7 BYLAWS OF THE SASKATCHEWAN LAND SURVEYORS ASSOCIATION PREAMBLE Whereas the Saskatchewan land surveyors association, hereinafter referred to as the association, is duly incorporated by an Act of the Legislature of the Province of Saskatchewan; and Whereas power is given to the council and the Membership of the said association to make bylaws in accordance with the provisions of the Act for the better management and regulation of the council, the association, the members of the association, the profession of land surveying and professional surveying and for the management of the property of the association and for the carrying out of the provisions of this Act: Now therefore be it enacted by the council and the Membership of the association that the following be and are hereby adopted as the Bylaws of the Saskatchewan Land Surveyors Association within and for the Province of Saskatchewan. 8 Part I Administrative Bylaws for Saskatchewan land surveyors and Professional Surveyors Article I Seal of the association SECTION 1 The seal of the association shall continue and be the same as the impression affixed to the margin of these bylaws. Article II Execution of Documents SECTION 1 (Amended 2014/01/27) (1) Except as provided for in the Act, all documents other than payments issued in the name, on behalf, of the association, shall be executed under the signatures of the president and the executive director. (2) In the absence or incapacity of the president, the vice president shall co-sign the document with the executive director. (3) In the absence or incapacity of the executive director, the document shall be signed by the president and vice president. Article III Finances SECTION 1 (Amended 2014/01/27) (1) The finances of the association shall be kept in accounts under the name of the association in a chartered bank or guaranteed investment instruments. (2) All payments less than the amount authorized from time to time by the council shall be signed approved by the executive director. (3) In the absence or incapacity of the executive director, an acting executive director shall be appointed under the provisions of subsection 12(3) of the Act. 2 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

9 (4) Payments exceeding the authorized amount shall be signed approved by: (i) (ii) the executive director or an acting executive director; and such member of the council as may be appointed from time to time by the council. Article IV Fiscal Year and Audit SECTION 1 The council shall, prior to the close of each fiscal year, make arrangements with a chartered accountant to audit the books of the association. (Amended 2011/09/19) SECTION 2 The financial year of the association shall close at December 31st in each and every year, when an audit of the books of the association shall be made. SECTION 3 The audited financial statement shall be provided to the members of the association, on or before February 14th of the following year, through electronic means or via mail upon the member s request. (Amended 2011/09/19) Article V Meetings of the association SECTION 1 - Council (1) The council shall hold at least two meetings in each year at such times and in such places in Saskatchewan as the council may determine. (2) Meetings of the council, other than those mentioned in subsection (1) may be called at any time by the President or any two members of the council. (3) The council shall meet within 30 days after its election. (4) Notice of each meeting of the council shall be given by the executive director to each member thereof, and also to such members of the association that have business therewith, at least seven days before the day fixed for the meeting. (5) The council shall not transact business at any meeting or hold any hearing in which less than a majority of members of council are present. (6) All meetings of the council shall be presided over by the President or, in his/her absence, by the Vice President or, in the absence of both, by a Chairman to be elected by the members of the council present. (7) All questions voted on at a council meeting, except as otherwise specified in the Act shall be decided by a plurality of the votes. (8) All members of council have full voting power except the presiding officer who shall vote only when the votes are evenly decided. (9) Meetings of council can be in person, by telephone conference, by Internet conference or any combination thereof. 10 (10)(a) Subject to subsection (10)(b) When the question is called for voting on motions of council, members participating in the meeting by telephone or Internet conferencing are deemed to be in support of the motion unless they voice either their opposition or their intension to abstain from voting. (Added 2011/09/19) (10)(b) At the request of the presiding officer or any member of council, voting on any specific motion of council shall be by verbal response from each voting member of council as that member s name is called by the presiding officer. (Added 2011/09/19) SECTION 2 - Annual and Special Meetings (1) Except as herein provided, Robert s Rules of Order Newly Revised (10th Edition) shall govern in the discussion on motions and resolutions at all Annual and Special Meetings. (Amended 2006/04/16) (2) Except in the case of resolutions that are brought forward by the council, or by a standing committee consisting of at least two persons, and which are published and circulated to the members of the association at least two weeks in advance of an Annual or Special Meeting, every resolution to establish or amend a bylaw or association policy shall be in writing and shall contain the name and signature of the mover and seconder thereof. (Amended 2006/04/16) (3) Every resolution shall be recognized by the chair before being presented for discussion. (4) The Chairman may limit the length of time allowed each member when speaking to a resolution. (5) All discussions on a resolution shall close when such resolution has been finally put to the meeting for a vote. (6)(a) Subject to sub-subsection (6)(b) the order of business for the annual meeting shall be as follows: (Amended 2011/09/19) (i) Call to order and president s address (ii) Presentation of minutes of last annual meeting and all intervening special meetings (iii) Report of council (iv) Presentation of bylaws passed by council (v) Report of executive director (vi) Auditor s report (vii) Reports of standing committees (viii) Reports of ad hoc and other committees (ix) Ratification of all actions by the council, standing committees and ad hoc committees on behalf of the association (x) (xi) (xii) (xiii) (xiv) (xv) (xvi) Reports from outside agencies Voting on motions for which written notice has been given Other unfinished business Election of officers and transition of council New business Open Forum Adjournment 4 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

11 (b) The chairman of the annual meeting may, with the approval of a majority of members present at the meeting, vary the order of business. SECTION 3 - Quorum A quorum for any annual or special meeting shall be twenty licensed members. SECTION 4 - Voting (Amended 2011/09/19) (1) All questions voted on at any annual or special meeting except as otherwise specified in the Act, shall be decided by a plurality of the votes of the licensed Saskatchewan Land Surveyors and Registered Professional Surveyors present. (2) Each licensed Saskatchewan Land Surveyor and Registered Professional Surveyor shall be entitled to one vote. SECTION 5 - Time and Place The annual meeting of the association is to be held in Saskatchewan at a time and place determined by council. Article VI Scholarships, Bursaries and Prizes SECTION 1 (Amended 2006/04/16) (1) There shall be an annual scholarship of $1,250 granted to a student land surveyor from Saskatchewan who is enrolled in any program that will, upon completion, result in the candidate receiving a certificate of completion from the BELS. (2) The criteria for awarding the scholarship shall be approved by the council upon the recommendation of the Public Relations Committee. (3) Selection of the winning applicant shall be by the council based upon the recommendation of the Public Relations Committee. SECTION 2 There shall be a scholarship offered annually in the amount of $1,250 to a student entering the fourth year in the Geomatics Engineering program at the University of Calgary, who has completed secondary schooling within the province of Saskatchewan. The award will be based on academic merit and the candidate must have attained a grade point average of not less than 2.60 in the previous academic year. To be eligible students must be enrolled in Survey Law and Field Surveys in the fourth year and have selected a topic dealing with cadastral land studies for their Field Surveys project. (Amended 2006/04/16) SECTION 3 (Amended 2011/09/19) (1) Subject to subsection (2) there shall be a scholarship offered annually in the amount of $1,250 to the second year Geomatics Engineering Technology student at the Saskatchewan Institute of Applied Science and Technology, who achieved the best academic record in the first year of the student s program at the Institute. 12 (2) In any year when there are no candidates that meet the criteria set out in subsection (1), the scholarship shall be granted, on the basis of third highest academic record, to a student entering the first year of the Geomatics Engineering Technology program at the Saskatchewan Institute of Applied Science and Technology. SECTION 4 (Amended 2011/09/19) There shall be two scholarships offered annually in the amount of $1,250, granted on the basis of first and second highest academic records, to students entering the first year of the Geomatics Engineering Technology program at the Saskatchewan Institute of Applied Science and Technology. Article VII Other associations and Organizations SECTION 1 - Saskatchewan Association of Geomatics Technologists The Saskatchewan Land Surveyors Association (the Association ) will generally assist and support the Saskatchewan Association of Geomatics Technologists Inc. (SAGT) as follows: (1) The Association may assist SAGT as herein set out and as may from time to time be requested by SAGT and approved by council, in the management of its affairs and in the promotion of its objectives. (2) The council of the Association may nominate and appoint two members of the Association to serve as Advisory Members to SAGT. One appointee shall be appointed annually, each appointment for a term of two years. (3) The council of the Association may nominate and appoint three members of the Association to serve on the Certification Board of the SAGT; said appointments to be made when vacancies arise in the number of the Association s members on the said Board. (4) If requested by the Certification Board of the SAGT, the Association may appoint three members of the Association to the Panel of Examiners for the Certification Board of the SAGT; such appointments to be made when initially requested and when vacancies arise in the number of members of the Association on the said Panel of Examiners. (5) The council of the Association may from time to time receive the recommendations of the Certification Board of the SAGT and/or the Advisory Members to the SAGT and approve such recommendations in respect to standards, educational requirements, classifications or other matters as council deems just. (6) The Association may support and/or co-sponsor, together with the SAGT education seminars and other projects of common interest. SECTION 2 - Professional Surveyors Canada (Amended 2011/09/19) (1) The Saskatchewan Land Surveyors Association shall maintain a relationship with Professional Surveyors Canada. 6 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

13 Article VIII Committees SECTION 1 Standing committees of the association are to be the Convention, Education, Finance, Government Relations, Nominating, Practice, Public Relations Committees and SLSA Charitable Fund Selection Committee. (Amended 2011/09/19) Article IX Remuneration and Reimbursement SECTION 1 In-town members of council, attending a meeting of council are entitled to a stipend of $75 per meeting. (Amended 2004/06/21) SECTION 2 Out-of-town members of council, attending a meeting of council are entitled to a stipend of $175. Any member residing over 275 km from the location of the meeting is entitled to $ per meeting. (Amended 2004/06/21) SECTION 3 Members of council, committee members and other members of the association, when incurring expenditures on behalf of a committee, the council, or the association, and approved by council, are entitled to claim travel expenses in accordance with the rates approved by council and which conform with the provincial government s travel allowance rates. 14 SECTION 1- Definitions PART II Regulatory Bylaws for Saskatchewan land surveyors Article XI Professional Examinations, Qualifications, Standards & Tests of Competency (1) Board of examiners for land surveyors (BELS) means any board of examiners approved by the council of the association to administer the curriculum, arrange for qualified examiners, establish a schedule of examinations and establish criteria for applicants to receive credits in a course of study in surveying. (Amended 2005/06/03) (2) Certificate of completion means a certificate issued by the BELS which establishes that the holder has completed his/her academic qualifications to the level of the baccalaureate degree in surveying engineering, survey science, geomatics engineering or equivalent degree in surveying. (Amended 2005/06/03) (3) Board of examiners for Saskatchewan land surveyors means a board of examiners established for the examination of applicants for a commission as a Saskatchewan land surveyor. (4) Professional examinations means examinations set by the board of examiners for Saskatchewan land surveyors. (5) Practical experience means the actual practice, in Saskatchewan, as a land surveyor in training or student land surveyor under the supervision of a Saskatchewan land surveyor with whom a Form O land surveyor in training agreement or Form L student land surveyor agreement has been signed and approved by the council. (Amended 2009/06/12) (6) Field experience means practical experience in the field, in the province of Saskatchewan, but does not include work carried out on Canada Lands except in the case of interjurisdictional boundaries. (Amended 2009/06/12) (7) (Deleted 2009/06/12) SECTION 2 - Board of examiners for Saskatchewan land surveyors (1) The professional examinations of applicants for a commission as a Saskatchewan land surveyor shall be under the control of the board of examiners for Saskatchewan land surveyors. (2) The council of the association shall appoint the board of examiners for Saskatchewan land surveyors which board of examiners shall be comprised of a chairperson and such other members as the council deems necessary. (3) The board of examiners for Saskatchewan land surveyors, after consultation with council, shall make rules governing the conduct of the professional examinations. (Amended 2009/06/12) (4) The professional examinations shall be held at such times and places as may be fixed by the board of examiners for Saskatchewan land surveyors. (5) The board of examiners for Saskatchewan land surveyors shall report the results of the professional examinations to the council of the association. 8 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

15 SECTION 3 - Professional Examinations (1) The professional examinations for land surveyors in training shall be comprised of the following: (Amended 2012/06/09) (a) Written examinations; (i) (ii) (iii) (iv) (v) (b) (c) Provincial Statutes - Paper I Provincial Statutes - Paper II Provincial Statutes - Paper III Standards of Practice and Principles of Evidence Practical Surveying One or two practical surveying projects which shall have, as a major components, the restoration and re-establishment of primary monuments in the Saskatchewan quadrilateral township system as well as activity in the secondary survey system including the subdivision process in Saskatchewan. (Amended 2012/06/08) Oral on practice (2) The professional examination for an applicant who holds a licence as a land surveyor in another Canadian jurisdiction, and who is a member in good standing of the professional survey association in that jurisdiction, shall be comprised of a single written or computerbased examination, of not more than four hours duration, that tests the candidate s knowledge of those aspects of professional land surveying that are unique to Saskatchewan including matters related to jurisprudence, the systems of survey and the land registration system. (Added 2009/06/12) SECTION 4 - Student land surveyors (1) An applicant for admission as a student land surveyor shall submit appropriate documents to council from an approved course of study in surveying listed in Article XVI, SECTION 2 as evidence that the applicant has met the requirements of subsection 19(2) of the Act along with one copy of Form L, duly executed, and the fee prescribed in Article XXI. (Amended May 25, 2007) (2) The executive director shall automatically cancel the registration of any student land surveyor who has not paid the annual prescribed fee by January 15 of each year following the year of admission. (Amended 2009/06/12) (3) Every Student Land Surveyor who has obtained a Certificate of Completion from the BELS is eligible to apply for membership as a Saskatchewan Land Surveyor in Training.(Amended 2009/06/12) (4) (Deleted 2009/06/12) SECTION 5 - Land surveyors in training (1) An applicant for admission as a land surveyor in training shall submit appropriate documents to council as evidence that the applicant has met the requirements of subsection 19(3) of the Act and Article XVI of the Bylaws, along with one copy of Form O, duly executed, and the fee prescribed in Article XXI. 16 (2) The executive director shall automatically cancel the registration of any land surveyor in training who has not paid the annual prescribed fee by January 15 of each year following the year of admission. (Amended 2009/06/12) (2.1) Before being eligible to apply to the council for a commission as a Saskatchewan land surveyor, every land surveyor in training shall: (Added 2012/06/09) (i) satisfy the practical experience requirements prescribed in Subsection 5(3); and (ii) pass all of the professional examinations prescribed in SECTION 3. (3) Subject to subsection (4), every land surveyor in training shall acquire a minimum of one year practical experience, at least nine months of which must be field experience in the Province of Saskatchewan, (Amended 2012/06/09) (4) Notwithstanding the requirement of Subsection (3), a land surveyor in training who: (a) has gained field experience in cadastral surveys while serving as a student land surveyor under the direct supervision of a Saskatchewan land surveyor, may be credited with one month of practical experience for each two months served, to a maximum credit of three months, when reported on Form M following admission as a land surveyor in training; (b) between the 3rd and 4th years of a baccalaureate degree program listed in Article XVI, SECTION 2, has gained field experience in cadastral surveys under the direct supervision of a Saskatchewan land surveyor, may be credited with up to three months of that experience when reported on Form P. (Replaced by new section 2009/06/12) (5) Upon completion of the practical experience requirements each land surveyor in training shall file with the executive director one duly executed copy of Form P. (Replaced by new section 2009/06/12) (6) Upon receipt of Forms M or P, the executive director shall present same to council at its first meeting thereafter. (6.1) Upon the practical experience of the land surveyor in training being completed to the satisfaction of council, the executive director shall advise the candidate and the board of examiners for Saskatchewan land surveyors that the candidate has satisfied the practical experience requirements of this section. (Amended 2012/06/09) (7) A land surveyor in training who has not completed the required term of practical experience within five years from the date of registration in that membership category must apply to council for permission to maintain membership as a land surveyor in training. The application must include a plan, that is satisfactory to council, by which the required period of practical experience will be completed within the following twelve month period. (Replaced by new section 2009/06/12) (8) The executive director shall automatically cancel the registration of any land surveyor in training who has not complied with subsection (7). (Amended 2009/06/12) (9) A person whose registration has been cancelled under subsection (8) may re-apply for membership as a land surveyor in training under the provisions of subsection (1). 17 SECTION 6 - Land surveyors licensed in other Canadian jurisdictions (1) An applicant for a commission as a Saskatchewan land surveyor who holds a current licence as a land surveyor in any other Canadian jurisdiction and who is a member in good standing of the professional survey association in that jurisdiction; (a) is deemed to have met the requirements of subsection 19(4) clause (a) of the Land Surveyors and Professional Surveyors Act with regard to the period of actual practice as a Saskatchewan land surveyor in training; and (b) may apply to write the professional examination specified in Subsection 3(2). (2) Applications under this section shall be in writing and accompanied by the fee specified in Article XXXIV Subsection 4(3) clause (b). (Amended 2009/06/12) SECTION 7 After having successfully completed the professional examinations and having been approved by council, a candidate, shall, before being granted a commission, file with the executive director the following: (1) Oath of office in Form A (2) Admission fee as prescribed in Article XXI, and on being admitted, shall be issued a commission in Form B. (Amended 2009/06/12) SECTION 8 A land surveyor shall not enter into Form L or Form O agreements until the expiration of two years from the date of his/her commission. (Amended 2009/06/12) SECTION 9 (1) The annual registration fee for a student land surveyor or a land surveyor in training shall be as prescribed in Article XXI, payable to the executive director not later than January 15 in every year. (2) Upon receipt of the registration fee, the executive director shall issue to that person a registration card for the year in respect of which the fee is paid. 18 Article XII Code of Ethics It shall be inconsistent with the honour, integrity and dignity of the profession for any Saskatchewan land surveyor: SECTION 1 To act for his/her clients in professional matters otherwise than as a faithful agent or trustee or to accept any remuneration other than his/her stated charges for services rendered his/her clients, except as provided in Section 2 hereof. SECTION 2 To accept any commissions, discounts, allowances, or any indirect profit in connection with any work which he/she is engaged to do in the practice of his/her profession which may be entrusted to him/her, unless and until receipt by him/her of such commissions, discounts, allowances or any indirect profit has been duly authorized in writing by the clients. SECTION 3 To abstain or neglect to advise and inform at all times his/her client or clients of any business connections, interest or circumstances which may be deemed to influence his/her judgment or affect the character and qualify of his/her services to his/her clients. SECTION 4 To offer or to pay any commission for the securing of any professional work to any person not a member of the association or to otherwise improperly solicit professional work. SECTION 5 To quote a price to a client or the agent of a client in the knowledge that such agent intends to quote a higher price to his/her clients or to enter into any arrangement whereby the professional services rendered shall cost the owner of the land more than the Land Surveyor received for his/her services. SECTION 6 To attempt to supplant another Land Surveyor after definite steps have been taken towards the employment of such Land Surveyor. SECTION 7 To accept employment by a client while the claim for compensation or damages or both, of a fellow Land Surveyor previously employed by the same client, remains unsatisfied and whose employment has been terminated, unless such claim for compensation or damages has been referred to arbitration or issue has been joined by due process of law. SECTION 8 To underbid a fellow Land Surveyor who has already been retained by reducing the usual charges or to compete improperly with a fellow Land Surveyor after having been informed of such fellow Land Surveyor s charges. 12 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

19 SECTION 9 To accept any engagement to review the work of a fellow Land Surveyor for a client without first notifying such fellow Land Surveyor, if at all possible. SECTION 10 To advertise in an unprofessional manner by making exaggerated or otherwise misleading statements regarding his/her qualifications or experience. SECTION 11 To sign and certify any plan or certificate for which he/she is not professionally responsible. SECTION 12 To associate himself/herself with or to allow his/her name to be used in a professional way with any enterprise of doubtful character or to do any act or thing unbecoming to the dignity or honour of the profession. SECTION 13 Sections 1 to 12 apply mutatis mutandis to Student Land Surveyors, Land Surveyors in Training and Professional Surveyors. Article XIII Standards of Practice The provisions contained in this article are the minimum standards of practice as established pursuant to clause 15(2)(e) of The Land Surveyors and Professional Surveyors Act and shall be adhered to by the members of the association in the conduct of Professional Land Surveying. SECTION 1 - Real Property Reports (1) The Saskatchewan land surveyors Real Property Report shall replace those documents known as Surveyor s Certificates or Mortgage Certificates. (2) Definitions: (a) Saskatchewan land surveyors Real Property Report means the plan and report prepared in respect of the survey performed for the purpose of certifying the location of all visible permanent structures relative to the boundaries of the parcel of land and for the purpose of this Standard shall be referred to as a Real Property Report. (b) structure means any permanent building constructed or placed in, on, or over land. (c) (d) parcel means a unit of land described in a Real Property Report. Surveyor means a Saskatchewan land surveyor. (3) A surveyor performing a survey for the purpose of identifying, locating and illustrating structures, together with the extent of the parcel shall prepare a Real Property Report in accordance with this standard. 20 (4) When conducting a survey for a Real Property Report, a surveyor shall: (a) (b) (c) (d) (e) perform sufficient research to identify the parcel boundaries, including obtaining a copy of the current Title which shall be retained in his/her file; (Amended June 3, 2005) research all easements and rights of way that relate to the title; locate and confirm sufficient monumentation to determine the parcel boundaries; find or re-establish monuments at one or more corners of the parcel in accordance with the Land Surveys Act and show the location of the found or re-established corner on the plan; (Amended June 3, 2005) locate the main external walls of all structures on the parcel relative to the boundaries thereof, whether entirely or partially within the parcel, together with any visible portions of the structure which may extend beyond the parcel boundaries. (5) A Real Property Report shall consist of a plan and a report. (a) When preparing a plan for a Real Property Report, a surveyor shall: (i) indicate that the plan is part of a Real Property Report and that it is prepared in accordance with Article No. XIII of the Bylaws; (ii) indicate the Surface Parcel Number, Reference Land Description, municipality and where available, the municipal address of the parcel; (Amended June 3, 2005) (iii) show land descriptions for adjoining lands; (Amended June 3, 2005) (iv) illustrate all structures located pursuant to subsection 1(4) clause (e) with their dimensions and minimum distances from the boundaries of the subject parcel; (v) indicate the stage of building construction and number of stories; (Amended June 3, 2005) (vi) identify encroachments of above ground structures and the nature of such encroachments; (vii) indicate all linear dimensions of the parcel; (viii) illustrate, identify and dimension all registered interests based on easements which affect the parcel; (Amended June 3, 2005) (ix) indicate the date of survey; (x) certify the plan by date, signature and embossed seal; (Amended June 3, 2005) (xi) (xii) show the copyright symbol and year; draw the plan to scale where reasonable; (xiii) show a North arrow; (xiv) state the units of measurement. (b) When preparing a report for a Real Property Report, a surveyor shall: (i) (ii) indicate the effective date of the title search, the registered owner, the Title Number and description of any easements affecting the subject parcel; (Amended June 3, 2005) make reference to all above ground structures that encroach onto the parcel as well as any portion of the above ground structures that are not within the parcel boundaries; 14 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

21 (iii) (iv) (v) refer to the plan as being part of the report; number all pages in the report; date, sign and seal the report. (6) All Real Property Reports or topographic plans issued by a Saskatchewan land surveyor shall be up-to-date and cannot be considered up-to-date unless: (a) (b) (c) a field inspection has been done and it has been determined that it reflects current conditions and; a statement has been added to the Real Property Report or plan stating that a site inspection has been made on the date of issuance and that the Real Property Report or plan reflects current conditions; and the current Title information as required in the Standards for Real Property Reports has been indicated on the Real Property Report. (Amended June 3, 2005) SECTION 2 - Recording of Real Property Reports All Saskatchewan land surveyors shall submit to the executive director a completed Form S showing all Real Property Reports performed in the province of Saskatchewan. Form S shall be submitted, in digital form where practicable, within six months of Real Property Reports having been completed. (Amended May 25, 2007) SECTION 3 - Primary Surveys (1) Where a Section or Quarter Section corner is re-established or restored in accordance with the provisions of The Land Surveys Act (2000) the Land Surveyor shall within ninety days of doing so, report the facts in connection with such re-establishment or restoration, on an acceptable format, to the Controller of Surveys. However, it shall be deemed that a report has been submitted where the particulars of the re-establishment or restoration are clearly shown on a Plan of Survey submitted for examination under the Land Surveys Act (2000). (Amended June 3, 2005 and May 25, 2007) (2) Where, upon carrying out a survey, it is necessary to establish a monument at a corner of a Quarter Section or Legal Subdivision not previously monumented, the Surveyor shall within ninety days of doing so, report the facts in connection with such establishment, on an acceptable format, to the Controller of Surveys. However, it shall be deemed that a report has been submitted where the particulars of the establishment, are clearly shown on a Plan submitted for examination under the Land Surveys Act (2000). (Amended June 3, 2005) SECTION 4 - Closures It shall be good practice to obtain a minimum closure in raw field data of one part in five thousand. SECTION 5 - Confirmation of Monuments It shall be good practice to confirm that any monuments used from any previous surveys are in their original undisturbed location prior to carrying out any new surveys conducted under the authority of the Land Surveys Act. Where this is not evident on a plan of survey, a complete report outlining the methods used to confirm the locations of these monuments shall accompany plans or other documentation submitted to the Chief Surveyor s Office or Central Survey and Mapping Agency Saskatchewan Land Surveyors Association - Bylaws - November 19,

22 SECTION 6 - Wellsites and Related Facilities These standards are in addition to the information required under the Oil and Gas Conservation Regulations, 1985 (and amendments thereto). (1) A Saskatchewan land surveyor, performing a survey for the location of wellsites and related facilities in surveyed territory, shall find, restore or re-establish sufficient monuments to define at least one boundary of the 1/4 section affected and shall measure the relationship of the wellsite and related facilities to the said boundary. (a) (b) Where it is necessary to restore or re-establish a survey monument, it shall be restored or re-established in accordance with the provisions of the Land Surveys Act, and in accordance with Section 3, Article XIII of the Bylaws. In all cases where evidence of an original section or quarter section corner is found, a standard iron post shall be established and a complete report shall be made to the Controller of Surveys in accordance with Section 3, Article XIII of the Bylaws. (2) Where the boundaries of a well site or related facility terminate on, are coincident with or purport to define a property boundary, the said boundary shall be established in accordance with the provisions of the The Land Surveys Act. (3) The type of monument placed on the boundaries of the well-site and related facilities shall be shown on the plan. (4) Elevations shall be determined from a minimum of two bench marks, one of which is recommended to be a bench mark with a published geodetic elevation, which is of public record. Fourth order accuracy (±120 mm x pdistance (km) ) shall be achieved within the surveyor s own work. The datum shall be geodetic and also noted on the plan. (5) (a) The name of the certifying Land Surveyor shall be printed legibly on the plan. (b) The seal of the certifying Land Surveyor shall be affixed to the plan. (6) Closures shall be in accordance with Section 4, Article XIII of the Bylaws. SECTION 7 Correction of Monuments Where a monument which was originally intended to be on a previously surveyed line is found to be off line, it shall be good practice to correct the position of the monument. Where correction of the monument is not practicable, the position of the monument shall be shown on a Plan of Survey. (Passed 2005/06/02) SECTION 8 Closure of Surveys of Rights of Way On surveys of rights of way which terminate within the interior of a section, it shall be good practice to show angular and linear measurements from the terminal monument to the nearest found primary monument. (Passed 2005/06/02) SECTION 9 Intersecting Section Lines and Surveyed Quarter Section Lines When surveying boundaries that intersect surveyed section or quarter section lines, it shall be good practice to use the nearest section or quarter section corners on each side of the point of intersection. If the monuments at these corners are lost, they shall be re-established in accordance with subsection 29 (1.1) of The Land Surveys Act, Where this is not practicable an intersection can be made with a secondary monument if the accuracy of its position has been verified and a full report shall be submitted with the Plan. 23 SECTION 10 - No Saskatchewan land surveyor shall plant, or authorize the planting of, a standard iron post: b) that was purchased after September 1, 2012 unless it was purchased though the association; a) that does not bear the identification number of the survey firm with which the Saskatchewan land surveyor is associated at the time the standard iron post is planted. (Added 2012/06/09) Article XIV Categories of Membership SECTION 1 - Life Membership (1) Subject to subsections (2) and (3) the council may confer life membership in the association upon any person who has been engaged in actual practice as a land surveyor in Saskatchewan for a period of thirty years or more, and who has during that period been duly authorized to practice as a land surveyor. (2) Candidates for Life Membership shall be nominated by five licensed Saskatchewan land surveyors. The nomination must be submitted in writing and approved as to qualifications by the majority of council. Once council has determined that the candidate has met the qualifications they shall seek the candidates approval of the nomination. When consent is obtained council shall publish the nomination report in the next annual Committee Reports. The nominee must then be elected by secret ballot by a majority of the licensed members present at an Annual Meeting. (3) The following criteria shall be used in the determination of qualifications of a nominee for Life Membership. (a) The member must have rendered signal service to the association and to the survey profession. (b) Signal service shall include at least one term on the council of the association in combination with three or more of the following: (i) Active service of not less than twelve years on one or more of the Committees of the association and/or related organizations. (ii) Service as President of the association for one or more terms. (iii) Significant contribution to the association through research and publication of papers pertaining to land surveying and/or related disciplines. (iv) Contributions to the enhancement of the professional standing of the association through good public relations with other professional organizations and the public at large. (v) Leadership in setting new directions in land surveying or related disciplines. (vi) Participation in the development of new techniques or equipment in surveying or mapping. 24 (4) All living Life Members appointed prior to December 31, 1998 shall continue to be life members. (5) Life Members shall be exempted from payment of the annual membership fee to the association. SECTION 2 - Honourary Membership The following criteria is to be used to determine eligibility for Honourary Membership: (1) The council may, with the approval of two thirds of those licensed members who vote at an annual or special meeting, confer honourary membership in the association upon any person who, through their own initiative and leadership, has rendered eminent service relating to the profession of surveying. (2) There shall at no time be more than three living honourary members of the association. (3) An honourary member is not required to pay an annual fee or any levy payable to the association. (4) Unless the council otherwise directs, an honourary member is entitled to receive all publications, reports, and notices that are generally available to Saskatchewan land surveyors. (5) An honourary member may attend an annual general meeting or special meeting of the association and is entitled to discuss any motion or resolution before the meeting, but no honourary member may propose a motion or resolution or vote at a meeting of the association, unless otherwise qualified to practice under the provisions of this Act. (6) Every honourary member shall have all the privileges of the association except the right to practice and to vote unless otherwise qualified to practice under the provisions of the Act. (7) An Honourary Membership may be revoked by the council for conduct considered by the council to be detrimental to the association. (8) All living Honourary Members appointed prior to December 31, 1998 shall continue to be Honourary Members. SECTION 3 - Retired Membership Any Saskatchewan land surveyor who is not in arrears of fees shall, prior to January 15th in the year in which he/she wishes to retire, file a Certificate of Retirement in Form R with the executive director and upon annual payment of the retirement fee, as prescribed in Article XXI shall be registered as a retired member and entitled to use the abbreviation S.L.S. (Retired) or S.L.S. (Ret.) Article XV Re-entry Education SECTION 1 A Saskatchewan land surveyor who has not held an annual license to practice for a period of two or more consecutive years and who wishes to obtain an annual license shall satisfy the following conditions in addition to the requirements otherwise specified in the Act and the Bylaws: (1) The Saskatchewan land surveyor shall submit to council a resume of his/her activities during the period in which an annual license was not held, together with the investigation fee prescribed in Article XXI. 18 Saskatchewan Land Surveyors Association - Bylaws - November 19, 2014

25 (2) The council shall review the resume and determine which, if any, educational programs or courses, as sponsored or approved by the Education Committee, are required to be successfully completed prior to the issuance of an annual license. The council may also require that the Saskatchewan land surveyor submit to such examinations, as set by the Board of Examiners for Saskatchewan land surveyors as council deems fit. (3) The council shall notify the member in writing of its requirements within sixty days of the application for an annual license by the Saskatchewan land surveyor. Section 1 - Approved Technical Schools (Deleted May 25, 2007) Article XVI Education Programs Section 2 - Approved courses of study in surveying For the purposes of subsection 19(2) clause (b) of the Act, the following courses of study in surveying are approved: (i) Geomatics Engineering degree program, University of Calgary; (ii) (iii) Geodesy and Geomatics Engineering degree program, University of New Brunswick; Geomatics degree program, University of Laval; (iv) Certificate of completion from the BELS. (Amended June 3, 2005) Section 3 (Deleted June 3, 2005) Section 4 - BELS certificate of completion For the purposes of subsection 19(3) clause (b) of the Act, a certificate of completion from the BELS is an approved course of study in surveying. 26 SECTION 1 - Mandatory Continuing Education (1) Definitions Article XVII Continuing Education (a) (b) Continuing Education Period (C.E.P.) means a period consisting of two consecutive calendar years beginning January 1st following the Proclamation of The Land Surveyors and Professional Surveyors Act and continuing every two calendar years thereafter. The first C.E.P. will begin January 1, 1998 and will end December 31, Professional Development Credits (P.D.C.) means credits assigned by the council of the association to the various forms of continuing education activities. (2) Requirements.Subject to subsections (1) to (7) every Saskatchewan land surveyor shall acquire thirty Professional Development Credits in the previous Continuing Education Period. Excess credits obtained during a Continuing Education Period may be carried forward to the next period to a maximum of twenty-five percent of the total required credits for one continuing education period. (3) Determination of Professional Development Credits.The council of the association shall publish and distribute annually, the point values of association sponsored events, seminars and meetings. (4) Records.Each Saskatchewan land surveyor is responsible for the design of their own Continuing Education Activities. The maintenance of records to be used to support the P.D.C. s claimed is the responsibility of the individual. Records required may include, but are not limited to the following: (a) A log showing: (b) (i) (ii) (iii) (iv) (v) (vi) (vii) type of activity claimed sponsoring organization dates location duration instructor s or speaker s names and qualifications credits earned Attendance verification records in the form of completion certificates or documents supporting evidence of attendance..a report, in the prescribed form, of accumulated point shall be forwarded to the association office for filing by the executive director at the end of the current CEP. Records must be maintained for a period of six years and copies may be requested by the association for verification purposes. 27 (5) Exemptions...A Saskatchewan land surveyor may be exempt from these Mandatory Continuing Education requirements for one of the following reasons: (a) A newly commissioned Saskatchewan land surveyor shall be exempt for the C.E.P. in which the initial issuance of a license to practice as a Saskatchewan land surveyor is made and all of the next C.E.P. (b) A Saskatchewan land surveyor experiencing physical disability, illness or other extenuating circumstances as reviewed by the Education Committee may be exempt. Supporting documentation may be requested by the Committee. (c) Retired Saskatchewan land surveyors shall be exempt. In the event such a member wishes to resume active practice, thirty [30] P.D.C. s must have been acquired in the two year period immediately prior to the date on which reinstatement is requested. Depending on the date of reinstatement, there may be insufficient time to acquire thirty [30] P.D.C. s for the next C.E.P. in which case council will determine the requirements for the member to acquire a license to practice in the next C.E.P.. The executive director shall audit the claimed P.D.C. s prior to the issuance of the said license. (d) Life members and honourary members shall be exempt. (6) Audit... The council of the association shall conduct an audit of at least ten percent of the Saskatchewan land surveyors claiming P.D.C. s for each C.E.P. Audits shall be done at random between the 15th and 30th of the month following the end of the C.E.P. (7) List of Professional Development Credits...The council of the association shall establish a list of activities categorized as Part A and Part B. All forms of educational achievements must be similar to one or more of the activities listed. Thirty percent of claimed P.D.C. s must be from Part A.
