4 Vacation Resort Owners Association Regular Preferred Plus Intervals Association Policy for Use and Enjoyment of Eagle Crest By Its Vacation Resort Owners Welcome to resort living at its very best. We desire that your use of your Vacation Resort Ownership will prove to be a satisfying experience. The following policies have been established for the use and enjoyment of your resort by you and all Vacation Resort Owners. These policies supplement the Amended and Restated Declaration of Covenants, Conditions, and Restrictions for Vacation Resort Ownership (the Declaration ) but do not change your obligations as an Owner under either the Declaration or the other Governing Instruments. The Policies may be amended from time to time by the Board of Directors of the Eagle Crest Vacation Resort Owners Association. Definitions To assist you in reading the Policies, the legal terms used in the Declaration have been dispensed with here in favor of plainer language. The context should make the meaning clear. To the extent there is any conflict between any provision of these Policies and any provision of the Declaration, the provisions of the Declaration shall control. General Information Eagle Crest Resort is operated under the jurisdiction of the following owners associations: Vacation Resort Owners Association Estate Homesite Owners Association Fairway Vista Estates Association River View Vista Estates Association Eagle Crest Hotel Condominiums; and Eagle Crest Master Association: Owns and/or leases and operates the common improvements and facilities for the benefit of all Owners. These common facilities include main access roads and parking, community water and sewer system, indoor sports center and outdoor pools, playing fields, bicycle paths and river front hiking trails as well as the open meadow areas. The sports center and two outdoor pools are leased to the Master Association. As an owner of a Vacation Resort Ownership Interval, you are automatically a member of the Vacation Resort Owners Association AND the Eagle Crest Master Association. 5 Reservations Requests are confirmed on a first request, first served basis and, therefore, the earlier you make your request, the greater the probability of receiving your particular preference. If you wait until the last 7 days, you will be in competition with Bonus Use reservations. Again, early planning helps not only you, but also your Association in serving your wishes. All reservations requests are to be made by telephone. These telephone reservations are accepted in the order received. Your patience is appreciated during busy calling hours. We will send you a written confirmation of your reservations. If you do not receive this confirmation within 10 days, please check back with us to be sure all is in order. All requests for reservations must include: 1. Name and Owner Number; 2. The first and last date of your desired stay on your property; 3. The number of persons in your party: and 4. If to be used by guests, their names and means of identification. Reservations requests may be made by calling: (541) , 8:00 A.M. to 5:00 P.M., Monday Friday Reservation hours are subject to change without notice. A cancellation fee of $20.00 will be charged for any more than one cancellation occurring in an Anniversary Year (or Calendar Year for alternate year owners). For owners convenience: OWNER NUMBER: ANNIVERSARY DATE: SEASON: VROA Regular Preferred Plus Interval, June Policies for Use and Reservations Preferred Plus Interval Ownership: As the owner of a Regular Preferred Plus Annual Interval, you not only own (via warranty deed and your association memberships) a portion of the total Community, you also own in perpetuity, for each ownership interest you own, seven nights lodging each and every year within the season that you have selected, plus certain use rights of recreational and other common area facilities. Regular Preferred Plus owners of an Alternate Year Interval have all the rights of use and occupancy described in this handbook in either even or odd numbered calendar years as designated in your purchase agreement by an O or an E. Preferred Plus Units: Owners of intervals sold in the last phases of the resort s development are referred to as Regular Preferred Plus Interval Owners. Regular Preferred Plus intervals are designated as either Summer or Holiday Plus Season intervals. These two seasons are referred to as Preferred Plus Seasons, and townhouse units sold under these seasons are called Preferred Plus Units. Your regular and split week use (Holiday Plus season only) will be reserved in any of the Preferred Plus Units which include Townhouse Unit Nos. 244, , , , and Bonus Use lodging will be reserved in any of

6 the available townhouse units within the Vacation Resort Ownership Project regardless of the season type. Units sold in earlier phases are referred to as Original Seasons Units and are all located to the north of Falcon Crest Drive. All forms of lodging use and reservations for Regular Preferred Plus Interval Ownership have these things in common: 1. Use is by confirmed reservation only. When making your reservation, you must include the requested arrival and departure days and dates of your visit, the number of persons in your party (six (6) persons maximum per unit), and your guests names, if for use by them without you (not allowed on Bonus Use). 2. Arrival and departure are on Friday, Saturday, Sunday or Monday for Regular Use. Split Weeks will be allowed (Holiday Plus Season only) in 4 and 3 night increments, with check-in any day of the week, as available. 3. CHECK-IN TIME IS GUARANTEED FOR 5:00 P.M. Townhouses will be available for occupancy as soon as housekeeping staff completes their services, which may be earlier than 5:00 P.M. CHECK-OUT TIME IS 11:00 A.M. The prompt availability of townhouse units relates directly to prompt check-outs at 11:00 A.M. Please help your Association provide townhouses on schedule to your fellow owners by checking out no later than 11:00 A.M. (Lockers and shower facilities are available while awaiting check-in or after check-out). 4. Requested dates are confirmed on a first-request, first-served basis, as further described in the section titled Forms of Lodging Use and Reservations. The earlier you make your request the greater the probability of receiving your particular request. Early planning helps not only you but also your Association in serving your wishes. 5. You may indicate a preference for a specific unit or view (river or fairway) and your reservation staff will strive to oblige, but cannot guarantee it. Reservations for Regular Use will be booked for Preferred Plus Units only. 6. Your telephone reservations are taken in the order the call is received. We will send you a written confirmation of your confirmed reservation. This confirmation form must be presented upon checking into your unit. 7. Any person checking in for Bonus Use or a preferential owner hotel rate will be asked to produce picture identification in addition to an Eagle Crest owner identification card. 8. You are responsible for your actions and the actions of your guests with respect to Eagle Crest facilities. 9. Any owner who reserves a townhome unit for Bonus Use and allows the unit to be occupied by a guest not accompanied by the owner will be restricted from making any Bonus Use reservations for a period of six (6) months from the violation. In the event this violation is repeated, the owner will be restricted from making any Bonus Use reservations for a period of one (1) year from the second violation. Any unit reserved for use as Bonus Use must be occupied by the owner. VROA Regular Preferred Plus Interval, June

7 10. You may be denied reservations if you have monies owing and unpaid to the Association or if you have been suspended by the Association. VROA Regular Preferred Plus Interval, June Forms of Lodging Use and Reservations Regular Use: Regular Use is characterized by seven nights lodging (per Vacation Resort Interval Owned) each Anniversary Year, or every other Calendar Year if an alternate year interval, within your chosen season. Full week: Your seven nights must be used consecutively. The actual dates for reservations are determined by your advance request for confirmed reservations. For stays of seven consecutive days, reservation may be made as much as twelve (12) months in advance of the first arrival date of the desired week number. The first arrival date will always be Friday. The first day to request reservations will always be the Thursday in advance of the desired week number, one year plus one day in advance of the requested Friday arrival date. To improve your chances of reserving a specific week, it is very important to reserve exactly twelve (12) months (plus 1 day) in advance. Summer months and holiday periods, including Spring Break weeks, are in high demand. Example: The first Friday arrival date for week #52 in 2010 is December 24, If you want to reserve this week, your chances of being able to reserve this week under the first come, first serve reservation system will be improved if you call Thursday, December 24, 2009 beginning at 8:00 A.M. Call on this date regardless of whether you are seeking Friday, Saturday or Sunday check-in. Split Week: Only Holiday Plus Intervals may be reserved and used on a split week program. If you are the owner of a Holiday Plus Interval, your seven nights may be used in 4 and 3 night increments and may not include more than one Friday and Saturday night. The actual date of reservation can be made eight (8) months in advance for split week use. A cleaning fee will be assessed at check-in for the second split week usage. Reservations: You may have as many as two separate confirmed reservations, per Vacation Resort Interval owned, within the reservation system at any one time. For Annual Interval Owners, you must use your seven nights within your ANNIVERSARY YEAR within your season, which is that one year time period which occurs each year beginning on the date of the original purchase agreement for the interval. For Alternate Year Owners, you must use your seven nights lodging within the ODD or EVEN NUMBERED CALENDAR YEAR as designated in the original purchase agreement. If you don t use your seven nights in your Anniversary Year or correct Calendar Year, you will lose those unused nights for that particular year. Guests may accompany you or may use your lodging rights with your approval during Regular Use. Reconfirmation: You must RECONFIRM your confirmed reservation at least ten (10) days prior to your arrival date by calling Owner Reservations at When reconfirming, please indicate your estimated arrival time. This will assist the housekeeping staff in scheduling units for service, although an early check-in time will not be guaranteed.

8 Cancellations: Cancellations must be made at least 10 DAYS prior to your confirmed arrival date. You may cancel ONE time per interval owned without penalty per Anniversary Year (or Calendar Year for an alternate year interval). There will be a $20.00 cancellation charge thereafter. The Association will make every effort, but can not guarantee that you will be able to reserve another use period in your current Anniversary Year or Calendar Year for alternate year intervals. If you fail to cancel at least 10 days prior to confirmed arrival date, you shall be considered to have used the entire use period for which the reservation was made. You MAY NOT accrue or carry over unused time from one Anniversary Year or Calendar Year to another and may not be used outside of your purchased season. If you wish to accrue your time through Resort Condominiums International, please read your guide to Vacation Exchanges. No Show Policy: If an owner or guest holding a reservation fails to check-in on the first day of the reservation, the owner or guest is considered a No Show. On the third day of a reservation, if the No Show owner or guest holding the reservation has still not arrived or called the Reservation Office by 5:00 P.M. (local time) on that day, the remaining nights of the reservation may be cancelled in order to open time for other owners. Call the Reservations Office at during business hours to speak with a reservationist. Outside of business hours, call and leave a concise message and your contact information. The Reservations Office will make a diligent effort to reach a No Show owner or guest holding a reservation on the second and third day after the check-in date has passed; however, if the Reservations Office is unsuccessful making contact and the No Show owner or guest has not called the Reservations Office as described above, the Association has the right to cancel the remaining nights of the reservation and release the time. In this event, the No Show owner forfeits their week, and the Association is not obligated to reschedule. Remember, it s important when making a reservation to leave current contact information (i.e. cellular telephone number, address, mailing address, alternate contact numbers, etc.) in case of situations like this and/or during emergencies. Your reservation team is here to help you. If you have questions about banking time with an exchange company, making or rescheduling a reservation, please call your reservation team at Bonus Use: BONUS USE allows for additional nights lodging AS SPACE IS AVAILABLE, if the unit has not been reserved by other owners entitled to reserve REGULAR or SPLIT WEEK USE. You can reserve BONUS USE by calling five (5) days in advance for lodging in any season. Bonus Use will be confirmed for a minimum 1 night, and maximum of 4 nights per reservation. The reservation office is open Monday through Friday. If the five calendar days in advance fall on a weekend, please place your call on the following business day. For example, if you desire a Thursday check-in reservation, you must call on Monday morning for the following Thursday. If Bonus Use is not available at the time you call for the date requested, your name will be placed on a waiting list for that requested date. In the event any cancellations are received by the reservations staff prior to the requested date, reservations will notify owners in the order in which their names appear on the waiting list. This waiting list does NOT carry forward to dates beyond the date originally requested. VROA Regular Preferred Plus Interval, June

9 The cost of Bonus Use will be set by your Association Board and is structured to cover housekeeping and administration costs. The costs will be set forth in a rate schedule provided to you by your Association. The Association will deposit this revenue in its general fund to help defray its operational costs. During the period from November 1 through April 30, your bonus use lodging will be reserved in any available Townhouse Units within the Vacation Resort Ownership Project. From May 1 through October 31, your bonus use lodging will be reserved in one of the units dedicated by the developer as described in the Bonus Use agreement. These dedicated units will be onebedroom hotel suites at the Inn at Eagle Crest (which sleeps four persons) or other unit types at Eagle Crest as determined by the developer. An additional, adjoining room may be reserved at the owner discounted room rate (not a bonus use rate) to create a two-bedroom suite. Bonus use rates in the hotel are subject to Deschutes County room tax. Cancellations must be made 72 hours prior to the arrival date, or THE DAILY RATE FOR THE FIRST RESERVED NIGHT WILL BE CHARGED TO THE OWNER. GUESTS (INCLUDING CHILDREN AND FAMILY MEMBERS) MUST BE ACCOMPANIED BY AN OWNER. Any owner who reserves a townhome unit for Bonus Use and allows the unit to be occupied by a guest not accompanied by the owner will be restricted from making any Bonus Use reservations for a period of six (6) months from the violation. In the event this violation is repeated, the owner will be restricted from making any Bonus Use reservations for a period of one (1) year from the second violation. Any unit reserved for use as Bonus Use must be occupied by the owner. A preference waiting list is employed for these holiday periods. Under this system, if you are unable to obtain a reservation for a particular holiday period your name will be placed on a preference list in chronological order based on the date your request is received. You will then be offered your requested date as a cancellation comes in to the reservation department. If you do not choose to make a reservation, your name will be dropped from the list and can only be placed on a list again by normal procedures described above. The waiting list is presently used for these holidays: -Christmas -New Years -Presidents Day weekend -Memorial Day weekend -July 4 th holiday -Labor Day weekend -Thanksgiving Exchange It is important to become familiar with your Exchange Company s policies and procedures. As Eagle Crest is a floating time resort, you will first need to contact the Owner Reservation department and confirm a week within your season to be relinquished to the exchange company. We will gladly assist you with your exchange. Exchange companies change values associated with your reserved week in their sole discretion and without notice. 11 Questions and Answers Q: What is my Anniversary Year? A: It is the one year period which occurs each year beginning on the date of the first purchase agreement for the Interval. If the initial Purchase Agreement is dated July 10 th, the Anniversary Year for the interval is July 10 th of the current year through July 9 th of the following year. Q: If I own an Alternate Year Interval, do I have an Anniversary Year? A: No. Your use rights begin and end on the first and last day of an even or odd numbered Calendar Year. An E or an O designation is part of the interval identification number. Q: Can I reserve a specific townhouse unit? A: You may indicate a preference for a specific unit, a river or golf course view unit, and the Association will try to accommodate your request subject to limitation of Regular Use reservations within Preferred Plus Units only; the Association cannot guarantee, however, that your request can be fulfilled. Q: What might prevent me from securing a confirmed reservation? A: Units might not be available for use at the time sought because that time was previously reserved by another Owner. In addition, your reservation request will not be confirmed nor will occupancy of an assigned unit be permitted if you are delinquent in the payment of any amounts owed to the Association or your use rights have been suspended by the Association Board. Q: What are the days of arrival and departure? A: Regular Use Full Week: Friday, Saturday or Sunday. Split Week Use (for Holiday Plus owners only): Any day of the week. Bonus Use: Any day as available. Q: Since I have the right to reserve seven nights of my Regular Use within a Season, what happens if my Anniversary Year begins in the middle of my season? A: If your Anniversary Year begins in the middle of your Season, you will have the right to make Regular Use reservations within the remainder of your Season in one calendar year and the beginning of the Season in the next calendar year. For example, if your Season is the Summer Season, the summer season runs approximately June 15 through September 14. If you own a Summer interval and your Anniversary Year begin August 1, you may reserve your seven nights any time during the two time periods from approximately August 1 through September 14 and June 15 through July 31. Since you may make reservations up to 12 months in advance for each interval in each Anniversary Year, you may even make a reservation request for Use Periods in separate Anniversary Years during the same calendar year. In our example, for instance, provided you did not request a Use Period more than 12 months in advance, you could reserve a seven night Use Period between June 15 and August 1, and another seven night Use Period in the same calendar year between August 1 and September 14 since each Use Period could occur in a different Anniversary Year. In addition, if you own a Holiday Plus Season Interval, you could split your time in four and three night increments in each Anniversary Year, as long as you have no more than two reservations at any time in any Anniversary Year for each interval you own. 12 Q: How does bonus use lodging become available? A: Of the 52 weeks in the calendar year, 51 weeks in each townhouse unit are sold to owners for their Regular Use one-week period. The 52 nd week was not sold and is available to the Association for the maintenance week needed to keep the townhouse units in quality condition. Therefore, the way time becomes available for bonus use is if an owner does not reserve their full week of Regular Use time. Statistically, about 20% of the sold time goes unused for various reasons and becomes available for bonus use lodging. In addition, the developer dedicates onebedroom hotel suites at the Inn at Eagle Crest for bonus use by Regular Preferred Plus interval owners in accordance with the Bonus Use Agreement. Demand for bonus use lodging is highest during summer months, on weekends throughout the year and during holiday periods. Q: Can I reserve bonus use lodging at the Inn at Eagle Crest? A: Yes, in the one-bedroom suites dedicated by the developer for this purpose as described in the Bonus Use Agreement, and only during the period May 1 through October 31 at Bonus Use rates. When a dedicated suite is reserved, adjoining rooms, when available, may be reserved at preferential owner rates as further described in Forms of Lodging Use and Reservations. Q: What will my Association do with revenue generated from Bonus Use? A: The Association will deposit all revenues generated from Bonus Use in the townhouse units into its general operating account to help defray some of the operational costs of the Vacation Resort Owner Association. Bonus Use in the developer-dedicated suites at the Inn at Eagle Crest is retained by the developer to offset hotel operating costs. Q: May I reserve a unit for Bonus Use during time periods in all seasons? A: Yes. Only your Regular Use and Split Week Use (for Holiday Plus owners) are restricted to your owned Season. You may reserve Bonus Use in a regular Townhouse unit between November 1 and April 30 subject to policies and procedures for the Bonus Use Reservations. Between May 1 and October 31, reservations for Bonus Use will be made in one-bedroom hotel suites dedicated by the developer for that purpose or such other units provided by the developer for Bonus Use according to the Bonus Use Agreement. As a reminder, owners of an Alternate Year Interval may only reserve lodging for Bonus Use in either the even or odd numbered year of ownership as designated in your purchase agreement by an O or an E. Use Week Calendar Preferred Plus Seasons means any one of two seasons designated and identified in the Use Week Calendar, being the Summer Preferred Season, or the Holiday Plus Season, which quoted terms shall have the following meanings. (a) Holiday Plus Season means Use Weeks numbered 1 through 23, inclusive, and 37 through 52A, inclusive, in the Use Week Calendar. (b) Summer Preferred Season Means the Use Weeks numbers 24 through 36, inclusive, in the Use Week Calendar. The Use Week Calendar for years 2008 through 2016 is shown on the following pages. 15 Recreational Facilities Golf As a Vacation Resort Owner and Member of the Master Association, you will receive favorable consideration for Resort Course starting times and be permitted to play at rates less than the public posted rates, all as further described in the Master Association Policies and Procedures. Resort Sports Center The Resort Sports Center has many recreational and leisure opportunities for your use while in residence or on a day use basis subject to availability. Racquetball and tennis courts must be reserved in advance by calling the Resort Sports Center Desk. Access to the facility is by the front entrance only. All owners must enter through the front entrance and register prior to use of the facilities. Day use owners must accompany their guests at all times and participate with them in their use of the courts, pool and other facilities. Hours of use and other policies for use and enjoyment of the facilities are posted from time to time at the Resort Sports Center. Day use is available subject to space-availability, and the Resort Manager is authorized to limit day use as necessary to maintain a safe and enjoyable environment. See Pages 19 and 20 for more information on policies for use and enjoyment of the Resort Sports Center and two additional sports center facilities. Pool and Spa Use Access to the pool and spa is by the Resort Sports Center front entrance and all users must check-in with the Front Desk prior to use. Policies for the use and hours of operation will be posted at the pool at the Resort Sports Center. Adults Only hours will be in effect from time to time for the pool and spa. For health and safety reasons, children under the age of six are not permitted to use the spa. Day use is available subject to space-availability, and the Resort Manager is authorized to limit day use as necessary to maintain a safe and enjoyable pool environment. The sauna, located adjacent to the locker rooms, is intended to be an adult amenity. Since the use of the sauna, pool and spa is regulated by state law, policies of use will be posted in the appropriate location and must be adhered to. Other Recreation Facilities The many other recreational facilities such as the hiking trails, the bicycle trails, barbeque areas and playgrounds/parks are available without cost (as they are included in the various Association dues) and are available while in residence or while you are visiting but not staying on your property subject to space availability and other policies posted for use. In order to restrict access of unauthorized persons, the Resort remote area swimming pools will be accessible only by key which can be checked out by owners at the front desk at the hotel or at the Resort Sports Center desk upon presentation of proper identification. 16 Should the Board of Directors of your non-profit association establish costs for any activities or facilities it will be due to the nature of a particular activity and their opinion that those using it should defray the costs as opposed to the Association in general. Guests Guests may obtain access passes to the sports centers located at Eagle Crest for a fee, as described in more detail in the Eagle Crest Master Association Policies for Recreational Facilities (available on the owner website under the ECMA section). Under certain circumstances, the guest(s) must be accompanied by the owner. Guest fees and other policies for use of the Resort Sports Center are determined by the operator of that facility, the Eagle Crest Master Association. Please note the Resort Manager reserves the right to limit day use (for VROA owners/guests not in residence staying overnight at Eagle Crest) as necessary to maintain a safe and enjoyable environment. Rates are posted at the sports centers. Multiple Owner Policy Ownership of your Interval provides full use rights to two (2) adults. As further described in the full multiple ownership policy (available on request), if a Vacation Resort Ownership Interval is owned by more than two adults (i.e. two married couples, two single persons who subsequently marry different people, a married couple and a single person), the owners must select two adults to use all the use rights afforded with the Interval, including reservations and voting rights. All other persons would be considered guests and be governed by policies concerning guests. This selection may be changed by written notice to the Master Association Board. See the Eagle Crest Master Association Policies for Recreational Facilities for information on access passes available for purchase. Ownership Records and Transfer Fee General Policies and Procedures For ownership information to be changed in the Association s records, you must forward a copy of the recorded deed (or equivalent title transfer document) showing the change in title and complete information on the name, address and telephone number for the new title holder. Because significant administrative work is required to process a title change, a transfer fee of $75 will be charged for all title changes (not just for sale transactions) including, by way of example only, transfers to a trust, removing an owner in the event of divorce and adding an owner. No transfer fee is required for name changes (marriage), address changes, nor will it be charged to remove a deceased owner. If a title or escrow company processes a sale transaction, the transfer fee information (along with information on association dues) will be provided to the escrow agents upon their request and the transfer fee will be collected from the purchaser during the process of closing the sale. If a title company or escrow agent does not close the sale transaction, the transfer fee will be billed to the purchaser. It is important to disclose the $75 transfer fee requirement to any subsequent purchaser along with the information you provide on association dues. Until proper documentation is received for a title transfer and the transfer fee is paid, the transferee on the title will not be recognized as the owner of the VROA interval. 17 Damage and Losses All owners are responsible for the proper use and maintenance of Eagle Crest facilities, furnishings and equipment. At check-in, you are asked to review the inventory listing for your unit and to confirm that all items are in good condition. Upon check-out, a similar inventory is compiled and any damages or missing items are assessed to the offending owner. If serious damage or loss is discovered prior to your check-out date, the Resort Manager may require you to immediately vacate the Townhouse Unit, or may require you to post payment for the damage or loss in order to continue your stay. The decision of the Resort Manager is final. You have the right to appeal the Resort Manager s decision to the Association Board at a later date. The Association Board may institute additional policies concerning deposits for damages. The Front Desk staff will notify you of current policies at check-in. These units are your units. If you leave the units in the condition that you found them in, then it will help keep the maintenance and housekeeping costs to a minimum. When you depart your unit, you are asked to assist your Association by reporting anything that has not been satisfactory during your stay. Please use the handy comment card that is in your unit. All of these forms are personally reviewed by Resort Management every week. Large Groups The Townhouse Unit is designed to accommodate six (6) persons. If you plan to host visiting day guests which would exceed a total of ten (10) people per Townhouse Unit (including the maximum of six (6) persons in-residence), please contact the Resort Manager before your guests arrive. In order to preserve the family vacation atmosphere for all owners, the Resort Manager reserves the right to request guests to leave the resort immediately if more than ten (10) people are in a Townhouse Unit. Decorating The right to decorate, paint or make changes in the individual units is exclusively reserved for your Association. Age Limit You may permit persons under 18 years of age to occupy your unit under circumstances that he/she/they are accompanied by you or a guest 21 years of age or older. If a responsible adult 21 years of age or older is not present, the occupants will be asked to vacate the Townhouse Unit immediately. Please remember that guests (this includes dependent children and other family members not on your deed) must be accompanied by the OWNER (not the owner s dependent children) if the lodging reservation is Bonus Use Please keep in mind that any damage or loss due to the occupancy of your guests and/or dependent children will be assessed to you, the owner. 18 Housekeeping The hours between check-out and check-in are reserved exclusively for housekeeping functions. If you arrive early, we will do everything possible to get you into your unit early, however, it generally isn t possible to do it for everyone. There are facilities for changing and showers in the Sports Center complex for your use prior to check-in and after check-out if you desire to remain on the property to use some of the facilities. Upon arrival, your unit will be fresh, crisp and clean and awaiting your enjoyment. Housekeeping services during your stay are available for a fee, by contacting the Front Desk. Laundry Facilities Washers and dryers are located in the units. Personal Items You are responsible for your personal items at all times while at the resort. The Association insurance policy does not extend coverage for your personal items. If the resort staff finds any personal items left behind in the Townhouse Unit, Sports Center or anywhere on the resort property, these items will be kept by the Housekeeping Department until claimed by the owner. Any items not claimed within thirty (30) days will be donated to a local charitable thrift shop. Restricted Activities Dangerous or unlawful substances may not be stored, introduced, or used within the Community. All obnoxious or offensive activities are prohibited in any unit or other areas of the Community. You are requested to control noise and your activities so that you do not disturb other occupants of the Project. In addition, you are requested to monitor your children s activities so they do not disturb other s activities. Pets No animals or pets of any kind are allowed anywhere on the Vacation Resort Ownership property or in any unit. You may contact the Front Desk for information on nearby kennel facilities if you wish to keep your pet nearby while using your resort. The Resort Manager is authorized by the Association to remove animals or pets from a unit and may assess a $250 fine for violation of this policy. For obvious safety reasons but also to avoid a fine for violation of the policy, do not leave animals in your vehicle. This policy applies to anywhere on the Vacation Resort Ownership property. Persons with disabilities requiring the use of a service animal must notify the Owner Reservations department of such need at the time the reservation is made. 19 No Smoking No smoking is allowed in any Vacation Resort unit. The Resort Manager is authorized to assess a $250 fine for violation of the policy. Parking and Safe Speeds Each building cluster has parking designated for those individual units. There is one parking space provided per unit, and two guest spaces per building. Any other vehicles must be parked in the common parking areas on the resort. Parking of recreational vehicles, boats and other over-sized vehicles is not allowed in the unit parking areas. Please contact the Front Desk to arrange short-term overflow parking for these vehicles. For safety and noise restriction, the maximum speed limit is 15 miles per hour anywhere on the property. Families and children are at play, so please observe this speed limit at all times. Appearance of Resort No sunshades, awnings or other similar devices may be used on the balcony or terrace. Draping of any article, including towels, swimsuits, etc. in the unit patio areas or otherwise is not permitted. Soliciting No commercial soliciting is permitted, whether within a unit or the common area, at any time by an Owner, guest, exchange user, or member of the general public. Front Desk THE FRONT DESK IS OPEN DAILY, 24 hours a day. You or your guests will be asked to provide proper identification upon check-in. Telephone calls Telephone service is provided to each unit and any long distance charges will be the responsibility of the owner or exchange user. Personal Charges Personal charges are due upon departure and may be paid in cash or by personal check. In order to discourage billing and to defray costs associated therewith, the Association adds a 20% surcharge if you do not pay at check-out and have to be billed by mail. Guests charges are considered the responsibility of the Owner who requested access for such guest. Firearms The use of firearms on the property is expressly forbidden. 20 Children and General Conduct Children are a vital part of Eagle Crest. To add to everyone s overall enjoyment, the Board of Directors requests that a young person s activities either be under the supervision of a responsible adult or that the youngster be enrolled in youth activities programs under the supervision of a responsible staff member. The Inn at Eagle Crest The Inn at Eagle Crest is a full-service hotel and conference center. As a benefit of your vacation resort ownership, the developer may, but is not required to, offer more favorable rates to Eagle Crest owners for their exclusive use. These rates may not be extended to non-owner guests. Your Front Desk and Reservations staff will have complete information on hotel room rates. You are invited to use these facilities for additional enjoyment of the resort and for meeting or group functions. Security You are requested to report any unusual activity to Safety Services or the Front Desk. In order to restrict access of unauthorized persons, you and your guests are asked to carry your EAGLE CREST identification at all times. Guests will be issued passes at the Front Desk on check-in. Safety Services is here to help you have a relaxed, comfortable stay at Eagle Crest. Enforcement of the Policies and Procedures The Board expects all Owners and their guests to adhere to the requirements set forth in the Association Policies and Procedures and the Declaration. To assist the Board of Directors in the enforcement of provisions of these two documents, the Board has delegated enforcement authority to the Resort Manager. Any Owner or guest who has been advised by the Resort Manager that they are in violation of the Association Policies and Procedures or the Declaration is asked to immediately cease and desist that activity. If any owner or his guest, after being notified by the Resort Manager that they are in violation of the Policies, fails to comply with the Resort Manager s direction, the matter will be handled at the Resort Manager s discretion. Depending upon the severity of the violation, the Resort Manager may require you and your guests to immediately vacate the Townhouse Unit or the property. The decisions made by the Resort Manager are final. You have the right to appeal the Resort Manager s actions at a later date. To do so you must notify the Association Board in writing and the Board will review the matter at its next regularly scheduled meeting. VROA Regular Preferred Plus Interval, June

21 Eagle Crest Master Association Policies and Procedures Summary for Vacation Resort Owners To maximize the use and enjoyment of your resort, the following Policies and Procedures have been established for all Eagle Crest Resort Owners and their guests. This statement of Eagle Crest Master Association Policies and Procedures is intended to familiarize you with the concept of the Planned Community and to summarize some of the important aspects of the Master Association policies and procedures that affect you as an Eagle Crest Vacation Resort Owner. A complete copy of the Master Association Policies and Procedures is available upon request. These policies supplement the Declaration of Covenants, Conditions, and Restrictions for the Eagle Crest Planned Community ( Declaration ) but do not change your obligations as an Owner under either the Declaration or the other Governing Instruments. These policies may be amended from time to time by the Board of Directors for the Eagle Crest Master Association. Definition To assist you in reading the Policies, the legal terms used in the Declaration have been dispensed with here in favor of plainer language. The context should make the meaning clear. To the extent there is any conflict between any provision of these Policies and any provision of the Declaration, the provisions of the Declaration shall control. Membership in the Master Association General Information As an owner of any property interest within the Eagle Crest Planned Community you are automatically a Member of the Eagle Crest Master Association, and a member of the applicable sub-association (Vacation Resort Ownership, Estate Homesite, Fairway Vista Estates, River View Vista Estates, or Eagle Crest Hotel Condominiums). The determination of which subassociation you belong to depends upon the property you purchased at Eagle Crest. As a member of a sub-association, you receive a statement of the policies and procedures of that subassociation which are in addition to the Master Association Policies and Procedures. Master Association Property The entire Eagle Crest Planned Community is operated under the jurisdiction of the Eagle Crest Master Association. The Master Association owns real and personal property and operates various facilities, including the safety services for the entire Planned Community, the main roads, the domestic water and sewer system, certain recreational amenities including the baseball and soccer fields, recreational pathways, and the trails along the Deschutes River. The indoor sports center, outdoor pools and tennis courts are owned by sub-associations and are leased to and operated by the Master Association for the use and enjoyment of all Eagle Crest owners.
