BUDGET ADJUSTMENTS Date of Meeting: October 4, 2016 STAFF CONTACT(S): John Sandy, County Administration Erin McLellan, Management and Budget BACKGROUND: Staff recommends that the Board of Supervisors approve the budget adjustments as stated below. BA BA BA BA This budget adjustment estimates and appropriates $2,776 in FY 2016 grant funds from the Virginia Department of Behavioral Health and Developmental Services and the Virginia Foundation for Healthy Youth in the General Fund for the Department of Mental Health, Substance Abuse, and Developmental Services. The funds will be used to cover personnel costs related to Tobacco Prevention and Intervention. No local match is required. (FY 2016) This budget adjustment estimates and appropriates $27,920 of 2016 Virginia Department of Motor Vehicles - Speed Grant funds in the General Fund for the Sheriff's Office for the reimbursement of expenses related to overtime and training costs related county-wide speed enforcement operations. The LCSO is required to provide an in-kind match of $13,960, which will be met through budgeted expenditures for vehicle fuel and maintenance. The grant period is from October 1, 2016, through September 30, This budget adjustment estimates and appropriates $40,635 of 2016 Virginia Department of Motor Vehicles - Alcohol Grant funds in the General Fund for the Sheriff's Office for the reimbursement of expenses related to overtime and training costs related to monthly DUI checkpoints throughout the County. Additionally, the grant funds will be used for the purchase of six Lidar Speed System units to be used during alcohol related enforcement. The LCSO is required to provide an in-kind match requirement of $20,318, which will be met through budgeted expenditures for vehicle fuel and maintenance. The grant period is from October 1, 2016 through September 30, This budget adjustment estimates and appropriates $17,753 of 2016 FBI Safe Street Task Force (SSTF) funds in the General Fund for the Sheriff's Office. The SSTF focuses on street gang and drug-related violence through the teaming of federal, state, and local law enforcement agencies. The funds will be used to reimburse overtime expenditures associated with sworn personnel being involved with the task force. No local match is required.
3 BA BA BA BA BA This budget adjustment estimates and appropriates $7,808 in revenue and expenditure to Fan Care, Title IIID Health Promotion and VICAP grants and decreases NSIP grant in the Department of Parks, Recreation, and Community Services General Fund to reflect actual FY 2017 awards. No local match is required. This budget adjustment estimates and appropriates $266,160 in grant funds from the Virginia Department of Behavioral Health and Developmental Services for Crisis Intervention Training Assessment Site in the General Fund for the Department of Mental Health, Substance Abuse, and Developmental Services. The funds will be used to cover contracted expenditures related to the facility operations. No local match is required. This budget adjustment estimates and appropriates $10, in grant funds from the Virginia Department of Behavioral Health and Developmental Services for Domestic Violence Crisis Stabilization in the General Fund for the Department of Mental Health, Substance Abuse, and Developmental Services. The funds will be used to cover contracted expenditures for the program. No local match is required. This budget adjustment estimates and appropriates $95,149 in restricted prior year fund balance to carryforward remaining funds in the Virginia State Corporation Commission power line shared expert fees project in the Office of the County Attorney. This budget adjustment decreases General Fund balance by $95,149. This budget adjustment transfers $4,273,976 in federal TIFIA funds out of the Capital Financing Fund and estimates and appropriates the funds in the Capital Projects Fund through the Transportation District Fund. FISCAL IMPACT: Budget adjustments presented for the Board s consideration have an impact on expenditure and revenue budgets of the following funds in FY 2016: Increase the General Fund by $2,776. Therefore, there is no impact on General Fund balance for FY Budget adjustments presented for the Board s consideration have an impact on expenditure and revenue budgets of the following funds in FY 2017: Increase the General Fund revenue by $6,358 and expenditures by $486,701.64; Increase the Transportation District Fund by $4,273,976; and Increase the Capital Projects Fund by $4,273,976. Therefore, there is a $6,358 impact on General Fund balance for FY DRAFT MOTION(S): I move that the Board of Supervisors 1) approve the budget adjustments as set out in the October 4, 2016, Administrative Items Report; 2) for FY 2016, increase the expenditure and revenue budget of the General Fund by $2,776; and 3) for FY 2017, increase the
4 expenditure budget for the General Fund by $486, and increase the revenue budget for the General Fund by $6,358; increase the expenditure and revenue budget for the Transportation District Fund by $4,273,976; and increase the expenditure and revenue budget for the Capital Projects Fund by $4,273,976. Powell, County Attorney s Office BACKGROUND: Loudoun Water (formally known as Loudoun County Sanitation Authority) has requested a 10 Loudoun Water (waterline) easement across County property (21561 Belmont Ridge Road, Ashburn, Virginia, and otherwise referred to as PIN # and Tax Map Number /78////////12/) to provide waterline services and facilities to serve the Edgar Tillett Memorial Park. The proposed easement has been approved by the Department of Transportation and Capital Infrastructure and is shown on the attached plat known as LW ID# A public hearing is not required due to the fact that the Loudoun Water service is required for site development and will serve County property. DRAFT MOTION: I move that the Board of Supervisors approve the requested grant of easement to Loudoun Water, as shown on the plat known as LW ID # , and that the Chairman, the Vice Chairman, the County Administrator, or his duly authorized designee be authorized to execute a Deed of Easement or form of agreement acceptable in form to the County Attorney. 9 THIS DEED OF EASEMENT (the "Deed") is made this day of, 2016, by and between the BOARD OF SUPERVISORS OF LOUDOUN COUNTY, VIRGINIA, a body corporate and politic (hereinafter referred to as "Owner"); the BOARD OF SUPERVISORS OF LOUDOUN COUNTY, VIRGINIA, a body corporate and politic (hereinafter referred to as "County") and the LOUDOUN COUNTY SANITATION AUTHORITY d.b.a LOUDOUN WATER, a body corporate and politic (the "Authority"). W I T N E S S E T H: WHEREAS, the Owner is the owner and proprietor of certain real property (the "Property"), as shown on a plat dated May 2015 and revised June 9, 2016 entitled Plat Showing Creation of Storm Drainage and Waterline Easements on Edgar Tillet Memorial Park, and prepared by Atkins of Alexandria, Virginia, certified land surveyors (the Plat ) which Plat is attached hereto; and WHEREAS, the Property is situate in Loudoun County, Virginia, the Owner having acquired the Property by deed recorded as Instrument No , among the land records of Loudoun County, Virginia; and WHEREAS, the County has declared the necessity to improve the Edgar Tillet Memorial Park pursuant to the plans and specifications of SPAM ; and WHEREAS, pursuant to SPAM , the Owner is required to create and establish on the Property, separate from the fee simple ownership of the Property storm drainage easements in the locations shown on the Plat and as hereinafter provided; and WHEREAS, it is the desire and intent of the Owner, pursuant to SPAM , to grant and convey unto the Authority a waterline easement in the location as shown on the Plat and as hereinafter provided; and WHEREAS, the Property is not subject to the lien of any deed of trust. 2
10 COUNTY EASEMENTS THIS DEED FURTHER WITNESSETH that in consideration of the premises and the sum of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged, Owner does hereby grant and convey unto the County, its successors and assigns, the easements as hereafter set forth in the respective locations shown on the Plat as follows: Storm Drain Easements. Easements for the purpose of constructing, operating, maintaining, adding to, altering or replacing present or future stormwater management facilities, storm drainage lines, storm sewer lines, or other drainage structures, including building connection lines, plus all necessary inlet structures, manholes, and appurtenances for the collection of storm waters and its transmission through and across the said property of Owner, said easements being more particularly bounded and described on the Plat as 20 STORM DRAINAGE EASEMENT HEREBY CREATED, respectively. The foregoing easements are subject to the following conditions where applicable: 1. All sewers, manholes, inlet structures, and appurtenant facilities which are installed in the easements shall be and remain the property of the County, its successors and assigns. 2. The County and its agents shall have full and free use of said easements for the purposes named, and shall have all rights and privileges reasonably necessary to the exercise of the easements including the right of access to and from the easements and right to use adjoining land where necessary; provided, however, that this right to use adjoining land shall be exercised only during periods of actual construction or maintenance, and further, this right shall not be construed to allow the County to erect any building or structure of a permanent nature on such adjoining land. 3. The County shall have the right to trim, cut, and remove trees, shrubbery, fences, structures, or other obstructions or facilities in or near the easements being conveyed, deemed by it to interfere with the proper and efficient construction, operation, and maintenance of said easements; provided, however, that the County, at its own expense, shall restore, as nearly as possible, the premises to their original condition. Such restoration shall include the backfilling of trenches, the replacement of 3
11 fences and shrubbery, the reseeding or resodding of lawns or pasture areas, and the replacement of structures and other facilities located without the easements, but shall not include the replacement of structures, trees, or other facilities located within the easements. 4. Owner reserves the right to construct and maintain roadways over said easements to the extent not prohibited or restricted by ordinance and to make any use of the easements herein granted which may not be inconsistent with the rights herein conveyed or interfere with the use of said easements by the County for the purposes named; provided, however, that Owner shall not erect any building or other structure, excepting a fence, on the easements without obtaining the prior written approval of the County. 5. The County shall maintain storm drainage facilities and systems contained within the easement, including pipes and other structures, inlets and catch basins, to ensure that they function properly. The owner of fee title to any property on which an easement is hereby granted for storm drainage purposes shall be responsible for grass mowing with reasonable frequency, if applicable, and for the removal of debris and other matter that has impeded or threatens to impede the free flow of storm water; provided, however, that owner shall not alter, disturb nor make any changes to the elevation or contours of any open channel, ditch, swale, berm or other drainage facility within the easement after the completion of the construction of the facilities in accordance with the County-approved plans. The owner shall notify the County of any defects with the structures, pipes and fencing within the easement, of any debris or other matter which is beyond the ability of the owner to remove, and of any excessive flooding, sedimentation or soil erosion within the easement area. 6. The County its successors and/or assigns shall maintain storm water management facilities and systems contained within the easement (for facilities such as wet or dry detention or retention ponds, bio-retention facilities such as rain gardens, and the like), including, removal of debris and maintenance of control structures, weirs and other devices constructed to control the flow of storm water. The owner of fee title to any property on which an easement is granted for storm water management purposes shall be responsible for maintenance such as grass mowing and weeding, with reasonable frequency, if applicable, removal of litter and other debris, care and maintenance of trees and other vegetation, provided however that the owner shall not alter, disturb nor make any changes to the elevation or contours of the land within the easement after the completion of the construction of the 4
12 facilities in accordance with the County-approved plans. The owner shall notify the County of any defects with the structures, pipes and fencing within the easement, of any debris or other matter which is beyond the ability of the owner to remove, and of any excessive flooding, sedimentation or soil erosion within the easement area. AUTHORTY EASEMENTS THIS DEED FURTHER WITNESSETH that for and in consideration of the sum of One Dollar ($1.00), cash in hand paid, the receipt of which is hereby acknowledged, the Owner(s) grants and conveys unto the Authority, its successors and assigns, the following easement(s) and rights-of-way for the purpose of the transmission and distribution of water and for the collection and transmission of sewage, through, upon and across the property of the Owner(s): Water Main Easements. Water main easements and rights-of-way for the purpose of installing, constructing, operating, maintaining, adding to or altering and replacing present or future water mains, fire hydrants, valves, meters, and other appurtenant facilities, including but not limited to, any communications equipment deemed necessary by the Authority in the Authority s sole discretion in the area depicted on the Plat as 10 LOUDOUN WATER EASEMENT HEREBY CREATED (the Water Main Facilities ). The said property and easements are more particularly bounded and described on the Plat attached hereto and made a part hereof. The foregoing easement(s), including any and all facilities and rights-of-way, are collectively referred to herein as the Easements. The Easement(s) are subject to the following conditions: 1. All Water Main Facilities and/or Sanitary Sewer Facilities which are installed in the Easement(s) shall be and remain the property of the Authority, its successors and assigns. 2. The Authority and its agents shall have full and free use of the said Easement(s) for the purposes named, and shall have all rights and privileges reasonably necessary to the exercise of the Easement(s), including the right of access to and from the rights-of-way and the right to use abutting land adjoining the Easement(s) when necessary; provided, however, that this right to use abutting land shall be exercised only during periods of actual construction or maintenance, and then only to the minimum extent necessary for such construction and maintenance, and further, this right shall not be 5
13 construed to allow the Authority to erect any building or structure of a permanent nature on such abutting land. 3. The Authority shall have the right to trim, cut and remove trees, shrubbery, fences, structures or other obstructions or facilities in or near the Easement(s) being conveyed, deemed by it to interfere with the proper and efficient construction, operation and maintenance of said Water Main Facilities and/or Sanitary Sewer Facilities; provided, however, that the Authority, at its own expense, shall restore as nearly as possible to their original condition all lands or premises included within or abutting the said Easement(s) which are disturbed in any manner by the construction, operation and maintenance of said Water Main Facilities and/or Sanitary Sewer Facilities. Such restoration shall include the backfilling of trenches, the replacement of fences (so long as such fences comply with Paragraph 4 herein), the reseeding or resodding of lawns or pasture areas, the replacement of shrubbery and the replacement of structures and other facilities located outside of the Easement(s), but shall not include the replacement of trees or the replacement of structures and other facilities located within the Easement(s). 4. The Owner(s) reserves the right to make any use of the Easement(s) which is not inconsistent with the rights herein conveyed to the Authority, and which does not interfere with the use of said Easement(s) by the Authority for the purposes named. By way of example only, and subject to the preceding sentence, such uses may include: (i) constructing and maintaining roadways and parking lots over said Easement(s), (ii) constructing trails, sidewalks and shared use paths within the Easement(s); (iii) planting shrubs within the Easement(s); (iv) installing within the Easement(s), utilities that are generally perpendicular to the Easement(s) and provide for the required vertical separation between the Water Main Facilities and/or Sanitary Sewer Facilities and the proposed utility line; (v) constructing fencing along the Easement, so long as such fencing is at least three (3) feet from the Water Main Facilities and/or Sanitary Sewer Facilities; (vi) constructing fencing generally perpendicular to the Easement(s) so long as such fencing is equipped with a gate at the intersection of such fence and the Easement(s), to which the Authority shall have a key; and 6
14 (vii) installing signs, so long as such signs do not require any foundation. Notwithstanding Owner(s) s rights outlined in the foregoing paragraph, Owner(s) shall not, without Authority s prior written approval: (i) erect any building or other structure, including, but not limited to, dumpsters, loading docks, foundations or footings, and any fencing that does not comply with the terms of the preceding paragraph; (ii) plant trees on or within the Easement(s); (iii) install any structure or equipment that is ancillary to a utility, such as transformers, vaults, manholes, or cabinets; regardless of whether the utility is permitted to cross or be within the Easement(s); (iv) construct any type of ramp or overhead walkway or other above ground structure; (v) install parallel utility lines; or (vi) perform any other action that is inconsistent with the rights herein conveyed to the Authority. In the event that Owner(s) performs any action prohibited by this paragraph 4, the Authority shall have the right to remove such structure or otherwise remedy such action taken within the Easement(s), and seek reimbursement for such removal from Owner(s). MISCELLANEOUS Headings used in this Deed are for convenience purposes only and are not intended to affect the express terms herein set forth. This Deed is made in accordance with the statutes made and provided in such cases; with the approval of the proper authorities of Loudoun County, Virginia, and the Authority, as shown by the signatures affixed to the Plat and this Deed, and is with the free consent and in accordance with the desire of the County, the owner and proprietor of the land depicted on the Plat, as aforesaid. Salazar, Deputy Chief of EMS BACKGROUND: American Medical Response Mid-Atlantic, INC (AMR), seek expansion of their operations in Loudoun County. AMR has applied to the Virginia Department of Health for their EMS agency license. In order to receive this license, the Virginia Administrative Code (12VAC Application for EMS agency license) requires that an ordinance or resolution be adopted/issued by the governing body of each locality where the agency maintains an office or stations an EMS vehicle for response within that locality. AMR has made a request to Loudoun County Fire-Rescue to seek a resolution from the Board granting them permission to operate within Loudoun County. Under Virginia Code section , no emergency services organization may be established in a locality without the prior approval by resolution of the governing body. American Medical Response Mid-Atlantic currently operates as a licensed EMS agency in Virginia and is seeking expansion of their license. As in their current license, the company will not be responding to any emergency (911) calls as part of their operation and therefore will not impact Loudoun County s EMS Operations. The Operational Medical Director and the Chief of the System have indicated their support of this request. 19 Loudoun County Fire and Rescue Company 801 Sycolin Road, Suite 200 Leesburg, Virginia Attn: Deputy Chief Jose Salazar 01 September 2016 Dear Deputy Chief Salazar: Please allow this letter to introduce American Medical Response Mid-Atlantic, Inc. ( AMR ) to your community. AMR has contracted with HCAVa to facilitate the interfacilty-transports and patient discharge transports to and/or from their Reston Hospital, Stonesprings Hospital, and Dominion Hospital Campuses. These transports will include BLS, ALS, and CCT Transportation of patients associated with the HCA Virginia Health System. We will be posting our Ambulances on Hospital property to meet the immediate needs of their current patient s as we continue to search and secure property for a permanent base of operations. This Northern Virginia area will be overseen by our Washington DC Operations Management Staff. The HCA Campus of Stonesprings has a start date of October 5 th and the Campus of Reston has a start date of November 1 st for Operations to start. As background, AMR is a licensed ambulance provider in good-standing with the Commonwealth of Virginia and currently provides ambulance services in the Hampton Roads area. In addition to the Northern Virginia Operation we are seeking to service the HCA Hospitals with, we are currently establishing ourselves within the Richmond and Roanoke Virginia areas. AMR s parent company, American Medical Response, Inc., has operated nationwide for nearly 100 years and currently provides services in 44 states and the District of Columbia; employs over 24,000 people; manages 43 dispatch centers, sustains more than 4,100 inter facility partnerships; holds more than 155 EMS contracts; and transports more than 3.4 million patients annually with a fleet of over 6500 vehicles. 20 12VAC Application for EMS agency license. A. An applicant for EMS agency licensure shall file a written application specified by the Office of EMS. B. The Office of EMS may use whatever means of investigation necessary to verify any or all information contained in the application. C. An ordinance or resolution from the governing body of each locality where the agency maintains an office, stations an EMS vehicle for response within a locality or is a Designated Emergency Response Agency as required by of the Code of Virginia confirming approval. This ordinance or resolution must specify the geographic boundaries of the agency's primary service area within the locality. D. TheOffice of EMS will determine whether an applicant or licensee is qualified for licensure based upon the following: 1. An applicant or licensee must meet the personnel requirements of these regulations. 2. If the applicant is a company or corporation, as defined in of the Code of Virginia, it must clearly disclose the identity of its owners, officers and directors. 3. An applicant or licensee must provide information on any previous record of performance in the provision of emergency medical service or any other related licensure, registration, certification or endorsement within or outside Virginia. 4. The applicant must submit a written agreement with the local governing body that states the applicant agency will assist in mutual aid requests
21 from the local government if EMS personnel, vehicles, equipment, and other resources are available. E. An applicant agency and all places of operation shall be subject to inspection by the Office of EMS for compliance with these regulations. The inspection may include any or all of the following: 1. All fixed places of operations, including all offices, stations, repair shops or training facilities. 2. All applicable records maintained by the applicant agency. 3. MARINE TOYS FOR TOTS FOUNDATION WAREHOUSE SPACE REQUEST ELECTION DISTRICT: Leesburg STAFF CONTACTS: Caleb Weitz, County Administration Ernest Brown, Department of General Services BACKGROUND: Board of Supervisors Leadership and County Administration have received a request from the Marine Toys for Tots Foundation for the use of County warehouse space during the upcoming holiday season. The purpose of this use would be to assist the annual Toys for Tots collection/distribution campaign. The Department of General Services (DGS) has identified vacant County-owned warehouse space on located at 751 Miller Drive that is currently scheduled for retrofitting in mid-january and is suitable for Toys for Tots temporary use during the holiday season. ISSUES: DGS plans for renovation activity to begin on this building in mid-january. Temporary usage for the Toys for Tots collection/distribution campaign will need to conclude prior to this work. DRAFT MOTION: 1. I move that the Board of Supervisors authorize the County Administrator or his designee to execute any necessary usage agreement documents with the Marine Toys for Tots Foundation for temporary usage for the 2016 Toys for Tots holiday collection/distribution campaign and waive the rental fee.

41 Meeting Summary Finance/Government Operations and Economic Development Committee September 13, 2016 Page 2 Sharon Virts, Chair of EDAC, gave a brief presentation on EDAC projects. She commented that EDAC would be reviewing long-term transportation project initiatives, focusing on the area around the silver line. She requested to return to FGOEDC in October to seek an ad-hoc membership to study the transportation project initiatives. Keith Segerson, Chair of FDI, presented the FDI recommendations for investment in Loudoun County from outside the state and country. He asked the FGOEDC for further guidance as to what the FDI s next step should be. He explained the soft-landing facilitating effort to Vice- Chairman Buona as making transition to Loudoun County easier for foreign companies. Chairman Letourneau mentioned several regional efforts for foreign investment were beginning. He commented that the FDI had completed the assignment from the FGOEDC and would be consulted if issues needed further review. He requested Buddy Rizer return to a future meeting to present Economic Development s plan to attract and land international business investments. Vice Chairman Buona suggested EDAC engage Metropolitan Washington Airports Authority in the discussions on the long-term transportation project initiatives. Active Sister City and Partnership Agreements The purpose of this item is for staff to provide a recommendation on designating qualifying Loudoun County sister city and partnership agreements as active. Staff contacted each of Loudoun s sister city and partnership relationships to inform them of the Board s new adopted criteria for active relationships and administration policy. Staff did not receive a response from the Karsiyaka Municipality in Turkey. Chair Randall suggested the Finance/Government Operations and Economic Development Committee review the sister city agreements every year. Buddy Rizer, Economic Development Director, responded to Chair Randall that in 2017 staff might be traveling to Main-Taunus-Kreis and Goyang City. Caleb Weitz, County Administration, answered Supervisor Saines that it was up to the Board of Supervisors discretion to add new sister city agreements and to apply time limitation to those agreements. On September 13, 2016, Chairman Letourneau moved that the Finance/Government Operations and Economic Development Committee recommend to the Board of Supervisors designate the sister city relationships with Main-Taunus-Kreis, Goyang City, New Taipei and Shunyi District and the friendship relationship with Gangneung City as active. Seconded by Vice Chairman Buona. The motion passed (5-0).
