3 SCHEDULE B - SECTION I REQUIREMENTS The following requirements must be met: (a) Pay the agreed amounts for the interest in the land and/or the mortgage to be insured. (b) Pay us the premiums, fees and charges for the policy. (c) Documents satisfactory to us creating the interest in the land and/or the mortgage to be insured, must be signed, delivered and recorded. (d) You must tell us in writing the name of anyone not referred to in this Commitment who will get an interest in the land or who will make a loan on the land. We may then make additional requirements or exceptions. 1. Receipt of satisfactory, notarized Seller/Borrower Affidavit ([Form IL-1], copy attached). 2. Cancellation and release of record OR release of record of the property described herein from the lien of: Mortgage dated October 4, 2004 and recorded October 5, 2004 as Document No. 2004R49039 executed by Courtney K. Joyner, a married person, in favor of Illini Bank in the amount not to exceed $724, Modification recorded November 30, 2007 as Document No. 2007R45296, recorded November 27, 2012 as Document No. 2012R45929 and recorded November 26, 2013 as Document No. 2013R Cancellation and release of record OR release of record of the property described herein from the lien of: Assignment of Rents dated October 4, 2004 and recorded October 5, 2004 as Document No. 2004R49040 executed by Courtney K. 5 SCHEDULE B - SECTION II EXCEPTIONS Any policy we issue will have the following exceptions unless they are taken care of to our satisfaction. 1. Taxes for the year of 2014, and subsequent years, not yet due and payable. Tax I.D. No Taxes for the year 2013 paid in the amount of $11, Rights of the public, the State of Illinois, the County, the Township and the Municipality in and to that part of the Land in question taken, used or dedicated for roads and highways. 3. Rights of way for drainage ditches, drain tiles, feeders, laterals and underground pipes, if any. 4. Building setback lines and utility and drainage easements as shown on the recorded plat of subdivision. 5. Title to all coal and minerals within and underlying the Land, together with all mining rights and other rights, privileges and immunities relating thereto. 6. Rights of the public and others entitled thereto in and to the use of that portion of the insured premises within the bounds of First Street. 7. Any encroachment, encumbrance, violation, variation or adverse circumstance affecting the Title that would be disclosed by an accurate and complete land survey of the Land. The term "encroachment" includes encroachments of existing improvements located on the Land onto adjoining land, and encroachments onto the Land of existing improvements located on adjoining land. Paragraph 2 (c) of the Covered Risks is hereby deleted. 8. Rights or claims of parties in possession not shown by the public records.
