On September 15, 2017, the United States Bankruptcy Court for the District of Delaware (the Court entered the Order (a Approving Sale of Debtors Assets Free and Clear of Liens, Claims, Interests and Encumbrances, (b Authorizing Assumption and Assignment of Executory Contracts and Unexpired Leases, (c Approving the Consent and Settlement Agreement and (d Granting Related Relief [D.I. 273] (the Sale Order On September 28, 2017, the Closing of the sale of certain assets of the Debtors to Corbion N.V. authorized by the Sale Order occurred. 3. Pursuant to paragraph (20 of the Sale Order, within ten Business Days after the Closing, the Debtors were required to file with the Court a list of Assumed Contracts, Assumed Real Property Leases, Excluded Contracts, Excluded Real Property Leases and Designated 1 The debtors and debtors in possession in these chapter 11 cases, along with the last four digits of their respective Employer Identification Numbers, are as follows: TerraVia Holdings, Inc. On October 12, 2017, the Debtors filed the Notice of Filing of List of Assumed Contracts, Assumed Real Property Leases, Excluded Contracts, Excluded Real Property Leases and Designated Agreements [Docket No. 315] (the Original Notice. Attached to the Original Notice as Exhibit A was a list of the Assumed Contracts and Assumed Real Property Leases (the Assumed Contracts Schedule. Attached to the Original Notice as Exhibit C was a list of the Designated Agreements (the Designated Agreements Schedule. 5. In accordance with the Sale Order, the Debtors hereby file this notice to (i supplement the Assumed Contracts Schedule (the Supplemental Assumed Contracts Schedule, attached hereto as Exhibit 1 and (ii amend the Designated Agreements Schedule (the Amended Designated Agreements Schedule, attached hereto as Exhibit 2. 3 The inclusion of any contract or lease on any List is not an admission that such contract or lease is an executory contract or unexpired lease. The Debtors reserve all rights, claims and defenses under all relevant agreements and applicable law on all issues including, without limitation, whether or not such agreements are executory contracts or unexpired leases. 2
