3 CONSTRUCTION LAW DEPARTMENT The Construction Law department specializes in advice and litigation involving public and private project developers. The department also provides assistance to contractors. In the course of its practice, the department works in close and permanent liaison with the following departments: Public Business Law Real Estate Law Tax Law It is organized in four areas of practice: definition of the contractual framework of the works initiation of preventive summary proceedings assistance during the works phase assistance at the key stages of acceptance of the works and enforcement of the legal warranties The department assists those involved in construction projects prior to startup, during the works phase and after acceptance.
4 AREAS OF PRACTICE DEFINITION OF THE CONTRACTUAL FRAMEWORK OF THE WORKS The department provides advice and assistance prior to the start of the construction project by drawing up: project owner representation agreements agency agreements contracts of works insurance contracts INITIATION OF PREVENTIVE SUMMARY PROCEEDINGS The department assists clients of DS Avocats to take into account the environment of the construction site. To limit the risks inherent in a demolition and/or construction project, the department can if necessary initiate preventive actions in summary proceedings, monitor appraisals and settle issues of disturbance of neighbours and party boundaries. ASSISTANCE DURING THE WORKS PHASE During the course of a construction site, the Construction Law department assist clients of DS Avocats when a difficulty arises with performance (a contractor files for bankruptcy, abandoning of the site, termination of the contract, etc.) to protect their interests and seek the appointment of an expert urgently before the judicial or administrative courts: construction site incidents performance difficulties a contractor files for bankruptcy abandoning the site termination of the contract additional works judicial appraisals: judicial and administrative courts
5 ASSISTANCE AT THE KEY STAGES OF ACCEPTANCE OF THE WORKS AND ENFORCEMENT OF LEGAL WARRANTIES Acceptance of the works is a key stage requiring quite particular vigilance by both project developers and their contractors. The Construction Law department assists clients of DS Avocats during this phase. The department also provides advice for any financial claims (preparation of detailed statements, amicable investigations and disputes about claim memorandums). Finally, at the post-acceptance stage, the department assists clients of DS Avocats for the enforcement of legal warranties (enforcement of the completion bond, existence of punch list items, works defects insurance, two-year, ten-year warranties). THE TEAM Marie-Pierre ALIX Marie-Pierre Alix, who became a partner in 2003, runs and directs the Construction Law department. Marie-Pierre Alix assists clients of DS Avocats in the implementation of their real estate development projects, her particular speciality being major litigation files. Valérie DESFORGES Offering an experience of over 15 years in the monitoring of major lawsuits and pre-litigation of construction operations for masters for work and private companies, Valérie DESFORGES joined construction department in 2011 as a partner.
6 Magali LEROY Magali Leroy, a senior associate, handles litigation facing participants in construction projects and particularly public and private project owners, both before the start of their projects and during the completion phase. Magali Leroy s practice also focuses on liability and ten-year warranty files and on financial files (contestations of the final detailed account). Cécile VALENTI Cécile Valenti s practice alongside clients and companies assisting in the management difficulties presented by the transaction. She provides in particular monitoring of forensic litigation (construction insurance, disorders, responsibilities of manufacturers) and subsequent proceedings. Vanessa BELLAHSEN-MARJOUX Vanessa BELLAHSEN-MARJOUX is involved in the management of construction disputes, including the implementation and monitoring of measures of expertise and procedures referred prevention. Stéphanie de La ROULLIERE Stéphanie de La ROULLIERE is operating in all stages of a construction operation and ensuring more particularly the follow-up of the preventive procedures and litigations under both judicial and administrative courts. Caroline NETTER Caroline NETTER assists the clients to monitor their construction operations. She focuses particularly in the management of preventive procedures and litigation expertise within the courts of private law and administrative law.
