1 VISTA DEL LAGO ASSOCIATION RULES & ENFORCEMENT I. INTRODUCTION A. The following rules were adopted by the Vista Del Lago Board of Directors at their meeting of November 5, 2016 in accordance with 1) Article XI, Para 2.A of the Vista Del Lago Declaration of Covenants dated December 5, 1996, as amended August 6, 1997 & June 7, 2003 and 2) Para 4.A and 4.C of the Vista Del Lago Association By-Laws dated November 15, These Rules become effective November 6, B. These rules, provided in Section 1, are intended to provide the Owners/Authorized Tenants and their guests with safe and pleasurable use of the Association's facilities while maintaining a balance between the individual Owner's rights and the rights of all. C. Section 2 provides the Rules Enforcement Policy. The Board requests that the rules be "selfpoliced" to the extent possible, and that each individual Owner/Authorized Tenant do their best to abide by these rules and assist the Board by requesting that other Owners/Authorized Tenants do the same. II. ACTIVITIES: The Association reserves the right to restrict the use of the complex as to hours, purpose, and conduct. All activities and requests for use of the facilities must be coordinated through the Social Committee. III. ALCOHOL: Excessive use is prohibited. IV. CHILDREN: A. All children (under 18 years old) may visit Vista Del Lago as the guest of an Owner/Authorized Tenant, and only when the Owner/Authorized Tenant is present at Vista Del Lago. Minor children cannot be permanent residents or occupants at Vista Del Lago. Minor children may visit no more than 15 consecutive days, and no more than 20 days in any 3-month period (calendar quarter). (CCR Article XVIII.2) B. Minor children will be allowed to use the downstairs of the community center only for prearranged reserved functions, with supervision of Owner/Authorized Tenant or Registered Guest. Children shall play on their resident host's lot or within their host's home. No Page 1 of 1 Revised 11/5/2016
2 skateboards or rollerblades are permitted. Outside of their host's area, they must have Owner/Authorized Tenant or Registered Adult Guest supervision in the resort at all times. C. The Manson Parks Department has granted an access from the Southeast end of the development to Singleton Park that adjoins Vista Del Lago. The park has a play area for children, baseball diamond, and soccer field and cookout area. V. COMMUNITY CENTER: A. The Community Center can be accessed by using the combination keypad on the front entrance door or the bottom back door, which can be obtained by contacting any Board member or member of the Building and Grounds Committee. The combination will be changed at a minimum of twice a year during the month of April and September. B. The upstairs portion of the Community Center is for use by Owners and accompanied Adult Registered Guests only. Minor children are not permitted to use the upstairs portion of the Community Center. C. Kitchen & Party Room: 1. The kitchen and party room are located in the downstairs portion of the Community Center. The kitchen is designed for the serving and warming of food only. Food preparation is not permitted, except for Association sponsored events. Children are not permitted in the kitchen. 2. Please be courteous to others and clean up after use of the facilities. 3. The kitchen and party room are designed for Association functions. Reservations for use for private functions are required, and can be made by contacting the Social Committee Chair. Reservations can only be made by Owners. Reservations will be made on a first come, first served basis. A cleaning/damage deposit of $100 and the Club House Usage Form are required for reservations. Reservations can be made for 1) a maximum of 50 people, including Owners, and 2) a maximum period of 4 hours and will not be later than 10:00 p.m. (designated quiet hours are from 10:00 p.m. to 7:00 a.m.) Pool and pool deck area will not be reserved for private functions. In fairness to all Owners no private function reservations will be made for the holiday weekends of Memorial Day and Labor Day, and for the three-day period encompassing the Fourth of July. 3 VI. GUESTS: A. All non-owners, including minor children are considered guests. Owner shall be responsible for assuring that their guests understand and abide by the Association rules. (CCR Article XVII I.2) B. Owners entertaining guests at the resort shall be responsible for their conduct while on the premises for any damage charges. C. All guests staying overnight or using the facilities shall be registered via or written notice to the Board. D. The Owner/Authorized Tenant must notify the Board via or written notice of their intent to allow guests to use their property, when the Owner/Authorized Tenant is not present. Minor children are not permitted when the Owner/Authorized Tenant is not present. VII. LANDSCAPING: A. Hardscape design requires prior written approval of the architectural committee. B. Owner/Authorized Tenants of all lots must keep them mowed or weed free. C. All plants, trees, and shrubs must be on the Approved Vegetation List as maintained by the Architectural Committee, and must not overhang/encroach other lots or common areas. (CCR Article VII 11.) D. Owner/Authorized Tenants are encouraged to accomplish spring cleanup of their property not later than May 30 th of each year and keep their property weed free during the year. The Board shall be the final authority on determining conditions of the lots. VIII. LAUNDRY FACILITIES: A. Laundry facilities are located in the laundry building adjacent to the pool area. The laundry facility can be accessed by using the same combination as the Clubhouse, which can be obtained by contacting any Board member or member of the Building and Grounds Committee. B. Owner/Authorized Tenants and guests using the laundry facilities are responsible for keeping the laundry room clean. It is expected that laundry is removed promptly upon completion. Please clean out the lint filters on the dryers after each use. Page 3 of 3 Revised 11/5/2016
4 IX. ICE MACHINE: Ice machine use depends upon the honor system to pay for maintenance of this equipment. The donation box is located on the left side of the machine. Suggested donation is $1.00 per standard ice bag size. X. NOISE: A. Designated quiet hours are from 10 p.m. to 7 a.m. B. Loud parties, excessive volume of radios, TV's or musical instruments, profanity, indecency, intoxication or other rude conduct will not be tolerated at any time. Sound levels, including those of pets, must be below that which is inconvenient or offensive to others. C. RV generators may be used only with prior permission of the Association. D. No exterior speakers, horns, whistles, bells or other sound devices, except those used exclusively for security purposes, shall be placed on individual lots. Also, noisy equipment must be used in a rational and non-offensive manner. XI. PETS: A. Only non-nuisance pets will be permitted. The Board has the authority make the determination as to what constitutes a nuisance pet. (CCR Article IX.14.A) 1. Nuisance dog breeds shall include, but not limited to the following: (1) Pit Bulls & Staffordshire Terriers (2) German Shepherds (3) Doberman Pinschers (4) Rottweilers (5) Akitas (6) Alaskan Malamutes (7) Chows (8) Great Danes (9) Presa Canarios (10) Siberian Huskies (11) Wolf-hybrids B. Pets, including cats, must be leashed and in the Owner/Authorized Tenant's control at all times when off the Owner/Authorized Tenant's lot. (CCR Article IX.14.B) Page 4 of 4 Revised 11/5/2016
5 C. Pet owners must clean up immediately after their pets everywhere in the resort, including their own sites. Cats are not allowed to run loose. (CCR Article IX.14.B) D. There are three designated pet walk areas in the park with Mutt Mitt stations. Please have your pets conduct their business in these areas. Failure of residents to control the barking of their dogs or other pet noises, which disturb the peace or annoy others, will result in the requirement to remove the pet from the resort. XII. POOL USE: A. Weather permitting, and at the sole discretion of the Board, the pool "season" is from one week prior to Memorial Day Weekend to two weeks after the Labor Day Weekend. During this period, the pool will be open for use and heated. During the remainder of the year the pool will be closed. 1. During the pool season, pool hours are 7:00 a.m. to 10:00 p.m., unless otherwise approved by the Board. 2. Minor children may only use the pool and the pool deck from 10:00 a.m. to 3:00 p.m. and 6:00 p.m. to 8:00 p.m. Children in diapers or less than three years old are not permitted in the poo B. Pool and pool deck area shall not be reserved for private functions. The pool deck is the area enclosed by the black iron fence. C. Registered guests may use the pool. Owner and Renters shall ensure their guests follow VDL Rules and other governing documents. D. Use of floatation devices only from 10:00 a.m. to 3:00 p.m. And 6:00 p.m. to 8:00 p.m., except floatation noodles may be used whenever the pool is open. E. Use pool at your own risk. There are no lifeguards on duty. Minor children must be accompanied at all times by a responsible adult. F. Ensure the gate to the pool is closed upon each entry and exit from the pool area. Notify a Board member if the gate is not locking or otherwise properly operating. Page 5 of 5 Revised 11/5/2016
6 G. When blood, vomit, or feces is present in the pool exit the pool and instruct other people in the pool to also exit. Report the incident to a Board member or a Building and Grounds Committee member. Do not reenter the pool the Board indicates the pool is safe and reopens the pool. H. Use shower before entering the pool. An outside shower and soap is available on the west side of the laundry room building. I. Wear proper swimming attire when using the pool. Cut-off jeans and street clothes are not acceptable. J. Do not dive into pool, including but not limited to cannonball dives. Do not run on pool deck. Do not cause excessive splashing that annoys other people in the pool or pool deck Entering the pool by jumping from the side is permitted. K. Do not create noise levels that annoy other people in the pool area. If another person in the pool area makes a reasonable request to lower your noises level, then comply. Report people to the Board who do not comply with request to lower noises levels. L. Do not bring beverages or snack foods in glass containers in to the pool area. Do not bring meals in to the pool area, except for VDL Association events. - M. No audio devices, such as radios, can be used in the complex, including pool area without headphones. N. Pets shall not be permitted in the pool area. O. Remove trash and personal belongings from the pool area when leaving the pool area. P. Lower and re-tie umbrellas after use, and place furniture back into the original location before leaving the pool area. Do not move umbrella stands without permission from a VDL Building and Grounds Committee or the Board member. XIII. Parking: A. No street parking is permitted except on a temporary basis for visitors. (CCR Article VIII.2.F) B. No overnight street parking is permitted. C. Overnight guests may park in the Community Center parking area on a first come, first served basis. Page 6 of 6 Revised 11/5/2016
7 D. Street parking is permitted, for a period not to exceed 4 consecutive hours, for loading and unloading of RV's. E. Street parking is permitted, for a period not to exceed 4 consecutive hours, for loading and unloading of boats. (CCR Article VIII.12.G) F. Only one (1) RV, Park Model RV, or Park Home may be located on any parcel at any time, except that one (1) additional RV may be parked on a parcel for a maximum of two (2) days for the purpose of loading or unloading. (CCR Article VIII.12.E) XIV. STORAGE OF EQUIPMENT: A. No storage of any kind is permitted under unskirted RV's. (CCR Article VIII.4.D) B. Only "normal" patio and deck equipment such as tables, chairs, benches, potted plants, BBQ's, etc. may be left outside. (CCR Article VIII.12.C) All other personal property such as lawn & garden equipment, bicycles, sports gear, etc. may only be left outside for temporary daytime use. Such items may only be stored outside if out of sight from neighboring parcels and the road. C. Items such as boats, motorcycles, jet skis, trailers of any sort, etc. shall not be stored on lots or streets except on a temporary basis (4 consecutive hours maximum). Such items may be stored in the Common Elements storage area by contacting the Storage Lot Manager for space assignment. (CCR Article VIII.12.G) XV. OUTSIDE EQUIPMENT RESTRICTIONS: A. No satellite dishes and/or TV antennas larger than 24" in diameter. (CCR Article VIII.12.D) B. No outside signs whatsoever without written approval. One for sale sign is permitted on each lot. VDL will provide a For Sale sign at the entrance to VDL. (CCR Article VIII.12.M) C. No external floodlights or motion detector lights. (CCR Article VIII.12.N) D. No clotheslines or other outside drying/airing equipment. (CCR Article VIII.12.O) XVI. RENT/LEASING: (CCR Article IX.16) A. Only entire parcel may be leased/rented and only to a maximum of 4 adults (no minor children). B. A parcel may only be leased for residential purposes and must be leased to the same person(s) for a continuous period of not less than forty-five days. Any leases less than 45 days must be by the Association only and are subject to the discretion of the Board. Page 7 of 7 Revised 11/5/2016
8 C. Owners must provide written notice to the Board of the intent to rent or lease their property. Notification must include the name of all tenants and a copy of a fully executed Lease/Rental Agreement. All Lease agreements shall include Association Rules and Regulations and be signed by both the Owner and Tenant and shall be in compliance with all other standards established by the Declaration and the Board. Please contact a Board Member for additional requirements. XVII. SPEED LIMIT: 10 miles per hour must be observed at all times in the Resort. Be considerate of your neighbors. XVIII. SOLICITATION: A. No solicitation of any kind by Owner/Authorized Tenants or other parties is allowed within Vista Del Lago. This includes through distribution, in person, or via mail. The use of the VDL distribution list for commercial purposes is not permitted. B. The distribution list is not intended to be used for solicitation, compliance issues, or rules violations discussion among community members. The distribution list is intended for Board and Committee use to notify the community of upcoming meetings, rule changes, and other Board issues. The use of community-wide should be positive and build community morale. C. To avoid potential conflicts of interest, VDL Association may not enter into a contract or workfor- pay agreement with any Owner or Tenant of VDL. XIX. TRASH: A. All trash & garbage must be placed in plastic bags, tied and deposited into the Dumpsters. No garbage, rubbish, trash or debris of any kind shall be placed or permitted to accumulate upon or adjacent to any property. (CCR Article VIII.12.N) B. All construction debris must be hauled to the refuse collection center located in Chelan. Do not dispose of construction debris in the Dumpsters. C. Please take cardboard boxes, recyclable plastic/glass items and newspapers to the recycling bins in Manson. A can and container for beverage cans is available adjacent to the pool. D. Hazardous materials shall not be placed in dumpster. These need to be properly disposed of at the appropriate facility. Page 8 of 8 Revised 11/5/2016
9 E. Dumpster is not intended for disposal of construction debris, furniture, mattresses, or other large objects. There is a transfer station located in Chelan that receives these types of items. Habitat for Humanity also accepts donations of items in reasonably good condition. XX. EMERGENCIES: A. The emergency telephone number for police, fire or ambulance is 911. An emergency phone is located on the outside wall of the Pool Equipment Room. The 9-volt battery must be connected to the phone to provide power for operation. XXI. ARCHITECTURAL COMMITTEE: A. The responsibilities and controls by the Vista Del Lago Architectural Committee are extensive and are provided in detail in the Declaration of Covenants, Article VIII, Paragraph 10, and in the Committee's Procedure and Operations Rules. For reference, the following excerpts are provided from Article VII, Paragraph 10. The term "Committee" refers to the Architectural Committee. B. Subparagraph B. In total - "Prior to placement of an RV, Park Model RV, or Park Home on a Parcel, the Owner shall submit plans for such placement to the Committee for approval. Additionally, after placement, no additional improvements to any Parcel or to any RV, Park Model RV, or Park Home, including without limitation all landscaping, concrete work, paving, wall building, fences, sheds, outside storage, decks, carports, awnings, and Chelan Rooms shall be performed or installed without prior approval of the Committee." Subparagraph E. In part - "... Upon completion of improvements the Owner must request inspection and approval of the work from the Committee. Said approval must be received prior to use or occupancy of improvement...." Page 9 of 9 Revised 11/5/2016
