4 Particulars of Sale Location The land is located close to the village of Walton, near to the town of Brampton, and can be easily accessed from the farm road. Directions From the village of Walton take the road signposted for Kirkambreck and Roadhead. After approximately two miles, at the junction signposted for Gilsland and Greenhead, branch right, Hardhurst Farm is located on the right after approximately a further quarter of a mile. Turn right into the farm road and the land for sale is located at the bottom of the farm road. The land can be accessed easily using the tracks highlighted on the attached sale plan. Description of The Land The land is divided into three useful sized lots, all of which are currently watered by a metered mains water supply, and one of which also contains an area of attractive Ghyll woodland. The grass fields within the lots have both grazing and/or mowing potential. Lot 3 also benefits from a field barn, constructed of timber and galvanised zinc, which can potentially be used for livestock accommodation and/or fodder storage. 5 Tenure Some of the land is currently grazed by a third party and is subject to a grazing licence, which terminates on the 1 st December The property is offered for sale freehold with vacant possession which will be given on completion. Sporting and Mineral Rights The sporting and mineral rights are included with the property for sale in so far as they are owned by the Vendors. The fishing rights are excluded from the property for sale. Burdens The property is sold subject to all rights including rights of way, whether public or private, rights of light, support, drainage, water and electricity supplies and other rights, obligations and easements, quasi easements and restrictive covenants and all existing and proposed wayleaves for masts, pylons, stays, cables, drains and water, gas and other pipes, whether or not constituted in the title deeds or referred to in these particulars. The Purchasers will be held to have satisfied themselves as to the nature of such burdens and for further details are advised to contact the Vendor's Solicitor, Mrs H Holland, Cartmell Shepherd, Gill Place, Brampton, Cumbria, CA8 1SQ, Tel: The area of Ghyll woodland within Lot 2 (as per the sale plan) is designated as Ancient and Semi-Natural Woodland. A public footpath crosses both Lots 1 and 2. The southern area of Lot 3 lies within Flood Zone Two and Three of the River Irthing. The Vendors have entered the land into a Countryside Stewardship Scheme (CSS) Reference: 11CSS011595, which terminates in October The area of land fenced off from the river on the boundary of Lot 3, and forming part of the CSS is being retained by the Vendors. The CSS encompasses hedge restoration, field margins, boundary maintenance and grassland management options. Further details of the CSS options can be obtained from the Sole Selling Agents. Currently Lots 2 and 3 are watered from a shared mains water supply, which crosses the track between points A and B, as per the sale plan. If Lots 2 and 3 are sold to the same Purchaser then that Purchaser will be required to install a separate water meter on the boundary of Lot 3 alongside the access track. If Lots 2 and 3 are sold separately then the Purchasers will be required to install separate water meters (at the location given above) and the Purchaser of Lot 3 will be required to install a separate water trough. On completion, if required, a right of access will be granted to the land from the farm road. The right of access will be from points X to A for Lot 2, X to B for Lot 3 and X to C for Lot 1, as shown on the sale plan, and maintenance of the farm road and tracks between these points will be on a shared basis. Single Payment Scheme The Vendors received an allocation of entitlements for the 2009 scheme year which provides for Non-SDA entitlements valued at per entitlement. It is anticipated that the entitlements relative to the property will be transferred to the Purchaser at no extra cost over

6 and above the sale price. For the avoidance of doubt, the Vendor will retain the 2010 Single Farm Payment. The Sole Selling Agents are not responsible for preparing or lodging the Single Farm Payment forms with the RPA. Copies of the relevant forms, and the most recent entitlements statement will be available for inspection at the Sole Selling Agent s offices.
