CALL TO ORDER District Manager Neil Kalin called the October 21, 2015, Regular Board Meeting of the Kendall Breeze West Community Development District to order at 7:01 p.m. in the Meeting Room at the Kendall Breeze West Community Clubhouse located at SW 138 th Avenue, Miami, Florida B. PROOF OF PUBLICATION Mr. Kalin presented proof of publication that notice of the October 21, 2015, Regular Board Meeting had been published in the Miami Daily Business Review on October 9, 2015, as part of the District s Fiscal Year 2015/2016 Regular Meeting Schedule, as legally required. C. ESTABLISH A QUORUM Mr. Kalin determined that the attendance of Chairman Allen Donelan, Vice Chairman Joseph Manners and Supervisors Joaquin Lopez, Eduardo Sanchez and Wilmer Gonzalez constituted a quorum and it was in order to proceed with the meeting. Attending Staff members were as follows: District Manager Neil Kalin and Associate District Manager Armando Silva of Special District Services, Inc.; and General Counsel Gerald Knight of Billing, Cochran, Lyles, Mauro & Ramsey, P.A. D. ADDITIONS OR DELETIONS TO THE AGENDA There were no additions or deletions to the agenda. E. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA There were no comments from the public for items not on the agenda. F. APPROVAL OF MINUTES 1. May 20, 2015, Public Hearing & Regular Board Meeting Mr. Kalin presented the minutes of the May 20, 2015, Public Hearing & Regular Board Meeting and asked if there were any changes. There being no changes, a motion was made by Mr. Manners, seconded by Mr. Gonzalez and unanimously passed to approve the minutes of the May 20, 2015, Public Hearing & Regular Board Meeting, as presented. G. OLD BUSINESS 1. Staff Report, as Required There was no report at this time. 2. Update Regarding Installation of Additional Traffic Calming Devices Page 2

5 KENDALL BREEZE WEST COMMUNITY DEVELOPMENT DISTRICT REGULAR BOARD MEETING OCTOBER 21, 2015 Mr. Kalin informed the Board s that the additional traffic calming devices project (the Project ), including applicable signage, on SW 137 th Place, just north of SW 118 th Street, had been installed and the cost was $1,130, which was came in under budget. 3. Update Regarding Installation and Repair of Street Signage (Stop Signs/Speed Limit Signs) Mr. Kalin informed the Board that stop sign and street sign replacements/repairs had been made in the community. In addition, the exit stop sign and entrance feature had recently been damaged due to a vehicular accident. The stop sign, including the sign post, was replaced by the District. Mr. Gonzalez stated that damages to the entrance feature sign would be repaired and the Kendall Breeze West HOA ( Association ) would be seeking an insurance claim for the damages against the vehicle s owner. A discussion ensued after which Mr. Kalin was asked to submit the repair cost invoice for the exit stop sign/post to the Association and that the District could expect reimbursement for this cost. No further Board action was required on this matter. H. NEW BUSINESS 1. Consider Resolution No Adopting an Amended Fiscal Year 2014/2015 Final Budget Mr. Kalin presented Resolution No , entitled: RESOLUTION NO A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE KENDALL BREEZE WEST COMMUNITY DEVELOPMENT DISTRICT AUTHORIZING AND ADOPTING AN AMENDED FINAL FISCAL YEAR 2014/2015 BUDGET ( AMENDED BUDGET ), PURSUANT TO CHAPTER 189, FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE. Mr. Kalin presented read the title into the record and provided an explanation for the document. He advised that there were sufficient funds in the Debt Service Revenue Fund Balance to make the November 1, 2015, interest payment (Debt Service on Series 2007 Bonds) to the Trustee in the amount of $36,719. A discussion ensued after which: A motion was made by Mr. Manners, seconded by Mr. Lopez and unanimously passed to approve and adopt Resolution No , as presented, thereby setting the amended/revised budget for the 2014/2015 fiscal year. I. ADMINISTRATIVE & OPERATIONAL MATTERS 1. Discussion Regarding Curbside Protection & Sanitary Sewer System General Maintenance Page 3

6 KENDALL BREEZE WEST COMMUNITY DEVELOPMENT DISTRICT REGULAR BOARD MEETING OCTOBER 21, 2015 Mr. Gonzalez requested that the Board consider implementing a plan to prevent vehicular traffic from parking on swale areas and to decrease vehicular traffic from cutting corners on radius turns and the turn-a-rounds and ruining the existing landscaping/sod. Mr. Gonzalez suggested that a pilot project be implemented to include curbing on the edge of pavement in designated areas throughout the community. Mr. Manners opined that the District should not spend funds on a pilot project and suggested that the Board come up with solutions to the problem. A discussion ensued after which Mr. Kalin suggested that he have a traffic engineer specialist visit the community, review the parking concerns and make recommendations on solutions to the concerns. Further discussion ensued after which: A motion was made by Mr. Manners, seconded by Mr. Sanchez and passed unanimously to authorize the District Manager to engage a traffic engineering consultant to review the parking concerns of the community and to provide recommendations to control swale parking for an amount not to exceed $600. Once it has been scheduled, Mr. Gonzalez will be included in the field visit with the traffic engineering consultant. On the subject of the Sanitary Sewer System, Mr. Kalin confirmed that the lift station on Tract C (southwest corner of District) and the water and sewer system throughout the District was owned, operated and maintained by the Miami-Dade County Water and Sewer Department. Furthermore, Mr. Kalin explained that the stormwater/drainage improvements within the ingress/egress tract conveyed by the Developer, Century Homebuilders, LLC, to the Kendall Breeze West Homeowners Association (the HOA ) by Quit Claim Deed recorded in ORB 23468, Page 3345 on June 13, 2005, (Folio No ) were owned by the District, and the District is responsible for cleaning the storm drain inlets/structures. Mr. Kalin stated that Staff will inspect the drainage structures during the winter months and if cleaning is required, the District will schedule cleaning prior to next year s rainy season. No further Board action was required at this time. 2. Discussion Regarding Launch of District s Website, Effective October 1, 2015 Mr. Kalin advised that the District s website had officially launched as of October 1, 2015, pursuant to Section , Florida Statutes. In addition, the Board was reminded of the importance of creating their individual District addresses. 3. Discussion Regarding Upcoming Meetings/Holidays Mr. Kalin stated that unless an emergency were to arise the Board would not need to meet again until after January 1, J. 8 TRAFFIC MEMORANDUM Traffic Memorandum DATE: December 29, 2015 TO: FROM: SUBJECT: C.C: Armando Silva (786) Juan S. Calderon, P.E., PTOE, Project Manager Project: Traffic Memorandum Location: Kendall Breeze West CDD Neil Kalin-District Manager This memorandum has been prepared in order to analyze current roadway conditions at Kendall Breeze West CDD located at SW 137 th Ave, Miami Florida Figure 1 shows the mentioned community study area. This memorandum was prepared as a traffic engineering assessment, due to the concerns of vehicles deteriorating the existing landscaping/sod at several corners and parking slots within the community. This assessment includes field inspections and observations and provides conclusions and recommendations. The summary of findings is presented as follows. Figure 1: Kendall Breeze West CDD Existing Conditions/Background: This community is composed of single-family residential attached dwelling units. Based on observations made by the Board and community's residents, various intersections are deteriorating at the corners due to vehicles running over the landscaping/sod while turning. The same situation is also being observed within the community guest parking sections. 10 Traffic Memorandum Field Observations: Field observations were performed in a typical weekday during the AM and PM peak hours on December 1 st, At the same time, observations were made to assess the deterioration occurring at each area of concern. The following results were determined: Several corners of Lawn and sod show deteriorations caused by repeated damage from vehicles running over the section while making a turning movement. Some sections are significantly damaged while others show minor intrusion. Several asphalt segments display poor or deteriorated conditions with patches or alligator cracking. Below are just a few of the field observations made. The continuation of the observations images can be seen in Appendix A of this memorandum. It should also be noted that an Engineer Report completed by Alvarez Engineers, Inc. was completed in June 2015 informing the status of the communities infrastructure. This Engineering report will be provided in Appendix B for reference. 11 Summary of Findings and Recommendations: Traffic Memorandum Given the level of variations between each intersection, parking slots and the intensity of the damaged cause to each of the identified sections, a list of possible recommended solutions will be presented beginning with the indicated curve sections. The most severe damaged areas should be addressed first and the less damaged curves/ guest parking slots can be given a lower priority. All solutions are to follow design standards to meet any regulations. Possible recommended solutions include: A. Widening the turn radii. This will require acquisition of the lawn sections for paving over but will be cost effective in reducing the lawn/sod damage caused by vehicles. Each section would have to be individually evaluated for redesigning and widening the turn radii. B. Adding vegetation. The inclusion of vegetation alongside the roadway should help in reducing the amount of vehicles that deliberately damage the existing sod. This works by reducing the drivers confidence when committing to a turn by creating the feeling of reduced room for errors while turning. Maintenance of the vegetation will be required but will increase the aesthetics of the neighborhood in the process. C. Placing Delineators. Delineators are a relatively low cost, highly effective solution. The main disadvantage with the use of delineators is the aesthetical appearance they present within the community. D. Adding curb with flare out to the turning segments. The addition of a curb should deter drivers from cutting too far in on the turn. Additionally, the curds should also help in increasing the lifespan of the roadway edges. E. Replace/ Repair existing sod. This recommendation is only given for those segments which show very low levels of damage, are expected to have low traffic and as an alternative should none of the above recommendations be taken into action. In all cases, the main problem does not seem to be the design of the roadway itself but rather the drivers behavior in approaching the corners. Because the drivers feel a high level of comfort while approaching the intersections, they become more careless, thus driving over the grass. All presented solutions aim to either mitigate the drivers comfort level while approaching the intersection or compensate for that comfort accordingly. Figure 4 summarizes the alternatives mentioned above in a simplified cost analysis table. 12 Traffic Memorandum Furthermore, it was observed that some of the guest parking slots within the community may not be meeting the code standards put forth by the county. Below in Figure 5 is a sample on street parallel parking slot with dimensions. Current County minimum standards for a parallel parking slot are 8 feet width by 23 feet length. For a 90 degree angle slot, minimum dimensions are 8.5 feet by 18 feet respectively. Also included into the standards is a requirement to have a certain number of handicap parking spaces per given number as show in Figure 6. Handicap parking space standards are to include a width minimum of 12 feet and be located as close as possible to a curb-ramp or curb-cut. All standards can be found in the Miami-Dade Code of Ordinances. Figure 5: Parallel Parking Design Figure 6: Handicap Spaces Requirement Should the current parallel parking slots be redesigned to meet compliance, the community may be able to provide a total of 38 code compliance parallel parking spaces. It is concluded that Kendall Breeze West CDD has expressed its traffic concerns which can be addressed with strategies and/or a long term solutions that are cost efficient. 730 NW 107 th Avenue, Suite 115, Miami, FL Tel: Fax: Page 5 Page 10

13 RESOLUTION NO A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE KENDALL BREEZE WEST COMMUNITY DEVELOPMENT DISTRICT, DESIGNATING A QUALIFIED PUBLIC DEPOSITORY, PURSUANT TO CHAPTER 280, FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is necessary for the Kendall Breeze West Community Development District ("District") to establish accounts with qualified depositories for the purpose of the deposits and subsequent expenditure of public funds of the District; and WHEREAS, the Board of Supervisors of the District has selected Seacoast National Bank, to serve as the depository of public funds for the District. WHEREAS, all resolutions or parts thereof of the District in conflict with the provisions contained herein are to the extent of any such conflict, hereby superseded and repealed. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE KENDALL BREEZE WEST COMMUNITY DEVELOPMENT DISTRICT, AS FOLLOWS: Section 1. The above recitals are hereby adopted. Section 2. That the District Manager is hereby authorized to establish an account(s) with Seacoast National Bank to serve as depository of public funds for the District, pursuant to public law and regulations under Section , Florida Statutes.
