4 Should I let in the current market? Demand for quality rental properties is currently at record levels, primarily due to the lack of properties available for rent. 6 Navigating legislation Energy Assessments Landlords need to produce an EPC every time they let their property ( in England and Wales or Gas Landlords must comply with the Gas Safety (Installation and Use) Regulations 1998, and carry out all necessary maintenance to gas appliances, gas pipe work and flues in their property through a Gas Safe registered engineer. You are also legally responsible to arrange for an annual gas safety check to be carried out on on every appliance and flue, provide a record of the check to existing tenants within 28 days of the check being carried out (or before new tenants move in) and hold records of the checks for a minimum of 2 years from the date they are carried out ( Furniture & Furnishings It is an offence to let a property with any furniture or furnishings that do not comply with safety regulations set out in the Furniture and Furnishings (Fire Safety) Regulations 1988 as amended in 1989 and ( Smoke and Carbon Monoxide Detectors Smoke and Carbon Monoxide Alarm (England) Regulations 2015 requires for a Smoke Detector to be installed on each floor with living accommodation which includes bathrooms. A Carbon Monoxide Detector must also be installed in any room which is used as living accommodation and contains a solid fuel burning combustion appliance. Electricity Landlords need to ensure that all electrics and electrical equipment in their properties are safe and will not cause harm (Electrical Equipment (Safety) Regulations 1994). (

7 The Housing Act 2004 (HMO Regulations) All property owners must comply with the regulations relating to Houses in Multiple Occupation (HMOs). Penalties for breach of these laws are severe with fines of up to 20,000 for failure to obtain a licence or for breaching permitted numbers and tenants may be able to claim back rent they have paid whilst the HMO has been operating without a licence. ( Right to Rent From 1 February 2016, all private landlords in England will have to check new tenants have the right to be in the UK before renting out their property. Under the new rules, landlords who fail to check a potential tenant s Right to Rent will face penalties of up to 3,000 per tenant. For more information visit Mortgage and Leasehold If you have a mortgage you must obtain consent from your mortgage lender. If your interest in the property is leasehold, you may also need to obtain consent from your landlord (or freeholder) prior to sub-letting. Tax You are required to pay income tax on rental income and have a legal responsibility to notify HM Revenue and Customs. If you reside outside the UK for more than six months out of twelve the rent receiving agent has a statutory obligation to deduct basic rate tax on the net income and make quarterly payments to HM Revenue and Customs on your behalf. 9 Legionella Risk Assessment Legionella naturally occurs within water supplies making every property a potential risk. Legionella is a serious flu like illness which is very often mistaken for pneumonia and can be fatal. Legal Requirements To help ensure your tenants risk of exposure to legionella is properly assessed and controlled, we work with the UK s largest legionella risk assessment specialists who can help you determine the risks to your property and tenants.

10 Tax Advice for Landlords UK Revenue and Customs need to be notified that you are letting property in the UK. Landlords must declare, via a Self-Assessment Tax Return, any profit derived from the rental income.
