1 APPENDIX A Requests for Use of JEA Real Property Guidelines and Application Goals The goals of this procedure are to ensure: The safety and best interest of the public; The integrity of the public utilities system; The protection and preservation of JEA property rights.

3 Introduction JEA s real property rights are valuable assets that must be protected to ensure the efficient delivery of the essential services of electricity, water, and sewage disposal. JEA property rights are acquired for the construction, operation, expansion, and maintenance of various utilities needed to serve its customers. JEA must have unobstructed access to safely operate and maintain its facilities and to provide for future expansion. Ensuring public safety as well as preserving the land rights that have been acquired for the benefit of the public are the primary goals of this procedure. Nothing will be allowed on JEA property that violates state or federal laws, the City of Jacksonville Ordinance Code, the National Electric Safety Code (NESC), or other applicable laws. JEA receives many requests from property owners, other governmental agencies, private utility companies, private corporations, and individuals to utilize its existing fee owned property and property encumbered by its easements. Potentially acceptable uses may include parking lots, temporary storage, agricultural and livestock purposes, ingress/egress, decks, fences, and gardens. JEA also will consider the collocation of facilities such as gas pipelines and communications technology. This booklet provides applicants with guidance in gaining permission to utilize JEA real property for purposes compatible with JEA s safe and efficient delivery of service. Applicants must provide the requested information and attachments in order to avoid unnecessary delays in the application process. This booklet includes direction for preparing scaled drawings to submit with the application. Definitions Appurtenance: Something that has been added or appended to a property and has since become an inherent part of the property; usually passes with the property when title is transferred. See also fixture. Buffer strip: A parcel of land, usually unimproved except for landscaping and screening, that separates parcels with different land uses. Compatible Use: JEA may determine that a requested use of JEA real property is compatible with JEA s current use of and future plans for the parcel(s). A requested use will be evaluated for compatibility with consideration given to all relevant factors such as current and future uses, use of surrounding parcels, safety, and costs. Conservation easement: A restriction (usually imposed by state or federal law) that limits the future use of a property to preservation, conservation, or wildlife habitat. Easement: A right afforded a person or entity to make limited use of another s real property for certain purposes. In easement areas, JEA has acquired specific rights from the underlying property owner, to construct, operate, and maintain power lines, water and sewer lines, substations, and other infrastructure necessary for the delivery of utility services. The underlying property owner may have certain rights defined in the original easement document which are consistent with JEA s rights in the property. Third
4 parties may be allowed use of the JEA easement parcels if the third party obtains permission from both JEA and the underlying property owner. Egress: The right to leave a tract of land. Often used interchangeably with access. Encroachment: An encroachment is any infringement on the property or authority of another. Any unauthorized use of JEA property is an encroachment. Encroachments are either licensed or unlicensed. The purpose of the Use of JEA Property Application Procedure is to provide a method to request a licensed encroachment and to ensure that all licensed encroachments are compatible with JEA property rights. Unlicensed and impermissible encroachments pose a potential conflict with JEA s safe and efficient operation of its utilities facilities and are subject to action by JEA. Fee Owned property: Absolute ownership unencumbered by any other interest or estate, subject only to the limitation imposed by the governmental powers of taxation, eminent domain, police power, and escheat. On fee owned property, JEA holds the title to the property and all the rights and responsibilities associated with public land ownership. JEA may grant permits, leases, licenses, temporary easements, or perpetual easements for compatible purposes. Users may be charged depending on the type of request. Fixture: An article that was once personal property, but has since been installed or attached to the land or building in a rather permanent manner so that it is regarded in law as part of the real estate. See also appurtenance. Hold Harmless Agreement: A legally binding agreement in which the liability of one party is assumed by another. The Hold Harmless Agreement usually accompanies a Use Agreement. Ingress: The right to enter a tract of land. Often used interchangeably with access. Lease: An agreement between two (2) parties whereby one party, the lessor, yields his right of possession and use of some real or personal property for a specified period of time to a lessee in return for consideration. License: A personal privilege to do some particular act or series of acts on land without possessing any estate or interest therein, and is ordinarily revocable at the will of the licensor and is not assignable. The permission by competent authority to do an act which, without such permission, would be illegal, a trespass, a tort, or otherwise unallowable. License agreements are renewable on an annual basis. Permit: In general, any document which grants a person the right to do something. A license or grant of authority to do a thing. Permits are issued for a specific time period. Retention pond: A man-made impoundment with a permanent pool of water that is used to reduce storm water runoff.
5 Right of way: A privilege to pass over the land of another in some particular path; usually an easement over the land of another; a strip of land used in this way for railroad and highway purposes, for pipelines or pole lines, and for private or public passage. Use Agreement: A document which describes the approved benefit of the permitee, licensee, lessee, or easement holder permitted on JEA property. The Use Agreement is usually executed in conjunction with a Hold Harmless agreement. Wetlands: Areas that are frequently saturated by surface or ground water at a frequency and duration sufficient to support vegetation adapted for life in saturated soil conditions. Section 404 of the Clean Water Act defines wetlands. The Application Process 1. The applicant must complete the application packet (providing the required attachments) and submit the packet to: JEA Real Estate Services, CC6 21 West Church Street Jacksonville, FL ATT: Director, Real Estate Services Incomplete applications will be returned to the applicant and will cause delays in reaching a determination of approval, denial, or approval with conditions. 2. Upon receipt of the application, a JEA Real Estate Services representative, will confirm that the information contained in the application is consistent with the drawings submitted. The representative will also verify that proper clearances, both vertical and horizontal, are shown on the plans and all proposed changes are identified in relation to existing structures. A JEA representative may inspect the property. 3. The completed application will be considered by the JEA Property Use Evaluation and Recommendation Committee. The Committee is comprised of representatives from Real Estate, Development, Transmission, Distribution, Water and Sewer, Environmental, General Counsel, or other branch(es) of JEA responsible for issues arising from the proposed use. Other departments may review the application if deemed necessary by the Committee. The primary objectives of the Use of JEA Property Application Procedure are to ensure the safety of the public, the protection and preservation of JEA land rights, and the safety and integrity of the public utilities system. The investigation will ensure that potential conflicts with other proposed projects do not
6 exist. The Committee may impose additional requirements not stated in these Guidelines. 4. The Committee will consider the application in accordance with the guidelines listed on the following pages and any other relevant factors 5. Applicants will be notified of the committee s decision within forty-five (45) days from receipt of a complete application packet. If the request is denied, the applicant will receive a letter of explanation. If the request is approved, the applicant will receive a letter stating that the request is approved as submitted or approved with conditions. A property use agreement must be signed prior to utilization of the property. 6. Insurance required: If the project is located on JEA fee owned lands, the applicant must provide proof of insurance with JEA as a named insured on either the insurance company s form or on JEA s form. The Applicant must provide the Agreement Number to the insurance company in the Description of Operations block on the form. The certificate of insurance must be on file prior to commencement of activities. The required policy amounts are: General Liability and bodily injury $200,000 each person and $500,000 each person and $1,000,000 each occurrence. Limits may vary depending on the type of use approved. Property damage $50,000 each occurrence and $100,000 aggregate. Proof of insurance must be updated annually. Failure to have a current Certificate of Insurance in JEA records may result in the cancellation of the agreement. It is the responsibility of the requester to supply JEA with annual proof of insurance. 7. If the apllication is approved, the final agreement document will outline in detail the necessary safety requirements, specifications, insurance requirements, and fees. TIME LIMITATIONS All approved applications are valid for one (1) year from the original date of approval. A new application will be required if the approved activity is not initiated within one year of the approval date.
7 GUIDELINES Transmission/Distribution Right-of-Way Use Guidelines The primary objectives of JEA are to provide safe, reliable, and economical electrical, water, and sewer disposal service to all of our customers. Maintaining reliability of these services requires unobstructed, around-the-clock, all-weather access for constructing, operating, and maintaining power lines, pipe lines, other facilities, and rights-of-way. Most joint uses of JEA s rights-of-way interfere with this objective to some degree and/or increase the company s cost of service. For those reasons, JEA does not routinely grant joint right-of-way use and will only consider those uses where the requirements of these guidelines are fully met. Nothing will be allowed on JEA property that violates state or federal laws, the City of Jacksonville Ordinance Code, the National Electric Safety Code (NESC), other applicable laws or sound engineering principles and practices. If you have a desire to use JEA transmission rights-of way for any purpose, for any length of time, please contact the Director of JEA Real Estate Services as the first step in all related planning. The transmission / distribution rights-of-way use guidelines herein are subject to change without notice. In some instances, use of JEA s property rights will require compensation to JEA. Subsequent to this initial contact, a Request for Use of JEA Real Property Application Form, and supporting drawings and other documentation must be submitted for all requests. All costs of the application and review process will be borne by the applicant and will vary commensurate with the complexity of the request. These guidelines should be used in planning every project. However, compliance with the guidelines shall not be construed as JEA permission or consent to use JEA rightsof-way property without a mutual use agreement or other formal written instrument, appropriate for the purpose, agreed to and executed in advance by the applicant and JEA. The joint user is responsible for the compatability of a requested use with the safe and efficient construction, operation, and maintenance of all JEA s existing and/or future utilities and facilities. Any remedial action required to resolve conflicts, present and future, related to land owner or third party joint use of JEA rights-of-way will be at the joint user s sole cost and expense. Extreme caution must be exercised at all times when working in the vicinity of high voltage power lines, such as those found on JEA transmission rights-of-way. In all activities on transmission rights-of-way, safety of life shall outweigh all other considerations.
8 All construction activities shall be performed in a safe manner and in compliance with the requirements of the Occupational Safety and Health Act (OSHA), and all other applicable rules and regulations including the Safe Work Practices of JEA. No work shall be performed by a dragline, cable type crane, backhoe, or any other machine unsuitable or unsafe for use around energized power lines. Refueling activities are prohibited on all rights-of-way. At JEA discretion, a safety inspector may be required to oversee the activities associated with the applicant s project. The compensation of, and all costs associated with, the safety inspector will be borne by the joint user. The joint user will be assessed a minimum penalty of $10,000 per incident for each power line contact or other activity associated with the applicant s project, regardless of the circumstances, that causes an outage to JEA power lines, even if the outage is only temporary. In addition to the penalty, fees will be assessed for any damages to JEA or third parties facilities. All landowners and third party joint users must adhere to all of the transmission rightsof-way use guidelines listed below. Universal Requirements For any proposed joint uses of JEA transmission / distribution rights-of-way, the following requirements are universal: 1. Unimpeded, around-the-clock, all-weather access is required for all parts of the transmission rights-of-way. 2. Right-of-way access roads and points of ingress and egress must be kept clear of obstructions to accommodate large vehicles with wide turning radii. 3. In the event JEA explicitly approves cross fencing, it shall have a minimum of sixteen (16) foot wide gates and, if secured with locks, must have JEA locks in a chain configuration to permit around-the-clock JEA controlled access. Unidentified locks will be cut out of the chain and discarded. Fencing shall be of metal fabric or strands of barbed wire providing visibility through the fencing materials. Rail fencing or other non-metallic fencing that allows through visibility may be considered. All fencing will be grounded to JEA specifications. 4. Fencing shall not prohibit unimpeded JEA access to any parts of the rights-ofway and shall not enclose animals that may pose a danger to JEA employees, contractors, or other authorized representatives patrolling, inspecting, surveying, engineering, constructing, operating, or maintaining lines or facilities, or other JEA activities in the corridor. 5. A seventy-five (75) foot radius around the base of each transmission line supporting pole or h-frame (two legged plane frame structure)is to be maintained clear at all times to permit the set-up and operations of the large
9 vehicles and equipment necessary for construction, inspection, maintenance, and repair of the structures. For transmission towers (four legged supporting structures) the clear working area shall be a one hundred fifty (150) foot radius measured from each leg of the structure. 6. A one hundred fifty (150) foot wide area centered on the split of the angle at each right-of-way turn is to be kept clear at all times to accommodate the present and future transmission / distribution line supporting structures, guy wires, and anchors necessarily located at such turn points. The split of angle is the line running from point of intersection of the right-of-way boundary lines on the inside of the turn angle to the point of intersection of the right-of-way boundary lines on the outside of the angle. 7. Ditches, swales, or canals shall not impede, around-the-clock, all weather access to all parts of the rights-of-way. 8. Culverts and bridges must be designed to have at least twelve (12) feet of useable roadway surface and accommodate vehicles of at least eighty thousand (80,000) lbs. gross vehicle weight (GVW). Culverts and bridges shall be positioned in the access road to provide a minimum of fifty (50) feet of approach area without roadway centerline curvature to accommodate the turning radii of large vehicles. Where such straight approach area is not practical the width of the traveled way over the culvert or bridge shall be wide enough to accommodate the turning radii of large vehicles. 9. No activity that results in the creation of new or enlargement of existing wetlands on transmission right-of-way shall be allowed. No right-of-way shall be used as a wetland mitigation area. This prohibition includes retention or detention ponds and the routing of drainage from adjoining lands onto rightsof-way. 10. No trees or other vegetation shall be planted in rights-of-way without prior written approval. In general there will be no consideration of the planting of trees and other vegetation that will grow to a mature height of six (6) feet or greater. 11. Nothing shall be grown or placed in rights-of-way that obstructs the vision of or otherwise endangers drivers along access roads. 12. No burning activities are allowed in any JEA rights-of-way. 13. JEA does not permit blow off / blow down valves within transmission corridors. 14. Applicant will execute a mutual use agreement and/or other binding legal instruments, appropriate for the purpose, prepared by and in final form acceptable to JEA. Structures 1, Equipment, and Storage Permanent or non-movable buildings, swimming pools, mobile homes, airstrips, and other non-compatible uses are almost never allowed within JEA s rights-of-way and will
10 be considered only in rare circumstances with binding assurances that all of the following criteria are met: 1. Universal Requirements (above) must be met. 2. The encroachment is temporary and is easily and immediately removable by the owner, at the owner s expense and the owner is willing to effect such removal on very short notice from JEA. 3. The use or activity does not restrict complete around-the-clock, all weather access and maintenance of lines, right-of-way, trails, culverts, bridges, fences, gates, or other JEA facilities or use. 4. The encroachment does not create any safety concerns for customers, JEA personnel, or the general public. 5. The encroachment facilities are not located under or within fifteen (15) feet of being under any power line conductor on the right-of-way and do not exceed twelve feet in height. 1 Structures, equipment and storage include, but are not limited to: any man-made assembly, buildings, sheds, storage facilities, trailers, signs, street or area lights, hunting stands, recreational facilities, satellite signal receiver systems, items within storage facilities, etc. Immovable Ground facilities Septic tanks and / or related drain fields, absorption pits, retention or detention ponds, wells, burial grounds, sports fields, tennis courts, underground vaults, and similar immovable in-ground or underground facilities will not be allowed within JEA s rights-orway or easements. Under very limited and controlled circumstances, immovable ground facilities such as: streets, roads, driveways, bike and hiking trails, water and sewer lines, ditches and other linear or spot located facilities may be considered, provided the following criteria are met: 1. Universal requirements (above) must be met. 2. Crossing facilities must cross the centerline of JEA s transmission rights-ofway at nearly right angles (ninety (90 degrees), or at angles of no less than forty-five (45) degrees and the nearest edges of crossing facilities shall be seventy-five (75) feet or more from any parts of JEA transmission support structures and twenty (20) feet from anchors, or other facilities. The clear area around structures shall be increased to a radius of one hundred fifty (150) feet for transmission towers (four legged structures) measured from the tower legs. 3. All underground facilities must be capable of bearing the weight of JEA s or JEA s approved contractors heaviest vehicles (at least 80,000 lbs.) Gross Vehicle Weight (GVW). 4. All third party underground facilities shall be marked with permanent above ground markers of a type suitable for the purpose and approved in writing by JEA.
11 5. Fire hydrants, utility pedestals, or any other above ground facilities shall not be allowed under or within fifteen (15) feet of being under any line conductor. 6. The cost of repair of any JEA facilities damaged during construction of owner or third party facilities is the responsibility of the owner or third party. 7. The cost of repairs / replacement of any sidewalks, bike trails, hiking trails, landscaping or any other facilities installed or constructed in JEA rights-ofway by a third party requestor that are damaged by JEA or its authorized contractors during maintenance, repair, mowing, tree trimming or any other authorized activity associated with the utilities in the rights-of-way shall be the sole responsibility of the party which filed the request for Use of JEA Real Property Application. Parallel Linear Facilities To a far greater extent than linear facility crossing, or spot located facilities, parallel linear facilities usurp significant portions of the usable capacity of transmission rights-ofway. Parallel joint use in a segment of right-of-way places a bottleneck in the entire right-of-way, not just the portion occupied. Facilities that run parallel to the centerlines of JEA transmission rights-of-ways or easements are therefore disfavored and will be considered only when the requirements and limitations listed below can be assured through a formal, binding, and legally enforceable agreement. 1. Universal requirements (above) must be met. 2. Applicant agrees to fund in advance the entire cost of the application and review process including an initial filing fee to be established by JEA. Applicant agrees to pay other fees and costs in advance that are assessed by JEA to cover its related costs. 3. Applicant agrees to compensate JEA for the full impact of the joint use upon JEA s land rights. Such impacts shall include but not be limited to: the value for the real property rights granted, damages to remaining company property rights, and a value for the prior assembly of the corridor that makes the proposed joint use feasible. 4. Applicant agrees to compensate for or mitigate JEA s increased liability exposure created by the proposed parallel joint use. 5. Applicant agrees to pay for any make ready work required to prepare the right-of-way for the proposed joint use, including but not limited to, relocation, removal, or alteration of existing JEA facilities. 6. Applicant agrees to pay for all present and estimated additional future costs incurred by JEA created by the proposed joint use. 7. All outstanding payments will be made in advance at the time of execution of the mutual use agreement unless otherwise agreed to in the agreement. 8. With the proposed joint use facilities in place, JEA shall continue to be able to use the right-of-way for its ultimate build-out capacity and to grant rights to other third parties.
12 9. All pipelines shall be installed along the outside edge of the right-of-way unless otherwise agreed to in the development of the mutual use agreement for the project. Snaking or weaving the construction of a piping system between any transmission / distribution structure to avoid natural or man made obstructions of any type shall not be allowed. 10. Any pipeline cathodic protection systems shall be designed such that no damage is done to any part of nearby JEA facilities. JEA facilities shall include but are not limited to: line structures, line structure foundations, grounding systems, anchors, and power line cathodic protection systems. If it is determined that the proposed parallel joint use can be accommodated, a mutual use agreement will be prepared by JEA Real Estate Services and Transmission Engineering. No work may commence on land controlled or owned by JEA until all parties have executed a final agreement. A minimum of four to six months may be required to review proposed parallel joint use projects. Parking Lots Parking facilities may be considered on JEA rights-of-way provided they are in compliance with all of the following requirements and restrictions: 1. Universal Requirements (above) must be met. 2. No parking or other obstruction at any time shall be allowed within a seventyfive foot radius of any transmission line pole or h-frame (two legged plane from structure) or within twenty (20) feet of any guy wire or anchor. For transmission line towers (four legged structures) the clear space shall be increased to radii of one hundred fifty (150) feet measured from each leg. 3. Finished grade of the parking surfaces shall be at the elevation of the area before construction or as approved in writing by JEA. 4. Lighting facilities design, layout, and elevations under or in close proximity to any JEA transmission or distribution conductors shall be approved in advance in writing by JEA. 5. Signs and other attachments to any JEA structures are prohibited unless a joint use agreement is developed and executed in advance by the joint user and JEA. 6. Runoff from parking lot drainage shall not be retained or detained within JEA rights-of-way. Existing wetlands on JEA rights-of-way shall not be enlarged, nor shall new wetlands be created, by parking lot construction. 7. Ingress and egress to, and access along, JEA rights-of way shall not be impeded by parking lot construction or operation. An unobstructed traveled way shall be maintained through, or shall bypass, parking areas for aroundthe-clock, all-weather access to all parts of the rights-of-way. The traveled way shall accommodate turning radii of large vehicles. Any paved areas or other construction where JEA or its authorized contractor vehicles will be required to operate shall accommodate large vehicles of at least eighty thousand (80,000) lbs. gross vehicle weight (GVW).
13 Excavating/Grading Excavating, grading, re-contouring, re-sloping, changing drainage patterns and similar activities on JEA rights-of way are prohibited without prior written approval from JEA Real Estate Services. Construction for approval of such activities must meet all of the following requirements: 1. Universal requirements (above) must be met. 2. Any activity that allows water to pond or to cause erosion around any transmission or distribution supporting structure (pole, tower, H-frame, etc.) or anchor is prohibited. 3. Grading within seventy-five (75) feet of any JEA transmission/distribution line pole or H-frame (two-legged structure) shall not be permitted. The grading restriction is extended to one hundred fifty (150) feet from transmission towers (four-legged structures). 4. Grading within twenty (20) feet of any JEA anchor shall not be permitted. 5. Slopes shall not exceed a one foot rise/fall in elevation over a four foot horizontal distance (4:1 slope) at any location on JEA rights-of-way. 6. No grading or excavation work shall be permitted by means of a dragline, cable type crane, or any other type of machine which is unsafe for working around energized high voltage power lines. 7. If required by a permitting authority, it is the applicant s responsibility to perform an endangered/threatened species study, prior to the alteration of the terrain on the JEA s rights-of-way. Conservation Easements or Other Types of Mitigation Conservation easements, wetland mitigation, tree mitigation, and/or wildlife mitigation credits are fundamentally inconsistent with the requirements for the construction, operations, and maintenance of high voltage electric power lines. Conservation easements will not be permitted in the right-of-way. Permitting JEA s approval of the applicant s use of JEA property does not relieve the applicant of obtaining additional approvals as may be required by other federal, state, or local authorities or requlatory agencies including but not limited to wetlands permitting and landscaping and tree ordinances. Expenses incurred by the applicant in meeting any of these requirements are the obligation of the applicant and not JEA. APPLICATION INSTRUCTIONS Applications and additional information may be obtained from JEA Real Estate Services, To avoid delays in the approval process, please complete all required sections and attach the following:
14 A. A general location map. Draw the location map on 8 ½ x 11 paper and make it detailed enough that someone unfamiliar with the area can find the project site. At minimum the map should include a north arrow, major roads, prominent landmarks, a reference to the nearest city or town, and detailed directions from the nearest major intersection to the project site. B. Tax identification map. C. Legal description of the impacted area. D. A detailed drawing and description of the proposed activity. The drawing must: 1. Be on standard sized paper (8 ½ x 11, 8 ½ x 14, 11 x 17, 18 x 24, 24 x 36, etc). 2. Be to scale. 3. Show and label existing and proposed vegetation by species and mature height. 4. Show existing utilities (underground and overhead) and improvements. All should be clearly labeled and dimensioned from the right of way. Include pipes, conduits, cables, manholes, valves, fire hydrants, poles, guys, etc. 5. Show all JEA structures (poles, guy wires, access roads, etc). 6. Label each JEA structure with its structure number. 7. Show the existing JEA right of way with dimension width. 8. Dimension the distance from the power line(s) to the edges of the right-of-way. 9. Show the applicant s name and daytime phone number. 10. Show one boxed note that includes the county, section, township, and range. 11. Show a north arrow. 12. Show the proposed project inside the right of way, clearly labeled, and dimensioned from the right of way. 13. Include anything else that will assist in processing the application. The description must clearly: 1. Describe the proposed project consistent with the project drawing. 2. Indicate Jack and Bores or Directional Bores with casing size, type, and depth. Also, cross-section of bore. 3. Describe method of installation of underground lines. 4. Describe pavement and/or driveway width, if applicable, showing existing and proposed elevations, contours, pavement grades, pavement material, typical pavement cross section, base and sub base material and depth. 5. Describe method of ground restoration (sod, seed, mulch). E. Easement Document, if the requester is the underlying property owner.
