Donor of the above described property, does hereby state that the property being donated has no outstanding maintenance fees, assessments, taxes, mortgage or any other type of fee or encumbrance of any type.i/we agree not to use, bank or make a reservations for the above described unit or points for any subsequent use unless directed to do so by Donate For A Cause. In the event that I/we have already banked or reserved any usage I/we understand that that usage may be lost due to the resort s independent policy which Donate For A Cause cannot control. If any future use is unavailable then we agree to be liable for any bill issued in the calendar year that I/we are retaining usage even if it isn t due until some future time (i.e., if your resort issues a special assessment before this property is transferred to the charity, even if the bill is due over multiple years, you agree to pay the entire special assessment prior to transfer). I/We also understand that once this form is submitted that Donate For A Cause will hire an escrow company to begin a time consuming and costly title search process on my property and that I fully intend to perform any necessary duties to complete the donation of the property. My duties include, but are not limited to, faxing or sending ownership documents to the closing company and notarizing newly drafted ownership documents. I/We understand additional fees may apply if documents need to be filed to clear probate. I/we understand that this agreement may be canceled in the event that we fail to return any documents required to complete this donation within 14 days of the date requested by the closing company. I/we also agree that we may be liable for additional title work in the event we use or otherwise make any future use unavailable during the donation process. In exchange for the payment of $2,495 (paid at closing), plus resort transfer fees of $ (Amount quoted in ),* Donate For A Cause agrees, via their escrow company, to transfer this property out of my name permanently (typically transfers take 8-10 weeks from the date your signed transfer documents or deed are received) and will issue me a tax receipt for this donation. If Donate For A Cause is unable to complete the donation process and transfer this property out of my name I am aware that I will receive a full refund. I/We agree to pay the 2013 maintenance fees in full as well as any other fees associated with that usage. If my usage is biennial or triennial and the maintenance fees are billed annually I agree to pay all maintenance fees in advance to the resort until the property is available for use. I am aware that all fees must be paid prior to Donate For A Cause taking ownership. If I am paying maintenance fees on future usage and that usage is being given to Donate for a Cause I/we will receive a donation receipt for the fees paid toward that usage..

5 I/We agree that I/we are not currently contracted with nor will we attempt to donate this property to any other organization, sell the property or in any other way dispose of it during the donation process. If I/we do dispose of the property during the donation process, cancel this donation, or fail to return document(s) requiring signature (or payments due) within 14 days of the date requested by the closing company, I/we agree to pay the fees incurred by the closing company.
