1 Cote d Azur Condominium Association, Inc INTRODUCTION Since publication of the Association s Rules and Regulations on October 1, 1986 the Board of Directors therein has made changes. These changes include amendments, deletions and additions. Recommendations are made by the residents and the Rules Committee and revised every two (2) years. To acquaint themselves with the changes, Association Members are requested to compare this booklet with its predecessor and to become thoroughly familiar with the contents. Strict adherence to the Rules and Regulations by all unit owners, guests and lessees is absolutely essential for condominium living in a pleasant atmosphere and for the preservation of property values. Cote d Azur Condominium Association Rules and Regulations are based upon the experience of the Association and of similar associations as well as upon requirements of state, county, city laws and ordinances and of the Cote d Azur Declaration of Condominium By-Laws. The condominium concept established by statute imposes a fiduciary duty upon the governing body of the association to afford due process and equal protection to each of its members. Each unit owner is entitled to adequate notice of the restrictions being imposed during membership in the association and is further entitled to have the condominium covenants and restrictions uniformly applied and enforced. The Condominium Act gives association fining authority as a tool in the enforcement process. When rules are broken, the offending unit will be referred to the Compliance Committee for a fine of $ per violation. A fine may be levied on the basis of each day of a continuing violation providing that the aggregate does not exceed $1, per violation. No fine may be levied unless the violator has been afforded a 14 day notice and the opportunity to be heard at a duly noticed Compliance Committee Meeting, which consists of unit owners not related to the Board of Directors. The committee will hear all sides of the referred offense and if the Compliance Committee confirms, the fine is imposed. Authority for fines and penalties are addressed in the Association Documents, Article XII, Amendment dated, December 29, 2016 and the Florida Statute 718. The Board of Directors has appointed a Compliance Committee. Owners must obtain copies of the rules for the use of their guests and lessees. Any changes in the Cote d Azur Condominium Association Rules and Regulations that an owner may wish to suggest, should be submitted to the Committee Chairperson or the Board of Directors in writing. 2 CHAPTER I USE AND OCCUPANCY A. GENERAL Condominium living is, for most unit owners, a new concept and requires an adjustment of attitude and a respect and understanding for the rights of other unit owners. Each unit owner must regulate the occupancy and the use of the common area and facilities so as not to unreasonably or unnecessarily deprive or disturb any other owner in the use, occupancy and enjoyment of his unit and of the common areas and facilities. Hence, the need for abiding by the directives set forth in the Declaration of Condominium, the By-Laws of the condominium Association, as well as the Rules and Regulations adopted for the common good. Compliance is required not only of the unit owner but of their children, guests and lessees. Furthermore, in all cases the unit owners and/or their lessees are held responsible for their behavior and compliance as well as that of their children and guests. It follows that they become financially liable for any damage they may cause to any portion of the common areas, facilities and other Association property. GUESTS All dwelling units are restricted exclusively to residential use. No business activities shall be conducted. 2. Of necessity, condominium living space is limited, and in order not to infringe on the rights of others, it becomes necessary to limit the number of occupants residing over night to six in any dwelling unit. This limitation applies not only to the unit owner, but when he is not in residence, to his guests or lessees. Accompanied Guests: Accompanied Guests are defined as guests of the unit owner that are occupying the unit while the unit owner is in residence. Accompanied Guests do not require a guest fee but if they are in residence over 30 days, they must submit an application and fee and pass a background check. 2. Unaccompanied Guests: Unaccompanied Guests are defined as guests of the unit owner that are occupying the unit or utilizing the premises while the unit owner is NOT in residence or present. Use and occupancy of a dwelling unit by Unaccompanied Guests or others, in the absence of the unit owner, shall be permitted only if the following procedures are adhered to: Unit Owners must register all Unaccompanied Guests with the office 72 hours before they a. arrive. A guest information sheet must be completed including the length of stay and any fees. b. Unaccompanied Guests Related: Only antecedents and descendants of the unit owner are permitted to occupy the unit, without a guest fee. Brothers, sisters, aunts and uncles, etc., require a $50 guest fee. Proof of the relationship will be required. c. Unaccompanied Guests not related: A person who is not related to the owner, staying in a unit in the absence of an owner. Owners may have Unaccompanied Guests not related once (1) in a quarter for not more than 30 days. The 30 day stay may not be in consecutive days so as to combine 2 quarters. (For example; last 30 days in March and first 30 days in April.) Such guests require a $50 guest fee. 3. On arrival, the Unaccompanied Guest must register with the Association office the first business day after arrival. 4. The unit owner shall furnish the necessary access keys to their guests and shall instruct such persons to acquaint them with the basic Rules and Regulations applicable to the use of the common areas and facilities of the Association. 5. Failure of the unit owner or the occupant to comply with the above directives shall result in a referral to the Compliance Committee. Modified 3/2017 Page - 2 -

3 6. No children under eighteen years of age are permitted to reside, even temporarily, in any dwelling unit, unless accompanied by an authorized adult, who is in residence at the same time. B. APARTMENT UNITS 1. Unit owners MUST follow the Closing of Unit Procedures as outlined below to protect their property and that of their neighbors during their absence; a. Set thermostat on 76F-78F. The AC must be left on during an owner s absence b. Turn main water off. (Located in A/C closet in corridor). c. Turn circuit breaker off in laundry room for hot water heater, the stove, oven, microwave, washer and dryer. d. Remove furniture and other articles from balconies unless perimeter shutters are in place. e. Close shutters. 2. Additional Rules for Apartment Units a. Unit owners are solely responsible for the maintenance and repair of their own apartments. b. No flammable or explosive materials shall be kept in units. c. No radio or TV antennas, satellite dishes or any other type of wiring shall be affixed to the exterior of the buildings. d. Window coverings must be white or lined in white. e. Nothing shall be stored in the meter rooms on each floor. f. All renovations made or work to any unit must be approved by the Property Manager in advance of construction. (See Contractor Rules). g. The Association may invoice any owner for actual costs involved in emergency procedures performed by our personnel on behalf of any owner who has failed to maintain their equipment properly and / or shut off water which caused damage to common areas or other units in their absence. This invoice will become part of the fees owed to the Association and will be due and payable within ten (10) days of receipt. h. Unit doors are not to be left or propped open unless approved by management. C. TRASH 1. Each owner is responsible for the proper disposal of his own refuse. A trash chute room is located on each floor between the meter room and stairwell. 2. Refuse must be contained in heavy gauge plastic bags and tied. 3. Sink disposals in each apartment should be used to eliminate wet garbage. 4. Nothing is to be left on the floor of the Trash chute room. Children, guests and lessees must be thoroughly instructed in this regard. 5. Large items, including cardboard boxes, MUST be deposited in the trash rooms located on the south side of each building, west of the entrance door. 6. No rubbish or debris shall be placed on the property. Heavy trash, such as furniture, appliances, carpet, etc., should be left on the NW side of the exit gate on the curb no earlier than the morning before the day of trash pickup [check with Association Manager for day of week]. D. RECYCLING 1. Two recycling bins are located in each floor s trash room. a. The plastic lined bin is for aluminum cans, plastic bottles, and glass ONLY (no broken glass). All items, bottles, jars, and cans must be rinsed out before being placed in recycling bin. b. The other recycling bin is for newspapers, magazines, catalogs, and phone books. 2. 4 3. ABSOLUTELY NO TRASH SHALL BE DEPOSITED IN THE RECYCLING BINS. (I.e. fast food containers, pizza boxes, books, cardboard boxes, etc.) E. BALCONIES 1. No decorative surfaces of any kind whatsoever may be installed on any balcony, terrace or porch in the condominium, other than the 13 x 13 Continenti Series, porcelain tile installed by the Association. The tile installed by the Association shall be in accordance with its Engineer s recommendation, as the manufacturers approved surface, in conjunction with Cathodic Protection System. The tile shall be maintained, repaired, and replaced, as necessary by the Association, except where the tile is damaged by the negligent or intentional misconduct of the unit owner or someone for whom the unit owner is responsible. If tile damage is due to Owner negligence or misconduct, the cost for repair will be at the owner s expense. The Association will make two colors of the Continenti Series, 13 x 13 porcelain tiles available to the owners for their choice. There will be no other options available for Balcony Covering. Established by the Board of Directors on May 10, All balcony furniture is to be of a neutral color. 3. Nothing shall be attached temporarily or permanently to balcony railings, ceilings, walls, or floor except the US flag. Holiday decorations may be displayed only between November 15 th and January 15 th. All attachments must be firmly secured. a. Balconies must not be swept in such a manner as not to cause debris to fall on balconies below. Rugs and mops shall not be shaken over railings. 4. No towels or clothing should be hung on the railing or chairs on the exterior balcony. 5. Heavy items cannot be placed on balcony ledges due to damage and/or injuries they may cause should they fall. 6. Absolutely nothing should be thrown from balconies particularly fireworks, cigar or cigarette butts, spit, or liquids. Children, guests and lessees must be thoroughly instructed in this regard. 7. When balcony plants are watered, care should be used to ensure that water would not fall on the apartments below. 8. The City of Riviera Beach Fire Code strictly prohibits gas grills, electric grills, or any sort of grilling device on balconies. 9. Only approved hurricane shutters shall be attached to exterior walls. All hurricane shutter installations must be approved by the Property Manager, and a contractor packet must be completed. 10. Owners and lessees who plan to be absent from the Cote d Azur for an extended period of time, especially during Hurricane season (June-November), must remove everything from the balconies unless perimeter hurricane shutters are in place. F. NOISES AND DISTURBANCES 1. ALL FLOOR COVERINGS, except carpet, are to be approved by Management prior to installation, and a contractor packet must be completed. 2. Occupants of units shall not disturb the occupants of other apartments with unreasonable noise, including but not limited to loud radios, TV sets, stereo equipment and musical instruments and slamming doors at any time, but ESPECIALLY between the hours of 10 PM and 9 AM. G. PETS 1. NO ANIMALS ARE ALLOWED ON THE COTE d AZUR PREMISES AT ANY TIME. This includes the parking lot, and common areas. All family, guests, lessees, and other visitors of owners must be instructed of this rule prior to visiting. 2. If a Pet is approved by the Board it must follow the following Rules: Modified 3/2017 Page - 4 -

5 a. No dangerous breeds allowed. b. All pets must be leashed and carried while in common areas. c. Pets must not be a nuisance or interfere with the living of other residents. d. All pets must be inoculated and licensed in accordance with Palm Beach County. e. Pets may not be allowed unattended on the balconies. f. All messes must be picked up and disposed of in sealed bags immediately. CHAPTER II COMMON AREAS A. GENERAL All areas of each Tower, excluding individual units, comprise the Common Areas. Common Areas must not be used by anyone for loitering, play, or storage of personal items or equipment. Unit owners will be held liable and accountable for any damage they make to Common Areas, as well as any damage caused by their children, guests, lessees or contractor. (See Owner/Contractor Rule). B. LOBBIES, ENTRANCES, EXITS, CORRIDORS, BATHROOMS, STAIRWAYS AND STAIRWELLS 1. Lobby areas are for ingress and egress to and from the premises and for awaiting, meeting and greeting guests and visitors. For loading or unloading use the north doors. 2. The lobby areas, building entrances, exits, corridors, passageways, stairways and stairwells will be kept free from the unit owners personal belongings. These areas are not play areas for children. Unit owners must prohibit children from congregating and playing in these areas. 3. Do not enter the buildings in wet bathing attire. Cover ups and shoes must be worn at all times. 4. The luggage and shopping carts MUST NOT be left in any common areas such as garages, lobbies, corridors or in the elevators. After use, they should be returned immediately to the cart storage areas located outside the east entrance of Tower I and the north entrance of Tower II so other residents may use them. 5. SMOKING IN CORRIDORS, LOBBIES, AND ELEVATORS IS STRICTLY PROHIBITED. 6. No personal items are allowed on the hallway floors or walls. 7. Only seasonal decorations are allowed on the doors between November 15 th and January 15 th. Nothing can be attached to entry doors (nails, hooks, screws, etc.) with the exception of a Crucifix or Mesusa not to exceed Official Association materials ONLY may be left under or on unit owner doors or anywhere on Association property. General informational material may be left on the counter by the mail boxes, subject to management approval. 9. Bathrooms; Each user MUST use the facilities as if it is their own. Please clean up after yourself! If you use the bathroom and notice it is in bad condition, you must notify the office immediately. If the office is not open, please write down the day and time that you noticed it. Through the cameras, we can determine who the previous user was and catch the offender and charge for the cleanup. C. ELEVATORS 1. The east elevator in each Tower is for both passengers and freight; the other is reserved for passengers only. Pads are required in the freight elevator whenever building materials, furniture or other large objects are being delivered. Prior to use of the freight elevator, the Association office must Modified 3/2017 Page - 5 -

6 be contacted at least 24 hours in advance and a refundable deposit of $ must be given to the office to allow the Management to have pads installed/removed at the proper times. 2. ABSOLUTELY NO CONTRACTORS, MOVERS, DELIVERIES, OR BICYCLES IN PASSENGER ELEVATORS. 3. Children must be instructed not to play in the elevators. Pressing all of the floor indicator buttons is inconvenient for other passengers, and it creates unnecessary maintenance. 4. No wet bathing attire in elevators. Shoes and cover-ups are mandatory. D. STORAGE AREAS/AC CLOSETS 1. All personal property must be stored in individual apartments or in assigned storage space on the ground floor. 2. Storage areas must be kept in a clean orderly condition and a/c closets must be empty of all personal items. 3. Fire regulations prohibit the storage of volatile liquids, paint thinners, paint removers, brush cleaners, and non-water based paints and lacquers in storage areas. Gasoline is also prohibited. 4. Any items left in the common area of the storage rooms or the ac closets will be removed and discarded without notice. E. SOCIAL ROOMS 1. The social room and exercise room are for the exclusive use of unit owners when not reserved for condominium functions. a. The Tower II Social Room is for private social gatherings and for Condominium business such as Association meetings, Board of Directors meetings, elections, etc. Permission will not be granted to anyone wishing to reserve the social room for meetings of organizations, nonprofit, commercial, political or religious groups or such. b. The Tower I exercise room is designated as an exercise and social room facility. 2. No lessee or guest may reserve these rooms for any purpose without the knowledge and consent of their unit owner and the approval of the Property Manager. This does not preclude lessees and guests from attending social functions as invitees. 3. The social rooms are also part of your home and must be regarded and treated as such. The room is available 10:00 a.m. until 10:00 p.m. If you wish to reserve the social room, please contact the Association office for a rental form. An inspection of the room will be performed prior to and directly after the function. Food must not be left in the social rooms or in the refrigerators overnight and persons sponsoring social affairs must have them cleaned and left in orderly condition by 10:00 AM the day after the affair. Outside cleaning service is available for a fee. 4. A security deposit of $500 must be left in the Association office in advance, to defray the cost of damaged or missing Association property: The deposit will be returned when the Property Manager inspects the property and is satisfied that the social room has been restored to its previous condition. This deposit is not to be construed as limiting liability. 5. Please turn the off lights, TV, and A/C when you leave these rooms. F. GROUNDS 1. All parts of the grounds of the Cote d Azur Condominium comprise the common domain of all unit owners. These areas include the driveways, reserved parking spaces, guest parking spaces, sidewalks, portions of the covered areas, stairs to the beach, the recreational deck with its swimming pool and gazebo and the tennis courts, as defined in the Declaration of Condominium. 7 be held liable for any damage they cause in the common areas, as well as any damage caused by their children, guests or lessees. 2. The driveways, covered and uncovered parking areas are not playgrounds and children are not permitted to play in these areas. The use of skateboards, roller skates, roller blades and bicycles are not permitted. Obstacles such as bicycles, strollers, children s riding toys, etc. should not be left in this area due to the liability of injury to residents and resident s vehicles. The Association is not responsible for loss or theft of any items left in parking areas. G. MOVING AND DELIVERIES 1. All transfers of furniture and deliveries of large items for Tower 2 must be made at the NORTH entrance and for Tower 1 at the EAST entrance. a. Owners moving in or out shall notify the office and submit a $500 refundable deposit to the Association office to cover any damage that may be incurred to Association property during the move. This deposit must be received by the office prior to the moving date. b. The office must be notified and a $ refundable deposit submitted at least 24 hours in advance of deliveries (with the exception of Federal Express, DHL and UPS deliveries); i.e., time of delivery and completion of such, in order to schedule padding the elevator. c. Direct your movers and delivery people to remove all large cartons and containers from the premises and clean up the common areas. d. All deliveries should be scheduled Monday through Friday between 8:30 AM and 4:30 PM and Saturday only with prior written approval by Property Manager. Moving of furniture on Sundays and Holidays is not permitted. e. Owners are responsible for arranging access for deliveries and contractors to their unit. The owners will be responsible for the actions of their contractor s and any damage to common areas caused by said contractors or delivery personnel. f. Owners are responsible for daily clean up of common areas and corridors. (See Owner/Contractor Rule). 2. Contractors must cover carpeting from the delivery elevator to the door of the residence during deliveries, moves and construction. CHAPTER III RECREATIONAL FACILITIES A. POOL DECK 1. GENERAL a. The pool deck, including all its facilities, is for the exclusive use of unit owners, their families, guests and lessees. The Unit owner or lessee host must accompany guests not registered at the Cote d Azur. b. Before entering the recreation deck, all tar, oil and sand must be thoroughly removed from shoes and feet. Mineral spirits are available at the top of the stairs leading to the beach and shower facilities are available at the beach station and on the pool deck. c. Glass or food of any kind is not permitted on the open deck at any time. Food is permitted under the covered gazebo only. Drinks and all food must be disposed of properly. Plastic recyclable containers are permitted on the pool deck. d. All lounges and chairs must be covered with pads, beach towels, or similar protection when occupied by persons in bathing attire. 8 e. When moving lounges, tables and chairs, please lift them by the frames. Pulling, pushing, or dragging the furniture scratches the deck surface. f. No one is permitted to engage in any game that involves running, throwing of objects, pushing. Shouting and boisterous conduct is also prohibited. Unit owners, guests, and lessees are expected to restrain their children from disturbing other users of the recreation deck. g. When proceeding to the recreation deck from apartments, all persons must wear shirts, robes or similar covering over their bathing suits. Shoes or sandals must be worn. h. All persons in bathing attire are requested to exit the elevator on the first floor and enter the recreation deck via the West corridor of Tower I and the East corridor of Tower II. i. Please help us keep the lavatories clean. These are located off the recreation deck in Tower I. Turn off the lights after use. 2. POSTED POOL RULES a. Bathing limit: 15 people. B. BEACH b. c. In accordance with health regulations, persons with skin rashes, open sores, infections, or communicable diseases are not allowed in pool. d. Remove all tar and sand prior to entering pool deck. Please shower to remove all oil and suntan lotions before entering the pool. e. No glass in pool or on pool deck area. f. Loud boisterous conduct, running, jumping, throwing of objects, or rough games are not permitted in the pool or pool deck area. g As a courtesy to your neighbors, please use earphones when listening to radio or tape players. h. Pool hours dawn to dusk. i. Emergency phone is located on pool deck adjacent to the Tower I west door. j. Lifesaving equipment is located on the walls. k. Swim at your own risk. l. No diving or jumping m. No lifeguard on duty. n. The pool may be used for group exercise weekdays from am. 1. When going to and from the beach through the buildings, all persons must wear shoes, shirts, robes, or similar covering over bathing suits. This is covered under pool/recreation deck. Bare feet are not allowed; shoes or sandals must be worn at all times. Please do not pass through the lobbies. Please use east and west doors in both Towers. DO NOT USE THE FRONT DOORS. 2. Beach walk gate must be kept locked at all times. This is part of our security. 3. Use the wooden bridge and stay off ALL dunes. C. TENNIS COURTS Any person(s) who uses diapers must use waterproof diapers. 1. The use of the tennis courts is restricted to unit owners, lessees and accompanied guests for tennis play only. 2. Only proper tennis attire and tennis shoes are permitted on the tennis courts. Halters, cut-off jeans, bathing suits or trunks are specifically excluded. Men are required to wear shirts. 3. Tennis courts are available on a first come, first serve basis. 4. Please limit play to one hour when courts are in demand and people are waiting to use them. Play as long as you like when courts are not reserved and no one is waiting. 5. No food is permitted in the tennis court area. 6. The tennis courts are for tennis only and not for any other purpose. 9 7. Commonly accepted Tennis Rules of Etiquette must be observed. 8. Please close the gates upon entering and leaving the tennis courts. D. SAUNAS 1. The saunas, located off the north corridor on the ground floor of Tower I, are for the use of unit owners, guests and lessees. All persons using the saunas do so at their own risk. 2. Read the instructions carefully and follow them. 3. Persons with high blood pressure, or other medical conditions, should consult with their physician prior to using the Sauna. 4. Please wipe up excess water on floors after use of the sauna or shower and turn off lights. 5. Use of sauna requires proper attire. E. EXERCISE ROOM 1. Use facility at your own risk 2. Shoes, shirts and proper gym attire are required at all times 3. A towel must be placed between you and gym equipment at all times 4. Wipe machines down after use. 5. Replace weights to appropriate area 6. Leave room neat and ac set on Turn off lights and TV before leaving CHAPTER IV COMMUNITY RESPONSIBILITY Owners at the Cote d Azur are encouraged to participate in committee and Board volunteer positions. Those assuming these responsibilities do so with the betterment of the entire community in mind and should serve in these capacities with professional and courteous attitudes. CHAPTER V SECURITY A. GENERAL 1. The Association makes every effort to maintain maximum security at all times. Since the size of our staff is limited, it is incumbent upon all unit owners to cooperate and maintain good security practices. 2. When you enter or leave the buildings, insure that all doors are locked. Whenever you are in the vicinity of the gate at the foot of the stairs leading to the beach, check to make sure it is locked. 3. Question anyone you feel may be trespassing; call the police, if necessary. Do not allow anyone you do not know to enter the buildings; direct them to the telentry system located at the main entrance doors to announce their presence. Modified 3/2017 Page - 9 -

10 4. Solicitors are not allowed on Cote d Azur grounds except by individual appointment with a unit owner or lessee. 5. Unit owners and lessees who intend to be away for an appreciable length of time should insure that the Association office has on file, an address and telephone number where you can be reached in the event of an emergency. The Association office must also be informed when apartments are to be left unoccupied. In addition, it is wise and prudent for unit owners to arrange for someone to inspect their apartments from time to time in order to check on the electricity and proper functioning of the air conditioning systems. 6. The roof is off limits to everyone except authorized personnel. 7. The entrances must be used, no climbing over fences or gates anywhere on the property. B. APARTMENT KEYS 1. Unit owners shall deposit, with the Association office, duplicates of the keys to their apartments to provide entrance in the event of emergencies or to perform necessary maintenance or repairs for which the Association is responsible. (Established by the Board of Directors March 29, 2001.) 2. Management or Association staff cannot utilize apartment emergency keys for: a. Showing apartments to prospective buyers or lessees. b. Opening apartments for real estate agents retained by unit owners to sell or lease their apartments. c. Opening apartments for deliveries, contractors, movers, etc. d. Opening apartments for cleaning personnel or for personnel designated by unit owners to inspect and check their apartments for any purpose. e. Opening apartments for representatives of companies with whom unit owners have service contracts for maintenance of appliances and equipment. 3. The keys deposited with the Association office are for emergency purposes only and are treated and honored as such. If unit owners have an arrangement with someone to look after their apartments during their absence, to show their apartment to prospective buyers or lessees, or any other purpose, they must furnish those persons with keys, which then become their responsibility. C. ENTRANCE KEYS 1. The Social Room, Tower II and Fitness Room, Tower I are keyed by Medeco cylinder locks that require a special key made by the Medeco Lock Company. 2. Medeco Keys can be used to access the North door of each building. It is important to have a Medeco Key to enable access to the buildings in the event of a power failure 3. Accountability for Medeco keys issued to owners is the responsibility of unit owners. 4. Replacement keys may be purchased for $ Because key control is an integral part of building security, the Association Board of Directors maintains key control by limiting the number of keys in circulation. D. VEHICLE KEYS Duplicate keys for automobiles must be left in the Owner Unit accessible to the Association Office, when an owner is absent. E. SECURITY FOBS 1. Each unit is provided 4 Access Fobs. 2. No owner will possess more than four (4) active fobs at a time. 3. If a fob is lost or stolen, the cost to an owner to replace the fourth (4 th ) fob is $20. GATE ACCESS (Q-Pass Sticker) After receiving your initial Q-Pass gate access sticker, any replacement will be at a cost of $ If you have two-(2) permanent automobiles on the property, you will be required to surrender your two-(2) transponders (beetles) before the new Q-Pass sticker(s) can be issued. Only unit owners and long term leasees (6 months or more) will receive a Q-Pass sticker. All other leasees will gain access via the visitor side of the gate. A. AUTOMOBILES CHAPTER VI VEHICLES / PARKING / BICYCLES 1. In consideration of others, please be as quiet as possible during early morning hours and evenings especially in regard to slamming of car doors, horns and locking mechanisms. 2. Hoses located in the guest parking area at the northwest section of the property behind the Tennis courts are provided for the washing and rinsing of vehicles only. 3. No repairs or work performed whatsoever on automobiles or machinery permitted on property. 4. A motor driven vehicle, which cannot operate under its own power, must be removed within twenty four (24) hours after discovering that it will not function at the Owner s expense. 5. Keys must be left accessible to the office for any vehicle that is left on site during an owner s absence. 6. The maximum number of vehicles allowed per unit is two (2). 7. Vehicles may not have any signage in the windows or on it such as For Sale. 8. All vehicles must have current MV tags or the vehicle will be towed B. ENTRANCE AND EXITS TO COTE D AZUR GROUNDS 1. There is only one vehicular entrance to Cote d Azur grounds on the south side of the Property parallel to Route A1A; it is so marked and is one way. 2. There is only one vehicular exit to Cote d Azur grounds on the north side of the property parallel to Route A1A; it is so marked and is one way. 3. When exiting Cote d Azur grounds, come to a complete stop; look for pedestrians and bicycles before proceeding onto Route A1A. These entrances and exits are protected by security gates. Visitors and guests enter at the left gate and gain access to the property by telentry or fob only. C. PARKING 1. All unit owner vehicles will display a blue Cote d Azur decal which will be issued by the office. The decal will be placed on the lower rear window, on the driver s side, by a member of the staff and the vehicle s owner, make, model and license plate will be entered into a vehicle ledger. Lessees will be issued a white sticker with the same required information. Owners will be entitled to two stickers per unit and the stickers are not transferable. Guests will be issued a Placard. The placards will be displayed on the front dash board of the vehicle and will indicate unit and date of departure. 2. Guests, both daytime and overnight, must use the uncovered parking spaces marked Guest. If guests intend to remain on Cote d Azur premises for more than 24 hours, the Association office must be notified and a guest pass obtained. Modified 3/2017 Page

12 3. Guests and lesees may use the parking spaces assigned to the unit owners when the unit owner is not in residence or by arrangement with their unit owners. All such arrangements must be in writing and on file in the Association office. 4. Drivers must park their automobiles completely within the white lines and should pull in as far as possible. Park HEAD in only. No backing in. 5. No trailers, campers, motorcycles, scooters, pick-up trucks, RV s or commercial vehicles may be on the property from 5:00 pm till 8:00 am. (except employee vehicles) All parking spaces are for passenger cars, sport utility vehicles and passenger vans only. There is to be no storage in any parking places. A tow hitch on a vehicle must not extend more than six inches beyond the bumper. Offending vehicles will be tagged and removed in accordance with Florida Law at the owner s expense. Do not leave cars parked under the porte-cochere or at any entrance. 6. All contractors must park their vehicles in yellow service parking spaces on the northwest side of the property. If it is necessary to load or unload materials, or to conduct business with a unit owner, their vehicles must be moved to service parking spaces immediately after the loading or unloading. If the vehicles are too large or if all service spaces are taken, the staff shall direct them to a suitable area. 7. If anyone accidentally damages another vehicle on Cote d Azur grounds and cannot locate the owner, the Association office must be notified. 8. Association owners should notify their visitors, guests, renters, or contractor regarding our association s parking rules and regulations. All owners, guests, renters parked on Association property should be made aware that violation of these parking rules and regulations including but not limited to parking in no parking areas, improperly parked in another owner s assigned parking space, non-registered overnight parking permit, etc. are subject to being towed. Any vehicle towed will be at the owner of the vehicle s expense in accordance with the current Florida laws. 9. Handicap spaces are for short term parking for vehicles with an authorized Handicap Permit. These are not assigned spaces or for overnight parking. 10. Due to our limited space, if you have a vehicle on the property, it must be parked in your unit parking place. If you have two vehicles, one must be in your parking place and one in a guest place. No unit is allowed to have more than 2 vehicles on the property. 11. If you cover your car, you are responsible for keeping the cover on it. With the strong winds, they routinely come off or partially off. When this occurs, the Association will remove the cover and put it in your unit as to not damage or inhibit other vehicles. D. SPEED LIMITS The maximum speed limit for all vehicles on Cote d Azur property is ten miles per hour and five miles per hour in covered parking areas. E. BICYCLES 1. Bicycles are not allowed to be stored in any of the common areas, including stairwells and corridors. 2. Bicyclists are not to use the covered parking areas, tennis courts or driveways for recreational riding. 3. BICYCLES may be transported to and from your unit on the FREIGHT ELEVATOR ONLY and walked while in the building using the east and west doors for access. 4. The Association is not responsible for damage or theft of bicycles left on the Association property. 5. Bicycles must be stored in owner s units or storage locker only Modified 3/2017 Page

13 CHAPTER VII ASSOCIATION EMPLOYEES A. STAFF Cote d Azur Condominium Association employs: General Manager One Office Assistant Maintenance and Custodial Personnel 1. The General Manager is responsible for the day to day business operations of the Association including the maintenance, cleanliness, safety and security of the Common domain and receives instructions and directives from the President of the Board of Directors, or, in their absence, a Board Member appointed by the President. The other staff members, including the office assistant, are supervised by the General Manager. 2. Unit owners and lessees are prohibited from asking the staff to perform personal services on the Association, i.e. company time. 3. No unit owner is authorized to give orders to OR reprimand any owner or member of the staff. If any unit owner or lessee is dissatisfied with a staff member s performance of duty, it should be reported to the General Manager or Board of Directors in writing and signed. B. ASSOCIATION OFFICE 1. The Association office is located in the main lobby of Tower II. The General Manager s office is located in the main lobby of Tower I. The telephone number is , or fax: The Website is 2. The office is open from 8:30 AM to 4:00 PM Monday through Friday for the transaction of official Association business only. Forms for owners to report property issues or repairs are available in the mail area. 3. Owners may request Association Office Personnel to perform personal transactions such as faxes, copies, etc. at the appointed fee for such services. 4. The General Manager and Office Assistant will receive packages and parcels and safeguard them in the Association office until picked up by addressee, provided the addressee signs a Waiver of Responsibility which is obtained in the Association Office. This Waiver relieves the Office Assistant and the General Manager and the Association of responsibility for the package after it is left in the Association office, until it is picked up by the addressee. Please pick up your parcels during business hours only. Association employees will not accept C.O.D. packages or registered letters. CHAPTER VIII SALE OF DWELLING UNIT A. GENERAL 1. The sale of a dwelling unit is prohibited unless approved by submitting an application to the Association in compliance with the provision of the Declaration of Condominium, the By-Laws of the Association and the Federal Fair Housing Act. 14 2. The application process generally takes 2 weeks; a non-refundable $ processing fee is required at the time of submittal of the application for membership. The applicant must have an in-person interview by the Board of Directors and/or member of the Welcoming Committee. B. REQUIREMENTS 1. Any incomplete application submitted to the Association will not be processed and will be returned. 2. Any transfer or sale attempted to be made without first complying with the above provisions shall be null and void. 3. The sale of a dwelling unit must conform to the Fair Housing Act, which is to include both individuals and legal entities. 4. No sale will be approved if there are outstanding assessments or maintenance fees, unless in foreclosure, bankruptcy, or when a lien is placed against the person named on the deed. 5. If the sale is approved and consummated, the seller shall furnish the purchaser with the Condominium Documents including the Declaration of Condominium, By-Laws, and Rules and Regulations. 6. If an applicant has previously been delinquent and or is involved in litigation with the Association, the application will be denied, when in accordance with the Fair Housing Administration Act. 7. Lock boxes are permitted under the counter in the mail room only. All realtors must sign in here. 8. A realtor may not post a FOR SALE sign on Condominium property. 9. Open House showings of a unit are not permitted CHAPTER IX LEASING A. GENERAL 1. LEASING a. All unit Owners leasing a unit must complete the Lease Application and obtain the Riviera Beach Certificate of Use before the Association will authorize the lease. b. A unit owner SHALL NOT lease or renew a lease for his unit without PRIOR written approval of the Board of Directors, following the submission, at least 10 days in advance of a properly executed Lease Application which is provided by the Association; a copy of the signed lease agreement accompanied by the payment of a processing non-refundable $ application fee and a refundable security deposit of $500.00, both made payable to the Cote d Azur Condominium Association, Inc. The request will not be processed until there is compliance with these requirements. c. Leasing of a dwelling unit, in any case, shall be limited to twice in any calendar year, and then for a minimum period of ninety days each. The maximum term for a lease is twelve months. d. Prior to the occupancy date by the lessee, the Association must be notified of the date and approximate time of arrival of the lessee. Upon arrival, the lessee shall report to, and register with, the Association office. Likewise, the lessee shall notify the Association of his departure date. e. A lessee, at registration, shall be furnished with a copy of the Rules and Regulations of the Association and shall be required to confirm by signature that he/she has received, understands and will comply with the provisions thereof. f. Neither the unit owner nor the lessee shall be permitted to sub-lease the dwelling unit the lease will not be extended beyond its termination date without approval of the Board of Directors. g. Leasing will not be approved if any maintenance fees and assessments have not been paid. Modified 3/2017 Page

15 h. The above directives shall not be construed as a waiver of the provisions of the Declaration relating to the right of first refusal by the Association. i. Should a unit owner represent a lessee as a guest, this action will constitute an infraction of these Rules and Regulations and the Declaration of Condominium and subject the unit owner and/or lessee to all legal remedies by the Association. j. If an applicant has previously been delinquent and/or is involved in litigation with the association, the application will be denied. k. Lock boxes are not permitted on the doors. Failure to comply with these Rules and Regulations shall be cause for the termination of the lease, the serving of a notice to vacate and the assessment of $ against the unit owner in addition to all costs, expenses and attorney s fees which may be incurred and resulting there from. CHAPTER X ACCESS TO ASSOCIATION DOCUMENTS Residents may request access to the Declaration of Association Documents during normal business hours, Monday through Friday. Residents may request copies of Association documents through written request. Upon receipt of the request, the Association has 5 working days to provide the requested documentation. Each request is limited to a maximum use of Cote d Azur paid staff labor of one (1) hour. Copies of any documents may be made at the per page fee established by the Association and must be paid before receipt of the documents. Modified 3/2017 Page

16 CHAPTER XI CONTRACTOR/OWNER SELF-PERFORMING WORKING RULES These rules are applicable to ALL contractors and ALL owner self-performed work. Owners must provide the completed Contractor Packet and deposit to the office prior to ANY work being done in their unit and supply Management with the required permits from the City of Riviera Beach, name of contractors, licensing and insurance certificate of same. If work is performed by owner personally, proof of homeowner insurance and certificates must be provided also. Management will return an executed copy which represents permission to proceed. Contractor packets can be found on the community website at or picked up at the office. CONSTRUCTION QUIET TIME DATES: There will be NO contractor or self-performed work permitted during the period from November 5th through April 15th. The "quiet time" dates apply to major remodeling, the removal and/or installation of sliders, shutters, flooring (except carpet), etc. If carpet is being installed, approval of such will only be applicable if underlayment is being installed over existing tile. If tile is to be removed prior to the install of carpet, the black-out dates will apply. Any and all major construction that an owner hires a contractor to perform MUST be completed prior to the quiet time dates as noted above. If you sign a contract, you must keep this in mind as the contractor(s) WILL NOT be permitted on the property during the designated quiet time dates (NO EXCEPTIONS). WORKING HOURS: Contractor and owner self-performed work hours are 8:30 am to 4:30 pm, Monday through Friday with NO work permitted on Saturday, Sunday or Association holidays. All contractors must NOT be on the property prior to 8:00 am and must be off the property no later than 5:00 pm. Association property is defined as all property along North Ocean Drive, and includes both sides of our gate. Modified 3/2017 Page

17 EMERGENCY WORK: If there is an emergency such as the replacement of an inoperable hot water heater or air conditioning unit, you will be required to notify Management immediately. The Property Manager will inspect the equipment to confirm it is not working and a written notice will be issued to the unit owner for approval of work to be performed. A contractor package is still required for all emergency work with the required security deposit/fee, required permits, name of contractor, licensing and insurance certificate of same. Upon approval of an emergency repair, if Saturday work is approved, there will be NO loud noise or excessive use of the elevators. Saturday work hours will be limited to 9:00 am to 1:00 pm with no exceptions. All vehicles must be off the property no later than 1:15 pm. All floor coverings, other than carpet, must be approved by the Manager prior to installation. A picture of the soundproof material will be taken during the installation of the underlayment. All contractors/vendors must check in with the Association office in both Towers One and Tower Two upon arrival each day. Contractors will be required to sign in and out, providing the unit number in which they will be working, as well as a phone number so they may be contacted should the need arise. The contractor/vendor sign-in sheets are located in the mailroom in each tower located in the lobby. Owners or their designee must supervise their contractors. The Association staff is not allowed to distribute keys or give admittance to units. All contractors are to enter through the North door when performing work in Tower Two and the East door when performing work in Tower One. Contractors are to bring their own means of transporting material. The use of the Cote d Azur shopping carts or luggage racks is prohibited. Contractors are to use ONLY the service/freight elevators. They cannot block elevator doors with any object as this shuts down the elevator operation. A key to lock the elevator for loading and unloading will be supplied by the office when appropriate paperwork is submitted with a $50.00 refundable deposit (no credit cards) and a copy of driver s license. 18 Carpeting or drop cloths must be placed on the hall carpets for protection each day work is performed. Owners or their designee should assure that the contractors keep the work area and common areas clean and that proper clean-up is done at the end of each day and after completion of the work. Contractor parking is allowed in designated areas only. Parking in reserved or guest spaces is not permitted. Unloading and loading of materials may be done at the North side of either building and then the vehicle must be moved to the designated contractor parking area. Any work that will affect the fire alarms, such as heavy sanding, soldering or welding must be reported to the office PRIOR to the start of work. If not reported and such work results in an unnecessary response of the fire department or fire security company, $50.00 for each occurrence will be withheld from any security deposit held by the office. Contractors are to maintain proper dress; shirts and shoes must be work at all times. NO smoking permitted in any of the common areas or in the elevators. Violators will be charged a $ fee per occurrence. Loud music or profanity will not be tolerated. No construction material may be left on balconies or placed in utility closets located in hallways.
