2 Application Form TO: The Corporation of the City of St. Catharines (the City ) I am the owner, or authorized agent of the owner in possession of the Property described below, which has been subjected to the unwanted application of graffiti without the consent of the owner or any authorized agent of the owner in possession, and as such, I have full authority to enter into this agreement. I acknowledge and agree that: 1. I have engaged, or propose to engage a Contractor from the list of prequalified contractors provided by the City (attached) to remove the graffiti from the Property, which may include covering, concealing and/or removal of the graffiti; 2. The work will be performed by the Contractor under my contract with the Contractor, and I will be solely responsible for the decision to cover, conceal, or remove the Graffiti, the type and colour of material used, and the method of application; 3. The City will not be responsible in any way for the Contractor, or for the removal of graffiti by the Contractor, or for any of the work; 4. The City does not warrant the Contractor s work, and makes no representation about the ability of the Contractor to perform the work; 5. I will be responsible for, and will pay the Contractor for the work under my contract with the Contractor; 6. I understand that the work can leave traces, marks, or other surface features; and, 7. The work shall be done at my sole risk, and I release the City from any and all actions, causes of actions, claims and demands for or by reason of any damage, loss or injury to person or property which has been, or hereafter may be sustained in consequence of my participation in the City of St. Catharines Graffiti Removal Program. 5 Cost of Removal It is the applicant s responsibility to engage a contractor from the attached list of contractors pre-qualified by the City of St. Catharines. The City of St. Catharines will contribute 50% of the cost of graffiti removal, up to a maximum contribution of five hundred dollars ($500.00) per incident to a maximum of three times per year. Application approval is subject to inspection by City staff. Total Cost of Graffiti Removal: $ Both the contractor's invoice and proof of payment must accompany the application.
