2 Sanction of Building Plan for setting up an Industry in Industrial Estate / Park of WBSIDC A. Delegation of Power Under the initiatives of the State Government to ease the doing business in the State, Department of Municipal Affairs, and Department of Panchayat and Rural Development vide notification no.548/ma/o/c4/2015(pt-ii), dated and memo no.436/55/pn/o/i/3r-5/03(pt-ii), dated respectively empowered Industrial Development Authority / Corporation for granting permission / approval for erection of new building / structure for setting up an industry or to make any additional / alteration of an existing industrial building in the industrial Estate / Park maintained by them. Department of MSME&T also in its order vide letter no. 18/PrS/MSMET, dated authorized WBSIDCL to sanction building plan for setting up an industry in the Industrial Estate / Park maintained by WBSIDCL observing relevant clauses of West Bengal Municipal (Building) Rules 2007 and West Administration) Rules 2004 has also (Panchayat Samiti Administration) Rules as amended time to time. Industrial Estates where the No Objection Certificate would be given by WBSIDC Since, KMC Building Rules, 2009 is not included in the delegation of power, WBSIDCL is unable to act for granting sanction of Building Plan in the Industrial Estates under the areas of KMC and HMC and WBSIDC would give No Objection Certificate (NOC) only, instead of Sanction 1. Guidelines / Modalities The Building Plan prepared by allottee and duly certified by EBA/LBS & ESE & GE enlisted with the local municipal bodies / Gram, Panchayat / Panchayat Samity etc. conforming to the relevant Building Rules shall have to be submitted to the Estate Office of the concerned Industrial Estate with all statutory documents including filled up Application Form, Application Fees & Processing fees. Executive Engineer of WBSIDC after being satisfied with the application details as submitted shall request the allottee to deposit Sanction Fees and Infrastructure Maintenance Fees as calculated thereof. On receipt of such fees necessary order towards sanction of Building Plan will be issued by Executive Engineer on behalf of WBSIDC obtaining Approval of the Authority. In case plot area exceeds 500 Sqm. necessary sanction order will be issued by Executive Engineer after obtaining approval of Building Plan Sanction Committee. The Building Plan Permit / Sanction order shall be valid for 24(twenty four) months keeping conformity with the relevant provisions of lease deed agreement of WBSIDC. 5
