Colorado Real Estate Practice (2018) CHAPTER 1 Malpractice This chapter contains an overview of real estate practice and malpractice, including recognized areas of liability and case studies. CHAPTER 2 Deeds and Conveyancing Types of deeds are discussed, including general warranty deeds, special warranty deeds, bargain and sale deeds, quitclaim deeds, and beneficiary deeds. CHAPTER 3 Surveys This chapter explores the history and descriptions of surveys in Colorado, including definitions, filing, indexing, metes and bounds descriptions, and subdivision plats. CHAPTER 4 Record Searches Record searches and land records in Colorado are covered, including patents, title statutes, title opinions, mining claims, and more. CHAPTER 5 Title Insurance in the Real Estate Practice This chapter describes the importance of title insurance, and discusses issues such as form usage, access, coverage problems, and probate considerations. CHAPTER 6 Mortgages and Financing Evidence of debt and security for repayment, deeds of trust, nonrecourse and partial release provisions, negotiating loan documents, and various special district clauses are covered in this chapter. CHAPTER 7 Foreclosure of Deeds of Trust by the Public Trustee This chapter details public trustee foreclosures from start to finish, including commencing the foreclosure, the public trustee sale, redemption, the foreclosure model, and more. CHAPTER 8 Judicial Foreclosure Actions and Sheriff s Sales Judicial foreclosure actions are discussed in this chapter, including whether judicial foreclosure is advisable, pre-filing considerations, court procedures, and commencing the sheriff s sale. CHAPTER 9 When Dirt Goes to Bankruptcy Court This chapter contains an overview of bankruptcy law as it pertains to real estate. Explanations of the types of bankruptcy, the automatic stay, leasing considerations, and more are provided. CHAPTER 10 Contract Drafting The Colorado Real Estate Commission contract forms are dissected in this chapter, and sample clauses are provided to enable the attorney to customize the contract to the particular real estate transaction. CHAPTER 11 Real Estate Closings This chapter discusses real estate closings, including settlement statements, reporting requirements, potential problems, and issues with home rule cities and towns. CHAPTER 12 Quiet Title Actions Quiet title actions are explored in this chapter, including parties, jurisdiction, service of process, defending the action, and more. CHAPTER 2 The Title Insurance Commitment The title insurance commitment is discussed in this chapter, including examining the title commitment, using the commitment as evidence of title, reliance on the commitment, negligence in preparation, and format of the commitment. CHAPTER 3 The Closing Document drafting, closing preparations, and post-closing responsibilities are discussed in this chapter. CHAPTER 4 Owner s Policies and Guarantees This chapter explores various owner s policies and guarantees in detail, including a comparison of owner s and lender s policies and examination of various popular policies and guarantees. CHAPTER 5 Lender s Policies and Guarantees This chapter explores lender s policies and guarantees in detail, including a comparison to corresponding owner s policies and examination of various popular policies and guarantees. CHAPTER 6 Endorsements This chapter examines each endorsement to title insurance policies, including applicability, when and how to use, and endorsement options for specific scenarios. Land Title Guarantee Company Update author of Colorado Title Insurance Practice and Author/Faculty for Title Insurance in the Real Estate Practice chapter in Colorado Real Estate Practice Peter J. Griffiths, Esq., is a Vice President and General Counsel of Land Title Guarantee Company. He has specialized in real estate law and transactions for the past 38 years, 16 of which were as a shareholder in a leading law firm in Cape Town, South Africa, and thereafter in the title insurance industry in Colorado, USA.
