Approve 1. Request for payment in the amount of $5, to the State of Michigan for the annual NPDES Permit fee for 2019 for discharges at the Wastewater Treatment Plant. 2. Request for payment in the amount of $2, to the State of Michigan for the annual Biosolids Land Appplication fee for 2019 for the reportated tonnage in 2018 by the Wastewater Treatment Plant. 3. Request for payment in the amount of $6, to Gratiot Isabella Regional Educational School District for the MMNet Internet services for the period July 1, 2018 to June 30, 2019 by the Alma Public Library. E. Requests for Purchase: 1. Request for purchase in the amount of $5, to Etna Supply Company for (40) 5/8 x 3/4 inch residental meters to restock the Alma Water Plant inventory. Approve 2. Request for purchase the amount of $1, to ASAP Sales & Service for the Snowplow Frame and Hardware to equip the new pickup truck. Approve 3. Request for purchase in the amount of $1, to ESRI for the ARC GIS annual software maintenance renewal for the Engineering Department. Approve 4. Request for purchase in the amount of $3, to Applied Imaging for the purchase of (4) Cannon Dr-M260 Scanners for the Alma Public Library and staff at City Hall. Approve 5. Request for payment in the amount of $2, to Alma Realty for the Alma Downtown Development Authority Façade, Roof, Fire Safety Enhancement Program for the property at 119 W Superior damaged by the fire at 117 W. Consideration of a resolution approving the First Amendment to the Water Tank Communication Site Lease Agreement between the City of Alma and T-Mobile Central, LLC for the use of the Water Tower. Approve (Subject: The original agreement was dated September 8, The Lessee wishes to extend the initial tem by five years commencing on Januay 1, 2019 and renew for five successive renewal terms of five years each. The Lessee guarantees to pay rent for the period of five years.) J. Reports: The City Commission may receive the following reports by one resolution. Appropriations Commissioner's Comments Approve Approve Invitation to Public (Subject: Pursuant to Article II of the City Code, individuals requesting to address the City Commission may do so by moving to the podium and being recognized by the Mayor, following which they should state their name and address for the record. Work Session began at 5:30 p.m. Alma, Michigan December 11, 2018 City Manager Schooley presented the December 7, 2018 Newsletter for discussion: Agenda Items Public Hearing Public hearing to consider a request from Shiloh Die Cast Midwest, LLC for a PA 198 Tax Exemption Certificate. Consideration of a resolution approving the application for an Industrial Facilities Tax Exemption Certificate for twelve years for real property. Consideration of a resolution authorizing Mayor Mapes to execute the P.A. 198 Agreement of Understanding between Shiloh Die Cast Midwest, LLC and the City of Alma for the issuance of an Industrial Facilities Exemption Certificate. Request for Purchase Request for purchase in the amount of $1, to Overhead Door of Lansing to replace 2 door sections, cables and clips on the perimeter seal for the Public Works Garage building. This purchase was approved by the city manager on an emergency basis. The west door had been struck by a truck. Ordinances Consideration of a resolution introducing Ordinance #806 to amend the Zoning Map of the City of Alma as it appears in Section of the Ordinances of the City of Alma. This ordinance is to rezone the property at 601 Woodworth from R-1, Single Family Residential to OS, Office Services Zoning District, subject to the conditions set forth in the Conditional Rezoning Agreement. On December 3 rd the Planning Commission held a Public Hearing for this property to consider the request for conditional rezoning. Ivory Manor, LLC is the requesting party. The property had been a church with no parking lot that has been on the market for nearly 2 years. Planning Commission recommended this be moved to the City Commission for consideration. City Manager Schooley advised the Commissioners that part of the Conditional Rezoning process is to have a pre-meeting with property owners to get their feelings on this zoning change. A pre-meeting with the affected property owners was held. Nine property owners attended. Most of the owners were concerned that their property values would decline with this Conditional rezoning. It was brought to their attention that a deteriorating structure would do more in declining their property values. The prospective purchaser wants to move her CPA accounting firm to this building and use the adjacent empty lot as a parking lot. It had been discussed to place shrubbery as a block on the north side of the property but after hearing concerns from the northern property owner the prospective buyer will be placing fencing on the property. There will be no lighting in the parking lot. It is recommended that that after two years on the market that this structure has no other recourse than to be Conditionally rezoned.

5 Informational Procurement Policy Please see the draft of the new procurement policy. Below are the procurement numbers with some changes from the last meeting. We would like to finalize the policy for the commission right after the start of the New Year. Invoice Approval Thresholds Type of Purchase Supplies, Equipment, Non-Professional Services and Information Services Leal and Audit Services Capital, Maintenance Contracts, and Other Professional Services Requisitioning Person Approval (per Dept Head) Up to $500 ($500) Department Head Approval Up to $5,000 ($500) City Manager Approval Up $10,000 ($1500) All Up $10,000 ($1500) to to City Commission Approval Over $10,000 (over $1500) All Over $10,000 (over $1500) Michigan Municipal League Recreational Marihuana What Now Seminar On November 30, 2018 I along with Mayor Mapes, Commissioner Ayers, and Commissioner Elect Stahl attended a seminar presented by the Michigan Municipal League that intended to answer some questions about the Michigan Regulation and Taxation of Marihuana Act (MRTMA). It appears there are not a lot of answers at this time. The law went into effect on December 6, A person at least 21 years of age may possess, use, consume, purchase, transport, or process 2.5 ounces or less of marihuana. Within a person s residence, a person may possess, store and process not more than a) 10 ounces of marihuana, b) any marihuana produced by marihuana plants cultivated on the premises, and c) for one s personal use, cultivate up to 12 plants at any one time, on one s premises. Unlike the Medical Facilities Act, for which municipalities had to opt-in, municipalities must optout of the MRTMA. There is no immediate rush to opt-out since the State has one year to assemble regulatory framework so as to begin accepting applications for licensure. However, if the State does not put regulatory framework in place within one year, licensure will, by default under the MRTMA, fall to local municipalities. The municipality, not the State, becomes the regulatory body for the period of the license; must issue a license within 90 days of receiving application unless the applicant is not in compliance with local ordinance. For that reason alone, I believe we would be smart to opt-out sometime in early 2019, at least for a period of time until the State has established any regulatory framework. Once that framework is developed, the Commission may choose to re-visit the City s options. Medical Marihuana Licensing Information Please see the draft Issuance of Medical Marihuana Facilities License Process along with the draft Zoning Pre-Approval Form and draft Marihuana Facilities License Applications. Please take a look at the documents prior to the meeting. If you have any questions committee members will be happy to discuss them at the work session. The task force will meet to finalize the documents. City of Alma Commission and Board Appointments: January 8 th Organizational Meeting We will hold our annual organizational meeting on January 8, 2019 starting at 5 pm. There are a number of items we are required to address. At that time, the Commission shall appoint a Mayor and

6 Vice Mayor who shall serve until the first day of January following the next City election. I have attached a listing of the commission and board appointments from 2018 to give you an idea of what is available. We had some discussion at the planning commission and I believe Don Ayers and Michelle Pitts both would like to stay on the commission. Don could become an at large member, and Michelle could take his place as a commissioner. I am compiling a list of open positions for community members. After the meeting next week, we will publish a request for application and get the information to the appropriate boards. I believe we have an open spot for a resident on the DDA, Alma Housing Commission has an opening as does the planning commission. FY 2020 Budget Schedule The schedule for the upcoming FY 2020 Budget preparation has been set. Note for Commissioners is the January 23 rd date set for the Annual Goal Setting Session at the Alma Library from 5:30 p.m. to 7:30 p.m. I wanted to get this out so everyone has a chance to make note on their calendars. Planning Commission Notes: A request to rezone the parcel of land located at 211 Woodworth Avenue, Parcel # from B2, General Business to LI, Limited Industrial has been received from the owners Joseph and Dawn Ahern. The parcel to the east is zoned LI, Limited Industrial allowing the property owner to request this zoning designation for leasing the property as a medical marihuana grow facility. Planning Commission Public Hearing set for January 7, 2019 at 5:30pm. A Special Use Permit and Conditional Rezoning Request has been received by Gemini Capital Management, LLC for 313 N State Street, Parcel # The applicant is proposing to develop eight (8) residential units on the second floor, and to conditional allow on (1) apartment on the first floor of the building annex. The property is zoned B-1, Central Business District. The B-1 district does allow residential uses provided they are on the second or higher floors of a permitted use through the issuance of a Special Use Permit. Planning Commission Public Hearing set for January 7, 2019 at 5:30 pm. T-Mobile Lease Agreement Staff is recommending for approval of a new agreement with T-Mobile for use of the City s Jerome Road elevated water tower tank for their communication antennas. This renewal takes into account the changing conditions in the technology market and company mergers. Come Home to Alma Holiday Celebration The Come Home to Alma for the Holidays Celebration put on by the Alma Action Association scheduled for Friday December 14 th. The parade starts at 5:45 pm at Gratiot Ave. heading West on Superior St. to Park Ave. Help to promote the local businesses by stopping by the downtown stores from 5:30 pm 8:30 pm. There are many family friendly events and performances throughout the downtown to get you in the Holiday spirit. It all culminates with the Christmas Tree lighting and Cash Giveaway at 8:30 pm between the Chamber Office and Alma True Value Hardware. Jingle Bell 10K 5K Run/Walk Too much to eat on Friday night at the Come Home to Alma Celebration? Run or walk it off on Saturday morning at the 8 th Annual Jingle Bell Run/Walk. Race Day Registration starts at 8:30 am at St. Mary s School. The kids Reindeer Trot begins at 10 am with the 10K, 5K, and Walk starting shortly after.

7 Happy Holiday Bonus to City Staff All City staff, including City Commission should have received their holiday bonus deposited to their accounts earlier this week. I am grateful for the efforts made by everyone over the past year to make this City a better place to live and work. Happy Holidays to everyone!! Reminder: Second December Meeting Moved to Thursday, December 27th Questions and brief discussion followed. The December 11, 2018, City Commission work session concluded at 6:00 p.m. Alma, Michigan December 11, 2018 Mayor Mapes called a regular meeting of the Alma City Commission to order at 6:00 p.m. at the Alma Municipal Building. Present: Absent: Allman, Harrington, Mapes, Mott, Nyman & Piccolo. Ayers. Mayor Mapes asked the City Commission and members of the audience to stand and recite the Pledge of Allegiance to the Flag. Motion by Commissioner Allman as supported by Commissioner Piccolo to approve the Agenda of this December 11, 2018 meeting with an additional Request for Purchase to I. T. Right. Yes: No: Allman, Harrington, Mapes, Mott, Nyman & Piccolo. None. Motion by Commissioner Piccolo as supported by Commissioner Nyman to approve the minutes of the November 27, 2018 regular meeting Yes: No: Allman, Harrington, Mapes, Mott, Nyman & Piccolo. None. Mayor Mapes opened the Public hearing to consider a request from Shiloh Die Cast Midwest, LLC for a PA 198 Tax Exemption Certificate at 6:00 p.m. Jim Wheeler of Greater Gratiot Development spoke to the Commission on this request from Shiloh. A PA 198 Tax Exemption is a tool to encourage expansion. Shiloh will be expanding their property to increase the size of the building to bring to the Alma plant a new line for processing. They will be retaining 5 jobs as well as increasing 5 more new jobs. Joe Bowen, Plant Manager added that this will be a win win situation for the City as well as the company. Construction has already been started and they hope that the project will be completed by the end of January Mayor Mapes expressed his appreciation of the investment that Shiloh is making into the City. Being no further discussion Mayor Mapes asked for a motion to close the Public Hearing. Commissioner Piccolo hoped that all would come out to enjoy the Come Home to Alma for the Holidays this Friday in downtown Alma. Commissioner Mott thanked Shiloh for their investment. City Manager Schooley made a note that the Alma Transportation Center s ridership was up to 6,100 in November higher than last November. He credits staff for the effort and long hours in completing this task. He wishes everyone a Happy Holiday. Mayor Mapes hopes to see a good attendance at the Come Home to Alma for the Holidays. He knows that this event will be a lot of fun and a great activity for Downtown. Mayor Mapes opened the floor for Public Comments. Laurie Wilson, 517 Michigan, St Louis again appeared thanking all for their support. Tim Lambrecht, County Commissioner wanted to wish everyone a Happy Holiday. He addressed that the Septic Ordinance is on hold at the moment. The Health Department heard a lot of good questions from the residents of the townships. They will be holding Public Hearings in February to answer these important questions. He thanked Mayor Mapes and City Manager Schooley for meeting with the County Parks Board on revenue funding. He is confident that good things will happen because of this meeting. It has been smooth running at the County. More Wind turbines will be coming to the County. He has been asked to join the U S Leadership Conference Advisory Board to discuss international business affairs and how they can benefit the

11 County and the State of Michigan. Lynn Ludy gave a report of the Book Sale scholarships. Thirteen Gratiot County residents benefited from the $11,500 dollars raised to continue their educations that had been interrupted before their completion. 25 Terms and Conditions E-4 THIS ORDER SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS: 1. This order shall not be binding on Applied Imaging (herein known as AI ) until approved by AI Corporate. 2. All shipments shall be F.O.B. our warehouse. 3. AI reserves the right to make delivery in installments. All such installments shall be separately invoiced and paid for when due, without regard to subsequent deliveries. Delay in delivery of any installment shall not relieve buyer of their obligation to accept remaining installment. 4. AI reserves the right at any time to revoke any credit extended to buyer because of buyer's failure to pay for any goods when due or for any other reason deemed sufficient by AI. 5. AI shall not be liable for failure to deliver or delays in delivery occasioned by causes beyond AI s control. This includes without limitation, strikes, lockouts, fires, embargoes, war or other outbreaks of hostilities, inability to obtain materials or shipping space, machinery breakdowns, delays of carrier or supplies, governmental acts and regulations, forces of nature, receipt of orders in excess of AI s scheduled production capability, or any other causes beyond AI control. 6. AI warrants that the goods covered by this order when delivered to the buyer will be merchantable quality and free from defects in workmanship and material for a period of 90 days on new equipment and 30 days on used equipment from the date of delivery by AI under ordinary use and conditions. In no event shall AI be liable for resulting or consequential damages occasioned by any breach of warranty. THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED ARE EXCLUDED. 7. All claims for goods or delay in delivery shall be deemed waived unless made in writing and delivered to AI within three days after receipt of goods by buyer. 8. Title to all goods and equipment shall remain with AI until such time as the purchase price thereof shall been paid in full. 9. AI shall have a security interest in all goods and equipment delivered to the buyer until the purchase price for same is paid in full. At the request of AI, buyer shall execute and deliver a security agreement and/or financing statements in the form or forms submitted to buyer by AI. 10. This contract shall be governed by and construed according to the laws of the State of Michigan. 11. This contract constitutes the entire agreement between the parties and may not be modified or terminated except in writing signed by an officer of AI. 12. General Scope of Maintenance Coverage - This agreement covers both the labor and material for adjustments, repair and replacements of parts as required by normal use of the equipment, subject to the exception in and in accordance with these terms and conditions. This agreement does not cover charges for installation of equipment or deinstallation of equipment if it is moved. Damage to the equipment or its parts arising out of or caused by misuse, abuse, negligence, attachment of unauthorized components, accessories or parts, use of substandard supplies or other causes beyond the control of AI are not covered by this agreement and may subject customer to a surcharge or to cancellation of the agreement. In addition, AI may terminate this agreement if the equipment is modified, damaged, altered, or serviced by personnel other than those employed by AI, or if parts, accessories, or components not meeting machine specifications are fitted to the equipment. AI may charge a fee upon customer request to pick up and dispose of equipment. Connectivity issues will either be billed at current pricing for network services or covered under the Network Connectivity Setup and Support section of this document. 13. Service Calls - Service calls under this agreement will be made during normal business hours at the installation address shown on the reverse side of this agreement. Travel and labor time for service calls after normal business hours, on weekends and holidays, will be charged at the published overtime rates in effect at the time the service call is made. AI will not handle, disconnect, or repair unauthorized attachments to components; customer is responsible for disconnecting and reconnecting unauthorized attachments or components. Customer hereby indemnifies and holds AI and its employees not at fault for claims for damages to any unauthorized parts, components or accessories resulting from service performed on AI equipment. 14. Term - This agreement shall become effective upon receipt by AI of the signed maintenance agreement and approval of the credit application. The AI contract shall continue for one full calendar year and/or the copy allowance as specified on the face of this agreement. The agreement is for a one year period. The agreement may be cancelled with 60 days written notice prior to the contract expiration date. If contract is cancelled prior to expiration date, a prorated penalty fee will be assessed, otherwise this agreement is automatically renewed for a like period at the then current contract rates. In the event AI is unable to repair the equipment due to the discontinuation of a part or parts by the manufacturer, AI will then credit the unused portion of the maintenance charges to the customer's account and cancel the contract. Any such credit must be used toward future purchases with AI. 15. Charges - The initial charge for maintenance under this agreement shall be the amount set forth on the reverse side of this agreement, 11" x 17" constitutes 2 clicks. Pricing for maintenance under this agreement is subject to change on a yearly basis due to cost increase of parts and labor. Customer agrees to pay the total of all charges for maintenance during the initial term and any renewal term within 15 days of the date of the AI invoice for each charge. In the case of the limited maintenance agreement, the initial annual charge is payable upon the signing of this agreement by customer. Customer understands that alterations, attachments, specification changes, or use of substandard supplies that cause excessive service calls may require an increase in maintenance charges and agrees to pay such charges promptly when due. 16. Breach of Default - If the customer does not pay all the charges for maintenance or parts as provided under this agreement promptly when due (1) AI may (a) refuse to service the equipment or (b) cancel maintenance agreement (2) the customer agrees to pay AI (a) its costs and expenses of collection including the maximum attorney's fees permitted by law, said fee not to exceed 25% of the amount due under this agreement and (b) all charges for service provided before payment of the contract on a "Per Call" basis based upon published rates in effect at the time of service. There will be a processing fee of $35.00 for NSF check. 17. Use of Manufacturer Recommended Supplies - The equipment is designed to give excellent performance with AI supplies including AI paper, toner, and fuser oil. If the customer uses other than AI supplies and if such supplies are defective or unacceptable for use in the machines and cause abnormality, frequent service calls or service problems, then AI may, at its option, assess a surcharge or terminate this agreement. In this event, the customer will be offered service on a "Per Call" basis based upon published rates. It is not a condition of this agreement, however, that the customer may use only AI authorized supplies. 18. No Warranty - AI disclaims all warranties, express or implied, including any implied warranties or merchantability fitness for use, or fitness for a particular purpose. Customer agrees that AI is not responsible for direct incidental or consequential damages including, not limited to damages arising out of the use of performance of the equipment or the loss of the equipment. 19. Miscellaneous - This agreement shall be governed by and construed according to the laws of the State of Michigan applicable to agreements wholly negotiated, executed and performed in the State of Michigan. It constitutes the entire agreement between the parties and may not be modified except in writing signed by duly authorized officers of AI and the customer. Network Connectivity Setup and Support 20. AI will confirm desired configuration from the customer. The following will be needed from the customer s network administrator: a. A live network drop must be available. Wireless connectivity is available for an additional fee. b. Local administrator access when we arrive onsite. c. SMTP server name and/or IP address for Scan to . d. For scan to folder, the customer s network administrator must provide credentials with write privileges to the folder. 21. AI will install one print driver & LAN Fax Driver on up to (3) servers and/or up to (10) workstations. 22. Includes set up of up to (10) address book destinations. 23. Includes set up of fax forwarding to folder or Includes print/copy restriction on up to (10) users/dept. codes. 25. Includes testing and training with the customer s network administrator. 26. AI must be allowed to resolve issues by using remote access tools that will provide a connection to the customer s servers and computers. The customer is responsible for assisting in the setup of remote access. If the issue cannot be resolved remotely, an onsite trip will be billable. 27. Support includes print driver support, scan setup (to network or folder) and network fax forwarding. Support is limited to the initial servers (up to 3) and the initial workstations (up to 10). 30. Support is limited to the connection and usability of the printing devices from the network. If the issue extends to the overall function of servers, workstations, switches, hubs, routers, internet services or any other network related issue, the customer is responsible for resolving the issue prior to AI attempting to fix any issue between the network and the printing device. 31. Each of these pieces of the building were damaged in the fire at LL7 W Superior in April The building is home to Rogers Natural Health Food Store, which still in business, except for a twowee k period as t he restoration was com pleted on th e bu ild ing. Also, Katie Tobias-State Farm lnsu ra nce will be moving back into the building. This space received a lot ofwater damage.. The total estimated project costs are s40,000, the grantee is requestins the maximum Srant amount ofs2,500. The grant amount would 6.3% ofthe total project costs. On Monday, January 8, 2018 the Alma Planning Commission approved the recommendation of a Zoning Map Amendment to rezone the former Middle School Property from R1,Single Family Zoning to R3-Multiple Family Residential.. The reason for the rezoning is for the sale of the property from the Alma Public Schools to the developer Gemini Capital Management LLC.. The developer plans to build six duplex style-quadplexs (24 units total); with twelve units facing Gratiot Avenue and twelve facing Pine Avenue. The remining twelve will face the interior of the lot, with a road running down the center of the lot.

40 I-1 FIRST AMENDMENT TO WATER TANK COMMUNICATIONS SITE LEASE AGREEMENT This First Amendment to Water Tank Communications Site Lease Agreement (the Amendment ) is effective as of the date of execution by the last party to sign (the Effective Date ) by and between City of Alma, a Michigan municipal corporation ( Lessor ) and T-Mobile Central LLC, a Delaware limited liability company ( Lessee ) (collectively, the Parties ). Lessor and Lessee (or its predecessor-in-interest) entered into that certain Water Tank Communications Site Lease Agreement dated September 8, 2009, (the Lease Agreement ) regarding the premises located at 530 Jerome Rd., Alma, Michigan (the Premises ), and herein. Lessor and Lessee desire to amend the Lease Agreement on the terms and conditions set forth Site ID: MT04490M NOW, for good and valuable consideration, Lessor and Lessee agree as follows: 1. Rent. a. Starting on the New Commencement Date, Lessee shall pay Lessor One Thousand Two Hundred and No/100 Dollars ($1,200.00) per month ("Rent") in advance, by the fifth (5th) day of each month, for the New Initial and First Renewal Terms. Rent shall increase to One Thousand Two Hundred Twenty-One and 60/100 Dollars ($1,221.60) at the beginning of the Second Renewal Term. Where duplicate Rent would occur, a credit shall be taken by Lessee for any prepayment of Rent by Lessee. b. Rent shall be increased by one and eight tenths percent (1.8%) at the beginning of the Second Renewal Term and at the beginning of each successive annual anniversary thereafter. 2. Renewal Terms. a. The Parties hereby wish to supersede and replace the term and any renewal terms of the Lease Agreement. If Lessee or Lessee s contractors infringes this notice and causes damage to the water tank, any and all repair expenses caused by, will be paid by Lessee or Lessee s contractors. 5. Notice. All notices, requests, demands and other communications shall be in writing and shall be effective three (3) business days after deposit in the U.S. mail, certified, return receipt requested or upon receipt if personally delivered or sent via a nationally recognized courier to the addresses set forth below. Present: Absent: Others Present: Pitts, Schooley, Mapes, Kulling, Ayers, Wheeler, and Richter Gilkins Aeric Ripley, City of Alma Zoning Administrator Aaron Hale, City of Alma Code Enforcement Officer Alan Leute, 1021 W. Superior St Jeff Vibber, 523 Woodworth Ave Jeff Turk, 609 Woodworth Ave Mary Ann McPherson, S. Chippewa Rd., St. Louis Ed Lorenz, 610 Woodworth Ave David Adam, 613 Woodworth Ave A motion was offered by Kulling, and supported by Ayers, to approve the minutes of the Regular Planning Commission meeting held on November 5, Yes: No: Pitts, Schooley, Mapes, Kulling, Ayers, Wheeler, and Richter. None. Re-Scheduled Public Hearing 601 Woodworth & 119 Hastings The Public Hearing was opened at 5:30 pm. To consider a request to conditionally re-zone a portion of land further described below from the current R-1, Single Family Residential, and to conditionally allow the building to be used for office professional, as defined by the OS, Office Services zoning district, with the conditions outlined within the conditional rezoning agreement. Ivory Manor, LLC is the requesting party. Staff Comments: A neighborhood meeting was held on October 3, 2018, taking the comments from that meeting, the Public Hearing was rescheduled for tonight, the following conditions were presented: The following additional conditions will be applied to the Conditional Rezoning Agreement under the traditional OS, Office Services, permitted and special use requirements. Primary Use Restrictions Prohibit the use of office space to medical offices, dental offices, laboratories, clinics, and veterinary offices. Restrict business hours open to the public to traditional business hours of 8:00 am 5:00 pm. Some occasional evening traffic may be required to operate the business; this shall be limited in nature. Restrict lit signage anywhere on the exterior of the property (building and ground). Restrict ground signage to small monument type not to exceed four feet in height.

51 J-2 Alma Planning Commission December 3, 2018 Page #2 Accessory Use Restrictions Restrict lighting structures in off-street parking lot to a maximum height of four feet. Restrict the banking of snow within six feet of the north bound property line. Additional Restrictions Place a green space buffer of not less than four feet in height between the parking lot and northern property line and trimming existing trees and shrubs. Conceal any exterior trash receptacles within a designated fenced or screened area. Addition Staff Comments If the conditional rezoning is approved by City Commission the Owner shall provide a change of use plan to be reviewed and approved by the Building Inspector. Site plan approval by the Planning Commission must be obtained before the construction of the parking lot. Parking lot drainage must be reviewed and approved by the Public Services Department. Public Comments: Mr. Turk, is not in favor of the conditional rezoning; he stated the property is in a residential neighborhood and the properties are very close together and the proposed use will cause parking and access issues. The new use would surround his house and parcel. Ms. McPherson and Mr. Turk have discussed a sale of a piece of the Hastings lot, to combine with Mr. Turks lot. How many people could be in the building at one time with the new use. Also concerned with the resale of his property, having a parking area next door. Mr. Adams, is concerned with what the parking area would do to his resale. How large is the parking area going to be, and has concerns of making sure the parking area drains properly. He was not in the favor of using shrubs for the parking area buffer on the north property line of 119 Hastings. What type of trainings would happen on site. Concern of large groups using the structure after hours. He would prefer a fence, along the north border of the property. Ms. McPherson, the parking area would be 8-10 spaces, stated she had no problems with putting in a fence along the north border, the parking would be designed to meet code. She would be using the front half of the building for her CPA business and at some point, in the future, make a couple of offices for a lawyer or insurance office, the conditions spell out what cannot go into the building. Mr. Lorenz, if the Conditional Rezoning is approved the conditions must be spelled out clearly, and verification, enforcing those conditions need to take place.

52 J-2 Alma Planning Commission December 3, 2018 Page #3 Ripley, the parking lot will have to come back to the Planning Commission for site plan review before it can be built. The designer will have to make the determination of the best way to drain the spaces, which will have to be approved by the engineering department. The conditional rezoning agreement once approved by City Commission is signed, recorded at the Register of Deeds, and before a final Certificate of Occupancy is granted staff must verify all conditions were followed. Hale, looked up the capacity of the building for this use and it could be up to 35 depending on how the interior is laid out. The Public Hearing was closed at 6:26 pm. A motion was offered by Ayers, and supported by Richter, to recommend the conditional rezoning to the City Commission with the conditions presented, and substituting a opaque fence in place of the shrubs on the north end of the parking area. Yes: No: Pitts, Wheeler, Schooley, Mapes, and Richter. Wheeler, Kulling. Request to set a Public Hearing for a Special Use Permit & Conditional Rezoning A Special Use Permit and Conditional Rezoning Request has been received by Gemini Capital Management, LLC for 313 N State Street, Parcel # The applicant is proposing to develop eight (8) residential units on the second floor, and to conditional allow on (1) apartment on the first floor of the building annex. The property is zoned B-1, Central Business District. The B-1 district does allow residential uses provided they are on the second or higher floors of a permitted use through the issuance of a Special Use Permit. A motion was offered by Wheeler, and supported by Mapes, to set a Public Hearing for Special Use & Conditional Rezoning for January 7, 2019 at 5:30 p.m. Yes: No: Pitts, Schooley, Mapes, Kulling, Ayers, Wheeler, and Richter. None. Request to set a Public Hearing to Rezone Property A request to rezone the parcel of land located at 211 Woodworth Avenue, Parcel # from B2, General Business to LI, Limited Industrial has been received from the owners Joseph and Dawn Ahern. The parcel to the east is zoned LI, Limited Industrial allowing the property owner to request this zoning designation for leasing the property as a medical marihuana grow facility. A motion was offered by Wheeler, and supported by Ayers, to set a Public Hearing on January 7, 2019, for Rezoning parcel Yes: No: Pitts, Schooley, Mapes, Kulling, Ayers, Wheeler, and Richter. None.
