2 Unified Hazard Mitigation Grant Assistance Common Questions 1. What dictates mitigation grant program requirements? 2. What types of mitigation grant programs are available? 3. 3 What is Mitigation? Mitigation - providing a permanent solution whereby reducing or eliminating the effects of future disasters.

4 Property Acquisitions or Relocation Program Overview 1. Program consists of a Subgrantee (city or county) purchasing flood prone structures from willing sellers. 2. The purchased property is maintained by the Subgrantee as open space for perpetuity. 3. This is to restore and/or conserve the natural functions of the floodplain.

5 Property Acquisitions or Relocation Eligible Activities 1. The property will be acquired from a willing, voluntary seller. 2. Property contains a structure that may or may not have sustained damage or destroyed due to a disaster event. 3. Property is not part of an intended, planned or designated project area. 4. Property will not be subdivided prior to acquisition.

6 Property Acquisitions or Relocation Subgrantee Open Space Restrictions 1. The Subgrantee will dedicate and maintain the property in perpetuity for uses compatible with open space, recreational, or wetlands management practices. 2. No new structures will be built on the property. 3. No federal disaster assistance of any means can be made with respect to the property. 4. Subgrantee must monitor/enforce deed restrictions.

7 Property Acquisitions or Relocation Subgrantee Assurances 1. Participation by property owners is voluntary. 2. Property owner will be informed in writing of fair market value of the property. 3. The property will be dedicated as open space for perpetuity. Consulted with USACE and NDDOT to ensure no future, planned improvements are being consider and will reject any proposals for such in the future. 4. Buildings will be removed 90 days from time of settlement. 5. Will not transfer or sell property without prior approval from NDDES and FEMA Regional Administrator.

8 Property Acquisition or Relocation Subgrantee Application Requirements 1. Complete and submit a three-part grant application by deadline 2. NDDES and FEMA will conduct a formal review for eligibilities and compliance to regulations. 3. If approved, sub-grantee will receive a Notice of Award; begin project implementation 4. Reporting requirements Site Visits Quarterly Reports Reimbursement Requests Project Closeout

Who will be responsible for the project?

Structure information (sq/ft, guest-imate value, damage data, BRV, etc) 4. NFIP data (if applicable) Maps, elevation certificate 5. River Data discharge level, recurrence interval 6. Substantial Damage Rule
