AD HOC COMMITTEE REPORTS 8.1 Bracebridge Public Library Board (Councillor, L. Giaschi-Pacini) CARRIED For the third year in a row, the 100,000 mark was reached at the end of November. Year-to-date circulation stands at 100,199 (-1%). Patron registrations went up in November to 99 new members. The Dads of Bracebridge presented the Library with an early literacy computer station in the Children s Department along with numerous software for a variety of ages, a colourful keyboard and mouse, and a custom-made desk and bench. The staff network connection was switched to fibre optics in hopes of a more stable connection that will reduce downtime. The facilities working group took a tour of the Collingwood and the Owen Sound Libraries, then met to discuss next steps in the process. A survey will be prepared to seek more information from the staff at the Collingwood Library for further discussion by the group. 8.2 Oakley Village Square Board of Management (Councillor, B. McMurray) Nil. 8.3 Bracebridge BIA Board of Management (Councillor, L. Cragg) The BIA merchants are still open for last minute Christmas shopping. 8

Giaschi-Pacini) The Chamber of Commerce held their monthly Business After Hours networking event at Riverwalk which was very well attended, and the Board of Directors was introduced. NEW BUSINESS / DISCUSSION ITEMS Nil. 11. DISTRICT INFORMATION ITEMS 11.1 Community Services (Councillor, S. Clement) Councillor Clement s update on the Community Services Committee meeting of December 14, 2011 has been circulated to members of Council as part of the December 21, 2011, Council Correspondence Circulation Engineering and Public Works (Councillor, S. Young) Triathlon Muskoka and the Muskoka Bicycle Club appeared as a delegation to request a higher standard of road patching and consideration of paved shoulders. These groups bring thousands of participants and visitors to Muskoka each year. MTO was on hand regarding Highway 11 between Washago and Gravenhurst. This is a long-term project that will likely impact Bracebridge in the future. 9

Giaschi-Pacini) The Muskoka Watershed Council provided an update on their goals and achievements. The Canadian Water Network has approved funding to the Muskoka River Watershed Monitoring and Management Consortium in the amount of $600,000 over three years for the research of Managing the cumulative effects in the Muskoka River watershed: Monitoring, research and predictive modelling. A presentation was received on the 911 verification program which will no longer be managed through test calls. A summer student will be hired to conduct site visits to review the on-site civic addressing signage and confirm the civic addressing information with the occupant and compare it to the Bell Canada customer database. GIS information can also be improved through this initiative Corporate and Emergency Services (Mayor, G. Smith) The Ambulance Service Agreement with Medavie EMS Ontario Ltd will be extended to December 31, A contract was awarded for the construction of the I.T. Services Computer Data Centre in the amount of $182,000. ANNOUNCEMENTS That the following bills be read a first, second and third time and finally passed: Bill # 99 (By-law No ) A By-law of The Corporation of the Town of Bracebridge to prohibit and regulate certain noises within the Town of Bracebridge (11-GC-342) (AF106-11) (Noise Control By-law) Bill # 100 (By-law No ) A By-Law of The Corporation of The Town of Bracebridge to levy and collect interim taxes for municipal purposes for the Year 2012 and to establish the due date for the payment and to charge penalties for non-payment of the same (11-GC-346) (AF111-11) Bill # 101 (By-law No ) A By-law of The Corporation of The Town of Bracebridge to amend By-law , a land use control by-law to regulate the use of land in the Town of Bracebridge (11-GC- 348) (DS073-11) CARRIED Councillor Cragg noted that on February 23, 2011, the Rotary Club of Bracebridge will be hosting the Gala presentation of this season s musical Annie. This is the first time a member of Council will be in the cast. Other shows are during the last weekend of February and the first weekend of March. Councillor Clement noted that 350 boxes of dried goods, 700 bags of perishable goods, and over 300 toy bags have been distributed by the Bracebridge Salvation Army. Deputy Mayor Maloney noted that on Tuesday January 10, 2012, at 1:00 p.m. at the Bracebridge Sportsplex the final round of Legacy presentations will be announced for the 2010 Winter Games. Mayor Smith noted his attendance at a number of holiday events and wished citizens, the media, Council and staff a joyous holiday season. The Mayor s Levee will take place on January 7, 2012, from 1:00 p.m. to 3:00 p.m. at the Bracebridge Sportsplex. 15. COMMITTEE OF THE WHOLE, CLOSED SESSION Nil. 16. Cathryn Willard, Chair, Annie Williams Memorial Park Board Let Them Be Kids Update 12-GC-001 Cathryn Willard, Chair, Annie Williams Memorial Park Board, provided a PowerPoint presentation and video highlighting the Let Them Be Kids project at Annie Williams Memorial Park, including a history of the Park, an overview of fundraising activities, and particular mention to the multiple contributions of various community partners, sponsors and volunteers to the Annie William Memorial Park s Extreme Makeover on September 10, Mayor G. Smith thanked Cathryn and the Annie Williams Memorial Park Board for being excellent managers of the Park and the community volunteers for their hard work keeping the Park beautiful. 13

The Environmental Protection One (EP1) is recommended to be applied to lands containing the creek up to the top of bank. These lands should be identified by an Ontario Land Surveyor. Comments received from the Town of Bracebridge Chief Building Official indicates demolition permits will be required for any structure on the retained parcel to be removed. 6. Comments received from the Town of Bracebridge Public Works Department indicate no concerns with the application and recommend that the applicants enter into a site plan agreement with the Town of Bracebridge to address future servicing, stormwater management, site access, construction mitigation and grading of the subject lands. 7. Comments received from the District of Muskoka indicate that staff would not be opposed to the proposed zoning by-law provided the by-law is amended to include a Holding H Symbol. In accordance with Section H.19 of the Muskoka Official Plan a Holding H Symbol should be included on the lands in order to ensure proper allocation of servicing capacity. Removal of the Holding H Symbol would be considered once confirmation has been obtained from the District that adequate capacity is available in order to ensure the appropriate allocation of services for the proposal at the time a site plan is entered into with the Town. 8. Comments received from the District of Muskoka also indicate that the property has frontage on a District Road and therefore an entrance permit will be required from the District prior to the construction of an access onto the District Road. 9. Letter received from Mike and Barb Spicer, neighbouring property owner, indicating their opposition to the proposed rezoning. Feel oversized development for the lot, concern with the entrance, sidewalks, where the children would play and that they feel a privacy fence should be erected around the entire lot due to the elevation being much higher than their lot. The applicant s agent, Patrick Mason, of Wayne Simpson & Associates, addressed the Committee. Advised that the owner had hired a surveyor to conduct a typographical survey and the top of the bank will be well defined. In agreement with the zoning of the Environmental Protection zone and the Holding Symbol as a requirement of the District of Muskoka. 29 BILL NO. 1 BY-LAW NO A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO AUTHORIZE TEMPORARY BORROWING FROM TIME TO TIME TO MEET CURRENT EXPENDITURES DURING THE FISCAL YEAR ENDING DECEMBER 31, 2012 WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the Municipal Act ) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein, inter alia, financial management; AND WHEREAS Section 407 of the Municipal Act, 2001, as amended, provides authority at any time during a fiscal year, for a municipality to authorize temporary borrowing, until the taxes are collected and other revenues are received, of the amount council considers necessary to meet the current expenditures of the municipality; AND WHEREAS the total amount which may be borrowed from all sources at any one time to meet the current expenditures of the Municipality, except with the approval of the Municipal Board, is limited by Section 407 of the Municipal Act, 2001; AND WHEREAS by motion 12-GC-005 the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS: 1. The Corporation of the Town of Bracebridge is hereby authorized to borrow from time to time during the fiscal year (hereinafter referred to as the current year) such sums as may be necessary to meet, until taxes are collected and other revenues are received, the current expenditures of the Municipality for the current year. 2. The lender(s) from whom amounts may be borrowed under the authority of this by-law shall be Royal Bank of Canada and such other lender(s) as may be determined from time to time by bylaw of council. 3. The total amount which may be borrowed at any one time under this by-law plus any outstanding amounts of principal borrowed and accrued interest under Section 407 together with the total of any similar borrowings that have not been repaid, shall not exceed from January 1 to September 30 of the current year, 50 percent of the total estimated revenues of the Municipality as set out in the budget adopted for the current year, and from October 1 to December 31 of the current year, 25 percent of the total off the estimated revenues of the Municipality as set out in the budget adopted for the current year or $7,000,000, whichever is less. 29

The treasurer shall, at the time when any amount is borrowed under this by-law, ensure that the lender is or has been furnished with a certified copy of this by-law, (a certified copy of the resolution mentioned in section 2 determining the lender) if applicable, and a statement showing the nature and amount of the estimated revenues for the current year and also showing the total of any other amounts borrowed from any and all sources under authority of section 407 of the Municipal Act that have not been repaid. 5. If the budget for the current year has not been adopted at the time an amount is borrowed under this by-law, the statement furnished under section 4 shall show the nature and amount of the estimated revenues of the Municipality as set forth in the budget adopted for the previous year and the nature and amount of the revenues received for and on account of the current year. 6. For purposes of this by-law the estimated revenues referred to in section 3, 4, and 5 do not include revenues derivable or derived from: 6.1. Any borrowing, including through any issue of debentures; 6.2. A surplus, including arrears of taxes, fees or charges; or, 6.3. A transfer from the capital fund, reserve funds or reserves. 7. The treasurer is hereby authorized and directed to apply in payment of all or, any sums borrowed under this by-law, together with interest thereon, all or any of the moneys hereafter collected or received, either on account of or realized in respect of the taxes levied for the current year and previous years or from any other source, that may be lawfully applied for such purpose. 8. The Bank shall not be responsible for establishing the necessity of temporary borrowing under this by-law or the manner in which the borrowing is used. 9. E.9, as amended, every municipality is required to develop and implement an emergency management program and an emergency plan; AND WHEREAS it is deemed necessary to establish a planning committee to prepare, upgrade and maintain an Emergency Program and Plan for the Town of Bracebridge; AND WHEREAS by motions 12-GC-014 the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS: 1. 35 BILL NO. 3 BY-LAW NO A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO REGULATE AND CONTROL TRAFFIC IN THE TOWN OF BRACEBRIDGE (TRAFFIC CONTROL BY- LAW) WHEREAS Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the Municipal Act ) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, traffic on highways; AND WHEREAS Section 128(2) of the Highway Traffic Act, R.S.O. 1990, provides that the council of a municipality may, for motor vehicles driven on a highway or portion of a highway under its jurisdiction, by by-law prescribe a rate of speed different from the rate set out in subsection (1) that is not greater than 100 kilometres per hour and may prescribe different rates of speed for different times of day; AND WHEREAS Section 137 of the Highway Traffic Act, R.S.O. 1990, provides that in addition to stop signs required at intersections on through highways the council of a municipality may by by-law provide for the erection of stop signs at intersections on highways under its jurisdiction; AND WHEREAS The Council of the Corporation of the Town of Bracebridge passed By-law on the 28 th day of September, 2011 for the purpose of regulating and controlling traffic; AND WHEREAS The Council of the Corporation of the Town of Bracebridge passed By-laws and , for the purpose of prohibiting heavy traffic; AND WHEREAS by motion 12-GC-017 the Council of the Corporation of the Town of Bracebridge deems it expedient to enact a new by-law to regulate and control traffic and to repeal By-laws 86-38, and in their entirety; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS: DEFINITIONS 1. In this By-law: 1.1. Highway - includes a common and public highway, street, avenue, parkway, crescent, lane, court, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof; 35

36 BILL NO. 3 Page Commercial Motor Vehicle - means any motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, fire apparatus, police patrols, motorbuses and tractors used for hauling purposes on highways; 1.3. Heavy Traffic - means a commercial motor vehicle, having a weight when unloaded of ten tonnes or more, or when loaded of fifteen tonnes or more, but does not include a passenger vehicle, an ambulance, a vehicle making a delivery to or a collection from a bona fide destination which cannot be reached via a highway or highways upon which heavy traffic is not prohibited by this By-law, and taking the most direct route to such a destination from a highway or part of a highway upon which heavy traffic is not prohibited by this By-law; 1.4. Official Sign - means a sign in conformity with the Highway Traffic Act regulations or approved by the Ministry of Transportation and Communications or approved by Council; 1.5. Owner - means a person who is registered as the owner of a motor vehicle or a person who is in possession of an Ownership Certificate duly signed by a person so registered; 1.6. Operator - means a person who operates a motor vehicle on a highway. TRAFFIC CONTROL 2. One-way street: 2.1. The highways set out below in Column 1 between the limits set out in Column 2, are hereby designated for one way traffic only in the direction set out in Column 3. Each designation made by Subsection 2.1 shall be upon the erection of official signs. 3. When any highway or portion of highway set out in Schedule A (Speed Limits) is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule. 4. When any highway or portion of highway within a public park set out in Schedule B (Speed Limits in Public Parks) is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule. 5. Any intersection on a highway set out in Schedule C (Intersections for Yield Signs) is designated as an intersection where yield right-of-way signs are erected at the intersection prescribed in the schedule. 6. Any intersection on a highway set out in Schedule D (Intersections for Stop Signs) is designated as an intersection where stop signs are erected at the intersection prescribed in the schedule. 7. When any highway or portion of highway set out in Schedule E (School Zones) is marked as a school zone, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule. 36

Heavy Traffic Prohibited: PENALTIES 8.1 When appropriate signs have been erected and are on display, no person shall drive, move or operate Heavy Traffic upon or over any of the streets or parts of streets named or described in Schedule F of this By-law during the hours prescribed in the schedule. 8.2 The provisions of this subsection shall not extend to the use of the said highways or parts of highways for emergency purposes or deliveries to or removals from any premises abutting thereon. 8.3 That the Town of Bracebridge, Town of Bracebridge contractors, District Municipality of Muskoka, and District Municipality of Muskoka contractors be exempted from this section, when engaged in road maintenance activities. 9. The penalties provided in the provisions of the Highway Traffic Act shall apply to offences against this by-law. FORCE AND EFFECT 10. That this By-law shall come into force and effect immediately upon passage. REPEAL 11. Upon the date of passage of this by-law, By-laws 86-38, , , and any amendments thereto, are hereby repealed. 53 BILL NO. 4 BY-LAW A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO AMEND BY-LAW 82-34, A MUNICIPAL SERVICING STANDARDS BY-LAW WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the Municipal Act ) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, highways; AND WHEREAS, Section 44(1) of the Municipal Act provides that the municipality that has jurisdiction over a highway or bridge shall keep it in a state of repair that is reasonable in the circumstances, including the character and location of the highway or bridge; AND WHEREAS Ontario Regulation 239/02 sets out minimum maintenance standards for municipal highways; AND WHEREAS, Section 55 of the Municipal Act, 2001, imposes responsibility for sidewalks to lower tier municipalities where the roadway is located; AND WHEREAS by motion 12-GC-017, the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law; NOW THEREFORE THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS: 1. That Schedule A setting out various classes of highways for minimum maintenance within the municipality be amended and attached to and form part of this by-law. 2. That Schedule B as attached hereto forms part of this by-law. 3. That Schedule C setting out the winter maintenance schedule for sidewalks within the municipality be attached to and forms part of this by-law. 4. That By-law is hereby repealed in its entirety. 5. That this By-law shall come into force and effect immediately upon passage. 87 BILL NO. 5 BY-LAW A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO ESTABLISH THE SECTION OF ROADWAY ADJACENT TO LOTS 3 TO 23 INCLUSIVE, PLAN 35M-705, ON STONEHENGE COURT, IN THE TOWN OF BRACEBRIDGE, IN THE DISTRICT MUNICIPALITY OF MUSKOKA, AS A PUBLIC HIGHWAY WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the Municipal Act ) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, highways; AND WHEREAS the Council of The Corporation of the Town of Bracebridge deems it expedient to establish the section of roadway adjacent to Lots 3 to 23, inclusive, Plan 35M-705, on Stonehenge Court, in the Town of Bracebridge, in the District of Muskoka, as a public highway; AND WHEREAS by motion 12-GC-017, the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS: 1. 93 BILL NO. 7 BY-LAW NO A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO APPOINT MUNICIPAL OFFICIALS AND COMMITTEES FOR THE TERM OF COUNCIL WHEREAS Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the Municipal Act ) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues; AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, governance structure of the municipality and its local boards; AND WHEREAS Section 204(3) of the Municipal Act provides for the appointment by Council of a Board of Management for the Business Improvement Area; AND WHEREAS Section 44(1) of the Planning Act, R.S.O (hereinafter referred to as the Planning Act ) provides that the council of the municipality may by by-law constitute and appoint a committee of adjustment for the municipality composed of such persons, not fewer than three, as the council considers advisable; AND WHEREAS Section 44(3) of the Planning Act provides that the members of the committee who are not members of a municipal council shall hold office for the term of the council that appointed them and the members of the committee who are members of a municipal council shall be appointed annually; AND WHEREAS pursuant to Section 54(1) of the Planning Act, the District Municipality of Muskoka, by By-law delegated to the Council of the Corporation of the Town of Bracebridge the authority for the giving of consents under section 53 in respect of land situate in the lower-tier municipality; AND WHEREAS Section 54(2) of the Planning Act provides that where authority is delegated to a council under Section 54(1), such council may, in turn, by by-law, delegate the authority or any part of such authority, to a committee of adjustment; AND WHEREAS Section 12 of the Ontarians with Disabilities Act, S.O. 2001, provides that the Council of every municipality having a population of not less than 10,000 shall establish or continue an accessibility advisory committee and the Council of every municipality having a population of less than 10,000 may establish or continue an accessibility advisory committee; AND WHEREAS Section 2 of the Line Fences Act, R.S.O. 1990, provides that the council of every local municipality shall by by-law appoint such number of fence-viewers as are required to carry out the provisions of this Act; AND WHEREAS Section 15.6(1) of the Building Code Act, S.O. 1992, provides for the establishment of a property standards committee composed of such persons, not fewer than three, as the council considers advisable to hold office for such term and on such conditions as the by-law may establish; 93

That Schedule A to By-law No is hereby amended by changing the zoning of Part of Lot 24 of Plan 8 Bracebridge Ward of the Town of Bracebridge, being Parts 3 and 4 of Plan BR from the present zones of Residential Type 1 (R1) to Residential Type 1 Special - 54 (R1-54), which lands are more particularly shown outlined in red on Schedule "A" attached hereto. 2. That Section 7.1.1: Residential Zones Exceptions is hereby amended by the addition of the following: Zone Permitted Uses R1-54 In a Residential Type 1 Special - 54 (R1-54) Zone, the permitted uses are all those uses in the Residential Type 1 (R1) Zone including one Accessory Apartment Dwelling Unit with each dwelling unit having a separate outdoor privacy area of 23 square metres with a minimum lot frontage of 15 metres. All other applicable provisions of the Residential Type 1 (R1) Zone shall continue to apply in respect to the lands located within the Residential Type 1 Special - 54 (R1-54) Zone. 3. That Schedule "A" attached hereto forms part of this by-law. 4.
