2 TO ALL OWNERS AND RESIDENTS OF THE WESTLAKE VILLAGE CONDOMINIUMS These rules are a revision of the House Rules published in 1984 and amended in late This publication is the result many hours of work by a Rules Committee appointed by the Board of Directors and a careful review by the BOD at several meetings which were open to all residents. Prior to beginning work on this document, the committee solicited every resident for his or her recommendations. The rules contained herein are effective June 1, 2011 and supersede any written, implied, or oral understanding. The House Rules is third in a hierarchy of documents governing the directors, owners, and residents in Westlake Village. The primary document is the Declaration of Unit Ownership, followed by the By-Laws of the WLV Condominium Owners Association. The provisions of the primary and secondary documents can be changed by a vote of association members. In creating this document, the Board is acting within its authority to make changes and clarifications that do not conflict with the Declarations or the By-Laws. THESE RULES ARE NECESSARY FOR THE PRESERVATION OF A PLEASANT LIVING ENVIRONMENT IN WESTLAKE VILLAGE. THUS. YOU SHOULD REVIEW THE DOCUMENT CAREFULLY. ADHERENCE TO THE RULES WILL PROTECT THE INVESTMENT OF EVERY OWNER AND WILL HELP CONTROL MAINTENANCE COSTS. THE BOARD OF DIRECTORS HAS THE RESPONSIBILITY OF ENFORCING THE RULES AND REQUIRES THE COOPERATION OF EVERY RESIDENT IN THIS EFFORT Two changes in this document merit special attention. First, this edition of House Rules includes, for the resident's convenience, a tabulated schedule of fines on pages six, seven, and eight. Second, the Association has expanded and clarified rules related to alterations and additions. The Board's responsibility here is to ensure that building codes are followed and that the appearance of the community isn't compromised while it assists the petitioner in achieving his/her objectives. 3 HOUSE RULES INTRODUCTION These House Rules have been established in accordance with the Declaration of Unit Ownership and the By-Laws of the Westlake Village Condominium Owners Association to protect the rights and privileges of all residents. It is the Board's responsibility to adopt and publish rules ensuring the appropriate conduct of residents and that property held in common is maintained in the best possible condition. The purchase of property in Westlake Village imposes a legal requirement that the owner abide by the Association's Declaration of Unit Ownership and By-Laws and, by extension, its House Rules. This House Rules document supersedes all previous publications and their addenda. OWNERS AND TENANTS Condominiums, like townhomes or common interest developments, were never conceived, designed, constructed or intended to serve the same function as apartments. They were built as a community of single family dwellings designed to share common facilities and costs. Thus, while nothing in existing Governing Documents prohibits the rental or lease of a unit, the entire community has a vested interest in establishing processes and procedures which require compliance with Association rules and regulations from both owners and tenants. Prior to renting or leasing a property or changing a tenant/lessee, it is the responsibility of the unit owner to notify the BOD and Property Manager of an intent to rent or lease a unit and to provide the management company with a signed Rental Application, a copy of which is included in the appendix on pages 35 & 36. This form ensures that the owner has completed appropriate screening and criminal background checks on the prospective tenant/lessee. Noncompliance of this item will result in an immediate fine of $25.00 and an additional assessment of $5.00 per day until the updated form is submitted. At the time of the rental/lease, the owner must provide his/her tenant/lessee with copies of the Declaration of Unit Ownership, By-Laws, and House Rules. The Landlord-Owner, at the time of entering the agreement, must have the party(ies) sign a statement acknowledging that he/she has received the documents and has agreed to abide by the Westlake Village House Rules. A copy of this statement is to be filed with the Property Manager. The owner of rental property must provide the Property Manager with an address and telephone number where he/she can be reached. Any owner who fails provide this 3

4 information will be assessed an immediate $50.00 fine and a fine of $10.00 a day until all issues of noncompliance are resolved. Any resident who believes that there has been an infraction of these rules is encouraged to bring the matter to the attention of the Board of Directors directly, or through the Onsite Manager via the WLV- CC&R Violation Form. The BOD or Property Manager may initiate action by notifying in writing the unit owner of the infraction. If after a length of time specified by the Property Manager the infraction has not been resolved, the offending owner will be fined as the BOD may direct. If a renter/lessee continues to be noncompliant with the Association rules the Association will take more severe action. An owner may offer his/her parking space and/or garage for rent to a resident of Westlake Village. The owner of the rented property must notify the Onsite Manager of the change in occupancy of the parking space or garage. This notice is particularly critical in the case of a parking space where a car could be towed if it weren't clear that the vehicle belongs there. An owner must notify the Onsite Manager of the change within five (5) working days. Failure to do so will result in a $50.00 fine and any towing costs the oversight causes. C. ENFORCEMENT POLICY & DISPUTE RESOLUTION The Board will impose monetary fines to ensure timely and consistent compliance with the House Rules. For each infraction, a written notice of the reported violation will be sent to the owner and parties involved. 1. The following procedures shall be used in dealing specifically with those community rules and restrictions as outlined in the Declaration, Article VII, and subsequent rules adopted by the BOD. The violation or complaint must be reported on the Westlake Village CC&R Violation Form, a copy of which is included in the appendix to this document. The completed CC&R Form is then submitted to the Onsite Manager. The form requires the person submitting it to identify himself/herself and to state the date, time, resident's name and address, and a description of the infraction or complaint. The Board cannot respond to anonymous complaints. An investigation of the violation or complaint shall be made by the BOD, the Onsite Manager or the Property Manager. c. The Property Manager will notify the unit owner in writing of the following: (1) the complaint or alleged violation, (2) the specific provision of the House Rules at issue, (3) the amount of the applicable 4

5 fine, (4) a statement informing the accused of a right to a hearing if requested within a specific period of time, (5) an abatement or cure period before the fine is actually imposed, (6) the date after which the fine will be imposed if the accused does not request a hearing, and (7) the method by which he/she can request a hearing. Following the designated time for a cure and abatement period, the Onsite Manager will determine if the corrections have been made satisfactorily. If the violator hasn't corrected the problem within the time designated for correction and has made no effort at conciliation, the BOD will levy an immediate fine based on the Schedule of Fines below. f. A unit owner of a rented/leased unit is responsible for the conduct of his/her tenants and is liable for costs incurred as a consequence of the behavior of the tenants. g - NOTE WELL: Enforcement of rules is an owner's, not a renter's or lessee's, responsibility. ORS (4)(k)(L)(m) requires that the BOD give an owner an opportunity to be heard before a fine is imposed. The purpose of the hearing is not to determine the validity of the complaint. Instead, the hearing's purpose is to provide the owner the opportunity to show why he/she didn't violate the rule. The Property Manager is authorized to file a lien against the owner's unit when charges reach $ The charges for the fine, legal fees, and any expenses incurred by the Association connected with correcting the violation shall become due and payable by the owner as the Association's bylaws direct. Fines are due and payable immediately by the owner and are not to be considered in lieu of compliance or as compensation for any damage that may be incurred as a result of said violation. Compensation for any incurred damage is also the responsibility of the unit owner and is payable immediately. Owners will be responsible for costs incurred in connection with filing fees, judgments, and/or foreclosures, including but not limited to recording costs, lien preparation, interest, attorney fees, and court costs. These costs are treated as special assessments against the unit and must be paid in full prior to the lien being removed. 5

6 6. SCHEDULE OF FINES: All fines are per occurrence. If the event is continuing in nature, the fine will renew either daily, weekly or monthly until the violation is remedied or ceased. 8 INFORMATION REQUIRED FROM RESIDENTS Owners, absentee owners, and tenants will maintain on file in the Property Manager's office a completed copy of the Resident Information Form. Any changes affecting the accuracy of the information originally provided must be reported in writing to the Property Manager within five (5) working days of the change. An owner's failure to ensure compliance with this requirement will result in a $50.00 fine. STORAGE Except as otherwise provided for in the Declaration, there shall be no storage of items in the common areas without prior written consent of the BOD. This applies to storage pods which may be placed in the owner's parking space for a maximum of thirty (30) days, after having been granted written permission by the BOD, a record of which is kept on file in the Property Manager's office. Balconies, patios, decks, and other areas visible to the outside must be kept neat, free of clutter, and not used for storage. Hanging laundry, unused furniture, dead plants, luggage, children's toys, empty boxes, hanging "curtain-type" items and other unsightly objects cannot be placed in these areas. Residents may park their personal bicycles on their decks, patios, and balconies but must limit this parking to two bicycles per unit. A contractor doing work on a unit may bring in a construction trash box for the duration of the project if the following conditions are met The owner must submit a written application to the BOD for the trash box. The owner must ensure that the trash box does not impede traffic flow. All parties involved must act on a daily basis to make sure that all trash is picked up and deposited in the box. The owner may make arrangements with a neighbor to place the construction trash box in the neighbor's parking space if such a placement were more convenient to the work site. The On-Site Manager must be informed of this arrangement. The BOD must approve in writing the use of a guest space for the placement of a construction trash box. 5. The Association assumes no liability for any loss or damage to articles left or stored in any common or other areas of WLV property.

9 F. GARBAGE DISPOSAL In order to better use the space in the garbage dumpsters so that the Association will avoid charges for additional pick-ups (and therefore keep assessments low), residents must adhere to the following guidelines: All household food garbage must be placed in plastic bags and secured with fasteners or ties. Residents must place all garbage inside the dumpsters, placing nothing on the side or the top of a dumpster. Items falling to the ground create a maintenance hazard and a consequent added expense to WLV. Residents must break down and flatten boxes before depositing them in recycling bins. Boxes that have not been flattened result in additional recycling costs. Newspapers, other paper goods, and additional items listed on the recycling bins are to be deposited there, not in the garbage dumpsters. Residents must not leave tires, furniture, construction materials, mattresses, electric or electronic equipment or similar large items in the garbage pick-up areas, as the garbage dumpster is for household trash only. No one may place large items in a dumpster. Owners and renters/lessees must ensure that contractors doing work on the property remove their debris rather than placing it in a WLV dumpster. Contractors' boxes are required for large construction jobs. Any resident found to have violated these garbage/recycling policies will be assessed a $25.00 fine for each violation. Garbage and composting cans shall not be placed outside the confines of the residence. Cat, dog, bird, or other animal waste must be wrapped in a plastic bag and tightly secured before being deposited immediately in the garbage dumpster. G. COMMUNITY RULES 1. GENERAL USE AND MAINTENANCE A. Balconies, decks, patios, and other areas visible to the outside must be kept neat and free of clutter. Hanging laundry, unused furniture, dead plants, empty boxes, luggage, and children's toys are examples of inappropriate objects that must not be seen in these areas. 9

10 If a unit is found to be used as a "Meth Lab," "Crack House," or a location housing any activity in violation of state or federal laws, the owner is responsible for all costs and damages to the property. The Westlake Village Association assumes no responsibility for illegal acts committed or activities engaged in before their disclosure. The BOD has the right and responsibility to enter any unit, abandoned or otherwise, in the event of an emergency. The Association requires that every unit have, at a minimum, window blinds. Tenants may install drapes or curtains as well. The color portion of the blinds, draperies, or curtains visible from the exterior shall conform to the color standard of off white as specified by the Board. The covering of all windows by a blanket, sheet, cardboard or any other material is prohibited. A Westlake Village resident's garage is for the purpose of housing vehicles and personal storage and nothing else. Because the electricity in the garage is provided by WLV, not the owner, the Association prohibits any commercial or business activity in the garage. F. Smoking of tobacco products is a danger to the smoker's health and, through second hand smoke, the health of others. In order to maintain a pleasant and healthful environment for everyone, the Association has adopted the following rules regarding the use of tobacco products: 2. ALTERATIONS & ADDITIONS The smoker must ensure that tobacco odor emitted from his/her unit does not cause a nuisance to neighbors. The smoker must dispose of butts, ashes, and other waste materials in appropriate places. He/she must not throw butts on the grounds, the parking areas, or the roadways. Nor may he/she stamp out butts on deck or patio floors or on stairways. A resident found to have improperly disposed of these materials in WLV common areas will be fined $25 for each offense. A. Article VII, Paragraph 8 of the Declaration of Unit Ownership states that except as otherwise noted, nothing shall be done in any unit, or in, on, or to the common areas which impairs the structural integrity of part or 10

11 3. PETS all of the building(s), or which would structurally change all or part of the building(s). No unit owner shall cause or permit anything (including a sign, canopy, shutter, storm door, or screen door, ) to be displayed or otherwise affixed to or placed on doors, exterior walls, or roofs without prior written consent of the BOD. Owners are reminded that any alteration to the common or limited common areas requires prior written approval of the board and that they must have the proper written authority before making any addition or alteration. Approval for installation in one unit applies to that job only; the same installation in another unit requires a new written request to the BOD. This requirement includes washer/dryer hookups, air conditioning unit replacements, baseboard heaters, and laminate flooring installations as well. The contractor doing the work must be licensed, bonded, and insured. D. Unit owners are required when making any alterations or installation of appliances such as washer/dryer, air conditioning units, baseboard heaters or the laying of new floors such as laminated wood that the contractor doing such work must be licensed, bonded and insured. All construction drawings and appropriate photographs must be available for Board review and approval. This information must be provided to the BOD at the time the application is made and before any permission is given to begin work. No animal, fish, or reptile, caged or not, may be kept as a pet if that creature could pose a danger or a safety or health hazard or could cause damage to personal or common property. This rule includes the prohibition against keeping exotic creatures like snakes, some rodents, and some insects if they strike fear or serious apprehension in nearby tenants. The unit owner is responsible for costs of the repair of damages caused by a leaking aquarium. C. The breeding or keeping of animals or fowl such as chickens, rabbits, or pigeons as a hobby or for commercial or food producing purposes is forbidden in units and in common areas of WLV. 11

12 All animals must be inoculated and meet other requirements for pet ownership according to Oregon State Law. No dog or cat may run free in the common areas of Westlake Village including the pet area near the pond. Dogs must be on a leash when outside the unit and under the control of the owner, another adult, or a responsible child. An owner who refuses to adhere to this leash rule is subject to a $50.00 fine per offense. If the owner continues to ignore the leash rule and allows the animal to run free in the common areas of WLV, the BOD shall declare the pet to be a nuisance to the community and shall take action deemed necessary to remove the offending animal from the complex. After being informed by certified letter that the pet has been found to be a nuisance, the owner must comply within ten days. A pet owner is required to pick up the animal's waste, place it in a plastic bag, and tie it securely before depositing it in the garbage dumpster. A pet owner found to have not picked up his/her pet's waste will be fined $25.00 for the first violation and $50 for each subsequent violation. The pet area has a supply of plastic bags available for owner's use in waste disposal. A pet owner is responsible for the control and behavior his/her pet. For that reason the BOD will take immediate action in the case of any animal that makes frequent or continuous sounds that disturb nearby residents, that becomes a nuisance in the community at large, or that damages any property in Westlake Village. The BOD or the Onsite Manager will notify the owner in writing specifying the problem and the action he/she must take immediately. If the pet owner has made no effort to correct the situation within ten days, the BOD will take action to remove the offending animal from the complex. The Westlake Village Condominium owner who keeps pets or permits the keeping of pets in his/her unit holds the Association, the BOD, the On-Site Manager, and the Property Manager harmless from any damage or personal injury caused by a pet owned by a resident of or visitor to Westlake Village. The pet owner is held responsible for the cost of the replacement, restoration, or cleaning of items damaged within a unit. He/she is also responsible for the cost of cleaning and repairing damage in the proximity of the building caused by the pet. The Onsite Manager may call animal control in the case of any cat or dog on the premises without an identifying tag. 12

13 J. Pet sitting or pet care as a commercial activity isn't permitted. 4. BALCONIES. DECKS. AND PATIOS Only deck furniture and potted plants appropriate to decks, patios, or balconies may be used thereon. All items of deck or balcony furniture should be durable and heavy enough to remain stationary during strong winds or other adverse weather conditions. Residents may park no more than two bicycles on these limited common areas. Residents watering plants or sweeping and mopping floors must take care not to create a nuisance or discomfort to neighbors residing below or adjacent to them. Containers must be placed under plant pots to prevent dripping water or water damage to the wood floor of the balcony or deck. Cigarette butts, the contents of an ash tray, or other articles cannot be thrown from balconies or patios. A repeated offense of this prohibition, after a written warning has been issued, will result in a $25.00 fine for each occurrence. In order to preserve the attractive appearance of the Westlake Village Condominium Complex, the Association regulates the nature of items that may be placed in or on windows, balconies, decks, patios, entryways, stairway landings, and the outside walls, all of which are visible to residents of and visitors to WLV. Textile items, including clothing and rugs, shall not be hung on balcony, patio, or stair railings for any purpose. Clothing and other laundered items shall not be hung in doorways or windows in such a manner as to be visible from the outside of buildings. No radios or other amplified sound systems may be played on decks or balconies at a volume sufficient to be a nuisance to neighbors. If persistent uncleanliness of a deck, patio, or balcony is visible from the outside, the Property Manager will issue a letter informing the resident that he /she must clean the property within three days of receipt of the letter. If he/she doesn't comply, the Association will have it cleaned at the unit owner's expense. Subsequent instances of an unclean deck, patio, or will result in a $25.00 fine per violation as well as the cost of cleaning. G Small wind chimes are permitted, provided that their noise doesn't become a nuisance to the residents of WLV. 13

14 Balcony floors may not be covered temporarily or permanently with carpet, tile, wood boards, or any other material. The permanent installation of awnings sun screens, or other kinds of netting is prohibited. A roll-up canvas sunscreen attached to the ceiling of the deck or patio must be beige in color and be maintained in good repair. Its installation is limited to the months of May through October. J. Outdoor cooking on balconies and decks is limited to an electric barbeque stove or a Coleman type stove with a propane gas container. Cooking with charcoal is not permitted. Persons violating this prohibition will be fined $50.00 for each violation. 5. FIREPLACES If the Board' required annual chimney inspection reveals that the cleaning of a flue is necessary, the unit owner must schedule the cleaning within thirty (30) days and must accept the costs of the work. A document certifying completion of the work by a recognized chimney sweep must be filed in the Onsite Manager's office within seven working days. Unclean chimney flues are sufficiently dangerous to the community that failure to comply with this requirement will compel the association to arrange to have the work done at the unit owner's expense and to fine the owner $ for the noncompliance. C. Fireplace wood may be stored only in areas designated by the BOD for that purpose. Wood may not be stored in parking stalls on walkways or other common and limited common areas. Residents may store no more than 1/4 (one quarter) of a cord of wood on a balcony. It must be neatly stacked to ensure that it not fall from the balcony, that precautions are taken to prevent rodent or pest infestation and that the stack is six (6) inches from the wall. E. Fireplace inserts and glass doors MUST NOT BE INSTALLED. These implements are prohibited because fireplaces in the WLV units at are not designed to accept these items, which can cause explosions and are thus a hazard. Any owner found to have made such an installation will be fined $ and be required to remove the item within twenty four (24) hours. If upon inspection the Association learns that the prohibited item has not been removed, the owner will be fined an additional $100.00, and the item will be removed at the owner's expense. 14

15 6. SIGNS. SIGNAGE. AND FLYERS A. No unit owner or his/her agent may display "For Sale" or "For Rent/ Lease" signs or other window displays on any part of his property or in common areas except as noted below: Realtors or unit owners are allowed to display one sign at the entrance to the WLV. This means that each realty company is permitted one sign only at this location, no realty company may post more than one sign at the WLV entrance even if it is showing more than one property. The total number of signs permitted at the entrance at any one time is three. An owner advertising a by-owner sale is subject to these restrictions. NOTE: If the Onsite Manager, the Property Manager, or a Board Member sees that the WLV entrance has become cluttered, that the entrance way is obscured in any way, or that a sign is not in compliance with HOA signage rules, he/she has the authority to remove the offending sign without prior notice to the sign owner. Neon signs and other electrical or battery powered light signs advertising open house or sales events are not permitted at the WLV entrance or anywhere else on the grounds of the condominium complex. No signs advertising WLV units may be placed on county property near the WLV entrance. One Open House sign may be displayed at the building entrance. The sign to be displayed must be no more than six square feet and must be painted on both sides. Signs may not be driven into the ground because of possible damage to the sprinkler system or underground power lines. A-Frame signs are acceptable. Signs on posts cannot be used. 7 A sign not exceeding 18" x 24" may be displayed during daylight hours advertising a sale, a rental, or an open house. The owner or his/her agent is permitted one sign per unit. The sign must be displayed in the window only, never on the door. 15

16 Signs may be displayed during daylight hours only and must be removed each day. They may be displayed only while the owner or his/her agent is on the premises advertised. No resident has the right to remove any for sale or for rent sign because it offends him/her or because he/she believes that it might be in violation of the House Rules. This act is a violation of law, and the offender can be arrested. A unit owner selling his/her property is responsible to ensure that the realtor or seller provides the buyer with a current copy of the House Rules and informs the buyer of his/her responsibility to know and follow the rules and that the signs are removed promptly. If a sign is improperly displayed in the window of a locked unit, the owner will be fined $50.00 with an additional $50.00 fine for each week the sign is displayed. This after an effort has been made to contact the owner concerning the noncompliance. Even though the property owner may be absent during the sale of the unit, IT IS STILL HIS/HER RESPONSIBILITY to ensure that all real estate signage is in compliance and that all rules are followed. B. The placement of hand-made or commercially produced signs in the mailbox area or on any wall in the Westlake Village and affixing it by nail, staples, tape or other means is prohibited. This includes, but isn't limited to, missing pet, for sale, or meeting announcement signs. The left bulletin board near the mailboxes is available for use by all residents. The signs should contain no material that may be offensive to some residents, should be neatly constructed and/or typed, and should be removed in a timely fashion. No sign will remain on the bulletin board more than thirty days. The Board reserves the right to remove a sign it considers inappropriate, offensive, or outdated. C. Residents may also post signs flyers in the laundry rooms. Again, good taste and good manners are required. Signs placed at the entrance to WLV must be at least 3 feet inside the property line and may not block walkways or views of traffic. Signs may not be placed in the county right of way. 16

17 7. INSURANCE INSURANCE COVERAGE: All owners of units in Westlake Village are required to have in force a condominium unit owner's insurance policy. All renters must have must have a renter's policy. It is the responsibility of an owner to make sure that his/her renter/lessee meets the Association's requirements in regard to insurance coverage. INSURANCE REMINDER: The Westlake Village insurance policy does not cover the content of a resident's unit or his/her personal liability. Renters should secure insurance for personal property and personal liability; owners should secure, in addition, loss assessment coverage. The Association's insurance policy does not cover additional living expenses, loss of rental income, or other costs incurred during repairs to a temporarily uninhabitable unit. C. Neither the WLV BOD, the Onsite Manger, the Property Manager, nor any agent/employee of WLV is responsible for a resident's personal property left in a common or limited common area, including deliveries left at front doors. 8. LANDSCAPING The Association cannot permit the planting of any kind of flora flowers, shrubs, and ground cover, for example -- without the written permission of the BOD or the Board Member responsible for landscaping. The BOD plans what flora are appropriate in terms of cost, durability, the complex's sprinkling capacity, levels of maintenance required, and general attractiveness and balance of the grounds. The BOD contracts with a landscaping service to assist in the planning and care of the flora and grasses in the complex. The dumping of charcoal in a landscaped area can be dangerous and is prohibited. Dry bark dust is a dangerously combustible and a serious fire hazard. In the hot summer months especially, plants and shrubs burn easily, often causing serious damage. C. The picking of flowers and cuttings of shrubs by residents and guests is forbidden. Parents are to watch their children and not permit them to do so. Violators of this rule will be fined $50.00 for each offense. 17

18 D. The landscaping and grounds maintenance of the common areas is done by a committee of volunteers and a commercial service. A Board member is appointed to oversee this work. 9. SAFETY AND SECURITY Each resident can assist in maintaining the safety and security of Westlake Village by reporting any suspicious activity to law enforcement. In the case of immediate danger, disturbance or medical emergency the resident should call 911. Each resident can assist in maintaining the safety and security of WLV by being vigilant with regard to his/her immediate area, by knowing the neighbors, and by keeping his/her property safe and secure. A resident should call 911 to report an apparent trespasser or trespassers. The BOD requires that each resident annually inspect and replace or recharge the batteries of all fire detectors located in the unit, after which he/she will inform the Onsite Manager in writing that the system has been inspected, the date of the inspection, and assurance that all detectors are operable. E. Door to door solicitations are, for the most part, prohibited in Westlake Village. Residents are encouraged to remind a solicitor of this prohibition and of the signs at the complex entrance prohibiting soliciting. Some recognized charities like the American Red Cross, the United Way, and the Salvation Army engage citizen volunteers to call on neighbors during fund drives. A resident who wishes to participate in any one of these events must have his/her sponsoring charity provide him/her with a picture ID badge with the name of the volunteer and the charity. Residents must disconnect Christmas tree lights or other forms of decorative holiday lighting when leaving the unit or retiring for the evening. Exterior Christmas decorations must be removed by January 7. H. Residents who are away for an extended period of time should give a neighbor or a friend a phone number and/or an address where he/she can be reached in the event of an emergency. The Onsite Manager cannot provide this service for residents. 18

19 I. Neither the Onsite Manager nor a Board member is permitted to retain keys to individual units, nor is there a master key. fl LAUNDRY ROOMS AND RECREATION FACILITIES I. RECREATION ROOM The recreation room is kept locked at all times to prevent vandalism and unauthorized use. It may be reserved for private functions on a first-come, first-served basis. Contact the Onsite Manager or a Board Member for scheduling. The person reserving the Recreation Room must deposit $50.00 by check made out to Westlake Village when he/she makes the reservation. If the trash is taken to the dumpster and the room and surrounding areas are thoroughly cleaned and left in good condition, the deposit will be refunded. If the Site Manager must do any cleaning or repairing after the use, these costs will be deducted from the refund and the guilty party will lose permanently the right to reserve the facility. Costs in excess of the $50.00 deposited will be due immediately. Unpaid amounts shall become a lien against the unit owner. The Recreation Room may not be reserved for commercial or business use. Keys to the Recreation Room may be secured from the Onsite Manager the day before the function. A $10.00 charge for the loss of the Recreation Room key will be deducted from the deposit refund. The recreation room may not be reserved by minors, and any function for minors must be supervised by an adult in attendance. Hours of use by reservation are 7:00 AM to 11:00 PM Sunday through Thursday, 7:00 AM to midnight on Friday and Saturday. Recreation Room reservations do not include the use of saunas or the swimming pool. It is the responsibility of the person reserving the Recreation Room to ensure that noise generated by activities is not loud enough to disturb neighbors. If the noise level of the Recreation Room function becomes a nuisance and a Board Member, the Onsite Manager or the Property 19

20 Manager must respond to a complaint, the $50.00 deposit is forfeited. If the problem continues and law enforcement is called, the responsible party making the reservation is fined $ in addition to forfeiting the $50.00 deposit. 1. Alcoholic beverages are prohibited in the recreation room and barbeque areas. 2. SAUNAS Smoking is strictly prohibited in the recreation room. When reserving the recreation room and paying the $50.00 deposit, the person making the reservation must sign an agreement assuming responsibility for the behavior of all guests and that the host and guests will adhere to the rules of the WLV HOA. The Westlake Village Homeowners Association assumes no responsibility or liability for incidents or damage that may occur as a consequence of the behavior of persons attending the event. The reserving party agrees to hold harmless the Westlake Village condominium Association from any and all damages or claims of liability arising out of the use of the recreation room. The BUD reserves the right terminate activities in the recreation room if the behavior of the persons attending the function is such that a Board Member, the Onsite Manager, or the Property Manager, or a law enforcement determines that the situation is such that this action is necessary. In addition to the cessation of activities, the fine of $ and forfeiture of the deposit apply. Hours of use are 7:00 AM to 11:00 PM Sunday through Thursday, 7:00 AM through 12:00 midnight Friday and Saturday. Sauna use rules: No more than three persons may be in each sauna at a time. It is advisable to limit each session to ten minutes. 3. Do not use the sauna after consuming alcoholic beverages or controlled substances. 20

21 People with chronic health conditions and pregnant women should consult with their doctor before using the sauna. Clothing (the minimum of a swimsuit) is required at all times. Children under the age of eighteen (18) cannot use the sauna unless accompanied by a parent or guardian. Smoking in the sauna is prohibited. Sauna users may not consume food or beverages other than water in the sauna. The water must be contained in plastic bottles; glass and ceramic containers are not permitted. Instances of obvious disorderly conduct or lewd behavior are not tolerated and are prohibited in the sauna areas and adjacent bathrooms. Any resident or guest found to have done damage to the saunas or the adjacent bathrooms will be fined $75.00 and made liable for all costs incurred in the repair of the damage. 3. SWIMMING POOL Residents are reminded that they are financially responsible for damages caused by a guest to the sauna and/or adjacent area and are subject to a $75.00 fine. For the safety of WLV residents, the doors to the sauna are locked when not in use. Residents must secure a key from the Onsite Manager for a specific period of time. If that is not practicable, a resident may keep a key in his/her possession after paying a $5.00 deposit, which will be refunded when the key is returned. 12. The WLV Board of Directors reserves the right to permanently deny access to any owner or resident who repeatedly violates any rule or combination of these sauna rules. Use of the pool and the pool area is permitted during the hours of 7:00 AM to 11:00 PM Sunday through Thursday, and 7:00 AM to midnight on Friday and Saturday. To prevent overcrowding, only two (2) guests per unit are permitted to use the pool. The resident host must accompany guests at the pool. 21

22 Alcoholic beverages and food are not permitted in the pool area. The use of glassware, bottles, ceramics, china, or other breakables is also prohibited. A person bringing an alcoholic beverage to the pool will be fined $50.00 for each Smoking is not permitted in the pool area. Anyone seen smoking in pool area will be fined $50.00 for each offense. The WLV permits the use of safety flotation devices and life preservers for adults and minors using the pool but assumes no liability for any misfortune consequent to their use. The use of automobile, bicycle, or motorcycle inner tubes as flotation devices or for other purposes in the pool or pool area is prohibited. Water boards are prohibited as well. Any person, adult or child, resident or guest, found using one of these items will be ejected from the pool area immediately. Repeated instances of this offense will result in a one-year loss of pool privileges. Children under the age of fourteen using the pool must be accompanied by a responsible adult at least 18 years old. Noncompliance with this rule will result in a letter from the BOD to the parents informing them of the infraction. Should there be subsequent violations, the Onsite Manager or the BOD will issue a letter for each instance informing the parent of a $50.00 fine. No person suffering from a communicable disease or who is under the influence of intoxicating or controlled substances may use the pool or be in the pool area. Diving is not permitted. This includes diving from the recreation room roof. Any person observed doing this is subject to a $50.00 and banishment from the use of the pool area for the season it is open. The WLV Association encourages residents and guests to adopt a buddy system when using the pool. Anyone swimming alone does so at his/her own risk and is responsible for misfortunes that my occur. Radios, stereos, and other sound producing devices are prohibited unless used with individual headphones. NO ELECTRICAL DEVICES ARE PERMITTED IN OR NEAR THE POOL. 22

23 The life preserver ring and the body pole are for emergency use only and are not to be moved from that location. Anyone found playing with the emergency equipment will be ejected from the pool immediately and fined $ Subsequent violations of this rule will result in a $50.00 fine for each offense. No "horseplay," running, or any activity that may endanger others around the pool area or in the pool are allowed. Any person who is not a resident or a guest of a resident found in the sauna or pool area is considered a trespasser, and law enforcement will be called. No pets of any kind are allowed in the pool or the pool area. 0. The dependent of any resident or guest who violates the rules governing the sauna, swimming pool, or pool area will have his/her privileges to use these facilities revoked for one year. The BOD or the Onsite Manager will issue a warning letter to the offending party detailing the violations and notice of a $50.00 fine and charges for the repair of damages. 4. TENNIS COURTS To maintain security, the pool user should make sure that the gate is closed and locked when leaving. Pool and sauna users agree to hold harmless the WLV HOA for any injury or accident incurred in the pool or sauna area. The BOD reserves the right to deny access to any resident who repeatedly violates any rule or combination of these pool rules. Residents and guests using the swimming pool do so at their own risk. Tennis courts are available on a first come, first served basis. Reservations cannot be made. The court user should report any damage to the court, net, or fence to the Onsite Manager or the Property Manager. C. To maintain court security the court user should make sure that the gate is closed and locked when leaving. 23

24 D. A person guilty of willfully damaging the nets or marring areas of the tennis courts will be fined $25.00 and be financially responsible for the costs of repair and replacement. 5. LAUNDRY ROOMS I. MISCELLANEOUS A. There are eleven (11) laundry rooms in Westlake Village, located in the following buildings: LAUNDRY ROOM HOURS: The laundry rooms are available from 8:00 AM to 10:00 PM daily. Anyone using the facilities before 8:00 AM and after 10:00 PM will be fined $ Residents should report malfunctioning machines to the Onsite Manager. Identify the laundry room by building number, the malfunctioning machine by type (washer or dryer), its number, and the nature of the problem. Arrange for refunds of lost coins with the Onsite Manager. The Onsite Manager will ordinarily hang an "Out of Service" sign on an inoperative machine. The wash cycle is 39 minutes; the dryer cycle is 45 minutes. In consideration of others using the laundry facilities, residents should remove the laundry from the machines immediately at the end of the cycle. Residents are required to empty lint traps of the dryer after each use. I. Cigarettes, cigars, and other smoking materials shall not be extinguished or discarded in parking areas, walkways, stairways, sidewalks, grounds, or other common areas or facilities, nor are these items to be thrown from any window, balcony, or patio. No employee hired by the BOD on behalf of the Association shall be asked to leave the property on any private business of the owner or occupant of a unit. No exterior lighting or noise-making device shall be installed or maintained on any unit. 24

25 NOTE: Residents are warned that it is a violation of Oregon law to dispose of crankcase oil or other hazardous material in the common elements, the catch basin or the pond. Violators may be fined up to $1,000. The BOD will pay a $ reward to anyone reporting the illegal dumping of oil or hazardous material in any common area. The violator's name and unit number as well as the date and time of the violation must be reported. This information will be reported to the Washington County Sheriff. No resident shall use or permit the use of any musical instrument, radio, television, amplifier, or loudspeaker or any other device at a volume sufficient to disturb the occupant(s) of any other unit. This prohibition includes car radios, the sound systems of which must not be heard outside the car while it is in the complex. Unit owners will be fined $50.00 for each violation of this prohibition, including violations by renters or lessees. The Association believes that a waterbed in a unit is not a good idea. The unit owner is responsible for any water damage caused by a malfunctioning bed. Ham/CB radio operations are prohibited in Westlake Village either in units or in automobiles. No bicycles, skate boards, roller blades, roller skates, tricycles, or other such wheel equipment are permitted on the bridge. NOTE: Unit owners are required when making any alterations or installation of appliances such as washer/dryers, air conditioning units, floorboard heaters, or the laying of new floors such as laminated wood that the contractor doing such work must be licensed, bonded and insured. This information must be provided to the BOD before the work may begin. J. PARKING & PARKING STICKERS The automobile or motorcycle owner must register his/her vehicle and obtain a parking sticker from the Onsite Manager within five days of moving into the complex. The sticker must be displayed on an automobile in the upper left corner of the rear window. The sticker is displayed on the rear fender of a motorcycle. 3. Limited parking spaces dictate that no more than two automobiles may be registered per unit. A resident who insists on parking more than two cars on site 25

26 will be fined $50.00 for each instance and an additional $50.00 for each week until the noncompliance is resolved. Reserved spaces are numbered and are the personal property of the unit to which the number is assigned; parking is permitted in those spaces only with the permission of the owner. Parking in these reserved spaces is limited to cars with valid WLV-issued parking stickers. A unit owner may rent his/her space to the resident with a valid parking sticker. Vehicles inappropriately parked in reserved spaces without proper permission may be towed at the direction of the owner and at the expense of the vehicle owner. The unit owner must inform the BOD of the particulars of the rental of his/her reserved space within five days of the consummation of the rental agreement. Guest spaces are available on a first come first served basis. Vehicles cannot be stored in these spaces. A vehicle is considered stored if it has not been moved for forty-eight hours. A car found to have been left in a guest space for more than forty-eight (48) hours will receive a ticket. If the car's owner has taken no action within twenty-four hours after notification, he/she will be fined $ If the owner has taken no action in a subsequent 24 hour period, the car will be towed at the owner's expense. If a resident's guest is staying more than 48 hours, the host will indicate on a Guest Parking Permit, nonrenewable and good for up to thirty days, the dates of the stay and the car's license number. This Permit must be displayed on the dash board of the car when it is parked in a guest space. The Guest Parking Permits are available in the Onsite Manager's office. An exception to the long-term parking restriction in guest spaces may be arranged in the case of a resident who owns two cars or must accommodate another person's car for a short time and must be away for an extended period. The resident can receive prior written permission from the BOD to park the car in a guest space for a period not to exceed thirty (30) days. If the owner of one car uses a guest space while leaving his/her space open, he/she will be fined $ Parking is prohibited in areas signed "No Parking," "Fire Lane," or "Tow Zone." No one may park in front of garages, in walkways or at yellow curbs. Vehicles parked in these spaces are subject to immediate towing. The only person authorized to call for a tow truck in these instances the Property Manager. 10. A property owner may have an illegally parked car towed from his/her reserved space. 26

27 An area not marked as a parking space is not a parking space, and a vehicle parked in such an area will be towed. Delivery trucks may park anywhere on the grounds in order to serve WLV residents. A driver must move the truck when a resident asks him/her to do so. 13. Vehicles must be parked within the marked confines of parking spaces. K. OTHER VEHICLE ISSUES The speed limit in Westlake Village is 10 m.p.h. A resident observing a speeding or recklessly driven vehicle within the complex is asked to record the license number and the date and the time of the violation. He/she then will give the information to the Onsite Manager or the Property Manager. A letter of violation notice will be sent to the registered owner advising him/her of the regulations and insisting that he/she follow the rules while in Westlake Village. The first violation of the speed limit will result in a warning. The second notice will result in a $25.00 fine, the third notice a $50.00, the fourth notice a $ fine with each notice thereafter doubling the fine. All vehicles parked in WLV must be drivable and currently licensed. No disabled vehicles may be parked in WLV. These vehicles are subject to immediate tow at the owner's expense as well as a $50.00 fine. Only emergency repairs of vehicles are permitted in the complex. A resident may not perform repairs on vehicles anywhere in WLV other than within his/ her own garage. 5. Vehicles weighing more than 1/2 ton, are more than eight feet wide, and are more than sixteen feet long may not be parked in WLV. Examples of these prohibited vehicles are campers, recreational vehicles, motor homes, trailers, limousines and tent trailers. Contractors' trailers, U-haul trucks, and moving vans are permitted at WLV for no more than a day at a time. Boats, trailers, and other such vehicles shall not be parked in any space, guest or reserved, in WLV. These vehicles may be stored in an owner's garage, but no item so large that it prevents closing the door may be stored in a garage. The offending vehicle will receive a warning notice requiring that it be moved within 24 hours. Failure to do so will result in a $50.00 fine and a 27

28 warning that the vehicle will be towed at the owner's expense if it isn't removed within 24 hours. No vehicle may be parked in any space so as to obstruct driver's view of a traffic sign, traffic control marking on the pavement, or other traffic control device. The BOD reserves the right, after issuing a written warning, to take appropriate action to remove any vehicle, regardless of type, that is determined to be dangerous, unsafe, or an impediment to the flow of pedestrian or vehicular traffic on Westlake Village walkways or streets. The BOD will order the removal of vehicles or parts of vehicles, including bicycles, shopping carts, automobiles, trucks, and motorcycles, that have been abandoned on WLV property. Before taking the actions described above, the BOD or its agent will make an effort to locate the owner and insist that he/she remove the offending item or resolve the problem it's created. If, however, it's deemed necessary to take immediate action in the interest of the safety, health, and welfare of the community's residents, the BOD, the Onsite Manager, or the Property Manager may do so prior to seeking the item's owner. C. Neither the BOD, its agent, the Onsite Manager. nor the Property Manager is liable for any damage incurred in removing an offending item. In reference to conditions cited in items 5, 7, 7a, 7b, and 7c above, the property owner is responsible for all costs incurred by the WLV Homeowners Association in their implementation. 9. Bicycle and skateboard riders: Bicycle riders must conform to all Oregon laws governing bike operations and must obey all posted traffic regulations in the WLV common areas. The WLV Association permits the storage of two bicycles secured to the stairwell posts of the buildings. These spaces are available on a first come, first served basis and cannot be reserved by a bicycle owner. A resident found to have reserved a space for his/her own use will be fined $25.00 for each infraction. C. Resident skateboarders must limit their activities to riding on on WLV walkways and streets, giving pedestrians the right of way and not interfering with traffic. Using the board to climb steps and curbs or any 28

29 other activity that may damage property is prohibited and subject to a $50.00 fine for each violation. D. Neither the WLV Association, the BOD, the Property Manager, nor the Onsite Manager will be held responsible for any accidental damage done by a bicycle rider/skateboarder to the person or property of a resident or guest in the WLV common areas. In each of these instances the bike rider /skateboarder is responsible for accidental damages to the person or property of a resident or guest in the WLV common area. THE ONSITE MANAGER I. As with every organization the Onsite Manager's hours are subject to change and adjustment. The hours are always posted on the front door of the office and on the Property Manager's web site. 2. The Onsite Manager's duties may include custodial, light maintenance, and limited management work. These management functions may include such matters as helping residents resolve difficulties with washer/dryer malfunctions and issuing citations for violations WLV House Rules. It is important to keep in mind that the Onsite Manager has no authority to excuse a violation or to collect a fine. All questions or objections regarding a citation must be directed to the BOD or to the Property Manager. AIR CONDITIONERS, WASHERS/DRYERS, LAMINATE FLOORING & FLOORBOARD HEATERS An owner has a right to make reasonable changes in the living space of his/her unit. It is required, however, that the BOD approve the installation of air conditioners, washer/dryers, and flooring. In each case the owner must notify the Board of his/her intentions regarding these three items before any work begins. He/she must be prepared, if directed, to acquire the services of a licensed, bonded, and insured contractor. The Association recommends that a resident consult with the board early in the planning of the project to avoid difficulties as the approval process goes forward. 1. The following rules apply when an owner requests approval for the installation of a window air conditioner. A. Window air conditioning units may be installed in the back bedroom window only, with the support brackets on the inside of the unit; no support brackets shall be seen on the outside of the building. 29

30 Installation is limited to standard window air conditioners as the slider type requires outside support brackets. The window gap over the air conditioning must be enclosed with clear plastic only; no boards, plywood, cardboard, or similar materials may be used. D. The color of the exterior of the air conditioner must be light gray or beige only. An owner wishing to install an air conditioning unit other than a window air conditioner must make application to the BOD before work begins. All requirements regarding the use of licensed, bonded, and insured contractors apply. The following rules apply in the case of the installation of a washer/dryer in an owner's unit: Only a licensed, bonded, and insured plumbing contractor may install a washer/dryer in a unit. The reason for this requirement is that substantial adjustments to the water supply and waste systems are necessary before viable and legal installation is possible. The owner must provide copies of required Washington County permits, if required, before the Board can approve the project. C. The Board must approve the project before work begins. 4. The installation of laminate flooring is subject to the following requirements: A sound dampening underlayment is required. While much laminate flooring is installed by the resident as a do-it-yourself project, a contractor hired to accomplish or assist in the installation must be licensed, bonded, and insured. 5. A contractor or subcontractor employed on any BOD authorized project in WLV must be licensed, bonded, and insured. 6. The BOD will approve no construction, installation, plumbing change, or electrical wiring that may do damage to the structure or structural integrity of 30

31 the unit or surrounding units and which may be a hazard to the health and safety of residents of WLV. 7. NOTE WELL! Any person found to have begun or completed any of the above projects before receiving written authorization from the board will be fined $ and will be responsible for all costs incurred in correcting the situation. N. BARBECUES In the interest of fire safety, the Westlake Village Homeowners Association has chosen to prohibit charcoal-briquette-type barbecues on decks, patios or balconies. Violators will be fined $ Residents may use electric barbecues and Coleman type gas container BBQs with lids on balconies, patios, and decks. A resident using one of these barbecues on a deck or balcony must have a fire extinguisher nearby. RULES GOVERNING THE USE OF THE PUBLIC BARBECUE: The barbecue is available on a first come, first served basis. No individual reserving of the barbecue is permitted. Only charcoal briquettes may be used in the public barbeque. 3. Normally the Onsite manager will dispose of the ashes in the barbecue. During periods of heavy use on weekends, for example, it may be necessary for a resident to remove ashes. On these occasions the resident must make sure that the charcoal is completely extinguished before disposal. The person using the barbecue must ensure that the charcoal is extinguished and the barbecue grill is cold before leaving the site. The Westlake Village Association assumes no liability for occurrences related to the use of the public barbecue. 31
