Proposed Rules and Regulations Adopted February 23, 2016 Effective March 15, 2016 Your rights and responsibilities as a Homeowner and those of the Association are formally described in the Declaration of Condominium for Town Center Residential Condominium 7. You received a copy of this document at or before the closing of your Unit. If you have mislaid your copy you can purchase another from the Manager. The governance of Town Center Residential Condominium 7 Owners Association is outlined in its Bylaws. The affairs of the Association are governed by a Board of Directors, whose members are elected by the Homeowners. The Board of Directors is responsible for the management of the building, and has hired professional management to supervise the day-to-day operation of the building. The Manager's responsibilities include such matters as hiring employees, maintenance and repair of the building and its equipment, contracting with vendors and service providers, ensuring the building's safety and security, developing and implementing an annual operating budget and capital budget, and dealing with the needs of individual Homeowners. The Board of Directors sets the overall direction, policies and specific Rules of the Association with the help of Committees of the Board. These Committees include: [List of various committees that will be ongoing]. Committee membership will be comprised of several Homeowners and Board member(s). The Association holds an Annual Meeting for Homeowners each year and informational meetings as needed during the year. The Board of Directors meets at such times as are determined by the Board and more often as and if needed. Committees meet as necessary. Homeowners are welcome to attend meetings of the Board of Directors other than those parts of the meeting that are closed pursuant to the provisions of the Virginia Condominium Act. Notice of all regular and special Board meetings is posted conspicuously on the Condominium Property at least 3 days prior to any such meeting. 1. GENERAL INFORMATION a. Phone Service i. You are responsible for arranging installation of your phone service. You may contact the service provider of your choice. b. Utility Service i. The Association pays for electricity, water, and gas. Each unit is sub-metered for its usage and billed on a monthly basis. You are responsible for having utility service transferred to your name. Contact Association Management at Note: a $50.00 late fee will be assessed if the bill is paid more than ten (10) days after the due date. ii. If you are renting your unit, utility bills must remain in homeowner s name and will be mailed the homeowner s Association address of record. c. Cable Television Service i. The Association provides basic cable and internet service. Please contact Verizon (800) to set up your account and add any additional services. d. Financial Information i. Association Fees 1. You will receive a coupon book at the beginning of the year or soon after taking possession of your unit for your monthly association fee. These fees are due on the first 1

2 of each month. All payments received after the 10th are subject to a late charge of the greater of Fifty Dollars ($50.00) or five percent (5%) of the amount not timely paid and a like amount each 30 days thereafter during which such monies are not paid. Make checks payable to "Town Center Residential Condominium 7 Owners Association Inc." or you may make arrangements to have the fee automatically deducted from your bank account each month. Contact the Manager to make the arrangements necessary for this service. Please remember, the staff CANNOT waive the "late fee" charge. e. Incidental Fees i. Incidental fees - such as additional keys and HVAC filters are billed when the service is complete and due and payable by check or money order made out to Town Center Residential Condominium 7 Owners Association, Inc. IMMEDIATELY (receipt provided upon request). 2. INSURANCE a. Each Unit Owner and lessee must obtain appropriate insurances to cover his unit (minimum liability requirement is $300,000.00). b. Each Unit Owner and lessee must provide a copy of his/her Certificate of Insurance to Association Management no later than April 15, 2016 and immediately upon renewal of any policy at: Town Center Residential Condominium 7 Owners Association, Inc Commerce St. Att: Office Virginia Beach, VA Fax c. Renters insurance must provide liability coverage in the minimum amount of $300, SECURITY POLICIES a. Security is vitally important at Town Center. No one may be admitted into a residence by the Westin Residences Staff without permission. We ask that you carefully review our admission policies. b. Entry Authorization i. Written permanent or temporary entry authorization for any guest or service person may be given to the Westin Residences Staff at any time. PLEASE NOTE: Building Staff may refuse entry into your Unit if written authorization is not current. Permission may be granted through the Association s web-site ( c. Visitors And Guests i. The Courtesy Desk Representative will announce (by telephone) all visitors to an Owner's Unit unless instructions have been given to waive the announcement. ii. Service Personnel 1. All domestic or service personnel must sign in and out at the Courtesy Desk, unless a Homeowner has provided them with authorization and access to the Unit. 2. Contractors must make separate arrangements with the Manager for any of their personnel to enter or leave the building. iii. Written authorization must be on file for entry into a Unit during times the Homeowner is not present in the Unit. d. Solicitations i. No solicitations of any kind are permitted at Town Center Residential Condominium 7. The Association's "no solicitation" policy also prohibits solicitations by Homeowners. e. Warrant Service i. While maintaining the privacy of all residents is of the utmost importance, the staff must comply with the provisions of Virginia law related to the service of legal process, and with the lawful requests of properly-identified law enforcement officials. f. Civil Papers i. On occasion, residents may be served with civil papers such as a subpoena relating to a lawsuit. 2

3 Staff will first verify the identity of the server and the authority under which the server is acting. If the server is not a law enforcement officer the resident will then be called to determine if they would like to accept service of the document. Should the resident decline, the server will be asked to leave the property. A law enforcement officer cannot be denied entry to the Condominium by law. g. Arrest and Search Warrants i. Westin Residences Staff will identify the law enforcement officials. The resident may NOT be notified or forewarned. The official(s) will be directed to the Unit and may ask for a key, or use force to enter, as the appropriate order permits. h. DELIVERIES i. For security purposes and to regulate traffic on the loading dock, all deliveries must be scheduled in advance with the Manager ( ) and must use the service elevator. Loading Dock hours are: 8:00 a.m. to 5:00 p.m. ii. If you will not be home to accept your delivery on the scheduled day, an entry authorization must be completed allowing access to your Unit. The Westin Residences Staff cannot be responsible to verify the condition of items received. i. Moving Small Items into the Building i. In consideration of all residents, the Association does not permit "moving" certain items through the Lobby. You may move small items into and out of the building in the following way, or, at the Manager's discretion, or as otherwise may be specifically approved: 1. Temporarily park your car in the loading area as directed by courtesy personnel and use the service elevator to take your parcels to your floor. Then promptly return and move your vehicle to your assigned parking space. ii. All other moving and all deliveries are to be made through the loading dock utilizing the service elevator. 1. See courtesy desk for elevator pads as needed. Remember you are responsible for any damages to the elevator iii. Small or One-Item Deliveries 1. Only small items that may fit conveniently on the valet cart such as luggage, groceries, dry cleaning, etc. will be permitted through the front lobby. iv. Caterers must enter and exit through the loading dock and must be properly signed in and out by Westin Residences Staff. 4. SMOKING: Smoking is not permitted in the common areas, including the lobby, Owners Lounge, common hallways, stairwells, storage room floors, or elevators. 5. COMMON AREA OBSTRUCTION: No resident or guest shall place or cause to be placed in the common hallways, stairways, and storage areas or facilities of a similar common nature, any furniture, packages or objects of any kind. Such areas shall be used for no other purpose than for normal transit. 6. STAIRWELL - Stairwell doors may never be propped open at any time for any reason. 7. RECREATION: a. No one shall engage in recreational activities in the lobby, corridors, halls, stairways, and elevator or on the docks, nor shall any person use recreational equipment, including but not limited to, devices as rollerblades, skates, or skateboards in any Common Element areas. 8. NOISE: All persons shall reduce noise levels, including sounds or vibrations which may be transmitted by electronic equipment or recording devices, between the hours of 11:00 PM and 8:00 AM, or at such other times as requested by Unit occupants, condominium housekeeping staff, or any member of the Board of Directors. Respect for your neighbor is expected at all times by all occupants. 9. LUGGAGE CARTS: luggage carts are provided in the first floor lobby area. They must be returned promptly to the first floor lobby so as not to inconvenience other residents. Carts may not be removed from the building. Luggage carts are for the exclusive use of residents. 3

4 10. STORAGE UNITS: a. Many Homeowners have been deeded a storage Unit for the Homeowner's exclusive use. The space is a limited common area of the Condominium, appurtenant to the Unit whose Owner is entitled to use it. Maintenance and upkeep of the closet is the responsibility of the Homeowner. Please remember that the Association has no liability for the contents stored in these areas. i. No structural changes may be made to this area without the prior written approval of the Association. (Non-flammable shelving, however, is permitted without prior approval). ii. No flammable material is to be stored in the storage closets. iii. Appliances of any type may not be plugged into any electrical outlet without Board approval. 11. PLUMBING: a. Effective April 15, 2016, all units must have upgraded, braided or hard piped, water feed lines to all appliances including but not limited to refrigerators, dishwashers, washing machines and toilets. Failure to comply will be deemed negligence on the part of the unit owner. Such deemed negligence means the Unit Owner will be held responsible for the cost of repairs to damaged common elements and or other units if one of the water lines serving only your unit breaks or leaks causing such damage. 12. TRASH CHUTE: a. The trash chute is used as intended. i. When using chute, follow all, if any, posted instructions carefully; ii. All trash must be secured in plastic bags before depositing in trash chute; iii. Be sure to secure newspapers in plastic bags. iv. Boxes too large to put in the trash chute must be taken BY THE HOMEOWNER to the ground floor parking garage on the south side of the Condominium for disposal; they must NOT be left in the halls. We do not have sufficient staff to remove articles left in the halls; v. If the trash chute is inoperable for any reason, do not leave bagged trash in the trash room. The Fire Department requires the trash rooms to be clear at all times; vi. The Homeowner is responsible for preventing any contractor working in his/her Unit from using the trash chute. All debris created by contractors should be removed from the condominium property by the contractor. vii. Notify Westin Residences Staff of any problems with the thrash chute. 13. COOKING INDOORS/OUTDOORS a. In order to prevent cooking odors from entering other Units, when cooking use the exhaust fan over the cook-top, close your front door into the foyer, and keep all exterior doors and windows CLOSED while cooking. Due to the building design, opening a window or exterior door allows air to be drawn in, and forces odors out into the corridors, which will then be drawn into other Units. b. The use of outdoor grills (gas or charcoal) on balconies is prohibited by fire code. 14. PARKING AND TRAFFIC a. Traffic signs, Parking Rules and Regulations must be observed at all times. b. Any unauthorized or improperly parked vehicles on the property MAY BE TOWED at the vehicle owner's expense. c. Visitor/Guest Parking i. Visitors and guests and service personnel may park in the public parking garage in Town Center 7 that is a part of the master Town Center Condominium 7; There is no long-term visitor parking at any time; ii. Long-term guests, whenever possible, should park in host's unused assigned parking space. iii. Please direct all service providers to use the loading dock and to sign in and out at the courtesy desk. iv. If you provide, rent, or give your assigned spaces to someone else, you must advise the Westin Residences Staff of the details; 4

5 v. Do not block (in any way) an entrance or exit, a vehicle parking space (whether occupied or not) or any garage gate or door (open or closed); 15. PETS In order to maintain the beauty of our residence and grounds, pet owners must carefully follow the rules and guidelines established by the Association. These rules and guidelines are created to allow convenience for those who have animals and consideration for those who do not. a. No more than two domestic animals (cats or dogs) be maintained in any one Unit; b. All pets must be registered with the Association. (see appendix for registration form) c. An annual service fee of $60.00 (subject to annual review by the Board of Directors) will be assessed against all units with dogs to defray the added expense of maintaining the common elements. This fee is due and payable on January 1 st of every year. The fee for FY 2016 is due on April 15, 2016 d. All animals are to be on a leash at all times when they are outside of the Unit. e. Pets are not allowed in the pool area, exercise room, or Owners Lounge except as required by the Fair Housing Act. f. Pets are not permitted to run loose outside a Unit; g. Any waste materials left by your animal in the elevators or in any part of the common elements is the owner's responsibility to clean up. h. Pets are not to be left unattended on balconies; i. Should any pet create a hazard or nuisance such as excessive noise or aggressiveness the owner may be asked to remove the pet from the building. 16. UNIT BALCONIES a. Balcony Furnishings i. Due to the likelihood of high winds, balcony furnishings and decorations must be secured. Rugs, furniture and other objects can blow off balconies and land on the street or other parts of the building. To prevent possible damage or injury, all balcony items must be secured. b. Outdoor Cooking i. The use of outdoor gas or charcoal grills is prohibited by the City of Virginia Beach fire code. c. When you water plants on the balconies, do not let the overflow water run off your balcony, such run off can cause damage to Units below (dirty windows and stain the concrete panels). i. A saucer must be used under all planters to prevent water runoff. d. Balconies should only be damp mopped. e. Other Rules Regarding Balconies i. Signs may not be displayed from balconies; ii. Bicycles, sporting equipment, rubbish, clothing, bedding, rugs, mops, appliances, indoor furniture or other household items may not be stored on balconies; iii. The discharge of firearms and fireworks from balconies is prohibited; iv. Launching of Drones (RPV s) is prohibited; v. Seasonal lighting on the balconies is permitted beginning the day after Thanksgiving and must be removed by January 7. Lights may only be attached to the balcony railings. The Unit Owner is responsible for any damages caused by the installation of seasonal lighting. 17. WINDOWS a. Window treatment lining when viewed from the street must be white or off-white; b. Tinting of windows or doors is prohibited without Board approval. i. The following window tints have been pre-approved and may be installed without additional Board approval. 1. 3M Night Vision 25 and 3M Night Vision LEASING AND SALE OF UNITS The Town Center Residential Condominium 7 Owners Association has specific Rules you must follow if you plan to lease or sell your Unit. These procedures are intended to make it easier for you to comply with the 5

6 Association s requirements and to ensure the building's security. a. A sales agent may not have an "open house" for showing a Unit. b. The Homeowner is responsible for transferring all keys, cards and Association Documents to the new owner/lessee. If you need to replace any of these items they may be purchased from the Manager. Note: In order to verify that all electronic entry devices have been surrendered, it will be necessary for the Unit Owner to bring all such devices to the Courtesy Desk during normal business hours for verification. Should the count of the devices not match that registered in the system, all of the devices registered will need to be turned off and only those presented will be reactivated. c. Leasing Your Unit review the Town Center Residential Condominium 7 Owners Association, Inc. Declaration Section 13 d. Request a copy a copy of the Move In/Out Rules. e. The following must be included in the terms of the lease: i. Term: initial term not less than 1 year, with no sub-leasing, per the Declaration. ii. The lease must contain a clause stating that the Lessee has been provide with and agrees to abide all the provisions of the Declaration, Bylaws, and Rules & Regulations of the Town Center Residential Condominium 7 Owners Association. iii. The Lessee is required to maintain Renters Insurance in the amount of $300, A copy of the insurance certificate must be provided with the lease. f. Give the Manager written authorization to allow the listing agent to enter your Unit. Either the Owner or the listing agent MUST be present when your Unit is shown. g. Upon signing the lease, give the Manager: i. A copy of the signed lease with a check for the move-in fee. ii. The names and contact information to include address of all those who will be living in the Unit (not more than 2 persons per bedroom) iii. Your new permanent or temporary address and phone number iv. The completed Move In/Out Form. h. Selling Your Unit i. Give the Manager written authorization to allow the listing agent to enter your Unit. Either you or the listing agent MUST be present when your Unit is shown; ii. Upon request and after payment of the standard fee, Management will provide the Disclosure package that will provide information concerning the budgets, amenities, association fees, and Condominium Documents. iii. Review the Move In/Out Rules for yourself and the new owner. iv. After the sale, give the Manager a copy of the HUD 1 Statement or the deed, along with the names and contact information of all those who will occupy the Unit (not more than 2 persons, per bedroom); 19. MOVE-INS AND MOVE-OUTS a. All Move-Ins and Move-Outs must be coordinated with the Manager and times and schedules are subject to the Manager's discretion. b. For security purposes and to regulate traffic on the loading dock, all move-ins and move-outs must be scheduled in advance with the Manager ( ) and must use the service elevator. Loading Dock hours are: 8:00 a.m. to 5:00 p.m. c. There is be a nonrefundable service charge of $ for exclusive use of the elevator. A check or money order must be written in the amount of $ and made payable to TCRC7. d. Scheduling A Move i. Contact Building Management for a copy of the form specifying the procedure, rules, and moving fees involved in moving in/out. This form must be signed by owner and mover at least one (1) week prior to the move so arrangement can be made for the service elevator and additional 6

7 security if needed. ii. Moving dates may be scheduled with the Manager at the Manager's discretion. No moves may be scheduled for Sundays or Legal Holidays (Emergencies will be considered on a case by case basis.). All work must begin after 8:00 a.m. and must be completed by 5:00 p.m. iii. Professional movers must be licensed and insured. iv. Moving fees are subject to change without notice. Confirm the current fee amounts when you make your reservation. 20. CONSTRUCTION RULES a. Making Changes To Your Unit i. Before making any additional alterations, or improvements to your Unit, Parking Space, Limited Common Area, or anything else in the Building, please carefully review and comply with all of the provisions of the Declaration, Bylaws, and Rules and Regulations. ii. First and foremost. DO NOT UNDER ANY CIRCUMSTANCE, CUT, DRILL, CHIP, CORE, OR IN ANY WAY PERMIT ANY PENETRATION OF ANY PART OF THE BUILDING FLOOR SLABS, COLUMNS, OR ANY OTHER PART OF THE BUILDING STRUCTURE. b. To protect the Building and its many common systems, it will be necessary for you, before undertaking any additions, alterations, or improvements to your Unit, to first have your plans approved by the Association's Board of Directors. Your first contact will be through the Manager. c. Prior to beginning any work, all contractors will be required to meet, at the discretion of the Manager, with the Manager and, together with you, read, sign and thereafter abide by our "CONTRACTOR AGREEMENT AND RULES AND REGULATIONS". The extent of required plans and plan review required will vary based on the type and amount of work planned, so please contact the Manager as early in the process as you can. d. The Unit Owner will be held responsible for any damages to the common elements caused by a contractor. 7

8 TOWN CENTER RESIDEINTIAL CONDOMINIUM 7 OA CONDOMINIUM REQUEST FOR OWNERS LOUNGE RESERVATION AGREEMENT I (print name) the owner / resident of unit # am presenting a $ security deposit to reserve the Owner s Lounge reservation on the following date. The time I wish to reserve the owners lounge is from to for the following purpose a. The Owners Lounge is reserved for the exclusive use of residents, Owners or tenants. b. Owners who do not reside at the Town Center Residential Condominium 7 OA are not eligible to reserve the Owners Lounge. c. The Owners Lounge cannot be reserved for an event in which the resident Owner or tenant is not taking part; the resident Owner or tenant who reserves the Owners Lounge must be present during the entire time it is being used. d. The use of the Owners Lounge is limited to the room proper and the deck outside. Use does not include any part of the common hallway. e. All persons using the Owners Lounge shall keep the noise level sufficiently reduced so as not to disturb other residents. No sound producing devices shall be used after 11:00 PM. f. Each person who uses the Owners Lounge shall clean the room of all refuse immediately following the function, placing all refuse in the penthouse trash chute or in the dumpsters located in the loading dock. In addition, floors shall be swept and mopped as needed, table, counter tops and appliances shall be cleaned g. Reservations must be made no later than 48-hours prior to the time of use through the Managing Agent. h. Any Unit Owner delinquent on monthly association fees will not be permitted the use of the Owners Lounge. This also applies to tenant(s) of said Unit Owner(s). i. This reservation is for private use only. It will not be used for commercial (I.e. Mary Kay, Jewelry Parties), political, or other similar events. j. The Owners Lounge may not be reserved for personal use on any holiday. k. An adult must accompany anyone under the age of 18 and assure that their behavior is appropriate. l. For Security purposes the Owner / tenant will provide a list of names of his / her guests to the Front Desk. Only those persons on the list will be allowed up to the lounge. m. A Pre and Post Inspection checklist is to be completed by the Owner / tenant and a member of the Owners Lounge Committee. I acknowledge that I have read and understand the Town Center Residential Condominium 7 OA Condominium Rules and Regulations regarding use of the Owners Lounge. I acknowledge that I am obliged to abide by all Town Center Residential Condominium 7 OA Rules and Regulations. I also acknowledge that I am responsible for informing all guests and contractors (caterers, etc.) of the Town Center Residential Condominium 7 OA Rules and Regulations and supervising them to ensure the rules are followed. 9 TOWN CENTER RESIDENTIAL CONDOMINIUM 7 OA MOVE IN/OUT ELEVATOR RESERVATION AGREEMENT The following worksheet is to be filled out, signed, and delivered to the Westin Residences Management in order to obtain a move in/move out date. Town Center Residential Condominium 7 OA Condominium Request for Move-In / Move-Out Date I (print name) the owner / resident of unit # am presenting a check for a $ nonrefundable fee to reserve the freight elevator for my exclusive use. In addition, the return of my deposit check may be delayed pending the completion of any necessary repairs to the common elements attributable to my move. Date(s) Requested for Move In or Move Out: I acknowledge that I have read and understand the Town Center Residential Condominium 7 OA Condominium Rules and Regulations. I acknowledge that I am obliged to abide by all Town Center Residential Condominium 7 OA Rules and Regulations, including those involving the moving process. I also acknowledge that I am responsible for informing the moving crew of these rules and regulations and supervising them to ensure the rules are followed. If the rules are not being followed, the Town Center Residential Condominium 7 OA building Manager will inform the resident making the move; if this happens, residents are expected to correct the violation immediately. If this does not occur, the building Manager will be required to stop the moving process until the violation is corrected. Town Center Residential Condominium 7 OA recognizes that moves are sometimes delayed despite adequate preparations and the best intentions of the residents. However, it is not reasonable to expect the building Manager to remain in the building for several hours because the moving company has not provided enough movers to finish the job by 5:00 PM or because the movers have arrived too late to finish by that time. Therefore, residents may be directed to delay a delivery or pick up until the next day if it is clear that the move will not be completed until significantly later than 5:00 PM. Loading Dock hours are 8:00 am to 5:00 pm Monday thru Saturday. 10 AGREEMENT FOR CONTRACTORS, THEIR SUBS AND ANY OTHER PERSONS OR COMPANIES PERFORMING WORK FOR OWNERS AT TOWN CENTER RESIDENTIAL CONDOMINIUM 7 OWNERS ASSOCIATION TO PROTECT HOMEOWNERS AND THE SECURITY RESTRICTIONS IN PLACE BY THE HOMEOWNERS ASSOCIATION, TOWN CENTER RESIDENTIAL HAS CERTAIN RULES, RESTRICTIONS, AND REQUIREMENTS OF PERSONS AND COMPANIES PERFORMING WORK FOR UNIT OWNERS AT TOWN CENTER RESIDENTIAL CONDOMINIUM 7 OWNERS ASSOCIATION. 1. All contractors must provide a copy of their current Business License and Certificate Of Insurance 2. All persons and companies performing work for Unit owners at Town Center Residential Condominium 7 Owners Association must sign in at the front desk upon arrival. 3. Subsequent entry and exit should be through the loading dock door. 4. The loading dock doors should remain closed at all times except when tools or materials are being brought in or out. 5. Tools and material may only be transported in the freight elevator. Because the freight elevator at times will be restricted for exclusive use, you must clearly define and schedule the times you will need elevator access, at least 48 hours in advance. Failure to do so may result in you being denied elevator access. 6. Vehicles may only be parked at the loading dock for loading and unloading. Again, if you anticipate using the loading dock, you will need to clearly define and schedule the times at least 48 hours in advance. Failure to do so may result in you being denied access to the loading dock. Parking for all other vehicles that are not involved in a loading/unloading process will need to park in the public parking garage. The manager will review appropriate parking places and floors with you upon signing this agreement. The freight elevator and loading dock are not on a first come, first serve basis. 7. The dumpsters and trash chutes are for Town Center Residential Condominium 7 Owners Association Residents and staff use only. All others must dispose of trash or debris off site. All persons and companies performing work for Unit Owners at Town Center Residential 7 Owners Association are responsible for properly protecting and cleaning common areas, such as hallway floors and walls, and elevators so that they are as clean as they were prior to being used. 8. Working hours are 8:00 am to 5:00 pm Monday thru Saturday. 9. No work such as cutting, painting, sanding, etc. shall be performed in any common areas or on any balconies. 10

11 10. Management must be notified any time any common elements of the building will be worked on or possibly affected by any work in a unit. These common elements include, but are not limited to concrete floors, ceilings or walls, windows, doors, plumbing, electrical, and mechanical systems. 11.
