The Board of Directors of the Shadowridge Owners Association feel you share in the desire to maintain an exceptional neighborhood. The key ingredient in fostering this environment is to meld as a group and still retain individuality. Shadowridge, as a planned community, offers a wonderful lifestyle that requires each of us to respect our neighbors and to adhere to the established policies and guidelines. This booklet provides a condensation of many of the items contained in the Association s Covenants, Conditions and Restrictions (CC&R s). The Board urges you to read this booklet and retain it for your periodic review. 4 GENERAL INFORMATION Shadowridge Owners Association is a planned community of approximately 2,100 single family homes, 400 condominiums, and 1500 apartments. Shadowridge is a diverse community comprised of singles, new families, growing families and retirees. In addition to the dwelling units there are three commercial plazas to support the 10,000 residents. This Master Development lies within the City of Vista, which is located 35 miles north of the city of San Diego, and 8 miles east of the Pacific Ocean. An independently owned and operated golf course and country club is centrally located within the community of Shadowridge and provides aesthetic and social benefits to our residents. The 550 acres of Shadowridge have grown and matured over the years to become one of the most beautiful and desirable communities in the north San Diego County area. Vista s climate is considered most desirable. With temperatures rarely below freezing or above 90 degrees, Vista is sometimes referred to as California s Climatic Wonderland. Some of the other amenities of the area include: a recreational vehicle storage lot (available to residents of Shadowridge for a low monthly fee; contact PCM for information), Thibodo Park (which has tennis and basketball courts, a children s play area, a picnic area and a community center), Rancho Buena Vista Park (which is a 125 acre park with a pond, picnic areas and walking trails), Shadowridge Park (a thirteen acre park with play and picnic areas), Rancho Buena Vista High School, major food markets, specialty stores, restaurants and much more! Shadowridge Owners Association publishes a newsletter entitled the Viewpointe, which contains news and information for Shadowridge owners and residents. There are 27 sub-associations and neighborhoods within Shadowridge. Each has its own unique character and style. The sub-associations and neighborhoods are encouraged to be self-governing. Shadowridge Owners

5 Association s Board of Directors is responsible for the over-all management of Shadowridge. PROPERTY MANAGEMENT COMPANY A professional property management company is contracted by the Board of Directors to implement the management of Shadowridge. Our property management company is PCM (Professional Community Management). Acting on behalf of all of the residents and owners of Shadowridge Owners Association are a number of individual volunteers serving on: THE BOARD OF DIRECTORS The Board of Directors consists of five members, each elected by the Owners to

6 a two-year term at the Association s annual meeting in March. They are responsible for the appointment of committee members, maintenance of the common areas and all financial dealings of the Association, as well as the interpretations and enforcement of the CC&R s. The Board has regular monthly meetings. The meetings are open to the membership and all residents are welcome and encouraged to attend. Meetings are held on the third Wednesday of each month at 3:30pm at PCM, 5950 La Place Court, Suite 250, Carlsbad. There are several standing committees to assist the Board and staff with the day-to-day functions of the Association. The Board of Directors may also create other committees as they deem necessary. In each case, activities are directed toward improving our environment, as well as protecting the rights and preserving the property values of all homeowners. The Association always needs volunteers. If you are interested in being involved in the activities of your Association, please contact any Board member or Committee member or call PCM. A listing of Board and Committee members appears periodically in the Viewpointe. The standing committees are: ARCHITECTURAL CONTROL COMMITTEE The Architectural Control Committee ensures the continuous harmony of individual structures and aesthetics throughout Shadowridge. Committee members, appointed by the Board of Directors, meet with homeowners regarding any architectural or landscaping changes, and review and approve plans. Committee members work with homeowners during escrow, to see that all architectural and landscaping disclosure documents are signed off, and that all work has been completed according to the CC&R s and

7 Architectural Guidelines. They also oversee any major architectural changes to the common area and advise and assist the Board of Directors in architectural matters. GREENBELT COMMITTEE Greenbelt Committee members, appointed by the Board of Directors, assist the Board in overseeing the maintenance and beautification of the common area. They meet monthly and go over any maintenance and improvement needs of each area within Shadowridge to ensure that Shadowridge maintains its reputation as the most beautiful planned community in north San Diego County. They also advise and assist the Board of Directors in greenbelt matters. ADVISORY COMMITTEE The Advisory Committee is comprised of a resident from each neighborhood, a Board member from each sub-association and a representative from each apartment complex and commercial entity. They meet to provide feedback to the Shadowridge Board as well as provide a communications channel between the Board and the community. SHADOWRIDGE POLICIES AND ENFORCEMENT The following general policies are based on the Shadowridge CC&R s, Parking Regulations, Architectural Guidelines and rules and regulations as established by the Board of Directors These regulations may be enforced by the Association s Board of Directors and the violating member may be subject to a special assessment for all costs incurred by the Association in bringing the violation into compliance. Please consult your CC&R s for complete information. If you have any questions, you may contact PCM.

8 RENTING YOUR PROPERTY Members (owners) assume full responsibility for the actions of their tenants and/or guests. They agree to assume all financial responsibility for any damage to common areas or landscape caused by their tenants and/or guests. Your tenants should have a copy of this booklet BEFORE they move in, and should be aware of the responsibilities of living in a planned community. Additional copies of this booklet may be obtained from PCM. USE OF COMMON AREAS The Shadowridge common areas were created and are maintained for the enjoyment of all owners and residents. We in Shadowridge take pride in having one of the most beautifully maintained developments in the area. Please be considerate of your neighbors when using these areas. Damage to the equipment, sprinkler system or landscaping detracts from our enjoyment of these facilities and takes time and money to repair or replace. PARKING/VEHICLE REGULATIONS (Revised 12/01/07) One of the major problems in a planned community is parking. These rules are promulgated to clarify Sections 5.3.6, and of the CC&R s. The purpose of the CC&R s parking provisions is to protect the value of real property for all homeowners within the community. The term Board refers to the elected Board of Directors for the Shadowridge Owners Association. VEHICLE DEFINITIONS Car or Standard Vehicle: A vehicle designed for the transportation of persons,

9 not falling within any other definition or prohibition of these regulations, and which falls within the definition of family automobile as that term is commonly used. Included in this category are standard sized pick-up trucks, vans and sport-utility-vehicles used for personal or family transportation as defined in these regulations. Standard Size Pick-Up Truck: A vehicle, falling into the definition of a pick-up truck as that term is commonly used, in its originally manufactured (unmodified) condition. Standard size pick-up trucks shall not include trucks with dual wheel body style, racks or a shell that is significantly higher or wider than the cab. Standard size pick-up trucks shall not exceed twenty-one (21) feet in length or eighty-six (86) inches in height. Van: A vehicle, falling into the definition of a van as that term is commonly used, which is designed primarily for the transportation of persons. A passenger van with manufacturer installed luggage racks shall be considered a standard vehicle. A van with no side windows or outfitted for recreational use shall be considered a recreational vehicle. A van with no side windows or outfitted for commercial use (cargo van) shall be considered a commercial vehicle. Maximum height for any vehicle may not exceed eighty-six (86) inches. Prohibited Vehicles Truck: A vehicle designed, used or maintained primarily for the transportation of property. A truck with dual wheel body style, racks or a shell that is significantly, higher or wider than the cab is not considered to be a standard size pick-up truck and is prohibited. Commercial Vehicle: A vehicle designed, used or maintained for the transportation of persons for hire, for profit, or for business purposes. Any vehicle

10 with no side windows, or outfitted with a commercial roof rack or construction rack, commercial markings, or any exterior equipment normally used for commercial purposes shall be classified as a commercial vehicle. Vans with no side windows or outfitted for commercial use (Cargo Van) shall be considered commercial vehicles. Camper: A vehicle on or in which there are facilities for human habitation, or camping or recreation purposes. Mobilehome/Motorhome: habitation. A vehicle designed, used or maintained for human Trailer: self-powered. A vehicle designed for carrying persons or property and which is not Recreational Vehicle: A vehicle which is sold or advertised as a recreational vehicle or RV by its manufacturer, or which is designed, used or maintained for purposes of human habitation, camping, amusement, social activities, entertainment, pleasure or sport. Any vehicle having top lights, roll bars, or any such equipment normally designed for off-road or recreational use, shall be classified as a recreational vehicle. Vans with no side windows or outfitted for recreational use shall be considered recreational vehicles. Inoperable Vehicle: Inoperable vehicles shall include any vehicle which is not currently registered or insured, or which is unable or not legally allowed to operate on public streets. Vehicle Exceeding Eighty-six Inches in Height: Any vehicle that exceeds eightysix inches in height is prohibited. VEHICLE AND PARKING REGULATIONS

11 1. Vehicles shall be garaged when not in use. The Board of Directors shall have the authority, after notice has been given to tow (at the vehicle owners expense) any vehicle that is parked outside in violation of the CC&R s or rules and regulations adopted by the Board. 2. Commercial vehicles must be garaged. 3. Motorcycles, inoperable vehicles and recreational and utility vehicles, such as golf carts, trailers, all terrain vehicles, or any other vehicles which fall into a prohibited category, must be garaged. With the exception of commercial vehicles, the garaging of these vehicles shall be in addition to the required garaging of approved/ standard, regularly driven vehicles. If a garage cannot accommodate the parking of all standard vehicles plus inoperable, recreational, utility or other prohibited vehicles, such vehicles must be stored elsewhere. 4. Vehicles that otherwise meet the Approved Vehicle requirements but have significant rust(as determined by the Board of Directors), mismatched or significantly faded paint, primer or non-automotive paint, oil or automotive fluid leaks, body damage or other exterior damage, must be garaged. 5. No trailer, camper, mobile or motorhome, recreational vehicle, commercial vehicle, truck (other than standard size pickup truck), inoperable vehicle, boat, motorcycle, or similar equipment shall be parked on any street, driveway or designated parking area. An RV storage lot is available to residents of Shadowridge. 6. Recreational vehicles may be parked temporarily for the purpose of loading or unloading only, for a period not to exceed twenty four (24) hours. Short term storage may be available at the RV lot for Shadowridge residents and may be available to rent.

12 7. The storage of any vehicle outside a garage for more than ten (10) days and not used on a regular basis is prohibited on any private lot or common area within Shadowridge. 8. When residents have more vehicles than garage parking spaces, or a standard/approved vehicle which will not fit in their garage, they must apply to the Board of Directors for a variance to park outside of their garage. There is an administrative fee of $100 per outside vehicle to process a parking variance request. 9. The Board of Directors may consider exceptions to these regulations when an explanation with a request for a special or temporary variance is submitted in writing. VIOLATION ENFORCEMENT COSTS Property owner may be subject to a special assessment for parking enforcement. These accumulated enforcement costs may be substantial. Per the Shadowridge Owners Association CC&R s, articles 16.1 and 16.7, the association may also assess additional legal costs associated with enforcement. SHADOWRIDGE OWNERS ASSOCIATION CC&R S SECTIONS AND Vehicle Restrictions No trailer, camper, motorhome, Recreational Vehicle, commercial vehicle, truck (other than standard size pickup truck), inoperable automobile, boat, or similar equipment shall be permitted to remain, to be constructed, or repaired upon any

13 area within the Property, other than temporarily for purposes of loading or unloading passengers or personal property. However, the vehicles listed may be maintained within an enclosed garage or carport or obscured from view of adjoining lots, streets or alleys by a fence or appropriate screen. The vehicles may also be stored in an area specifically designated for such purpose by the Board. (a) Commercial vehicles shall not include sedans or standard size pickup trucks which are used both for business and personal use. Any signs or markings of a commercial nature on such vehicles shall be prohibited. However, such commercial vehicles may be allowed in designated Commercial Areas. (b) No noisy or smoky vehicles shall be maintained or operated upon the Property, except as reasonably necessary to the execution of the rights or duties of the Association under this document. No trailer, camper or mobile home shall be allowed to be parked on public streets within the property. Any such parking shall be considered a nuisance. (c) Any fences, screens or screening required under this Article shall comply with the Architectural Control Guidelines as to size, color and other qualifications. (d) The Board shall have the power to enact and enforce Rules and Regulations governing vehicle parking including but not limited to garage parking, driveway parking, the definitions for each category of vehicle, and enforcement costs that may be assessed for violating the rules Use of Garages (a) THE PRINCIPAL USE OF GARAGES SHALL BE FOR PARKING VEHICLES. Garages shall be used in such a manner as to accommodate the parking of at least the number of vehicles (cars, trucks, or vans) for which the

14 garage was designed. Unless a variance is obtained, vehicles must be parked in the garage, and the parking of vehicles in the driveway or street is prohibited. Permanent living quarters, exercise rooms or excessive storage areas which displace a vehicle are prohibited in any garage. (b) Garage doors shall be closed except for temporary purposes such as when vehicles are being loaded or unloaded. Driveways must be kept free of oil, grease, paint, rust and other unsightly materials. (c) Fines or individual assessments may be levied against Owners for violations by Owners or their invitees, employees or tenants (e) Owner Discipline The Board shall have the power to remove any vehicle within the project parked in violation of this restated declaration or the Rules and Regulations adopted by the Board regarding the towing of vehicles. PLEASE NOTE: If you live in a sub-association your parking regulations may be more restrictive than those of the Shadowridge Owners Association. PET REGULATIONS 1. All dogs are to be leashed while on the neighborhood streets or the other common areas. 2. Cats can become a nuisance to your neighbors. Please consider your neighbors, and protect your cat s health and safety by not allowing your cats to

15 roam the neighborhood. 3. Pet waste on the premises is a nuisance and a health problem. Please immediately clean up after your pets. (Shadowridge CC&R s Article 5.6.3) Responsibility for your unleashed pet includes discouraging it from using your neighbor s property to eliminate. Encourage your pets to use their own facilities. 4. Pet enclosures must follow the Architectural Guidelines regarding the location on the owner s lot and the type of materials that may be used in constructing the enclosure. 5. Pets creating a nuisance for Shadowridge residents are subject to action by the City of Vista, the Humane Society and the Association. Please be a responsible owner and keep your dog from barking or otherwise creating a nuisance for your neighbors. If you are experiencing barking dog problems we encourage you to go to your neighbor to try to solve the problem. If this is not successful, several resources are available. You may contact the City of Vista Code Compliance at , ext. 1464, or the North County Humane Society at You may also file a complaint with PCM. ARCHITECTURAL / LANDSCAPING REVIEW AND APPROVAL Each owner shall maintain in good repair and appearance all portions of his lot and improvements. The owner shall care for the landscaping on his lot so that it presents a neat and attractive appearance. BEFORE YOU MAKE ANY CHANGES OR ADDITIONS (ARCHITECTURAL OR LANDSCAPE) BE SURE THAT YOU GET APPROVAL FROM THE ARCHITECTURAL CONTROL COMMITTEE. This includes, but is not limited to:

16 major planting, hardscaping, landscaping, painting, any construction, swing sets, etc. WHEN IN DOUBT, ASK! ANY WORK STARTED PRIOR TO APPROVAL MUST BE TREATED AS A VIOLATION AND A MANDATORY LATE FILING FEE OF $100 WILL BE ASSESSED. ANY WORK, other than rough grading, is considered a violation. Architectural approval forms are available from your Architectural Committee members, PCM or on the association s website: 1. Review your CC&R s and Architectural Guidelines. A current, packet summarizing architectural guidelines, procedures, restrictions and standards is available from PCM. If you have any questions about what is or isn t permitted, consult a Committee representative. 2. Obtaining a City permit does not waive the need for Architectural Committee approval. Normally, the City will not issue a building permit unless Shadowridge Owners Association approval is shown on the plans. 3. If you have work which you feel is of an emergency nature, call your Committee representative. 4. When re-painting your home, if you are using the exact same color paint, no additional forms or approvals are needed. If you are contemplating a change in the color of a project, you will need to submit an architectural approval form to the Committee for consideration. Sub-Associations may have their own color palette and regulations. Please also be sure to check with your sub-association. 5. Minor plantings, such as changing annual flowers or tree removal, do not need approval. Again, if in doubt as to whether your project needs prior approval, ask

17 your Committee representative. GARAGE SALES 1. All residents are required to follow the sign guidelines established by the Board of Directors. Signs may be displayed on weekends only between 9 AM and 5 PM and must be removed the same day as posted. Please refer to section N of the Architectural Guidelines for further sign restrictions. Any unauthorized signs are subject to removal by the Association. Garage sales are limited to two days per year. 2. Prior to time of sale, homeowners must contact PCM for approval to conduct a sale, 3. Review your sub-association CC&R s (if applicable) and the City of Vista garage sale restrictions for additional regulations. SELLING YOUR HOME 1. As required by state law, if you sell your home you must pass along to the buyers a copy of the CC&R s, the By-Laws, and any other regulations that have been made a part of these documents. 2. Any For Sale or Open House signs must conform to the sign guidelines established by the Board of Directors. Signs may be displayed on weekends only between 9 AM and 5 PM and must be removed the same day as posted. Please refer to section N of the Architectural Guidelines for further sign restrictions. Any unauthorized signs are subject to removal by the Association. 3. It is also necessary to have an Architectural Control Committee member

18 complete an architectural and landscaping disclosure before the close of escrow. This inspection is to ensure that all exterior work necessary to meet the CC&R s and current Architectural Guidelines and standards is complete and approved. Please request your property inspection early to avoid delays. DO YOU LIVE IN A SUB-ASSOCIATION? If you live in a sub-association your CC&R s may be more restrictive than the Shadowridge Owners Association s CC&R s. If you have any questions regarding the CC&R s or other restrictions in your sub-association, please contact your community manager or a member of your sub-association board of directors.
