8 Avoidable Requisitions Avoidable if it s clear from Land Registry forms, the register, practice guidance (e.g. practice guides) and Land Registration Rules 2003 what is needed we have given a reminder before lodgement (e.g. on Official Search result) or when rejecting an application the law is well established, e.g. how a deed should be executed or that the extension of the term of a lease takes effect as a surrender and re-grant it is a matter that a diligent conveyancer would have been expected to satisfy themselves prior to completing the transaction. 9 Unavoidable Requisitions Unavoidable if it s not obviously a requirement stated in our forms or practice guidance the point is unusual, obscure or something which could not have been reasonably anticipated by the customer required at the Registrar s discretion under rule 17, Land Registration Rules For more information please see: Land Registry requisitions Practice Guide 50 Requisition and cancellation procedures
10 Requisitions We cannot complete a registration if the evidence you lodge does not satisfy the requirements of the restriction. We will requisition for further evidence if we need it. For example, does a restriction specifically require a consent? If it does, we cannot act on a conveyancer s certificate Practice Guide 19 Notices, restrictions and protection of third party interests. Practice Guide 19A Restrictions and leasehold properties.
11 Discharges If you are acting for an owner redeeming a charge, you must: Get a redemption statement that is as definitive as possible. Warn them about any further borrowing on the mortgage, which may cause a delay in the lender issuing the discharge. Practice Guide 31: Discharges of charges
12 Variations in names A disposal of the legal estate must be made by all the registered proprietors. Avoid problems by: checking the name carefully. If a person s name in a deed is different from that in the register, you need to account for that change, even if that person is coming off the register providing evidence to account for any discrepancies and confirm the correct name to be entered in the register
13 Execution of Deeds Avoid common problems with executing deeds by checking: each party s signature has been witnessed, and that the witness details have been included you are using the correct form of execution for the person or organisation involved Avoid the two main types of errors with powers of attorney by enclosing: a copy of a power confirmation of identity for an attorney, as well as the donor of the power when this is required Practice Guide 8 Execution of deeds
14 Confirmation of Identity We have to reject applications that are lodged without a required confirmation of identity. deed poll a statement of truth or statutory declaration When including ID for attorneys, enclosing a copy of power with an application is not sufficient by itself.
