 1, Archer Estates. The application has been submitted for the purpose of subdividing the property into three residential lots averaging 6.22 acres. This application is being run concurrently with a zone change application, requesting a change in zone district from A1 (Agricultural and Rural Residential) to AR (Agricultural Residential) to allow a reduction in the minimum lot size requirement from 10 acres to 5 acres for the proposed subdivision. The subdivision permit and plat cannot be approved if the zone change is not approved, given the minimum lot size requirements. BACKGROUND The subject property is approximately acres located northeast of the intersection of Westedt and Stewart Roads. Should the zone change be approved, the proposed subdivision would establish a minimum of 5 acres for each of the existing residences, located at and Stewart Road, leaving approximately 8.67 acres as a vacant residential lot. The existing structures will become the residences of Tracts 1 and 2, with access from Stewart Road. DISCUSSION The Laramie County Comprehensive Plan designates this area as RM (Rural Metro), located generally outside the Urban Interface of Cheyenne, and including the areas within the Metropolitan Planning Organization (MPO) boundaries. The areas outside this boundary may be a mix of residential and neighborhood oriented services, where buffering of dissimilar uses is essential. Average residential developments may be acres depending on availability of services. PlanCheyenne contemplates Rural Residential uses for this property. This category provides a gradual transition from the urbanized areas of the Cheyenne Area to the rural areas on the periphery. The Rural Residential category includes a mix of rural and residential uses and is not intended to be an area for intensive future residential development. The primary use in this category is single family residences on individual large lots, where farm animals and horses are permitted, and clustering is encouraged. Current zoning for this property is A1 (Agricultural and Rural Residential), which requires a minimum lot size of 10 acres for any use. A zone change to the AR (Agricultural Residential) district has been requested to allow the tracts in the proposed subdivision to meet the minimum lot size requirements of 5 acres. Surrounding properties are zoned A1 and A2, range in size from approximately 5 to 147 acres, and are either single-family residential or agricultural in use. Public notice was published, and neighbor notice letters were mailed. Staff received no comments from adjacent landowners. Agency reviews were combined for the zone change and subdivision permit & plat applications. Comments received regarding clerical errors on the plat shall be addressed prior to the public hearing of the application before the Board. Staff finds the proposed Subdivision Permit and Plat is in conformance with the plans and policies of the Laramie County Comprehensive Plan and PlanCheyenne. 3 RECOMMENDATION and FINDINGS Based on evidence provided, staff recommends the Planning Commission find that: a. This application meets the criteria for a subdivision permit pursuant to section (a-d) of the Laramie County Land Use Regulations. b. This application meets the criteria for a plat pursuant to section (e) of the Laramie County Land Use Regulations. c. This application is in conformance with section of the Laramie County Land Use Regulations governing the AR (Agricultural Residential) zone district. and that the Planning Commission recommend approval of the Subdivision Permit and Plat for Marianne Estates with the following condition: 1. Clerical updates on the plat shall be addressed prior to the Board public hearing of the application. PROPOSED MOTION I move to recommend approval of the Subdivision Permit and Plat for Marianne Estates, a replat of Tract 1, Archer Estates, Laramie County, WY, to the Laramie County Board of Commissioners with condition 1, and adopt the findings of facts a, b, and c of the staff report. 9 PZ (109) Marianne Estates Zone Change & Subdivision Permit/Plat County Engineer: Scott Larson COMMENTS ATTACHED 06/23/2017 Engineer Review 1. It is my understanding that a septic tank/system needs to be a minimum of 50 feet from a property line. The septic system shown for Tract 2 appears to be less than 50 feet from the newly create property line. Confirmation with Laramie County Health should be accomplished by the applicant and results should be provided to County Planning. 2. I concur with the request for a waiver of a detailed drainage study and traffic study. The proposed development of these three tracts will not create any significant increase in traffic and/or runoff. 3. A note regarding whether or not any portion of this plat falls within a FEMA flood hazard area and reference to the FIRM Panel Number needs to be included on the plat drawing. Surveyor Review 1. The Plat Requirements state that The title shall indicate the section, township and range, and this is not provided. 2. The Plat Requirements state that survey tie(s) by bearing/azimuth and the distance to the nearest public land survey system monument shall be accurately described. No direct tie is provided; however, it can be derived as a parallel offset from the roads along the west and south boundaries, but only with the assumption that the road right-of-way is 40 on each side of the shown section lines. The addition of dimensions to indicate the distance from section line (or a direct tie to the corner) would satisfy this requirement. 3. The statement describing sewage disposal, water supply, and fire protection is provided, however it should be inside the border of the plat. Environmental Health Department: Roy Kroeger COMMENTS ATTACHED 06/16/2017 Laramie County Small Wastewater System Regulations. Any new development will require the submission of a copy of the signed final plat to this office. A percolation test shall be completed prior to application for a small wastewater system permit. Fire District No. 2: Jason Caughey COMMENTS ATTACHED 06/12/2017 I have no concerns with subdividing this property. It is important to understand the distance from an existing fire station hinders emergency response to this location.
