1 Villa Marina Condominium Association House Rules & Regulations Handbook (Revised and Approved, February 2016) The Villa Marina Board of Directors (hereafter referred to as BOD) is to govern the rules of the Villa Marina Community. The BOD is made up of 7 members who are elected for two year terms. The election takes place at the annual meeting held during the first quarter of each year. The names and contact information of your current board members are posted on the website and are available from the Property Management Company (hereafter referred to as PMC) listed below. The following are the Rules and Regulations for Villa Marina adopted by the BOD pursuant to the authority granted to the Board in section 5 of the bylaws. The House Rules are designed to maintain an orderly, fair and pleasant living atmosphere for all residents of the Villa Marina. Violations of house rules may at times result in fines, towing of vehicles, or revocation of privileges, so please be sure you are familiar with this document. These Rules and Regulations supersede all other Rules and Regulations previously adopted by the Association. All owners, residents and guests of Villa Marina are required to comply with the House Rules. The House Rules are posted at the Villa Marina website The Association will provide each unit one printed hard copy at no charge. Extra hard copies may be printed from the website or requested from the property management company at a fee of $ RESIDENT / OWNER REGISTRATION 1.1 A Villa Marina Registration Form with current contact information must be completed and submitted to the PMC immediately upon taking occupancy of a unit as a new owner or new renter and updated yearly at the annual meeting. 1.2 All Villa Marina owners, residents and guests must abide by all Villa Marina Declarations, Bylaws, and House Rules. Owners are responsible for assuring compliance by their tenants/residents and guests. 1.3 Absentee/offsite owners must keep the PMC advised of their current address and phone number, and the phone number of any tenants. 1.4 Initial pool cards, launch keys, and boatyard keys have a deposit of $50. Additional pool cards, available for tenants of units which are rented, cost $50. Lost pool cards, launch keys, and boatyard keys have a charge of $50 for any new cards or keys. 2. HOMEOWNERS DUES AND ASSESSMENTS 2.1 Homeowners monthly assessments (dues) are due on or before the first day of each calendar month and payable to Villa Marina HOA. Monthly assessments shall be submitted to the Villa Marina Bookkeeper/CPA. 2.2 Any account which is not paid in full as of the 15th day of each month will be assessed a late fee of $25.00 on the 16th of the month. 2.3

2 Homeowner Assessment accounts in arrears will be turned over to an attorney for collection and attorney s fees will be added to the units account ledger. 3. LEASED UNITS 3.1 Unit owner shall provide to the PMC a Villa Marina Registration Form with current contact information of tenants and unit owner, vehicle information, pet information, etc. 3.2 Offsite owners may use the common area facilities of the property. However, the BOD reserves the right to restrict or refuse the use of the common areas if offsite owners are abusing the privilege or are in violation of the House Rules. 4. EXTERIOR AND COMMON AREA CONDITIONS AND REGULATIONS 4.1 In order to preserve a uniform exterior appearance of the buildings and common areas the BOD has the sole right and authority to monitor the buildings, decks, fences, storage areas and other common and limited common areas and to enforce the House Rules. 4.2 No exterior alterations, replacement or removal to ANY part of the Villa Marina Property are permitted without prior written approval of the BOD. 4.3 Any changes or alterations to the interior of a unit must have prior written approval of the BOD. 4.4 Landscaping: The landscaping is common area and is owned by the HOA. Any homeowner wishing to trim, remove or plant flowers, trees, shrubs or alter the landscape around their units or anywhere on the property must have prior written approval from the BOD BEFORE beginning any work. Residents who do not have written permission will be fined and may be required to pay to have the area restored to its original or equal state. 4.5 Window Appearances: Any and ALL visible interior window treatments shall be white or off white. The only allowable window treatments are draperies, drapery liners, levolor blinds or shutters to maintain a uniform exterior appearance. No sheets, blankets, aluminum foil, cardboard, newspaper, posters, or stick on film shall be visible at any time from the exterior of any window or sliding glass door. Window treatments cannot be torn or broken. 4.6 Window cleaning inside and outside is the sole responsibility of the residents. 4.7 No shades, awnings, window guards, ventilators, air conditioners, etc. shall be installed in any manner that protrudes outside the building without written approval of the BOD. 4.8 Wiring/Plumbing Interior and Exterior: No owner or resident shall install anything, whether wiring, electrical, plumbing, telephone, cable, etc. that intrudes into or affects the limited common area or common area except as authorized in writing by the BOD. 4.9

3 Decks, Patios and Entryways: must be kept clean, neat and orderly and NOT USED FOR STORAGE. The only items allowed are: Appropriate, attractive patio/deck furniture no indoor type furniture or appliances Potted plants are allowed and MUST have saucers to catch any water runoff Hanging plants are allowed and may be hung from rafters. Plants may not be hanged in any way that penetrates the siding Up to but not exceeding ¼ cord of firewood stacked no higher than the railing and not touching the deck, floor or building. Wood must be in a rack and allowed on back decks only not in entryways or on landings BBQ grills must be kept away from the railing and the building when in use. A fire extinguisher must be kept near the BBQ. BBQ s may be used on back decks or patios only Bicycles may be stored on decks, and may be hung from rafters in a tidy and safe fashion. Bikes may not be hanged in any way that penetrates the siding. Bikes may not be stored in entryways, landings or stairways A maximum of two medium size gas cans may be stored EMPTY and in a safe manner on decks or patios. Gas cans are not allowed on landings, stairs or entryways Splitting wood on decks, patios, walkways, entryways, or stairways is not permitted Open flames of any kind (other than BBQ grills as outlined in 4.9) are not permitted on decks, patios, railings, entryways, landings or stairs Objects such as rugs, mats, blankets, etc are not to be thrown, dropped, hung, beaten or shaken from decks, railings, landings, entry ways, stairways, or windows No exterior clotheslines shall be erected or maintained and there shall be no drying or laundering of clothes, ski gear, water toys, blankets, towels, mops or any other items from railings, rafters, or soffits Walkways, stairways and entryways to each unit are designated for access and shall be used exclusively for entering and leaving the units. They must be kept neat, clean and orderly Littering is prohibited. Do not throw cigarette butts, wrappers, gum or any other articles on the grounds, walkways, entranceways, common areas or limited common areas No bicycles, scooters, strollers, toys, shoe storage, or any other personal articles shall be left or placed in any common area, including entryways, stairways and walkways. Such items are subject to removal except as described in No signs, such as posters, advertisements, handbills, or flyers of any kind may be posted on the grounds, on the buildings, or in unit windows at any time. Open house signs are permitted only during the actual open house hours. No flyers of any kind are allowed to be placed on cars. For Sale and For Rent signs are only allowed in windows.

4 4.18 Nothing may be projected or hung out of any window, nor installed on or at any exterior portion of the building except with the written approval of the BOD All holiday decorations may be installed the month before a holiday and must be removed the end of the weekend after the holiday. 5. GARBAGE AND RECYCLING 5.1 All garbage, recyclables and other refuse from the units shall be deposited with care in the appropriate containers provided in each designated trash collection area. No garbage or any other refuse may be placed outside the trash containers. 5.2 All organic matter, cat litter, animal wastes and diapers must be put in sealed plastic bags for sanitation purposes and to minimize odors and flies. 5.3 Cardboard boxes must be broken down before placing them in the recycle container. 5.4 No extra-large items such as furniture, carpeting, mattresses, appliances, Christmas trees or lumber over 5 feet long may be put into or left near the trash containers. Residents are required to remove these from the premises. 6. INSURANCE 6.1 Nothing shall be done or kept in any unit, limited common area or common area that will increase the rate of insurance premium or that will result in the cancellation of the Master Policy. 6.2 Owners have the obligation to notify the PMC immediately of any water leaks to prevent further damage. The Association s insurance covers only damage to the physical structure and liability. It does NOT COVER interiors, contents, appliances, personal property or liability, NOR damage to other units from water leaks. (Note: Per the Declarations, Section 11.2, Owners must obtain their own personal HO6 homeowner s policy to cover the above and other hazards.) 7. NOISE AND OFFENSIVE ACTIVITIES 7.1 There shall be no illegal activity allowed on Villa Marina property by any owner, resident, tenant, guest or any other person. 7.2 Quiet hours are designated between the hours of 10:00 pm to 8:00 am. 7.3 Washers, dryers, dishwashers, vacuums or any other noisy or loud appliances should not be used between the hours of 10:00 pm and 8:00 am. 7.4

5 No resident or guest shall make or permit any noise or disturbance which would disturb or compromise the rights, comforts or convenience of other residents. Stereos, televisions, musical instruments and voices shall not disturb adjacent units. At no time should noise from a unit including stereos and televisions be heard from the parking lot. 7.5 No loud or boisterous conduct or activities shall be allowed in any common area at a level which is annoying to other residents. 7.6 Excessive vehicle noise including loud or modified mufflers and loud car stereos are not allowed. 7.7 Construction work by contractors or homeowners shall only be done between the hours of 8:00 am and 7:00 pm Monday through Saturday, except in the case of emergencies. 8. PARKING / VEHICLES Parking is at a premium at Villa Marina, and the rules here are designed for the benefit of the homeowners. Parking rules are enforced by ticketing and towing at the owner s expense. Owners, residents, tenants and guests are required to abide by these rules. 8.1 All vehicles must be registered with the PMC. Any vehicle not registered is subject to tow without warning. 8.2 All vehicles on Villa Marina property must have a valid parking permit displayed in plain view. Any vehicle without a parking permit is subject to tow without warning. 8.3 Parking spaces are restricted for parking of properly licensed operative passenger motor vehicles and pickup trucks only. No trailers, boats, recreational vehicles or commercial vehicles may be parked or kept on Villa Marina property with the exception of properly registered trailers, boats, recreational vehicles, or commercial vehicles in the boat yard. Commercial vehicles will be allowed to park in the boat yard only with prior express approval from the Board. Precedence for boat yard use will first be given to trailers, boats, and recreational vehicles prior to allowing use for any commercial vehicles. Replacement parking permits are $ All vehicles parked on Villa Marina property shall have a valid license plate and current tabs. Vehicles must be in running condition and capable of movement at all times. No inoperable vehicles may be stored on Villa Marina property at any time. Flat tires must be repaired within 48 hours. 8.5 Owners may tow unauthorized vehicles from their own deeded parking spot. Vehicles in Permit Parking Only spots must be moved every 72 hours or are subject to towing. 8.6 Guests must have an official parking permit displayed in their car to park on the property. 8.7 Resident parking permits may not be used in nonregistered vehicles. 8.8 No automotive work such as oil changes, tune-ups, brake work, engine work or any other kind of vehicle repairs shall be done within the condominium property. This does NOT include changing a battery, changing a tire, or adding oil, water or antifreeze. Spillage of any kind must be cleaned up immediately. Failure to do so will result in fine to also include the cost of cleaning.

6 8.9 No vehicle shall be parked in or around Villa Marina property in a manner that obstructs another vehicle, takes up more than one parking space or obstructs access to or from any building entrance or exit Any vehicle parked in a yellow NO PARKING area, FIRE ZONE, another occupant s reserved space, obstructing traffic or violates any other provision of section 8 of the House Rules is subject to immediate tow without notice and at the owner s risk and expense Villa Marina has a few tandem spots clearly marked by lines on both sides. Parking in tandem in any other space is not allowed No parking allowed in the boat launch. The boat launch is used for the loading and unloading of water craft only. 9. PETS 9.1 Allowable pets are domesticated dogs, cats and birds. Only two pets per unit are allowed. 9.2 All pets must be kept in accordance with the City of Redmond Animal Control and King County ordinances, and the Declarations set forth for Villa Marina. Pets must be registered with the PMC. 9.3 Dogs are required to be on a leash and attended by the owner at all times while in common areas or limited common areas. Pets may not be tethered on ANY common areas at any time including stairwells, decks, patios, light poles, etc., nor left unattended outside for any length of time. 9.4 Absolutely no pets are allowed inside the pool fenced areas, pool house or cabana. 9.5 Pet owners are responsible for the IMMEDIATE removal and disposal of animal waste. Cat litter must be contained in a plastic bag for disposal. Dog waste must be picked up and disposed of in a plastic bag immediately. 9.6 Pet owners are responsible for prevention of odor, nuisance, noise, unsanitary conditions and other problems relating to their pets. Owners are responsible for keeping pets quiet. 9.7 The Board may at any time require the removal of any pet which it finds is unreasonably disturbing other Homeowners, or that it finds is frightful or dangerous to the Villa Marina Community. 10. POOL / SPA 10.1 Hours of use of the spa: 9:00 am to 10:00 pm, seven days a week Hours of use of the pool: 9:00 am to 10:00 pm, seven days a week from the Friday of Memorial Day weekend to Labor Day Extension of these days are at the Board s discretion Health department rules must be followed and are posted at the pool and spa. Any persons failing to follow the posted rules are subject to removal from the pool fenced area.

7 10.3 Valid pool card is required to enter the pool/spa area. One card is allowed for each unit owner, and if unit is rented, one card is also allowed for tenant. Owners will be responsible for claiming pool card from tenant upon dissolution of tenant/owner rental agreement. Replacement cards are $ Children under 12 years of age MUST be accompanied by an adult of at least 18 years of age in the pool, spa and within the pool fenced areas Children under 6 years of age are not allowed in the spa at any time Guests to the pool, spa and within the pool fence must be accompanied by a Villa Marina owner or resident at all times A limit of FOUR guests per unit is enforced. Parties of more than four require special permission from the BOD and a permit from the Property Manager. Per the King County Health Department, a maximum of 30 people are allowed within the pool fenced area at any one time Owners are responsible for any and all guests, including the actions of their guests, and any damage caused by their guests The following items are not allowed: No soaps or shampoo in the pool or spa No large and/or dangerous toys (i.e. motorized toys, surfboard, etc.) No food or drink in the pool or spa No smoking inside the fenced pool area No pets inside the fenced pool area No skateboards, bikes, rollerblades, etc No loud music, yelling or profanity No glass containers - drinks must be in plastic or cans Garbage must be disposed of in the proper receptacles provided in the pool area No alcohol allowed inside the fenced pool area The pool gates must not be propped open. 11. LAKEFRONT CABANA 11.1 Cabana is available 7 days a week, and may be used only by prior reservation.

8 11.2 Reservations forms need to be filled out and turned in or mailed to the Property Manager s office Events must end no later than 11:00pm Sunday through Thursday, and no later than 1:00am Friday and Saturday nights. No noise shall be heard outside of the Cabana after 10:00pm Rental Fee - There is a $20 rental fee for the cabana. Monthly assessment fees for the unit owner must be current to reserve the Cabana Deposit A $200 refundable cleaning / damage deposit is collected with each reservation. (See Reservation Form) 11.6 Parking two guest parking passes will be assigned per event. All other guests must park offsite. Violators will be towed without warning at vehicle owner s expense and the host may be fined Alcohol if liquor is to be served at Cabana parties, and if minors (under 21) are to be present, a banquet permit must be obtained and displayed in conformance with Washington State Law and Ordinances of the City of Redmond ($10.00 at any Washington State Liquor store). If all attendees are over 21 years of age, no banquet permit is required. No liquor can be sold Inspection The Cabana must be cleaned and ready for inspection by noon (12:00pm) on the day following the event. If not, the deposit check will be cashed to cover cleaning Conduct the host of the party must maintain control of party guests at all times. Host and guests may not offend or disturb residents of Villa Marina. A party at the Cabana may be closed if it disturbs residents or gets out of control in any way Fireplace only presto logs that have no chemical treatment or wood are allowed in the fireplace. Fire must be completely extinguished before the end of the Cabana event. No candle flames are allowed in the Cabana Cabana Penalties/Suspension any misuse or abuse of the Cabana rules by owners, tenants or guest may result in fines or suspension of Cabana privileges for a period to be determined by the BOD. 12. BOAT 12.1 Launch and Boatyard keys are issued to owners only renters must obtain a key from their unit owner Launch or Boatyard keys have a $50.00 refundable deposit and keys may be obtained by contacting the PMC A Non-replacement fee for a lost launch or Boatyard key is $ Boat launch and boatyard access gate is to be kept locked at all times except while launching or removing boats. 12.5

9 Boat trailers may not be parked on Villa Marina property with the exception of those renting a boat storage spot. Violators are towed without warning Guests using the boat launch and facilities must be accompanied by a resident or owner at all times All boats and trailers must have current registration from the state of Washington. 13. DOCK AND BOATYARD: 13.1 Boat slips are privately owned and deeded to particular unit owners. Deeded slips are not to be used by anyone other than the owner without permission from the owner Two slips are reserved for guests. Guest slips may be used for a maximum of two hours Slip owners may rent slips, but only to other Villa Marina residents. Boat slip rental forms must be filled out and filed with the PMC No storage of gasoline, chemicals, oils or detergents of any kind is allowed in the dock area Fishing is not allowed off private piers. Fishing is only allowed off the deck area surrounding the cabana Throwing trash, rocks, wood, chairs or any other foreign material into the marina area and lake is prohibited Finger piers and dock must be kept clear of objects to ensure safe use of piers Any and all modifications to finger piers, including but not limited to attaching bumper pads or other mooring equipment, must be approved in writing by the BOD Any damage to the facilities, cabana, dock, boats, piers, etc. is the responsibility of the owner. If the offending parties are guests, the owner connected to those guests will be held responsible Boat storage is available on a first come first served basis, and a waiting list is kept by the Property Manager The fee for storing boats in the boatyard is $50.00 per month. The fee for storing Jet in the boatyard is $30.00 per month All boats and tents must be kept clean and in good (operable) condition at all times. Fines may be assessed for unsightly condition.

10 13.13 Boatyard Rental other than boats: Maximum 5 spots in the boatyard at any given time for vehicles or trailers other than boats. Campers will be allowed. Must fit within the railroad ties. Cannot be longer than 25ft max. Must be licensed, registered in working condition and cannot be an eyesore. Must not impede turn around traffic in the boatyard. No cars allowed in the boatyard that are used daily. Must be for storage only. No guest, cabana party or pool party parking All vehicles, vessels, and trailers in the boatyard must be registered with the PMC. Any vehicles, vessels, or trailers not registered are subject to towing without warning. 14. RESIDENTIAL USE: 14.1 Villa Marina shall be used exclusively for residential purposes and for customary social, recreational or other reasonable uses incident to such purposes No unit shall be used as a rooming house, for hotel purposes or any transient accommodations No trade or business of any kind may be conducted in or from any unit, except with Board approval within the unit if: The existence or operation of the business activity within the unit is not apparent or detectable by sight, sound or smell from the exterior of the unit and is incidental to residential purposes The business activity is a legal activity and conforms to all city, county or state licensing requirements and zoning requirements for Villa Marina property The business activity does not involve persons coming onto Villa Marina property who do not reside on the property The business activity does not increase the liability or casualty insurance premiums of the Master Policy In the sole discretion of the Board, the business activity is consistent with the residential character of the Association and does not constitute a nuisance, hazard or offensive use

11 Application for business activity is made in writing to the Board and has received written approval prior to the start of any such activity There shall be no more than two adult persons per bedroom permanently residing in each unit Each owner shall keep the interior of their unit and its equipment and appliances in good, sanitary and safe condition, free of rodents and pests, and in a good state of preservation, condition and repair No one is permitted to sweep, throw or drop dirt or any other substance from doors, entryways, windows, decks or patios. 15. MAINTENANCE AND REPAIR RESPONSIBILITES 15.1 No Owner shall do any work, which would jeopardize the soundness or safety of the property or impair any easement Owners are responsible for the cost of damage to the units, common and limited common areas due to negligence, misuse or neglect of any owner, tenant/resident or guest If an owner undertakes the repair/replacement in installation of wiring, piping, etc. in the common areas (for example, within the walls) without Board approval, the Association will not automatically be responsible for the cost nor be liable for any resulting damage Any remodeling undertaken by an owner which affects common area (such as central plumbing, heating, wiring and alteration of walls) must be presented in writing to the BOD Owner must furnish the Board with certification by an architect or engineer that the proposed remodel will not impair the structural integrity of the building. The plans must be approved by the BOD in writing PRIOR TO the commencement of the work All work must be performed by a licensed and bonded professional contractor. 16. REPAIR OF WATER DAMAGE The resident must notify the PMC within 24 hours (or sooner) for any water leaks in the unit, windows or roof The PMC, BOD and Insurance Companies shall determine scope of work and the responsibility for damages. 17. HARASSMENT, INTIMIDATION, INTERFERNCE OF VILLA MARINA EMPLOYEES, CONTRACTORS, OR SUPPLIERS 17.1

12 No homeowner or renter shall harass, intimidate, or interfere with the duties of a Villa Marina employee, contractor or supplier. Harassment, intimidation and interference shall be defined case by case by the Board of Directors, employee, contractor or supplier. 18. FINES/ASSESSMENTS for violations of House Rules, Declarations and Bylaws Owners and occupants in violation of the provisions of the Declaration or amendments thereto, or Rules and Regulations adopted by the Board of Directors shall be subject to the following procedures to enforce compliance: A. Warning (first offense) Property Manager sends written notice of violation sent to owner. The unit owner is responsible for fees and compliance. B. Fines If damage is caused to the property, the owner of the unit responsible for the damage will be responsible for payment of all associated repairs. In all cases, fines are assessed to the owner of the unit. C. Hearing If the owner disputes the violation they have the right to request a hearing with the BOD, to be scheduled at the next scheduled board meeting. The BOD will notify the owner of the decision in writing, through the Property Manager. If the violation is upheld, the fine must be paid. D.
