1 Edits by MBT Lakeshore Landing Homeowner's Association Mission Statement 1.0 Background Lakeshore Landing is a private residential neighborhood/community located on the beautiful eastern shore of Seneca Lake ten miles south of Geneva, New York, bounded by forever green Sampson State Park (the former Naval / Air Force training station during WW II and the Korean War) and comprised of 100+ homeowners. The Lakeshore Landing Homeowner's Association is an organization that strives to develop a sense of community through the promotion of common interests, preserving the aesthetics of our neighborhood, enhancing the value of our property, and maintaining a high quality of life within Lakeshore Landing. The core values of the association are: Good Neighbors We are neighbors first, and association members second. There is no better solution than to resolve issues as neighbors. Not all issues will have Association implications. Local Area Involvement We encourage members to become involved in the neighboring community around Lakeshore Landing on various issues that affect our quality of life. Volunteerism - We highly value our volunteers who go beyond the normal commitments of being a resident. Property Each home / property owner will maintain or improve the condition and appearance of their property as well as the properties of the Association realizing that these are the most significant factors affecting our property valuations. Common Good - We will evaluate all issues on their merit to the Association, and the Mission Statement and not with regard to any particular interest group. Continual Improvement We will endeavor to evolve as an Association to the ever-changing times in the policies and judgments we make, while referring to these rules for guidance in our decisions. 2.0 Rules & Regulations The rules and regulations are derived from the Lakeshore Landing Declaration of Covenants, Conditions and Restrictions, the rules developed over time by the board and committees, surveys of members and a vote at 1 P a g e

2 the annual meeting and the recommendations of the document committee. These rules for the community are in addition to the Town Zoning Code and various other local laws that apply to all residents of the Town of Romulus. These rules are posted on the town website: Zoning Ordinance Air Pollution Open Burning Guidelines Dog Control Ordinance Noise Ordinance Regulations Subdivision Regulations The HOA recommends that violations of the town laws be reported to the code enforcement officer, dog control office or the town office, as appropriate. Some of the most common complaints that the Town can deal with include: high grass, parking/storage of commercial vehicle, exterior maintenance, unsafe/vacant structures, junk or unregistered vehicles on properties and dog complaints. The HOA will become involved only when the HOA rules are more stringent than the Town requirements. A form is provided at the end of this document for your convenience. It should be filed with the Town of Romulus, not with the HOA. 2 P a g e

3 2.1 Association Fees and Member Responsibilities When selling it is the responsibility of the property owner to provide the association with the purchaser s name, address, telephone number and date of closing. A copy of these rules should also be provided. Monthly HOA fees: Each fee is per lot/per month: All $22.00* Monthly Assessment Lots $10.50 East Lake Road and East Lake Way Lots $22.75 Common Driveways Lots $10.50 Sunset Court Strip Lots $10.50 Owned by Resident $32.50 Not owned by Resident * $30.00 effective January 1, 2013 Common fees are due on the 1st of the month. After a 30 day grace period, a $25.00 late charge for each month is incurred the first day of the month it was due, each month or portion of months in arrears. Fees may be paid quarterly, semi- annually or annually. Monthly payments must be done through automatic withdrawals. The auto withdrawal form is available on line at the Lakeshore Landing website Homeowners who rent their property: Homes may be rented. Tenant must follow all guidelines for members. Tenants, guests and invitees must follow all rules and regulations of the Association. Owners are responsible for the conduct of their tenants and any damages incurred to association property by tenants, guests and invitees. Must advise the HOA of the name, mailing address, and contact information of all tenants named on the lease or the rental agent. 3 P a g e

4 Must refer to the HOA and this document in the lease and state the need for the tenants to follow the rules. Must provide a copy of these rules to all tenants Other Common areas are maintained by the association. Members wishing to assist in the planting, landscaping or gardening of the common areas should contact the Board of Directors. Volunteers are welcome. 3.0 Property Maintenance All homeowners and tenants must Promptly repair all home and property damage Promptly dispose of all refuse, garbage, rubbish, leaves, and debris Install landscaping that compliments and enhances the character of the existing vegetation, topography and structure Maintain the grounds of each property, including the common elements in front of each home between the sidewalk and street, if applicable Mow grass to a height of six (6") or less and properly trim bushes and trees Maintain property in a safe, aesthetically pleasing, clean and sanitary manner Preserve and maintain designated easements in keeping with these rules, the by-laws and applicable laws and ordinances 4 P a g e

5 4.0 Construction and Exteriors 1. Building lots shall be used for residential purposes and for occupancy by a single family, and for use by their guests and invitees. Strip Lots shall be used for the purpose of providing private or separate recreational access to Seneca Lake for owners, their guests, and invitees. 2. The construction of a dwelling, accessory structures or additions must receive the necessary approvals from the Architectural Control Committee and the local town, county, and state governmental authority, as required. A $500/day fine can be assessed by the Board for projects that begin prior to ACC approval. Unattached structures that have a footprint less than 25 sq.ft. and are less than 6 ft at their maximum height do not require ACC approval, e.g., dog house, children s playhouse. 3. Outbuildings, storage buildings, unattached garages or other structures are allowed on residential building lots with ACC approval provided they are in architectural harmony with the house; sheds for the purpose of storing recreational lake access associated items and tools for maintaining the lot are allowed on Strip Lots with ACC approval. Sheds under 140 square feet do not require a town building permit, but do require ACC approval. Property owners must observe the Town of Romulus set-back regulations for any structures on the property. No outbuildings or structures of any kind may be erected on a vacant building lot. 4. New construction and proposed improvements should: Be compatible with the architectural characteristics of the applicant s house, adjoining houses, and the neighborhood setting. Relate favorably to the landscape, the existing structure and the neighborhood. Consider access, view, sunlight, ventilation and drainage. Relate well to adjacent structures and its surroundings in terms of size. Consider possible impacts on adjacent property. 5. All plans for home building must be prepared by a licensed professional builder, architect, or engineer. Each newly built residence must have a minimum of 1200 square feet, excluding basement, garage, porches, and decks. 6. All plans shall also include a drainage plan. 7. All new houses shall follow the attached driveway design standards (see attachment at end of document). 8. All rubbish must be removed and exterior work completed within one year from the time of start of construction. 9. Interiors of all residences should meet town and county requirements for occupancy. 10. When making application to the ACC, the ACC form at the end of this document must be used. The form is also available on the Lakeshore Landing website or may be requested from any ACC member. The completed application must be submitted to the Chair of the ACC. 5 P a g e

6 The Chair s and contact information is available on the website. 11. Mobile homes and manufactured homes are not allowed. Modular homes are allowed provided they meet the BOCA codes and all state and local building codes for the location of the home. Building plans for modular homes must also be submitted to the ACC. 12. Proper sanitary accommodations must be provided for workers during construction. 13. All fences must be approved by the ACC and constructed of pressure treated wood, cedar, maintenance free exterior plastic, aluminum, dark colored vinyl coated chain link, stone or brick. No fence may exceed 6 feet in height and the ACC must approve the location of the fence. 14. Any fences, exterior lighting, basketball goal attached to a structure or in ground pole, swimming pool, decks, hot tub or other exterior improvement and structures of any kind must be approved in writing by the ACC. 15. All driveways must be paved with stone, brick, concrete or asphalt. Other materials must have approval of the ACC. All driveways must have a proper culvert to aid in water run-off. 16. Burning of garbage or other refuse is not allowed and all other burning must comply with state and town regulations. 17. Garbage or other trash and refuse shall not be allowed to accumulate out-of-doors. 18. Central boiler outdoor units are not allowed within Lakeshore Landing due to the close proximity of homes 19. Propane tanks are to be buried or concealed from the street and/or adjacent properties. 20. Awnings, deck and patio covers of any kind must be approved by the ACC. 21. General landscaping does not require formal approval however a few guidelines must be followed. Bushes and trees should not be planted near the Street so as to obstruct the views of traffic on the road or emerging from a driveway. 22. Owners are responsible for changes to drainage as a result of landscaping. Run-off shall not adversely affect your neighbor. 23. Residents are encouraged to use pesticides and fertilizers that are environmentally sound products. Seneca Lake is why we are here. Let s keep it safe for now and the future. 24. It is the responsibility of the property owner to trim tree foliage so that it does not protrude into the private road ways or overhang on the walkway interfering with pedestrian use of the walks. 25. When considering tree removal please take into consideration the tree s contribution to restraining soil erosion and water run-off, providing aesthetic qualities and a wildlife home which are probably some of the reasons you choose to move to Lakeshore Landing. Intent is to enhance the environment. 26. It is not required that a residential building lot be built on; however the lot must be properly mowed until such time as construction begins. This does not apply to the heavily wooded lots: 6 P a g e

7 45, 46, 62, 106, and 107. Strip Lots must be properly mowed. 27. No commercial trailers, and/or closed utility or storage trailers are allowed to be stored on any lot at any time. The Board may approve occasional exceptions. The ACC must approve temporary structures such as construction trailers and enclosed storage trailers during the construction period. 28. Camping trailer (pop-up, pull behind, fifth wheel and motorhome) storage is permitted as follows: Camping trailer must have a current registration and license. Camping trailer must be stored in an inconspicuous area in a garage, alongside or behind the house. For our purposes the street side is always considered the front. There is no storage on the street, vacant lots or on common areas. The area around and under the Camping trailer must be kept neat. 29. No commercial vans, trucks, tractors or trailers having a gross vehicular weight in excess of nine thousand five hundred (9500) pounds will be permitted to be parked or stored on any lot or adjacent street. 30. Motorized watercraft (i.e. motorboats and jet skis) are permitted as follows: Watercraft must be stored on a trailer. Motorized watercraft must have a current registration and license. When not in active use, motorized watercraft must be stored in an inconspicuous area, in garage, alongside or behind the house. For our purposes the street side is always considered the front. There is no storage on the street, on vacant lots or on common areas. The area around and under the Motorized watercraft must be kept neat. 31. No vehicles shall be repaired or restored on any lot or adjacent street. Any repair and restoration work on a vehicle must be in a garage. 32. Disabled or inoperative vehicles or watercraft must be stored inside a garage and may not be stored on lots without a house. 33. No all-terrain vehicle, off road vehicle, mini-bike, snowmobile, recreational vehicle and the like shall be used or driven on any part of the community, except to enter or exit the property. 34. No signs or advertisements are allowed with the exception of house or lot FOR SALE signs. The sign must be placed on the property for sale. Directional signs are not allowed within Lakeshore Landing. From time to time the Board may consider other signs; however the property owner must seek written approval to display other signs. Signs are exempt from BOD control that meet the following criteria: A) less than 200 sq. inches that are attached directly to the home or are within 10 feet of the home which are not advertisements, political in nature or deemed to be objectionable by the BOD 7 P a g e

8 5.0 PETS No animals, livestock, poultry of any kind shall be raised, bred, or kept on any Lot, except that (a) normal household pets may be kept in reasonable numbers. Pets that are kept, bred or maintained for any commercial purpose are not allowed. Members and guests shall be responsible for cleaning up after their pets and comply with all the state and local laws about dogs. The Town of Romulus is responsible for the enforcement of the New York State laws regarding dog licensing, shelter and control, including dangerous dogs. In addition, the Town has extensive regulations regarding leashing, barking, menacing, committing nuisances, etc. Complaints about dogs should be made to the Town Dog Control Officer. Pet owners are responsible for cleaning up their dog s waste within the neighborhood when walking dogs in the community. Dogs should not be tied outside when the owner is not at home. 6.0 Recreation, Pavilion and Beach, and Satellites Camping is allowed on any lot which has a home erected upon it. Camping is not allowed in any Common Area. For those lots which do have homes, camping is allowed on an occasional basis for periods of time less than one week. Portable lavatories are not permitted on lots except during home construction phase. Occasional exceptions require Board approval. Be considerate of neighbors when utilizing outdoor radios or other sound systems and when entertaining. The Pavilion and Beach is a shared area near residences, please observe courtesies; no loud music or noise. Stack the beach chairs when not in use. Be considerate of neighbors when utilizing the Pavilion and Beach areas after dusk. The areas to the north and south of the Pavilion are privately owned lakefront areas; respect the owners private property rights. Camp fires are allowed in the designated fire pit. Completely douse with water before leaving the area. The Association has a Carry In-Carry Out policy at the Pavilion and Beach areas. Remove all litter in observance of our carry in-carry out policy. The Pavilion may be reserved by members for private events. Contact the social committee to 8 P a g e

9 reserve a date. For the safety of all, the following regulations apply to the common lakefront areas. There is NO lifeguard on duty, swimmers swim at their own risk. Never swim alone. Children under 12 years of age must have adult supervision. No glass containers in the beach areas. No watercraft in the swimming area and no fishing in the swimming area from May September. Members using boats and motorized watercraft should be aware of all boating safety requirements for their equipment. 6.1 Satellites. Use of of satellites and exposed antennas are regulated by the FCC and the OTARD rule (Over-the Air Reception Devices Rule, adapted in October, Installation is controlled by this Federal statute and are also subject to safety restrictions as provided by local building statutes. The ACC does NOT add any additional rules in this regard. (used to say No exposed antennas, except satellite TV, shall be installed or permitted on any Lot. 7.0 Lakeshore Landing HOA Dock Guidelines Dock construction must adhere to Army Corp of Engineers Regulations (see If a proposed dock structure does not meet all restrictions delineated below, the homeowner must apply directly to the Army Corp asking for a variance to the rules along with the justification for such variance. If the Army Corp approves the variance, then the ACC also approves the variance. All new docks and improvements to existing docks must be approved by the ACC using the following guidelines. 1. There will only be one dock per home. 2. All new docks must be approved by the LSL HOA Architectural Control Committee (ACC), as well as any other local, state or federal agency, prior to the start of any work (see first sentence of this section). Docks must be in compliance with all governmental (ACE, state, town) dock regulations. 3. Lake Access Lots are bound by these regulations. 9 P a g e

10 4. Maximum dock length: No dock shall extend waterward more than 100 feet from the ordinary high water shoreline (defined by Army Corp for Seneca Lake at ft.) 5. Dock walkway width: 3 feet minimum; 8 feet maximum. 6. Maximum dock area: No dock shall exceed a total area of 1200 square feet including walkways. The use of fingers, T s or L s is permitted in any configuration from the main body of the dock within the maximum 1200 square feet area and required set backs described below. The deck area shall not exceed 240 sq.ft. (defined as any portion of the structure that is wider than 8 ft). 7. Maximum total surface area of all boat and ski hoists and covered boat slips shall not exceed 900 sq. ft. 8. No side staving is allowed below dock surfaces and sides of canopy structures (boat slip) shall not be closed in so as to not impede views by other residents. 9. Maximum height of top of dock surface(s): No dock surface shall be more than 5 feet above the lake high water mark. Maximum height of any canopy structure is 16 ft from the high water level (447.1 ft is reference level). 10. Set back: All parts of the dock including but not limited to walkways, fingers, T s, L s and hoists will be a minimum of 15 feet from all property lines and from the side property lines extended lakeward. For purposes of this provision, side property line shall include the lakeward projections of such line on the same bearing it had at its intersection with the shoreline.. Strip Lot docks will be 7.5 feet from all property lines. NOTE, the 15 ft setback is 10 ft in the Army Corp standard. 11. Double deck docks are not permitted. 12. Boat hoists: No more than two boat hoists per dock are permitted. Boat hoist sides may not be enclosed in any manner. However, gable ends are allowed. Boat hoist roofs may not be larger those presently installed in Lakeshore Landing. 13. Personal Watercraft: No more than two personal watercraft hoists per dock is permitted.14. No commercial use of docks is permitted. 15. Dock lighting is not to exceed a total of 100 watts for incandescent lighting fixtures or equivalent in LED lighting and, should limit light trespass and be dark sky sensitive. 16. Dock colors shall be earth tones or neutral. Other colors must be pre-approved by the HOA ACC. All appeals shall be submitted to the Army Corp (see beginning of this section). Adopted 7/27/ P a g
