2 Application Guidelines For: SITE PLAN DEVELOPMENT APPROVAL FOR RESIDENTIAL CONSTRUCTION, EXPANSION OF EXISTING BUILDINGS AND STRUCTURES, OR ACCESSORY STRUCTURES WITHIN THE OAK RIDGES MORAINE CONSERVATION PLAN AREA In accordance with the Township of King Zoning By-law as amended by By-law all applications for the expansion of existing residential buildings and structures and the construction of or addition to accessory structures that are within the 120 metre Area of Influence and/or Landform Conservation Area Category 1 and 2 are subject to Site Plan Control. This Guide has been prepared by the Township of King Planning Department to provide a general outline of the procedures involved in the processing and review of an Application for Site Plan Development. The purpose of the Guide is to familiarize the Applicant of the responsibilities of both the proponent and the Municipality under the provisions of the Planning Act, as amended. Any required information that is not provided with the application may result in a delay of the processing until all the required information is available to the Township of King. Application Fees 1. Township of King Municipal Administration Fee for Complex applications in the amount of $1,030.00, and Simple applications in the amount of $ in accordance with Fees By-law No A cheque is to be payable to the Township of King. 2. Private Sewage Servicing Fee in the amount of $ may be applicable. Upon the Building Department s review of the application, if it is determined that the appropriate fee is less than the required amount, a credit will be applied toward the building permit fee. A cheque is to be payable to the Township of King. 3. Conservation Authority Review Fee as determined by the Conservation Authority Fee Collection Form attached to the application may be applicable. Lake Simcoe Region Conservation Authority - $ and for Toronto and Region Conservation Authority - $ A cheque is required payable to the appropriate conservation authority and submitted with the application whereby Township of King will forward the application and fee to the agency.

Additional Municipal Fees associated with the review of the process may include Township of King peer review fees which would include independent professional consultants, including the Township Solicitor retained by the Township of King to review submissions. Planning Staff will advise upon submission of the application whether such additional costs are to be anticipated. In the event a Site Plan Development Agreement is required, and subsequently registered on title, the cost of searches, sub-searches, postponements, registration, and disbursements incurred by the Township Solicitor will be forwarded to the Owner as additional municipal fees. Information Required: 1. Key Map showing the location of the property in relation to major roads, natural and man-made barriers and features, immediately adjacent lots and properties (may be located on the site plan). 2. Site Plan to Indicate (does not have to be to scale, however, accurate measurements in metric are required): a. The dimensions and area of the property being developed indicating any road widenings, easements, etc. b. Location of existing and proposed buildings, structures, pools, driveway entrances and exits to abutting roads with dimensions to the lot lines and roads. c. Dimensions of the existing and proposed buildings and structures. d. Location of any site alteration, grading or areas to be filled or excavated (may include driveway expansions, construction of patio, etc.) to abutting roads with dimensions to the lot lines. e. Topographical features including all natural and artificial features such as watercourses, wooded areas, berms, swales, ponds and ditches must be indicated and generally dimensioned. f. Location of the limit of disturbance (manicured area compared to naturalized area) with dimensions to the existing and proposed buildings, additions, structures, driveway. g. Location of wells, septic tanks and tile field systems. h. Location of Silt-Fencing Erosion Control barriers. See sample site plan attached to the back of this guide 3. Site Servicing and Grading Plans Adequate to explain and indicate the following: a. Centreline grades at 15 metre intervals along all existing streets bounding the property and existing grades. b. A legend indicating existing and proposed elevations. c. Contours at maximum 0.6 metre intervals to indicate the existing elevations of the site. These contours are to extend to a minimum distance of 15 metres beyond the property limits to indicate the grading and drainage patterns of the adjacent lands. As an alternate to contours, spot elevations may be noted on the drawings to illustrate existing grade conditions providing that these elevations were obtained from field survey on a regular grid pattern with the interval not to exceed 15 metres. d. Cross sections as required to clarify the proposed grading, particularly in relation to adjacent lands. e. Proposed elevations on paved areas, around proposed buildings, along swales, along roadways, parking areas, driveways, catch basin rim elevations, and any other elevations necessary to establish the grading and drainage patterns for the development. Arrows to be used to indicate

4 direction of the surface drainage. f. Major Development (500 square metre foot print total or greater for all buildings and structures proposed) will require a stormwater management/grading plan prepared by a Professional Engineer. g. Cut and Fill Analysis with details to include origin of imported fill, where the fill will be placed on the site and the estimated volume of imported fill. A certification will be required from the Ministry of Environment for clean fill for the proposed land use. 4. Natural Heritage Evaluation/Hydrological Evaluation A Natural Heritage Evaluation and/or Hydrological Evaluation may be required if the development is within 120 metres of any key natural heritage feature or hydrologically sensitive feature. An evaluation is to be completed by a qualified ecologist/biologist and shall demonstrate conformity with the Oak Ridges Moraine Conservation Plan. Please consult with Planning staff regarding the applicability of this requirement. 5. Drawings & Reports Six (6) full size copies of the Site Plan, Site Servicing and Grading Plans and Key Map drawings are to be submitted (folded plans only) with the application together with one reduced set (8 1/2 x 11) of plans. All drawings are to be in metric and shall provide a bar scale. Three (3) copies of all related reports (Stormwater, Natural Heritage Evaluation, Geotechnical, Soils, Environmental Phase 1, etc.) The submission should be accompanied by a letter identifying all materials provided and be signed by the agent/owner. Circulation and Review: Outside Agencies In some instances, an application will be required to be circulated to various agencies and organizations that may have an interest in the proposed development. The applicant is encouraged to pre-consult with all applicable agencies before submitting a formal application to the Township. Once an application is submitted, Planning staff will coordinate a circulation to all applicable organizations. The following is a list of the most common agencies and contact information. Box 160 Bradford, Ontario L3Z 2A8 T: Conformity with Statutes, Regulations, and By-laws: The application must show conformity with all applicable statutes, regulations, by-laws and requirements of any relevant governmental authority or agency. The proposed structure(s) or additions, etc. must conform to the Ontario Building Code and all relevant regulations and the Township of King accepts no responsibility for any lack of compliance therewith. Building permits will not be issued until the site development approval is granted and where applicable, the site plan development agreement is fully executed by all interested parties and registered on title. Processes: 1. Site Plan Development Approval This process is followed when a site plan development agreement will not be required and the decision of which process is applicable will be determined by Planning Staff. If Planning Staff determine that a site plan development agreement is warranted due to the scale of the proposal, the site plan development agreement process will be followed. Site plan development approval will be granted by the Director of Planning. Planning Staff require permission and access to the subject property to conduct a site inspection between the hours of 8:30 am to 4:30 pm. Planning Staff will inform the applicant/agent when the site inspection will occur and if no one is to be present, please have any gates, if applicable, open so access can be obtained. No work will be commenced until approval is granted by the Director of Planning and all permits or other approvals have been obtained. 2. Site Plan Development Agreement Site Plan Approval is facilitated through a Site Plan Agreement between the owner and the Township as well as any encumbrancers on title to the subject property. The Township Solicitor will conduct a search of title to determine the proper parties to the Agreement, including all encumbrancers. A formal agreement will then be prepared and submitted to the registered owner and encumbrancers for execution. All costs incurred by the Township s Solicitor in the preparation of the Site Plan Development Application and registration on title to the property are the responsibility of the applicant. Financial considerations required with the Site Plan Development Application include the submission of securities to be held by the Township until the site development has been satisfactorily completed. No work shall be commenced and no permits issued until the agreement is properly executed and registered on title, all required fees, levies and securities have been paid or posted and a proper application has been made for all permits and additional approvals required.

6 Development Charges: Owners/applicants are advised that upon application for a Building Permit to erect a dwelling unit or non-residential structure on a lot, growth related Development Charges payable to the Region of York, the Township of King and both the Public and Catholic School Boards may apply. To determine the rate/cost prevailing at such time, please contact the individual agencies.
