OHCD is responsible for the data coordination, program and policy compliance and support that benefit low- to moderate-income residents and is structured into four divisions: Administrative, Community Development, Existing Housing, and Grants Management. ADMINISTRATIVE DIVISION: Responsible for the accounting, clerical, and technology support services for the department. COMMUNITY DEVELOPMENT DIVISION: Provides coordination and construction management for rehabilitation and new construction projects for County owned facilities, technical assistance with Fair Housing inquiries, funding and exemptions to housing projects. GRANTS MANAGEMENT DIVISION: Responsible for the administration of the Community Development Block Grant (CDBG), HOME Investment Partnerships Program, Neighborhood Stabilization Program (NSP), Special Purpose Grant, Housing Preservation Grant, Workforce Investment Act (WIA) Grant, and other programs. KAMAKOA NUI WORKFORCE HOUSING OVERVIEW The information contained in this packet is designed to provide the applicant with a general overview of the eligibility requirements, application, sales and closing processes for the Kamakoa Nui Community. Further details specific to each process will be provided by the Community Sales Staff. As part of the OHCD s workforce housing program, all purchasers must (1) meet all the eligibility and income requirements and (2) accept the (a) Use, Sale and Transfer (Buyback) and (b) Shared Equity Program (SEP) restrictions. Other conditions may be required by the lenders as part of this development. A1. DEFINITIONS / COMMONLY USED TERMS Commonly Used Terms Applicant Buyback Program TEN (10) YEAR RESTRICTION ON USE, SALE AND TRANSFER Co-applicant County Eligible Purchaser Family Gross Monthly Income Household Composition/ Household Size 8 Definition / Description Primary person applying to purchase a property. If applying with a spouse, co-applicant and coapplicant spouse, collective reference to include all members purchasing a property. From the date of recordation, for a period of 10-years: 1. Purchaser shall occupy, establish, and use the property as a primary residence at all times; 2. The County has the first-right-of-refusal to repurchase the property if the homeowner, under extenuating circumstances, cannot be an owner occupant as required, has the need to sell, and/or transfer the property. In the event the County exercises its option to repurchase the property from the homeowner, the repurchase price shall not exceed the sum of: (a) The original purchase price and certain original closing costs; plus (b) The cost of any capital improvements added by the purchaser; plus (c) Simple interest on the original purchase price, certain original closing costs and capital improvements at the rate of one (1) percent per year. 3. Future refinancing of the property during the buyback period is limited where additional financing cannot exceed the above repurchase price. NOTE: Prior to contract signing, a full disclosure of the program will be provided for review and acceptance. A co-applicant, is 18-years or older, can be a spouse, and will reside in the unit. If there is more than one co-applicant, complete additional forms as needed. Submit all co-applicant forms, appropriate documentation with the primary applicant s forms. The County of Hawai i, or the Office of Housing and Community Development as its representative. Applicant who meets OHCD s eligibility & income requirements based on OHCD s review of the application and required supporting documentation. (1) Two or more persons who live or intend to live together as a unit and whose income and resources are available to meet the family s need and who may, but need not be, related by blood, marriage, or operation of law, including foster children and hanai children and whose head of household has reached the age of majority, or is otherwise legally emancipated; (2) A person who is pregnant or in the process of securing legal custody of a minor child or children, and who has reached the age of majority or is otherwise emancipated. (Ch , HAR) The total amount of income for one month before deductions of taxes, social security, savings plans, child support, etc. Income to include earnings from part-time jobs, tips, cost of living allowance (COLA), basic allowance for housing (BAH), dividends, interest, royalties, pensions or annuity distribution, Veterans Administration (VA) compensation, sick pay, income from trusts, contributions to deferred compensation plan, and other income from sources such as welfare benefits, workers compensation, aid to families with dependent children, public assistance, tax exempt interest income. Refer to Family. Person(s) who are residing or intending to reside together as a unit at the property purchased.
9 Household Income Limit The maximum income allowed per household according to the total household size. Refer to the table below for the appropriate income limits for Limits are subject to change. If applications are found listing the same household members, such applications will be rejected. Dependents claimed on applicant s Hawai i Resident Income Tax Returns, which are qualifying children and qualifying relatives. Applicant(s) must be a resident of the State of Hawai i and must be paying Hawai i Resident Income Tax at the time of application. Proof of residency will be determined by Hawai i State income tax return filing and tax withholdings. If spouse is not a resident of Hawai i, spouse must complete the application, but will not be eligible to purchase a unit. Upon request by OHCD, applicant and spouse must submit verification as confirmation. Family members who are related by blood, marriage, or operation of law and/or legal custody who are currently living with or intend to live as a unit in the dwelling purchased, but do not qualify as a Legal Dependent. The Preferred Family size provided by Section , Hawai i Administrative Rules, as follows: DWELLING UNIT SIZE PREFERRED FAMILY SIZE 2 bedroom 3 persons 3 bedroom 4 persons A person who is: (1) a citizen of the United States or a permanent resident alien; (2) at least eighteen years of age; (3) a legal resident of the State of Hawai i who physically resides in the State of Hawai i and shall physically reside in the unit purchased; (4) proof of residency will be determined by Hawai i State Income Tax Filing and Tax Withholding; (5) does not by himself/herself, his/her spouse or together with a spouse (unless separated and living apart under a decree from a court of competent jurisdiction) own a majority interest (more than fifty percent 50%) in fee simple and/or leasehold, any real estate property anywhere in the world, that is suitable for dwelling purposes including homes, condominiums, cooperatives, etc.; including a majority interest in lands under any trust agreement or other fiduciary arrangement in which another person holds legal title to such land; (5) has sufficient gross income to qualify for the loan required to finance the purchase. Applicant and spouse (and Co-Applicant and Co-Applicant Spouse), individually or together cannot own more than fifty percent (50%) in any fee simple and/or leasehold property(ies). Ownership by parties on the application of more than fifty percent (50%) interest in any real estate property suitable for dwelling purpose anywhere in the world, including property held in a trust agreement, will disqualify an application. Ownership of such real property by a spouse even if spouse is not on the application (unless separated and living apart under a decree from a court or competent jurisdiction), will disqualify an applicant or co-applicant. From the date of recordation, for a period of 15-years: 1. Purchaser shall occupy, establish, and use the property as a primary residence at all times; 2. If the purchaser wishes to sell or transfer title to the property, the County is entitled to receive a percentage of the sales proceeds. NOTE: Prior to contract signing, a full disclosure of the program will be provided for review and acceptance. 9
10 Total Household Income Total Household Size The sum of the gross monthly income received from all household members 18 years and older who intend to reside in the property. Refer to Gross Monthly Income above. Household income will be based on the information submitted at the time of application. Subsequent income increase or decrease will not change applicant s income eligibility, except in the case of a change in the household composition that occurs prior to closing. THE TOTAL HOUSEHOLD INCOME MUST NOT EXCEED THE HOUSEHOLD INCOME LIMIT ESTABLISHED FOR THE PROJECT. Refer to Household Income Limit above. The sum of all household members listed on the application and co-application, if any, who live or intend to live as a unit in the property purchased. Applicant is responsible to notify the sales agent of any changes to household size prior to closing. A2. ELIGIBILITY REQUIREMENTS In order to be eligible to purchase real property, all Applicant(s) must meet all of OHCD s eligibility and income requirements, at time of application. These requirements must be maintained until the recordation of the sale of the property, except in the case of income which is determined at time of application only, unless a change in household size occurs. Applicant will be required to sign an acknowledgement of continued eligibility as part of the sales contract and closing process. EACH APPLICANT MUST MEET THE FOLLOWING REQUIREMENTS: a. Be a qualified resident as defined in Section A1 Qualified Resident. b. Applicant s total household income cannot exceed the maximum income limit according to total household size, as established in Section A1 Household Income Limit. c. Work within a 45 mile radius from community. d. Applicant, Co-Applicant, or spouses must not own or have owned a home within three (3) years prior of submitting an application. Applicants who meet the above requirements as determined by OHCD will be deemed an eligible purchaser as defined in Section A1 Eligible Purchaser. NOTE: If applying with a person who does not meet all of the OHCD requirements, only the eligible applicant will be able to purchase a home and hold title to the home purchased. An ineligible person will not be able to purchase or hold title. A3. APPLICATION TO PURCHASE PROCESS a. Application Review All completed applications must be submitted to the community sales agent with all the required documents and applicable forms. 10
11 Upon preliminary review and processing of the applications received by the Community Sales Staff, the applications will be transmitted to OHCD for review and determination of eligibility to purchase a home. b. Notice of Approval/Disapproval Applicant will be notified of their application status in writing or electronically, at the end of the application review period. If approved, applicant will be deemed an eligible purchaser. If disapproved, applicant will be deemed ineligible to purchase and reasons for ineligibility will be provided. If applicant disagrees with OHCD determination of ineligibility, applicant shall submit a request for reconsideration in writing and include supporting documentation to support its position of eligibility. If OHCD determines an application to be incomplete, OHCD will request additional information from the applicant, through the Community Sales Staff. Applicant is encouraged to cooperate with the Community Sales Staff and provide requested documentation for OHCD to complete its review of the application. Otherwise, the application will be disapproved due to incompleteness. B1. Property Selection B. SELECTION PROCESS Property Selection will be on a first come, first serve basis, with priority going to those who have been deemed eligible by the Community Sales Staff and OHCD through the application process. B2. Phase of Homes Release Community Sales Staff will notify qualified applicants of the Phase of Homes Release date, time and process. B3. Project Status For periodic project updates, contact the Community Sales Staff at (808) C1. Pre-Contract Signing C. PURCHASE CONTRACT Eligible purchasers will be notified by the Community Sales Staff of the contract signing date and the requirements to sign the sales contract, such as a mortgage pre-approval letter and Earnest Money Deposit. 11
12 C2. Contract Signing The Community Sales Staff will orient the buyer(s) with the Deposit Receipt and Sales Contract document and review the terms and conditions under which the property is being sold. Failure to comply with the terms and conditions of the sales contract may result in default and cancellation fees. a. OHCD Affordable & Workforce Housing Program As part of OHCD s workforce housing program, OHCD imposes 2 separate restrictions on all property developed or sold under Chap 201H, HRS. These restrictions will encumber the property as deed restrictions. Prior to signing the sales contract, a full disclosure of the two programs will be provided to buyers as part of the sales contract. Homes at Kamakoa Nui must be occupied by the owner. Only in extenuating circumstances, where owner cannot be the occupant, shall these restrictions apply. Brief hi-lites of the programs are listed below. i. Buyback: o From the recording date for a period of 10-years, owner must be an owneroccupant. o OHCD consent is required under certain conditions. o There are certain limitations under the buyback program. o Buyback restriction automatically expires after 10 years. o OHCD has the first-right of refusal to repurchase the unit, if owner cannot be an owner occupant as required. ii. Shared Equity (SEP): o SEP is separate from the buyback. o From the recording date for a period of 15-years, if the Purchaser wishes to transfer title, the County shall be entitled to receive a percentage of the sales proceeds. o From the recording date until the SEP is paid, owner must be occupant for a ten-year period. o SEP percent shares are determined prior to closing on the transfer and once recorded will not change. o Sample calculation of how the percentage is determined is provided in the deed exhibit. o Sample of how to calculate the pay-off is provided in the exhibit to Sales Contract. o OHCD consent is required under certain conditions. o There are certain limitations under the SEP program. o SEP will be satisfied after 15 years. C3. Pre-Closing Prior to closing, buyer will be notified by Community Sales Staff of the closing process and the anticipated closing date. In order to close the transaction, buyer must complete the Homeownership Counseling class as required by the terms and conditions of the sales contract, regardless if buyer is paying cash or have already taken a similar class. Buyer will be required to complete the class as provided by Hawai`i Homeownership Center. Failure to complete the class may result in closing delays, additional fees due to delays, and/or cancellation of sales contract. 12
13 C4. Closing Upon closing, escrow will provide buyer with a copy of buyer s closing statement (itemized costs of the transaction) and certified, recorded copy of the property deed document. Buyer is encouraged to retain copies of the recorded deed for future reference of the OHCD programs. D. APPLICATION INSTRUCTIONS This section is provided to assist the applicant in submitting a completed Application to purchase Real Property within the Kamakoa Nui Community. Attach all applicable supporting documentation to the Application for eligibility verification. Upon request by OHCD or the sales agent, any additional information and/or documentation must be submitted in order for OHCD to complete its review of the Application. D1. Household Composition on the Application, that is over 18 years of age employed, are required to submit a Verification of Employment Form. Each Household Member, employed, and over 18 years of age, please complete Part I only, and then submit to your employer. Your Employer is to fill out Part II Verification of Present Employment and return it directly to the Sales Office. Telephone, Fax, and for the Sales Office is listed on the top of the form. 13
14 c. Residency and Household Income Eligibility Verification Documents: A. Applicant Resident and Income Verification: o Submit signed State of Hawai i Income Tax Returns & all applicable schedules, and W-2 statements for the most current year. o Voter Registration Certificate, if recent resident and no Hawai i state tax returns filed. o Pay statement showing Hawai i state withholdings, if recent resident and no Hawai i state tax returns filed. o If self-employed, submit copy of General Excise Tax filing for the most current two (2) years.
