5 Summary of Deed Restrictions for Gasparilla Preserve -The designated land use for this subdivision is A.E. (Agricultural Estates) single-family residential estates uses and structures only. -Mobile homes, modular homes/buildings, are not allowed. -Any /All improvements must be approved by the Architectural Review Committee. -The designated land use for this subdivision is A.E. (Agricultural Estates) for single- -- family residences. -Parcel Acreage may include water and land. -Horses are allowed. -No buildings may be constructed prior to construction of a single-family residence on a lot without written permission of the developer. -Non-Commercial (private) garages only, each of which shall be constructed for no less than 2 vehicles. -In addition to the single family residence, and attached guest quarters, no more than 2 storage structures, barns and extra garages per lot/tract. -Gazebos, surrounds for wells or filters, shade for animals, may be constructed in addition to the two detached structures. -No parcel shall be subdivided. -Living area must be at least 2000 sq. feet living area. -No combustible powered boats; jet boat or jet skis shall be operated in the Keyhole Lake. -No livestock or poultry in subdivision. -No loud or objectionable noises, or obnoxious odors may be emitted which may cause a nuisance to other occupants. -No temporary living quarters will be allowed. -No barbed wire shall be allowed any place in the subdivision. -No chain link fences allowed on the front of any parcel, nor along Rotonda Trace. -The first 50 ft_ of each driveway on a parcel commencing from a roadway must be paved with concrete or other hard surface. -There will be a mandatory Home Owners Association. -There will be an Architectural Review Board. -All unsightly growth, trash debris or waste which might constitute a health hazard or which will distract from the beauty and appearance of the subdivision, will be removed by the owner. -Owners may, after obtaining the proper permits, construct a lake or pond provided no fill dirt obtained should be removed from said tract. -No commercial activity. -All utilities shall be underground. -Charlotte County Utilities shall furnish the water_ -Septic is allowed. -Horse trail shall be provided within the 80 ft. road easement and as provided on the plat and the subdivision. -Roadways shall be considered private. -Vehicles shall not be used in a manor so as to disturb the property owners nor to impede with the riding of the horses.
