The applicant shall acknowledge that Park Dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent Board Action. Board meetings are held on the third Thursday of each month. 2 RESOLUTON RESOLUTON NO CTY OF MAPLE GROVE GRANTNG FNAL PLAT FOR EAGLE LAKE SHORES THRD BE T RESOLVED, by the City Council of the City of Maple Grove, Minnesota, as follows: WHEREAS, Exemplar, nc., (hereinafter referred to as the "Applicant" or "Developer") has made application for final plat for the property legally describe as "Lots 3 and 4, Block 1, Eagle Lake Shores Second" (hereinafter referred to as the "Property"); and WHEREAS, the City Staff studied the matter, made a report, and provided other information to both the City Council and the Planning Commission; and WHEREAS, the City Council considered the matter at its meeting of September 8,2015, at which time the City Council received further information. NOW, THEREFORE, the City Council of the City of Maple Grove, makes the following: FNDNGS A. The Applicant is proposing to subdivide the Property into 3 single-family detached residential lots. B. The Applicant has submitted, for the City's review and approval, the final plat for Eagle Lake Shores Third drafted by Lot Surveys Company, which is on file with the City (hereinafter referred to as the "Final Plat"). C. The Property is zoned R-2, PUD Single-Family Residential. D. Minnesota Statues Section , grants the City, for the purpose of protecting and promoting the public health, safety and general welfare, the authority to adopt subdivision regulations providing for the orderly, economic and safe development ofland within the City. E. City Code Section 30-7 states: [With exceptions], no conveyance of land shall be filed or recorded if the land is described in the conveyance by metes and bounds, or by reference to an unapproved registered land survey made after April 21, 1961, or if the land is described by reference to an unapproved plat made after
3 February 25, 1954, unless the transaction has been reviewed pursuant to Minn. Stats , if required. F. The proposed subdivision of the Property is governed by City Code Chapter 30. G. The Plat meets the City Code requirements, provided it is subject to and meets the conditions set forth in this Resolution. NOW, THEREFORE, BE T RESOLVED by the City Council of the City of Maple Grove and based upon the information received and the above Findings: 1. That the City Council does hereby conditionally approve the Final Plat and the Mayor and City Clerk! Administrator are hereby authorized to execute the Final Plat, subject to the conditions set forth in Paragraph 2 below that must be met, to the satisfaction of the City, prior to release of the Final Plat, unless otherwise expressly stated. 2. The following conditions of approval must be met, to the satisfaction of the City, prior to release of the Final Plat, unless otherwise expressly stated: a. The approvals granted by this Resolution are subject to the completion of and compliance with all ministerial matters set forth in City Ordinance Code and required by the City, including, but not limited to, those of Engineering, Planning, Administrative and Legal Departments, e.g., title examination, execution of Developer's Agreement, filing of letters of credit, and payment of fees. City Code Section b. The conditions of City Resolution No must be met to the satisfaction of the City within the timeframes expressly set forth therein. c. The Property shall, at all times, be in compliance with all applicable local, state and federal rules and regulations. d. The Final Plat is are-plat of Lots 3 and 4 Eagle Lake Shores Second into three lots. Park dedication has been satisfied previously for two of the three lots. Based on the 1 new lot, the the Applicant's cash obligation for park dedication has been computed based upon the formula approved by City for use in the year Based on this formula the park dedication amount to be paid for the Final Plat is $3, n the event the City approves an amendment to the park dedication formula prior to release of the Final Plat, the above-referenced payment shall be adjusted based upon the computation formula approved by City in effect when the Final Plat is actually released for 2
4 filing with the Hennepin County Recorder or Registrar of Titles. The park dedication fee as set forth above shall be paid prior to the Final Plat being released for filing at the Hennepin County Government Center. e. The Applicant shall provide an updated and certified Abstract of Title and/or Registered Property Abstract as required by Minn. Stat. SOS.03. The City will not accept a Title Commitment and Title nsurance Policy in lieu of the title evidence requirement of Minn. Stat The above-mentioned evidence of title shall be subject to the review and approval of the City Attorney to determine what entities must execute the Final Plat and other documents to be recorded against the Property. Developer shall provide the City with evidence, which sufficiency shall be determined by the City, that all documents required to be recorded pursuant to this Resolution and by the City Attorney are recorded and all conditions for release of the Final Plat have been met prior to the City processing or approving any building permits or other permits applicable to the development of the Property. f. The Applicant shall pay upon demand all expenses, determined by the City, that the City incurs in relation to this development and Resolution, and shall provide an escrow deposit in an amount to be determined by the City. Said expenses shall include, but are not limited to, staff time, including, but not limited to, hourly wage, overhead and benefits, engineering, legal and other consulting fees incurred in relation to the development. g. The Final Plat must be filed and recorded with Hennepin County within two years of the date of this Resolution. f the Final Plat is not timely filed or recorded, this Resolution and all approval herein shall be void with no further action required by the City Council. 3

Maple Grove Maple Grove Parks and Recreation MEMORANDUM TO: FROM: Dick Edwards - Community Development Director Chuck Stifter - Superintendent of Parks and Planning DATE: August 21,2015 SUBJECT: Eagle Lake Shores Third Addition - Final Plat After reviewing the above-mentioned submittal, the Park & Recreation Board staff has the following comments: The Park Dedication ordinance applies to this subdivision which requires a land dedication or a cash equivalent per unit based on the current rate. Park dedication fees for a single-family residential subdivision are calculated by the unit. The single family rate for 2015 is $3993 per unit. Fees will apply to all platted lots in the subdivision. The Eagle Lake Shores Third Addition proposes to re-plat lots 3 and 4 of the Eagle Lake Shores Second Addition into three lots. Park dedication has been satisfied for two of the three lots. Based on the proposed 1 new lot the park dedication requirements calculate as: 1 units x $3993 = $3993 Eagle Lake Shores Addition is located within the city's Park Service Area 25. Residents of this subdivision are served by the Maple Grove Junior High Community Playfields. General The recommendations above are that of the Parks and Recreation staff. Final park dedication requirements are acted on by the Parks and Recreation Board at their regularly scheduled monthly meetings. Applicants may pay the park dedicationfee at any time after the final plat has been approved by the City Council and Park Board but it must be paid before the plat is released by the City forfiling. Park dedication rates are reviewed annually in February by the City Council. The rate is applied at the time the plat is released to the County forfiling.
