1 TREASURE COAST REGIONAL PLANNING COUNCIL M E M O R A N D U M To: Council Members AGENDA ITEM 4G From: Date: Subject: Staff March 16, 2007 Council Meeting Local Government Comprehensive Plan Review Draft Amendments to the City of Lake Worth Comprehensive Plan DCA Reference No Introduction The Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Florida Statutes, requires that Council review local government comprehensive plan amendments prior to their adoption. Under the provisions of this law, the Department of Community Affairs (DCA) prepares an Objections, Recommendations, and Comments (ORC) Report on a proposed amendment only if requested to do so by the local government, the regional planning council, an affected person, or if an ORC Report is otherwise deemed necessary by the DCA. If the local government requests DCA to prepare an ORC Report, then Council must provide DCA with its own objections, recommendations for modification, and comments on the proposed amendments within 30 days of its receipt. Background The City of Lake Worth is proposing two amendments to the Future Land Use Map (FLUM) and text amendments to the Future Land Use Element of the City Comprehensive Plan. The City has requested that the amendments not be formally reviewed by the DCA. Evaluation The FLUM amendments are summarized in Table 1. The location of the subject properties is shown on the attached maps.

Future Land Use Map Amendments 1. Amanzi Property This 4.8 acre property is being annexed by the City concurrent with the FLUM amendment. The property is located on the north side of Lake Worth Road, east of Congress Avenue and west of I-95. The property is vacant, except for three old single family structures that are to be demolished. The proposed use is a condominium resident development. The current FLUM designation under the County Plan is High Density Residential (HR-12). The proposed City designation is Medium Density Residential (MDR), which allows a maximum density of 20 dwelling units per acre. The existing land use on surrounding properties is vacant land to the north, residential development to the east and west and a senior citizens facility to the 2

3 west. The FLUM designations on surrounding properties are Industrial to the north, Park to the south, and HR-12 to the east and west. 2. Lake Worth Beach and Casino Area This property contains 18.6 acres and is located oceanfront on the east side of South Ocean Boulevard at the eastern terminus of Lake Worth Road. The property is owned in its entirety by the City and currently contains public beach and related facilities, as well as a number of non-conforming retail and commercial uses. A redevelopment plan for the property is under consideration by the City. The current FLUM designation is Public Recreation and Open Space. The proposed FLUM designation is Beach and Casino (BAC); a new designation drafted specifically for this property. The current land use on surrounding parcels include a County beachfront park to the north, a residential condominium development to the south, vacant property across SR A1A to the west and the Atlantic Ocean to the east. The present FLUM designations on surrounding properties are Public/Recreation and Commercial to the north, Multi-Family, High Density Residential to the south, and Mixed use and Neighborhood Businesses to the west across Ocean Boulevard (SR A1A). B. Text Amendments The City proposes to establish a new FLUM designation to be known as Beach and Casino (BAC). The new designation is considered necessary to reflect both the existing uses and the proposed development of the Beach and Casino property. Presently, in the City Plan, no non-public uses of the property are permitted. However, there are a number of existing non-public uses that exist as non-conforming uses. The BAC designation will be exclusively used for the public beach and casino area. By definition, this public beach area is to be used exclusively for public recreation and specified accessory uses; while the casino area to the west is to be for a combination of private commercial and public uses. These include ballroom and banquet facilities, limited retail, restaurants; and special events such as green markets, concerts, festivals and art shows/exhibits. The City has been considering the redevelopment of the Lake Worth Beach and Casino property for a number of years, and has recently selected a proposal to redevelop the property. Extrajurisdictional Impacts The amendments were submitted to the Palm Beach County Intergovernmental Plan Amendment Review Committee (IPARC) and were distributed to other local governments on February 21, According to the IPARC Clearinghouse Coordinator, no objections have been received to date. 3

4 Effects on Significant Regional Resources or Facilities Analysis of the proposed amendments indicates that they would not have adverse effects on significant regional resources or facilities. Analysis of Consistency with Strategic Regional Policy Plan The amendments are not in conflict with the Strategic Regional Policy Plan (SRPP). Conclusion Due to the lack of detrimental extrajurisdictional impacts or effects on significant regional resources and facilities, Council does not recommend that the DCA formally review the proposed amendments. Consistency with Strategic Regional Policy Plan The contract agreement between the DCA and the Treasure Coast Regional Planning Council requires Council to include a determination of consistency with the SRPP as part of the written report to be submitted to the DCA. Council finds the proposed amendments to be CONSISTENT with the SRPP. Recommendation Council should adopt the above comments and approve their transmittal to the Department of Community Affairs.
