CHA is responsible for the application being completed. In this case, the residents did not get an opportunity to vote on whether or not to submit the application. You may also see a gradual rent increase, phased in over 5 years, if you currently pay flat rent and this building converts to RAD. An HCV voucher would allow you to pick the unit of your choice, based on certain standards, and you would continue to receive rental assistance. You have to live in the building for 1 or 2 years. Then you go through the paperwork process. You would be responsible for moving expenses. As long as a voucher is available, you are able to bypass the wait list. With RAD there would be no flat rate rent? What does that mean? All rents would be calculated to be 30% of income. Flat rent would cease to exist. RAD is not going to be in force until 2014? If we apply before the end of 2013, we are able to lock in 2012 funding levels. We want to move quickly to take advantage of this opportunity. We do not know what will be available in the future. Not until your next recertification. We must submit an application. The application will be reviewed by HUD. We have already included this building in our count. Currently, you must report the increase immediately in accordance with the ACOP. As a part of RAD, you do not need to report until your next recertification. We are not planning any changes to our wait list procedures. However, if your building becomes a RAD property, it is possible for you to obtain a HCV voucher for use in the private market. You have to live at the building for 1 2 years before you can request a voucher. We will review this further to see if there is a penalty. Do you have to be on the HCV wait list for this? Once we receive RAD, will we be able to take our voucher somewhere out of town? How much would you have to pay? Is RAD coming? No. With the right paperwork, and pending the availability of a voucher in the jurisdiction of your choice, as long as the unit/landlord are eligible, the voucher can be used anywhere. If we use a voucher to get another unit, would our maximum rent stay the same? HUD has a standard called fair market rent, used to determine the maximum allowed for the unit. Will we still be able to use LIHEAP to pay for gas? Yes. LIHEAP would still be a available if you qualify. When will I be able to get a HCV? Through RAD, you would not be able to get a voucher until you have lived in the building for 1 or 2 years before being eligible. We found a place. Can I get a voucher? Under RAD, you would be eligible for a voucher after living in the building for 1 or 2 years. 5

6 What happens if rent goes down? Must I still wait 2 years? No. You may request an interim re exam for a rent adjustment. If I want to move to another state, is that possible? If we do RAD here, and you are eligible for a voucher, that voucher can be used throughout the United States. I noticed that you said you had vouchers. Is there a waiting period once you apply before you are called? Generally, the only waiting period is one to two years of living at the property N I would benefit from the RAD program. What if I lose my part time job in between recertifications? What happens to my rent? 40 years is a good amount of time, after which we will likely need to re evaluate all the building systems. The cost of laundry has not changed. That is a possibility, but that would put them in default. Historically, however, RAD would be a much more stable contract. HUD has long term contracts with many parties, and historically, those contracts are honored. Interim recertifications can be scheduled to adjust rent downward in between regular recertifications N How many properties does CHA own? How many do you want in RAD? We have about 20,000 units. We plan for 10,900 to be a part of our RAD application N If the budget changed from 82% to 77%, how come this wasn t in place before? This is a new program. By applying for this program, we can lock in funding N Are there other considerations down the road that might also impact policy decisions, such as a new CEO? Our CEO has submitted his resignation, and a new CEO has been nominated. Our plans with RAD and this building are scheduled to continue. RAD has the full support of our administration. However, there is only authorization for 60,000 units, so we want to apply prior to all other units being authorized N As it relates to the number of available units, are there 60,000 for Chicago or the country? There 60,000 units available nationwide N Are we allowed to apply for HCV now? Our current HCV wait list is closed, and we are still under PH rules, so we don't currently have a mechanism that can get you a voucher N In between recertifications, if you get a temporary job, will that be counted towards rent? In RAD, the change in your rent doesn't begin until the next time you go in for recertification. Things will stay the same for market rate tenants. You have to qualify for tax credit at this location, and you must reapply to the wait list. In general, there is no time limit to HCV. However, we do not know what rules will exist in the future. This building was developed meeting the Section 3 requirements. This does not change due to RAD. Holsten will continue to own the property and have on site property management. CHA will continue to fund the low income units. CHA is required to fund a tenant council with a certain amount of money. We will continue that funding under RAD. If funds are being cut, where is the money coming from to fund Housing Choice Vouchers? If there is a 2 Year recertification under the RAD program, is there still an annual certification under the Low Income Housing Tax Credit Program? I am a "Right to Return" resident. How does RAD affect me? Do I qualify to receive a Housing Choice Voucher? After 12 months of being under the RAD program and being lease compliant, a resident can request HCV. Income is captured during recertification and previous income would not be counted. No relocation services will not be provided by CHA. I have been without a screen door for 3 years. I am not familiar with any plans to phase out Section 8. Of course, anything is possible. However, historically, Section 8 is well funded. Under the RAD Program the Public Housing units would be converted to RAD, which is technically a type of voucher. This gives you the option to take your voucher with you after 1 2 years in the program. Please visit the management office, where you can be specifically told if you receive Section 8. We will be reviewing our capital improvement budget to make as many repairs as possible. When would the program go into effect? The application takes about 12 months. We would hope to implement in E. 43rd Street Would this program apply to market rate units? No; only public housing tenants would be impacted. 454 E. 43rd Street Does this apply to me? 10 Do we have a choice to be in RAD or not? You have the choice to stay with the RAD program or accept a voucher and relocate with your voucher. In regards to recertification, if your income increases do they retro your rent? No, rent will not be retroactive due to increases in income. If your are in a 3bdr paying $1000 and switch to a 1bdr, do you still pay $1000? Regardless of the size of the apartment, resident will pay at 30% of their income. Rent is dictated by income percentage and not unit size. Do you have to move? You have the choice to stay with the RAD program or accept a voucher and relocate with your voucher. Explain 12 months to receive a voucher. You have the choice to stay with the RAD program or accept a voucher and relocate with your voucher 12 months after the property converts to RAD. Is this for people already in the CHA units? Are they the only ones with this option is for? This program applies only to CHA residents residing in public housing units. Can you take a voucher and move to a non RAD unit or site? Yes. If you have a voucher, would your rent still be 30% of your income or increase to 40%? Under RAD, rent would be no more than 30% annual adjusted income. I like the option of having a voucher. What happens if I want to get into a Home Ownership Program while I am in RAD? Would that stop me? No, RAD would not interfere with the Home Ownership Program. However, should the property convert to the RAD program, as long as a resident remains in that unit, resident would be under RAD. Resident can still work on plan for home ownership while in RAD. Further, CHA will provide information in the future on how RAD will integrate with current programs offered by CHA. If there are only 60,000 units nationwide, how many does CHA get? CHA is looking at this time to apply for 10,000. Any increase would be subject to federal approval. Is the voucher included? After being under the RAD program for 12 months, residents will have the option to accept a voucher. I think that RAD will be good for the property. Thank you for your comment. My concern is that only 10,000 units will be under the RAD program, will the number of RAD units applied for include the Voucher program? West End What is the take away from this? What does this give? West End Will market rate residents be asked to pay more for their rent? 10 No, this doesn't concern the voucher program. The RAD program is only for the selected public housing units. If the number does increase, that would be a second round process. RAD will help stabilize the property financially for the next 40 years. It will also provide our residents the opportunity move, if they chose, under the HCV umbrella. RAD applies only to PH residents. For those residents, rent remains 30% of income. RAD will stabilize the property, which benefits all residents. A switch to RAD is not going to lead to a rent increase for market rate tenants.

11 Jan 14 Jan 14 Jan 14 Jan 14 Feb 14 Feb 14 In HUD s RAD Program Update presentation dated December 31, 2013, there were five objectives listed. Which of these, if any, apply to senior housing? Why is CHA targeting the senior buildings for RAD and why not Lathrop or some of the other CHA sites? In the same December 31, 2013 presentation by HUD, it mentions the top 10 applicants by PHA and it states that there are 10,935 units. How is CHA placing us in the top 10? Is CHA basing it on the amount of units it has or the upkeep of the buildings? I live on the north side and a lot of work has been done but we seem to have been targeted first for the RAD Program, so one of my questions is how are you basing the top ten? In the HUD RAD update presentation, the indicated public housing objectives on page 15, Modernizing aging family & elderly properties, I noticed CHA is working on the senior buildings, but we re not the only public housing development. It seems as though RAD is targeting senior buildings. The seniors have enough to worry about with the social security and pension. I am a retiree from the City and I have only been in the senior building for two years, so I am concerned about modernizing the senior buildings and then turning it over to RAD, so what is CHA s proposal on that? {Referencing the five PHA objectives from the HUD presentation } When HUD says portfolio streamlining, what does that mean? RAD is a new HUD program that helps improve and stabilize the funding that CHA receives from HUD to operate its properties. The properties included in CHA s RAD application were selected based on their characteristics to readily benefit from the more secure financing stream and to meet program deadlines. Of the PHAs around the country that have applied to HUD for RAD, CHA s application represents the most in terms of total number of units. RAD includes several important protections for current residents. The transition to RAD does not change how tenant rent will be charged tenants will still be responsible for paying 30% of their income towards rent. CHA s RAD application is based on the objective to stabilize and improve the funding received to operate its properties. Some housing authorities (PHAs) may have noted other objectives to HUD such as portfolio streamlining but CHA is seeking to maintain a consistent funding stream to service properties. I am from Lincoln Perry and I want to speak about RAD. The statutes and regulations governing the RAD initiative state that a PHA that converts public housing units to project based units must allow any public housing resident who desires to remain in a public housing unit to be transferred to a comparable PHA public housing unit before RAD conversion, CHA will comply with all of the requirements of the RAD program. or shortly after. Will the agree to adopt a resolution requiring staff to notify all CHA residents of a building targeted for RAD conversion, with a minimum of 90 days notice before conversion from public housing to projectbased Section 8 and allow for a period of transfer of no less than 90 days after the conversion? I am the Senior Housing South LAC President. The CHA has proposed to convert all senior buildings from public housing to project based Section 8 under the new HUD initiative. Why did CHA make this decision, since none of the senior buildings suffer from poor maintenance or are in need of demolition? 11 RAD is a new HUD program that helps improve and stabilize the funding that CHA receives from HUD to operate its properties. A variety of properties, including senior and mixed income properties were proposed for the RAD program. These properties were identified as properties that would readily benefit from a more consistent funding stream.

12 Feb 14 Feb 14 I am a resident of Lincoln Perry. The public housing ACC for all senior buildings was extended for an additional 20 years, from the date of completion of rehab. Given the extensive capital renovation work at various CHA senior buildings, the public housing ACC, per the US Housing Act, will be extended again for an additional 20 years, from the date that renovation is completed. Given this fact, why is there the need to convert CHA senior housing to project based Section 8 under RAD, since the operating budget will be available for an additional 20 years under the extended ACC? The need for capital funding for these buildings will be greatly diminished going forward. 1) CHA has verbally communicated that it will provide the same lease and same grievance protections available under the public housing regulations, but it is not required to do so under RAD. Will the of Commissioners agree to adopt resolutions that will require CHA staff to provide the same lease, ACOP and grievance protections, to include properties which are converted to RAD? 2) Will CHA adopt and comply with all 24 CFR part 964 regulations governing PHA resident councils including continued funding of all CHA housing LAC. Can we agree on that? 3) Why are the senior buildings being targeted? They live their life. They choose CHA, they didn t choose RAD. Where are the seniors supposed to go? RAD would provide a more consistent funding stream for selected properties. Senior properties, in addition to other properties within CHA s portfolio were selected as properties that would readily benefit from the more consistent longterm funding stream. 1) CHA will comply with all of the requirements of the RAD program, including all applicable resident protection policies. Additionally, the CHA will continue the public comment and Board approval process for the rules and lease, as is done currently under public housing. 2) Existing resident councils will continue at RAD properties, as they do currently under public housing. 3) A variety of properties, including senior and mixed income properties, were proposed for the RAD program. Tenant rents at RAD properties continue to be based on 30% of household income. No existing resident is required to move as a result of RAD. Feb 14 Will the adopt a resolution requiring that all CHA public housing sites and/or CHA buildings be converted to project based Section 8 under the RAD initiative, remain owned and operated by CHA for the remainder of the RAD Program? The current application for RAD units does not result in any changes in ownership. 12

The stated purpose of CHA s multi year Plan for Transformation was to address years of deferred maintenance. CHA staff claims that the program has been a In CHA s portfolio application, a mix of family and senior properties was proposed success and that the properties have been either for RAD. The first round of properties were selected based its characteristics to rehabilitated, or demolished and have been replaced with readily benefit from a more consistent funding stream. It is likely that the second new public housing units at the CHA mixed finance sites, (e.g. RAD phase will include a mix of properties that require rehabilitation and/or Oakwood Shores, Roosevelt Square, etc.). If true, then why [is addressing other deferred maintenance needs. there a] need for CHA to participate in the RAD program at the CHA senior buildings, and the new mixed finance sites? There should not be any deferred maintenance issues at any of these sites, so why the need for RAD at these properties? Mar 14 E mail/ Fax Correspondence The Final HUD Notice issued in July of this year states that once a PHA is accepted for participation in the RAD program, the properties accepted for RAD participation will no longer be eligible for HUD operating [nor] capital funding; and that the PHA s operating and capital subsidy will be reduced pro rata based on the removal of those units from the public housing inventory. Therefore, if, as CHA staff indicated, that the goal is to remove all CHA units, that will mean the reduction of CHA capital funding for the remaining public housing units by that amount, about a 2/5 reduction. RAD funding replaces public housing capital and operating subsidy with equivalent dollars. Tenants contribution towards rent will remain at 30% of their annual income. A benefit of RAD, which is not accessible under the Public Housing program, is the ability to leverage additional funding to invest in properties as needed. The RAD program helps preserve the long term affordability and maintenance of the property. Mar 14 E mail/ Fax Correspondence The HUD RAD Notice, and the statute, require that the PHA allow residents to organize and for a residents organization and require that the PHA provide funding at a $25 per unit rate. If the mixed finance units listed by CHA for RAD participation are accepted by HUD, this would mean that the residents in those units will have resident organization rights that the CHA currently denies to residents in other CHA mixed finance sites because of the MTW waiver of Part 964. Will CHA rescind its waiver request of 24 CFR Part 964 for all mixed finance units and allow full residents participation under Part 964 at those locations? Will CHA include the RAD tenant organizations in a comprehensive multi year CAC Funding Agreement? The HUD RAD Notice allows PHAs to charge a fee for the use of space by resident organizations formed at RAD properties. Will CHA provide space for RAD tenant organizations, and allow use of that space without a fee? For properties that are currently represented by Local Advisory Councils (LACs), the Central Advisory Council (CAC), and the Senior Housing Advisory Council (SHAC), CHA will continue to recognize and fund (per the RAD regulations) these organizations. CHA is not planning to rescind its waiver of 24 CFR part 964 for mixed finance units. CHA will continue to provide tenant organizations formed at RAD properties with appropriate office space at no cost to the tenant organization. 13

Prior to The HUD RAD Notice requires written notice to tenants in PHA submitting the portfolio application to HUD in October, CHA provided notice and moderate rehabilitation units being converted to RAD. The HUD RAD Notice provides for payment for vacant units at RAD properties under certain conditions. If vacancies at some CHA senior buildings continue in a manner it has for several years, what are the options for those properties if the income is not sufficient to meet the operating costs, given these will no longer be public housing units with possible access to other CHA funds (e.g. CHA reserves) to cover those shortfalls? I have reviewed budget documents on the HUD website and could not find any documents stating or suggesting that buildings that are converted to project based Section 8 under RAD will have a more stable funding source than the traditional PHA operating and PHA capital programs. All these programs (the operating budgets, the capital budgets and the project based budgets) are all subject to annual appropriations by the U.S.. If anything, the recent shortfalls in the Section 8 Voucher program nationally, could put RAD funding at risk if the national PHA project based budgets are reduced in the future. Further, the senior buildings now undergoing capital improvements will have the ACC extended for an additional lengthy period (per the Housing Act) dating from the completion of the capital work.) It is more accurate to state that all three programs will have stable funding sources, subject to annual appropriations from. CHA s occupancy rates in the properties proposed for RAD have been around 98% for several years. While CHA expects to maintain these occupancy levels for the foreseeable future, CHA has determined that the property income under RAD will be more than sufficient to meet current and projected operating expenses, even at a 6% vacancy rate. Per RAD guidelines, a vacancy payment will be made during a 60 day lease up period and is adjusted per certain conditions if the vacancy extends beyond 60 days. The terms for receiving vacancy payments beyond the 60 day window are contingent upon certain conditions. The conditions, terms and sources of payment will be evaluated on a case by case basis as the need arises. With the exception of 2010 and 2011, which were stimulus funding years, on a percentage basis, CHA s funding for HCV (Section 8) has outpaced the funding for public housing (under Section 9) for the last seven years ( ). The percentage funded comparison between the two programs is based on the actual proration percentages provided by HUD. While both programs are subject to annual ional appropriations, the recent history of receipts has indicated that the Section 8 program has a stronger likelihood of being fully funded by than does the operating and capital budgets under the Section 9/Public Housing program. Additionally, the ability to leverage additional funding to invest in properties as needed is a substantial benefit under RAD to preserve both the long term affordability and maintenance of the property. The HUD budget contains the budget allocation/authority for all of its programs nationwide. The HUD budget alone is not an applicable representation of the funding allocation and trending for the CHA. 14

15 Mar 14 E mail/ Fax Correspondence The CHA RAD Questions and Answers also states that CHA will continue to recognize and fund LACs and their representatives in buildings converted from public housing to project based under the RAD initiative. It is unclear, from the statutory language about tenant organizations under the RAD initiative, how CHA will be able to fund tenant organizations in these As stated in the RAD Notice, PHAs are required to recognize and fund legitimate buildings since 24 CFR Part 245 will apply in place of the 24 resident organizations. My research of HUD regulations at Part 245, and RAD other resident protections. provisions, has not disclosed any language that allows a PHA to fund tenant organizations (and or representatives of tenant organizations) formed under Part 245. Has or will CHA obtain a waiver to allow this? If so, that should also be explained to clarify this point about tenant organizations formed (or already in existence) in buildings converted to RAD. SHAC If our application is accepted by HUD, will we take vouchers from our existing tenant based vouchers and move them to project based? SHAC If so, what is the potential impact on families? SHAC SHAC SHAC SHAC SHAC Do we anticipate any problems with obtaining adequate Administrative fees for the operation of the program? It is important to determine what position SHAC will take if RAD is approved; CHA residents are not being asked for input; residents should get together and determine a strategy I would like some basic information about RAD; the message to the residents is your voice is not important Do we have assurances that if RAD application is accepted, that CHA will continue to house low income seniors in the buildings? We need bullet points to send a petition to stop RAD to our Alderman; Mr. Whitfield had promised this but has not yet provided them. Why is everyone so anxious to make the conversion to RAD don t the staff realize they will all lose their jobs?! No. The RAD funding provided to these properties in the form of vouchers will not be taken from the existing allocation of tenant based vouchers. There will be no impact on families. The new RAD funding is established to replace at an equivalent level the current funding received through the public housing funding formula. No. We do not anticipate any problems with obtaining adequate Administrative fees for the operation of the program. CHA held dozens of meetings with residents prior to the submission of the application in October, and will continue to meet with residents to seek their input and questions. Information about RAD is located on the CHA webpage at Yes. RAD requires that CHA continue to house the same population of low income seniors at the properties. Properties that move to the RAD funding contracts will continue to have on site property management, just like there is today. 15

16 The CHA originally indicated that senior residents who did not want to remain in a CHA building targeted for RAD conversion could transfer to another public housing unit but that request must be made before the conversion to RAD. The CAC distributed information from the HUD website that indicates public housing residents can request a transfer before the conversion and for a reasonable period after the conversion to RAD. It is requested that the establish a specific period after conversion from public housing to RAD to request a transfer to another public housing unit. I am the President of Senior Housing North. Information on the HUD website including the HUD notice on RAD provides that if a PHA converts public housing units to assistance under RAD, the PHA must recognize legitimate resident organizations. The HUD notice refers to the resident participation provisions at 24 CFR Part 245. These provisions apply to multifamily projects that are funded thought HUD assistance, and are not the same as the resident participation provisions applicable to resident councils at 24 CFR Part 964. Nothing in the HUD notice and or information on the HUD website about the RAD initiative requires a PHA to recognize and continue funding an existing resident council under the same Part 964 provisions after the property is converted from public housing to assistance under RAD. The regulations under 24 CFR Part 245 do not require a PHA to provide permanent office space for a tenant organization, and is silent about stipends paid to officers of the resident organization recognized under a RAD conversion. It is requested that the commit to a policy that will continue recognition of existing senior housing resident councils as legitimate resident organizations as defined under 24 CFR ; and also commit to continuing the provision of office space and current level of funding, and payment of stipends that exists under 24 CFR Part 964, and that these provisions be included in the new CAC funding agreement to be approved by the. CHA seniors question whether we can transfer? If all CHA senior buildings will be converted to RAD, many seniors are not willing to move to public housing units in CHA family buildings and do not want the option of receiving a voucher. It is therefore requested that the limit the number of CHA senior buildings to be converted from public housing to RAD and that staff be directed to meet with resident councils on this issue as soon as possible and promptly submit recommendation to the CAC Board. 16 Yes, a resident in a property transitioning to RAD may request to be transferred to an available public housing unit prior to the transition. The CHA will establish a reasonable timetable for a transfer request, which will be outlined in draft policy plans that will be submitted for public comment prior to Board approval. Under RAD, Public Housing Authorities (PHAs) have the option of transitioning RAD projects under Project Based Voucher (PBV) rules or under Project Based Rental Assistance (PBRA) rules. The CHA has selected to operate RAD properties under PBV rules. RAD PBVs are not explicitly governed by CFR Part 245 or CFR Part 964. (It is only the election of PBRA that PHAs have to adhere to CFR Part 245.) While the RAD notice provides guidance regarding how resident organizations would be recognized under RAD PBV, it does not specifically cite that CFR Part 245 applies. Therefore, CHA intends to uphold key provisions from CFR Part 964 that will allow resident organizations to continue operations as it currently does under public housing. No resident is required to move as a result of the RAD transition. The RAD program brings 2 new options for residents to move if they choose. Residents may request to move to an available public housing unit and/or request a tenantbased voucher. The CHA encourages residents to stay.

17 May 14 Jun 14 My concern is transparency. The information on the HUD website indicates that the consultation process related to RAD conversion must include meetings with residents and an opportunity for resident comments. The CHA staff indicated that initial meetings at some CHA buildings were recorded but that none of the three meetings at SHAC were recorded. It is requested that CHA view and record the comments from the second SHAC meeting that happened on Nov. 5 and that CHA prepare responses to the comments made at the meeting. It is also requested that all future meetings on RAD be recorded by CHA and that all comments be recorded and responded to, in writing. The HUD notice on the RAD initiative and the RAD information on the HUD website do not appear to prevent the subsequent sale or transfer of property converted to RAD. It is requested that the approved RAD policy include a provision that CHA will retain ownership of any currently owned CHA public housing properties converted to RAD for the duration of the assistance provided under RAD. SHAC will be meeting with CHA, and will convene additional meetings with the CAC at various CHA senior buildings, and will be forwarding additional comments and questions. Line 7 on one of your handouts states you will maintain buildings under RAD. One of the speakers prior to me mentioned the seniors who will follow us. The one issue I do not see addressed, what will be the status of the buildings that participate in RAD after 30 years? Will they not have money for administrative costs, which happened in Atlanta? Will the City be forced to sell them? When the government says 30 years, they mean 30 years. Where will the money come from to maintain the buildings after 30 years? I think you should all look at RAD. The scattered sites and traditional housing has a higher percentage of residents who are getting out of subsidized housing. It seems confusing that you want to go to the voucher system, which has a lower percentage of residents who are getting off housing assistance. Prior to submitting the portfolio application to HUD in October, CHA held two meetings in each proposed Phase 1 RAD property to discuss resident impact. After notification of a RAD award, CHA will hold another meeting to discuss the transition with affected households. The CHA will repeat this process for subsequent RAD phases and participate in ongoing communications regarding RAD with residents and stakeholders. On CHA s webpage there are responses to questions about RAD received at resident meetings, Board meetings, SHAC meetings, and via /fax. All RADrelated questions and responses can be found at The CHA will update the webpage monthly to record new questions and responses. The CHA will amend the MTW Annual Plan and the Administrative Plan to reflect that CHA will retain ownership or control of all RAD properties. CHA has applied for RAD to secure financial stability for a period of 40 years. This time period gives CHA the maximum window to stabilize funding for units within the program and leverage other financing (as needed) to preserve buildings longterm. At the appropriate time, CHA will discuss with HUD options for extended preservation of units. Thank you for your suggestion.
